Abstract

Marriage is a phase that binds a couple called husband and wife in a marriage bond. The purpose of marriage one of course is to have offspring as a family successor. But not all couples can have offspring naturally due to interference with reproduction in one partner or both partners, so they are considered as unproductive couples. However, as advances in the health sector began to be found assisted reproductive technology methods, which allow unproductive couples to have offspring through the method of fertilization outside the womb, henceforth this program is often known as the IVF program. However, this program cannot be immediately accepted in the community, causing controversy in its journey.In this paper, the IVF method is seen from the perspective of the legality ofnational law and Hindu religious law, which method of IVF is something that can be done with its terms and conditions. In national law it is regulated that IVF is legal as long as the sperm and egg cells that will be fertilized through this program are from a legitimate married couple. Likewise Hindu teaching in lontar bhuana mahbah views this positively, because having offspring is a good thing and can help ancestors in terms of experiencing the process of reincarnation, but in the process of implementing IVF there are some formulations of the requirements that must be done by Hindu couples in undergoing a baby program This tube, which is a masturbation carried out in order to obtain offspring is not a masturbation aimed at achieving sexual satisfaction (masturbation) but purely for health, and if an abortion occurs, the fetus who died must receive a ceremony of panglungahan

Abstract

The determination of a public policy is of course always faced with the problem of budget constraints which often puts the government in a trade-off situation which is defined as a dilemma condition that makes it difficult to make choices in determining priorities. This is what makes many policies that are not effectively implemented. The neglect of community expectations has resulted in negative reactions ranging from acts of violation even to anarchy that leads to crime. For this reason, it is deemed very important for the government to have a strategy in setting a priority scale so that a policy is more beneficial to people's lives, not just focusing on legal certainty. For this reason, the main problem is related to the efforts of the Regional Government in determining the priority scale so that an implementation of public policy is truly on target. Keywords: Budget Constraint, Trade off, priority scale

Abstract

In Bali, the existence of customary law is still stable and sustainable until now and it is very easy to find it in some areas that still maintain the lives of indigenous people through the institution of customary villages or villages. Traditional law dibali generally include; awig, awig, perarem, eka elikita, and other customary rules. In carrying out customary rules, there are customary sanctions that will be imposed on violators of customary rules. These customarysanctions are of various kinds and are different in each customary area in Bali.Dedosan sanction is an example of one of the sanctions that exist in customary rules. As applied in banjar pegok through banjar awig-awig adat which makes dedosan sanctions as an alternative in minimizing losses arising from the negligence of customary manners in carrying out customary obligations, so that the activities of manners customs that are preoccupied with matters outside the customs, do not interfere with the development of traditional traditions thatare still ongoing. Although the application of customary sanctions has begun to be more flexible in the present, it should still be carried out firmly and clearly, so that it does not cause jealousy and does not accustom customary manners to carry out dedosan sanctions just to avoid adat activities. So that if this is allowed to continue then it will certainly also affect the existence of adat thatprevails in an area.

Abstract

The purpose of this paper is to see the extent to which the Election Law is able to address gender equality in politics and democracy and how Balinese women apply this provision as an opportunity to advance and align themselves in the political field by looking at the results of the elections in Bali. So based on that research method used is normative research that refers to the provisions of applicable regulations and is supported by sources of literature and supporting data.It is known that the Election Law requires a 30% quota requirement for women's representation in the electoral process of each political party. This will be an opportunity for women to be able to align themselves and dilute the backwardness of men who used to dominate, although it is known that this cannot be said to be equal or balanced, but at least women are guaranteed their opportunity to be certain in politics through opportunities chosen rights they have.Balinese women from the results of the implementation of the 2004 legislative elections to 2019 for women's representation in the Bali Provincial DPRD, were able to show a significant increase in representation, so it can be said that Balinese women from time to time are able to take advantage of opportunities and opportunities to participate in the political and democratic equalization.

Abstract

AbstractThe sustainability of balinese indigenous civilization can not be released from the existence of Indigenous Villages and banjar adat as a unity of indigenous peoples guided by customary rules in the form of awig-awig, perarem, or other forms. It also organizes a youth organization in Bali called sekaa teruna which is part of banjar adat. In this era the existence of awig-awig seems like a mere rule crest, because many contents of awig-awig mainly on the sanctions section in ancient times that are no longer relevant to be applied in the present. Therefore, in this paper will be discussed in advance on How the concept of formulation of awig-awig, How the form of old customary sanctions that have been applied in Bali and have been irrelevant applied, and How the modernization process can be done against the irrelevant customary sanctions. From this it is seen that the concept of formulation of awig-awig in Bali is generally related to the concept of Tri Hita Karana, while the old forms of customary sanctions that are considered irrelevant include: customary sanctions against the case of twin buncing, sanctions kesepekang, forced marriage sanctions, and other types of sanctions. Modernization of ancient customary sanctions can be done by youth organizations by incorporating customary sanctions that can be applied by youth in the present, so that the existence of such awig-awig is not only limited as a symbol.Keywords: Awig-awig, Modernization, Customary Sanctions, Sekaa Teruna

Abstract

Indonesia is a democratic country whose implementation is one of them is carried out through a democratic party called elections. Elections are held regularly in Indonesia which has been regulated by the rules and by the executors called the Electoral Commission. Elections in Indonesia are held to select formations in legislative and executive institutions both at the central and regional levels. Elections at the regional level are often referred to as elections, which are commonly used to select regional heads whether governors, regents, or mayors who are held in turn according to the stage of the period or time period. Elections in Bali after the reform period have been held several times, and it is always interesting to observe in addition to the election results, also related to the level of participation of its people as voters. The purpose of this study is to find out about the level of voter participation, especially in Denpasar at the 2018 election and the factors that affect the participation rate.From the results of the study it is known that the rate of voter registration in Denpasar city for the 2018 election is 63.18% that is in the moderate category. This lack of participation rate can be due to several factors, such as: economic factors of people who tend to vote to remain elected during the election process, factors that candidates or candidates feel are less attractive to them, or may be due to factors in voter data collection techniques. So it is advisable to overcome these factors can be done through the selection of the right election time or setting the election day as a holiday, in addition to socializing the mission vision of the candidate, as well as the systematic and measurable implementation of the stage so that no voter loses his or her voting rights due to technical factors.Keywords : Rate, Participation, Regional Elections, Medium, Factors

Abstract

Customary law in Bali is a basis or guideline in carrying out rights and obligations in an indigenous organization, including Sekaa Teruna. The form of customary law in Bali is Awig-Awig, in terms of the preparation of Awig-Awig the concept of wisdom in the community is often adopted as part of the existing peculiarities. The purpose of this writing is for to show that the concept of Tri Hita Karana is able to be synergized in the process of preparing Awig-Awig and become an important part in explaining the relationship of rights and obligations krama. From the study carried out the concept of customary legal order dibali exist in various forms such as awig, awig, perarem, eka eli kita, and others. The concept of Tri Hita Karana is often used in linking the rights and obligations of Sekaa members in the fields of parhyangan, pawongan and palemahan. In the preparation of Awig-Awig Sekaa Teruna Taman Sari is carried out synergy by using Tri Hita Karana as a foothold in describing self-sufficiency in three areas of life.

Abstract

Efforts to save and prevent coastal tourism areas from the threat of abrasion and the threat of monopoly on the use of areas by certain parties need to be pursued, so that the existence of coastal areas that are used as tourist destinations can provide comfort for the user community. As an area that respects local wisdom inherited from its ancestors, Bali always implements policies that are in line with its local wisdom, one of which is the teachings of Tri Hita Karana. In an effort to save and develop a beautiful and comfortable coastal tourism area, it is necessary to design a development system that is in harmony with local wisdom in Bali. The purpose of this paper is to show that The Beach Recovery System is in line with the teachings of Tri Hita Karana and becomes a relevant role model to be applied for the recovery and arrangement of safe and exotic coastal tourism areas. From the study conducted, a strategy for developing a coastal tourism area called The Beach Recovery System was drawn up which is in line with the teachings of Tri Hita Karana owned by the Balinese people. The Beach Recovery System emphasizes the need to determine the supporting components in coastal tourism areas which include: crab, groint, walk way, buffer zone, and green zone. With the fulfillment of these components, surely the welfare expected by the teachings of Tri Hita Karana can be realized in a beautiful and comfortable beach tourism area, which of course will be an attraction for tourists.

Abstract

This study aims to describe the moral character education in early childhood in the Hindu family. Education itself is the noblest thing in achieving physical and spiritual perfection, education, which should begin to be instilled as early as possible, starting moral character education cultivation from the smallest environment, namely the family. In the family, children feel a peaceful and harmonious environment. The results showed that moral character education in early childhood in the Hindu family, in the beginning, children were taught about how to live the greatness of God by carrying out prayers or Tri Sandya three times a day. It was along with the introduction of spiritual songs to develop good behaviors and strengthen their diversity.

Abstract

Berdasarkan ketentuan Pasal 63 ayat (1) Undang- Undang-Undang Nomor 23 tahun 1992 tentang Kesehatan dinyatakan “pekerjaan kefarmasian dalam pengadaan, produksi, distribusi, dan pelayanan sediaan farmasi (obat) harus dilakukan oleh tenaga kesehatan yang mempunyai keahlian dan kewenangan untuk itu. Tenaga kefarmasian dalam Peraturan Pemerintah Nomor 32 tahun 1996 tentang Tenaga Kesehatan dikatakan meliputi apoteker, analis farmasi dan asisten apoteker. Berdasarkan ketentuan tersebut selain tenaga kefarmasian tidak dilegalkan melakukan pekerjaan kefarmasian termasuk dalam hal ini penyerahan obat kepada pasien, kecuali hal tersebut dilakukan oleh tenaga medis di daerah terpencil yang tidak ada Apoteknya. Namun realitanya, tenaga medis melakukan praktek penyerahan obat di Kota Denpasar yang secara ketentuan bukan merupakan daerah terpencil, sehingga dapat dikatakan tenaga medis telah melakukan penyimpangan terhadap ketentuan hukum yang berlaku. Tingkat penyimpangan penyerahan obat oleh tenaga medis pada tempat praktek pribadi berdasarkan penelitian yang dilakukan dengan analisis ketentuan hukum, serta penentuan sample dengan metode tabel Isacc dan Michael di kota Denpasar berkisar 66,37%. Dispensing oleh tenaga medis tertinggi diamati terjadi di kecamatan Denpasar Barat.
