Abstract

Custody disputes between biological and adoptive mothers often pose legal dilemmas as they involve both biological and social aspects, particularly in determining who has the stronger claim to raise the child. This study aims to examine and analyse the judges' reasoning at the first instance, appellate, and cassation levels, with reference to the application of the principle of the best interests of the child. Using a normative juridical method and a case study approach, the findings reveal that at the first instance and cassation levels, the principle of the best interests of the child was not comprehensively applied. The panel of judges focused primarily on formal provisions set out in the legislation, thereby neglecting the factual circumstances relating to the child's well-being. In contrast, at the appellate level, the Aceh Sharia Court adopted a different approach by prioritising the best interests of the child, reflecting a more holistic and child-centred perspective. These findings conclude that the application of the best interests of the child principle greatly depends on the interpretation of judges at each level of the judiciary. Therefore, a deep understanding of this principle is essential to ensure that legal decisions not only fulfil formal legal aspects but also have a positive impact on the child's future.

Abstract

Physical violence is an act that causes pain, injury, or serious wounds. In the Gayo Lues community, there is a customary law that regulates sanctions against perpetrators of physical violence. Adat Ngaming, one of the customs of Gayo Lues, regulates the types and levels of sanctions and the weight of the sanctions according to the purpose of forming a law. This research examines how the Ngaming customary sanctions resolve physical violence cases according to the customary law of the Marpunge Raya settlement and the review of Islamic criminal law on Ngaming customary sanctions for perpetrators of physical violence in the Marpunge Raya settlement. This research uses the empirical legal research method through library and field data collection techniques. The research results show that Ngaming customs impose sanctions on perpetrators of physical violence crimes according to the type and severity of the actions committed by the perpetrator. Violence to the head that causes a lot of bleeding (blood flowing out) is compensated with one goat, and the bleeding wound is treated (luke besalin) until healed. If the blood flows a little (does not stream), it is compensated with a chicken, and the bleeding wound is treated (luke besalin) until it is healed. The Ngaming customary sanction is by the sanctions regulated in Islamic criminal law, where wounds on the head that bleed (al-Damiyah) and wounds on the head that do not bleed (ghair al-Damiyah) are subject to legal sanctions. For physical violence on objects other than the head and face, the penalty is to pay for medical expenses until recovery, which is not regulated in Islamic criminal law because violence on objects other than the head and face has different penalties, namely, ja’ifah wounds and non-ja’ifah wounds. The penalty for a ja’ifah wound is one-third of the diyat, while the penalty for a non-ja’ifah wound is qishash.

Abstract

The problem of narcotics abuse and illicit trafficking is one of the most serious problems and continues to grab the attention of the community. In carrying out its duties, BNN requires the support and active role of all components of society, which when viewed more deeply in the Law, the community can support the implementation of BNN's duties, one of which is by becoming a P4GN activist. The abuse and illicit trafficking of narcotics and narcotics precursors (P4GN) as mandated in Law Number 35 of 2009 concerning Narcotics in Article 104 explains that "The community has the widest possible opportunity to participate in assisting the prevention and eradication of abuse and illicit trafficking of narcotics and narcotics precursors". This research aims to see how the influence of communication strategies as a means of strengthening the P4GN program, maqashid sharia review of the influence of communication strategies as a means of strengthening the P4GN program. In this study the authors used qualitative research methods with a field research approach. The results of the research obtained are, first, knowing how far the effectiveness of the communication strategy carried out by the Aceh Provincial BNN as a strengthening of the P4GN program and second, knowing how the maqashid sharia review of the strategies used by the Aceh Provincial BNN in terms of realizing the P4GN program.

Abstract

This study explores the role of Syi'ah hadith in the Tarekat Syattariyah, particularly in the context of the Abu Peulekung community in Aceh, Indonesia. The Tarekat Syattariyah is one of the most prominent Sufi orders in Southeast Asia, known for its unique spiritual practices and teachings, which blend elements of both Sunni and Shia traditions. This research examines how Syi'ah hadith is integrated into the teachings and practices of the order, and how it influences the spiritual lives of its followers. The Abu Peulekung community, located in Aceh, has long been a center for the practice of Tarekat Syattariyah, with a strong emphasis on the teachings of Sufi saints. The use of Syi'ah hadith in this community is notable for its distinct emphasis on the spiritual dimensions of Islamic teachings, particularly in the context of love for the Prophet and his family, which aligns with Shia principles. Through a detailed examination of the hadiths used by the followers of this order, this study highlights the living tradition of Syi'ah hadith in a predominantly Sunni region. It also sheds light on how these hadiths contribute to the development of religious identity, spiritual practices, and inter-sectarian relationships in Aceh. The findings contribute to the broader understanding of the diversity of Islamic traditions in Southeast Asia

Abstract

This study aims to determine the factors of child neglect after divorce, review legal protection based on Law Number 35 of 2014 concerning Child Protection, and identify solutions and prevention of such cases in Bantayan Village, Simpang Ulim District, East Aceh Regency. This study uses a normative-empirical legal approach, with qualitative methods and data collection techniques through interviews, observations, and documentation of child victims, caregivers, and village officials. The results of the study indicate that the main factors of child neglect after divorce include economic problems, parental remarriage, parents who migrate and lose contact, lack of responsibility and communication between parents, and minimal intervention from the village government or related institutions. Based on Law Number 35 of 2014 Article 26 paragraph (1), it was found that children's rights to care, protection, and education were not fulfilled. Reviewed from the Best Interest of the Child theory by John Eekelaar, the condition of these children does not reflect the fulfillment of the child's best interests. Therefore, an active role is needed from all parties to prevent and handle similar cases, including through increasing legal awareness and collaboration between village governments and child protection agencies.

Abstract

Penelitian ini membahas upaya Polresta Banda Aceh dalam menegakkan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap pelanggaran lalu lintas oleh anak di bawah umur yang mengendarai sepeda motor. Penegakan dilakukan melalui pendekatan preventif berupa sosialisasi di sekolah dan komunitas, serta pendekatan represif seperti razia dan pemberian sanksi sesuai dengan ketentuan Pasal 81, 281, dan 287. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa kolaborasi antara aparat kepolisian dengan guru dan tokoh masyarakat berperan penting dalam edukasi dan pembinaan. Namun, penegakan hukum masih menghadapi hambatan seperti rendahnya kesadaran hukum masyarakat dan keterbatasan personel. Oleh karena itu, peningkatan frekuensi sosialisasi, kerja sama lintas sektor, dan pemanfaatan teknologi menjadi strategi yang diharapkan mampu meningkatkan efektivitas penegakan hukum serta menciptakan lalu lintas yang aman dan tertib di Banda Aceh.

Abstract

A leader must have the ability to act legally so that every action he does is legal. This skill is required to be perfect, even exceeding the ability to act legally on a husband and wife in managing a household or someone in managing their property. On the basis of perfect legal skills, the leadership process will be able to run well, and various benefits can be realized in society at large. In this case, Islamic law as one of the legal systems that live in society is believed in giving a view of the legal skills of a leader. Some verses of the Qur'an and the Hadith of the Prophet SAW. give a signal about the criteria for a leader's legal competence. There are two important elements that must be possessed so that the ability to act in law is perfect; first, the age of a leader (caliphate), either a leader of a state (prisident), or a region (governor and regent/mayor) is at least 40 years old. While the position of assistant to the caliphate (minister and police) must be at least 21 years old; second, having perfect intelligence (rusyd). This intelligence is based on deep knowledge and broad insight into leadership. Based on this intelligence, a leader will carry out policies to his people in accordance with the benefit principles. Seorang pemimpin menjadi sentral bagi rakyatnya untuk mengantarkan mereka dalam mewujudkan kemaslahatan, kesejahteraan, dan kehagiaaan. Untuk hal itu, seorang pemimpin diharuskan memiliki kecakapan hukum yang baik, bahkan melebihi daripada seorang suami atau isteri dalam membina rumah tangga, atau seseorang dalam mengelola harta bendanya. Konsep kecakapan hukum pada seorang pemimpin telah disebutkan dalam berbagai ketentuan atau pemikiran para ahli. Dalam hal ini, hukum Islam memberikan konsep dan kriteria kemampuan kecakapan bagi seorang pemimpin. Tulisan ini mengkaji konsep hukum Islam tentang kecakapan seorang pemimpin yang mampu mewujudkan kemaslahatan bagi umat. Metode yang digunakan pada kajian ini yuridis normatif, yakni dengan mengkaji beberapa ayat Alquran dan Hadis Nabi SAW. yang memberi isyarah tentang kriteria kecakapan hukum seorang pemimpin. Hasil penelitian ditemukan ada dua unsur penting yang harus dimiliki seorang pemimpin supaya cakap bertindak hukum secara sempurna. Pertama, usia seorang khalifah, baik Presiden, atau Gubernur dan Bupati/Walikota, minimal 40 tahun. Sementara jabatan pembantu khalifah, seperti Menteri dan Polisi minimal berumur 21 tahun. Kedua memiliki kecerdasan yang sempurna (rusyd), yakni seorang pemimpin mempunyai kecerdasan intelektual, emosional, dan spiritual yang baik. Dari ketiga kecerdasan tersebut akan melahirkan sifat bijaksana, dan pada gilirannya terwujud kemaslahatan hidup masyarakat secara luas.

Abstract

Penentuan waktu salat secara praktis merupakan kebutuhan primer dalam Islam. Jadwal waktu waktu salat sepanjang masa pernah menjadi alternatif acuan dalam mengawali awal waktu-waktu salat. Pasalnya hal tersebut dipandang cukup memberikan solusi dalam memulai dan mengakhiri salat. Disisi lain, keberadaan jadwal waktu salat sepanjang masa perlu dikaji kembali tingkat akurasinya. Data matahari yang selalu berbubah-ubah dalam setiap tahunnya menjadi salah satu faktor terjadinya perbedaan waktu dalam setiap tahunnya, sehingga hal ini akan bertentangan dengan jadwal waktu salat sepanjang masa yang mengacu kepada suatu data yang sama untuk sepanjang masa. Belum lagi koordinat lintang dan bujur tempat serta tinggi tempat yang besar kecil akan mempengaruhi hasil perhitungan. Penelitian ini merupakan penelitian kepustakaan (library research) yang bertujuan untuk mendeskripsikan relevansi dari jadwal waktu salat sepanjang masa, serta memberikan alternatif keberlakuannya. Hasil penelitian ini menunjukkan bahwa terdapat beberapa faktor yang menyebabkan tidak relevannya penggunaan jadwal waktu salat sepanjang masa ini, diantaranya: penggunaan lintang dan bujur tempat yang mengacu kepada satu titik dalam suatu daerah, penggunaan equation of time (perata waktu) dan deklinasi matahari rata-rata dan belum adanya standarisasi waktu ihtiyath.

Abstract

In a society still dominated by patriarchal views, women often face injustice and domestic violence, which hinders gender equality and leads to poverty. This phenomenon, which is often considered a private matter, is further exacerbated by a lack of legal understanding and suboptimal community responses. This study aims to explore in depth the dynamics of patriarchal domination and its impact on domestic violence at the micro level. Using a qualitative case study design in Gampong Cot Matahe, data was collected through in-depth interviews, observations, and documentation studies. The results showed that patriarchal structures are deeply rooted, leading to power imbalances and the normalization of domestic violence, with victims facing stigma and dependency. Although regulations exist, their implementation in the field is still weak due to a lack of legal awareness and the suboptimal role of community leaders in prevention and handling. This study contributes to an enriched understanding of the manifestations of patriarchy and domestic violence at the local community level, and suggests a comprehensive approach for more effective interventions.

Abstract

Aceh Province is the only region in Indonesia that has fully implemented an Islamic financial system, as outlined in Qanun Aceh Number 11 of 2018, concerning Islamic Financial Institutions. This regulation mandates all financial institutions operating in Aceh to comply with Sharia principles. However, the effectiveness of the Financial Services Authority (OJK) in supervising substantial adherence to Islamic jurisprudence (fiqh muamalah) remains questionable. This study aims to assess the efficacy of OJK’s supervision over Islamic financial institutions in Aceh and to identify the main obstacles and challenges in its implementation. The research employs an empirical, juridical, and statutory approach, with data collected through interviews, field observations, and a literature review. The findings reveal that OJK's supervisory role remains primarily administrative and has not adequately addressed the substantive aspects of Sharia compliance. Key obstacles include low Sharia literacy among industry players, weak roles of internal Sharia Supervisory Boards (DPS), limited human resources within OJK knowledgeable in Islamic finance, underutilised digital supervision systems, and weak institutional coordination. Based on Soerjono Soekanto's theory of legal effectiveness, all five components—legal substance, legal structure, legal culture, infrastructure, and community—are found to be insufficiently developed to support the ideal implementation of Islamic finance. The study recommends reformulating the supervisory approach to adopt a more participatory, contextual, and locally grounded model, ensuring the authentic and sustainable application of Islamic financial systems in Aceh
