Abstract

Violence against women in Indonesia has been recognized as a serious problem. Violence against women can be found everywhere such as in family, workplace, community and state, in the form of physic, psychology, sexual and economy. Perpetrators of violence against women can occur in various ways, ranging from individual, groups in society, and in a state institution with the main target toward women; children, adults, and including women with disabilities. It can be due to lack of knowledge and understanding of women to Undang-Undang No. 23 tahun 2004. Consequently, those who become the victim of violence are still trying to survive because of their fear to husband’s retaliation, the lack of shelter, their fear to the people’s negative assumption, their low self-confidence, and the reason of the children’s interest. In these difficult conditions, most wives still love their husband and defend their marriage. The awareness enhancement of law for women which is continually made might reduce the violence against women as mandated by Undang-Undang No. 23 tahun 2004. [Kekerasan terhadap perempuan di Indonesia telah diakui sebagai permasalahan yang serius. Kekerasan terhadap perempuan ini dapat ditemukan di mana-mana, baik di lingkungan keluarga, tempat kerja, masyarakat dan negara, dalam bentuk kekerasan fisik, psikis, seksual dan ekonomi. Pelaku kekerasan terhadap perempuan dapat terjadi secara beragam, mulai dari perorangan, kelompok-kelompok yang ada di masyarakat, maupun institusi-institusi negara dengan sasaran perempuan, baik anak, dewasa maupun usia lanjut, termasuk kaum perempuan penyandang cacat. Hal ini dapat disebabkan karena rendahnya pengetahuan dan pemahaman perempuan terhadap UU No. 23 tahun 2004, sehingga mengakibatkan perempuan menjadi korban kekerasan tetap berusaha mencoba bertahan. Hal ini karena adanya rasa takut pembalasan suami, tidak adanya tempat berlindung, takut dicerca masyarakat, rasa percaya diri yang rendah, alasan kepentingan anak, dan sebagian isteri tetap mencintai suami mereka serta mempertahankan perkawinan. Peningkatan kesadaran hukum bagi perempuan yang terus menerus dilakukan diharapkan angka kekerasan terhadap perempuan dapat ditekan sesuai dengan amanah Undang-Undang No. 23 tahun 2004.]

Abstract

Legal positivism and legislative procedures in Indonesia Focus on formal legality which often causes the resulting laws to reflect less social justice or the moral values ​​of society. Based on Lack of Public Participation, legislative procedures include public consultation; in practice, public participation is often considered a mere formality. Law as a Political Product: The dominance of competent authorities in legislation often makes law a political instrument rather than a tool for realizing justice. The basis of Positivism in Legislation in Indonesia is that legal Positivism is reflected in the Indonesian legal system through the Hierarchy of Legislative Regulations.

Abstract

This study explains that the implementation of good governance principles in village administration is a crucial foundation for establishing transparent, participatory, and accountable governance, while also promoting the integration of gender perspectives to achieve inclusive governance. The research analyzes the extent to which good governance principles have accommodated gender aspects in village governance policies and practices based on Law Number 6 of 2014 concerning Villages. This study employs a normative legal research method, using both statutory and conceptual approaches to analyze the application of good governance within the village governance system. The analysis primarily uses Law Number 6 of 2014 as the analytical tool. The findings reveal that good governance is a fundamental concept in establishing sound government. The principles of good governance, although unwritten, can in certain circumstances be drawn upon as applicable legal norms. When good governance is achieved, good government will follow. According to the Village Law, the application of good governance in the village governance system can be seen through implementing several principles, such as legal certainty, orderly administration, transparency, accountability, effectiveness, efficiency, public interest, local wisdom, and participation. However, alongside these opportunities, implementing good governance in village governance also faces various challenges. Opportunities include: a supportive legal and regulatory framework, the availability of village funds, a local culture that supports participation, and advances in information technology. The challenges include: limited human resource capacity, risks of corruption and abuse of power, low public participation, political interference and conflicts of interest, and unequal access to information technology.

Abstract

This research examines nepotism as a form of Corruption, Collusion, and Nepotism (KKN), which has significantly undermined social and institutional order in Indonesia. The problem stems from the negative impacts of KKN on community welfare, resource misuse, and the erosion of public integrity and morals. The main goal of the paper is to analyze nepotism from a positive legal perspective by exploring the conceptual differences between "onrechtmatige daad" in civil law and "wederrechtelijk" in criminal law. The study uses a doctrinal approach that integrates conceptual, statutory, and case analysis, focusing on Law Number 28 of 1999 and Constitutional Court Decision Number 90/PUU-XXI/2023 as key case studies. Through evaluative, argumentative, and prescriptive techniques, the research develops arguments concerning the classification of nepotism as either a criminal or civil matter. The findings highlight that while both legal concepts—onrechtmatige daad and wederrechtelijk—serve to protect individual rights and public interests, they are applied differently. The study concludes that nepotism, which has caused systemic harm to fair and transparent governance, should be classified as a criminal act (wederrechtelijk) to ensure legal certainty and maximize the repressive effects of the law, adhering to the principles of lex scripta, lex certa, and lex stricta. As a recommendation, the government and the DPR should revise Law Number 28 of 1999 to strengthen the norms regarding nepotism and submit a material review to the Constitutional Court to align the law with the principle of legality, ensuring optimal protection of the public interest.

Abstract

AbstrakPerkawinan merupakan sebuah awal antara seorang laki-laki dan wanita untuk hidup bersama yang  mana perkawinan dalam sebuah negara di di atur dalam peraturan perundang-undangan. Perceraian merupakan salah satu bagian dalam sebuah perkawinan, karena perceraian tidak akan mungkin teradi tanpa perkawinan terlebih dahulu, perceraian merupakan akhir dari sebuah perkawinan yang mana kehidupan bersama antara suami istri telah berakhir. Dalam hal terjadinya sebuah perceraian ada sebuah masa untuk melangsungkan perkawinan yang di larang bagi si istri atau yang biasa di sebut dengan masa iddah. Iddah sendiri adalah waktu menunggu bagi seorang mantan istri yang telah di ceraikan oleh mantan suaminya, dan masa iddah wajib di jalani seorang wanita apabila ikatan perkawinannya telah terputus. Pada dasarnya bagi wanita hamil masa iddahnya adalah sampai dia melahirkan anak dalam kandungannya, dengan semakin berkembangnya kehidupan manusia  maka semakin berkembang pula permasalahan yang muncul di kehidupannya salah satunya adalah tentang pengguguran kandungan (aborsi) oleh wanita hamil untuk mempercepat masa iddahnya. Dalam penelitian ini penulis akan membahas bagaimana pandangan hukum islam terhadapa permasalahan mengenai pengguguran kandungan untuk mempercepat masa iddah.Kata Kunci: Pengguguran Kehamilan, Masa Iddah, Hukum IslamAbstract               The Marriage is a beginning between a man and woman to live together where marriage in a country is regulated in the legislation. Divorce is one part of a marriage, because divorce will not be possible without marriage first, divorce is the end of a marriage in which the common life between husband and wife has ended. In the event of a divorce there is a period of marriage which is forbidden for the wife or what is usually called the iddah period. Iddah itself is a waiting time for an ex-wife who has been divorced by her ex-husband, and a period of iddah is obliged to be lived by a woman if the marriage bond has been broken. Basically for a pregnant woman during her iddah period is until she gives birth to a child in her womb, with the growing development of human life, the more developed problems that arise in her life, one of which is about abortion by pregnant women to speed up their iddah period. In this study the author will discuss how the views of Islamic law regarding problems regarding abortion to accelerate the period of iddah. Keywords: Abortion of Pregnancy, Idle Period, Islamic Law

Abstract

Correctional Institutions are institutions implementing the criminal system whose function is to develop correctional inmates, including, in this case, women who are serving sentences and required to participate in the entire series of training activities in correctional institutions. In this case, the effectiveness of coaching prisoners can provide a good role model for others, especially prisoners of female, children, and the elderly. Then, the supporting factors can be used as examples to become even better in the future, and better solutions can be found for factors that can hinder development. This research aims to determine the pattern of coaching females, children, and elderly prisoners and to determine the factors that inhibit and support coaching. Synergy is needed between all parties involved, starting from prisoners, correctional officers, and related agencies, in cooperating with each other in carrying out training for female, child, and elderly prisoners to overcome problems in the implementation of training for female, child, and elderly prisoners, For this reason, it is necessary to carry out treatment and guidance to achieve better goals, and if the convict leaves, he will create an independent character and have a better leadership spirit.

Abstract

Kasus kejahatan pada anak seringkali terjadi bahkan jumlah kejahatannya semakin tahun bertambah. Dengan kerapnya kejahatan yang terjadi pada anak maka diperlukan tindakan tegas serta perlindungan dari KPAI sebagai lembaga perlindungan terhadap anak-anak. Mengingat bentuk pencabulan merupakan pelanggaran hak anak dan tidak dapat dibenarkan bagaimanapun alasannya, baik dari segi moral, susila dan agama. Anak memiliki hak untuk dilindungi demi kesejahteraannya, karena anak-anak merupakan golongan yang rawan. Dengan adanya peraturan perundang-undangan terkait hak-hak anak maka dapat melindungi anak-anak dalam kejahatan. Selain itu para tindak kejahatan pada anak dapat memberikan efek jera. Dari segi hukum pidana islampun para pelaku kejahatan terhadap anak dapat dikenai hukum juga dengan hukuman dera sebanyak seratus kali atau dilempari dengan batu. Sedangkan pada hukum positif, pasal 82 para pelaku kejahatan pada anak dikenai hukuman maksimal 15 tahun dan minimal 3 tahun penjara dengan denda paling banyak 300.000.000,00 dan paling sedikit 60.000.000,00. Sedangkan dalam hukum pidana islam para pelaku dirajam hingga mati, dicambuk seratus kali.

Abstract

Cases of crime in children often occur, even the number of crimes is increasing year by year. With the frequent crimes that occur in children, it requires firm action and protection from KPAI as an institution for the protection of children. Given the form of abuse is a violation of children's rights and can not be justified whatever the reason, both in terms of moral, moral and religious. The children have the right to be protected for their welfare, because the children are a vulnerable group. With the existence of laws and regulations related to children's rights, it can protect children in crime. In addition, the crime against children can provide a deterrent effect. In terms of criminal law, the offender of crimes against the children can be subject to the law as well. Seeing the number of victims of molestation, of course the offender's can be punished according to the principle of legality, namely the principle that no acts are prohibited and threatened with criminal offenses if not determined in advance in legislation. In Article 82, the perpetrators of crimes against children are subject to a maximum sentence of 15 years and a minimum of 3 years in prison with a maximum fine of 300,000,000.00 and at least 60,000,000.00. Whereas in Islamic criminal law the offender's are stoned to death, flogged a hundred times.

Abstract

Euthanasia is a problematical issue among doctors, legal practitioners, and religious scholars. It has become a topic of discussion in various countries, especially Indonesia and Malaysia when viewed from the perspective of religion and human rights. The scholars agree that an action can only be classified as a Jarimah if the action is strictly prohibited by syara'. Although there is no clarity or certainty in determining whether euthanasia is a crime or not, the concept of euthanasia itself, formulated by experts, is written and is prohibited in the Al-Quran and Hadith. For example in the Al-Qur'an in QS. Al-An'am verse 151: "And do not kill the soul that Allah has haraam (kills it) but with the right cause". Killing here means killing in any way, including killing with the help of others, such as the concept of active euthanasia. Meanwhile, from a human rights perspective, euthanasia is an effort to eliminate the right to life of a human being, because the nature of euthanasia itself eliminates human life because it will harm others.

Abstract

The court is a place to seek justice. It is a place that must be respected. However, there are still many cases of contempt of court.  This is contrary to the Criminal Code and Islamic law.  This study examines the contempt of court perspective of Islamic law. This research is a library and qualitative research. Data collection is carried out through literature studies derived from laws, books, and journals. The collected data is described for deductive analysis using Islamic law. The results of the study mentioned that in Indonesia there is no specific law on Contempt of court.  Contempt of court is based on criminal code articles 210, 2lindung16, 217, 221, 222, 223, 224, 225, 242, 222, 231, 232, 233, 317, 417, 552.  In Islamic law, contempt of court is a prohibited act as described in the Qur'an and hadith. The sentence is in accordance with the form of the contempt of the court perpetrator's actions and the consequences they cause. If the terms of his sentence are not mentioned in the Qur'an and hadith, then the judge can decide based on his ijtihad called ta'zir.
