Abstract

The maladministration of Sugarcane Plantation Rights (HGU) in Boalemo Regency has ignited structural conflicts, profoundly distorting agrarian justice and the social function of land. This normative legal research aims to analyze governance anomalies resulting in the deprivation of local communities' living spaces, while formulating a reconceptualization of oversight grounded in the Green Constitution and ecocracy. Utilizing statutory, conceptual, and case approaches, this study demonstrates that the formal legality of land registration instruments is frequently reduced to legitimize land commodification and ecological exploitation by corporate entities. The systemic failure of land authorities to evaluate the environmental obligations of right holders empirically creates a phenomenon of rightlessness for affected citizens. Therefore, this article concludes that a radical transformation of land governance is absolutely imperative. Oversight mechanisms must no longer rely rigidly on formal administrative procedures, but must integrate ecosystem sustainability parameters as mandatory prerequisites to effectively halt land grabbing and restore justice.

Abstract

This study aims to analyze the disharmony between normative regulation and the implementation of the protection of Persons with Mental Disorders (ODGJ) in Indonesia, especially at the regional level, by integrating the perspectives of national law, human rights, and Islamic law. The method used is normative legal research (doctrinal legal research) enriched with a socio-legal approach. The research approach includes the statute approach, conceptual approach, and case approach, with theoretical frameworks in the form of legal functionalization theory, legal protection theory, and maqāṣid al-syarī'ah which emphasizes the protection of the soul (ḥifẓ al-nafs) and the principle of non-discrimination. The results of the study show that the failure of ODGJ protection does not stem from weaknesses in legal norms, but from structural failures in implementation. The disharmony of regulations is reflected in weak coordination between agencies, limited resources for mental health workers, and the lack of operational and applicable regional regulations. In addition, the legal culture of the community that is still full of stigma and discrimination exacerbates the ineffectiveness of legal protection for ODGJ. This study concludes that the effectiveness of ODGJ protection requires an integrative model that incorporates a human rights approach and the values of maqāṣid al-syarī'ah in an implemented manner. The main findings confirm that the main problem lies in structural and cultural aspects, not normative; Therefore, it is recommended to strengthen implementing regional regulations, increase institutional capacity and mental health services, and social interventions based on public education to remove stigma, in order to realize an inclusive, effective, and equitable ODGJ protection system.

Abstract

The rapid growth of e-commerce and cash-on-delivery (COD) transactions in Indonesia has exposed a critical regulatory gap: delivery couriers remain legally unprotected against consumer default, despite bearing substantial operational and financial risks. This study examines the weaknesses of Indonesian e-commerce regulations in protecting couriers from consumer default in COD transactions. Employing a normative legal research method with statutory and conceptual approaches, supported by empirical data from semi-structured interviews with couriers and documentation of dispute cases, this study reveals two fundamental regulatory failures. First, the current legal framework, particularly Law No. 8 of 1999 on Consumer Protection, remains trapped in an outdated bipartite paradigm that recognizes only consumers and business actors, rendering couriers legally invisible and devoid of clear legal standing. Second, existing protections are exclusively repressive, responding to harm only after disputes or violence occur, while no preventive mechanisms such as mandatory compensation schemes, buyer verification systems, or accessible dispute resolution exist to deter consumer default or mitigate couriers' economic losses. Consequently, couriers bear the entire risk of default despite having no control over product quality or consumer conduct. This study concludes that legislative reform is urgently needed to recognize couriers as distinct legal subjects and to establish preventive-protective regulations ensuring justice for essential workers in Indonesia's digital economy.

Abstract

This study examines how spousal rights and obligations are implemented in the Kawin Turun marriage practice in South Kotamobagu. Kawin Turun is a socially negotiated marriage conducted after premarital pregnancy, but the husband commonly leaves the wife after the marriage ceremony. Using empirical legal research with a qualitative approach, this study draws on interviews, observation, and legal materials concerning marriage law and customary practice. The findings show that the legal bond of marriage does not automatically produce substantive domestic life. The husband’s obligations to provide maintenance, protection, and residence are weakly fulfilled because economic readiness and cohabitation are absent. The wife’s domestic role is also constrained because household management occurs without spousal support. This gap reveals limited legal protection for women and children when customary settlement dominates formal marital obligations. The study concludes that Kawin Turun requires preventive legal education, Religious Affairs Office supervision, and community-based intervention by local institutions.

Abstract

This study analyzed the juridical changes in the function of forest areas into agricultural land in the village of Tamit, Bunobogu District. The research uses empirical legal methods with a socio-legal approach through observation, interviews, and literature studies. The results showed that land use by the community obtained a legal basis after the area of Tamit village was designated as another Use Area (APL) based on SK 6624/MENLHK-PKTL/KUH/PLA.2/10/2021. Legal certainty is strengthened through land certification, especially PTSL programs, which transform factual control into juridical rights. However, Forestry supervision is still needed so that land use does not exceed APL limits. The synchronization of forest, land, and community participation laws is the key to legal protection.

Abstract

The urgency of microtransaction regulation through the in-game gacha system developed by miHoYo as a form of practice that potentially resembles digital gambling. The gacha system raises legal issues because players spend money to acquire virtual items at random with no certainty of outcome. This research uses normative legal method with legislation, conceptual, and comparative approaches. The results of the study indicate that Indonesia does not yet have specific regulations governing the gacha system, causing a legal vacuum in the protection of digital consumers. Gacha practices also potentially violate the principles of transparency, fairness, and consumers ' right to truthful, clear, and honest information. Therefore, special arrangements are needed that regulate the transparency of opportunities, age restrictions, transaction supervision, and responsibility of digital game business actors.

Abstract

The development of digital technology has encouraged the increasing use of electronic transactions in various walks of life, including in rural areas. However, the rapid utilization of digital transactions has not been balanced with an adequate level of public understanding of the law, causing various legal risks such as online fraud, misuse of personal data, and legal uncertainty in electronic agreements. This community service activity aims to improve the legal literacy of the community through educational assistance and legal consultation related to legal protection in digital transactions. The method used is in the form of legal counseling and direct consultation held in Mekar Jaya village, Duhiadaa District, Pohuwato Regency, involving village officials and the general public. The results of the activities show that the public has been actively using digital transaction services, but still has a limited understanding of the legal rights and obligations as digital consumers. Through practical and contextual education, people are beginning to understand the importance of personal data protection, the validity of electronic agreements, and dispute resolution mechanisms in digital transactions. This legal assistance and consultation proved to be effective in increasing the legal awareness of the public and strengthening their position in facing the risks of digital transactions. This activity is expected to contribute to creating a secure, fair, and equitable digital transaction ecosystem, as well as being a model for sustainable legal service in the era of digital transformation.

Abstract

The increasing dissemination of intimate content without the victim's consent (revenge porn) as a form of Online Gender-Based Violence (OGBV) raises legal concerns due to the absence of explicit terminology in Indonesia's Electronic Information and Transactions Law (ITE Law). This study aims to analyze the applicability of the ITE Law in addressing revenge porn in cyberspace and to examine the legal implications of the absence of explicit regulation. The research employs a normative legal method using statutory, conceptual, and case approaches. The findings indicate that Article 27(1) of the ITE Law remains applicable to prosecute perpetrators based on the principle of lex specialis derogat legi generali, despite the absence of the term revenge porn. However, this condition results in broader law enforcement discretion, suboptimal victim protection, greater complexity in law enforcement, and limited liability of digital platforms. The study concludes that strengthening the legal framework is necessary to enhance legal certainty and improve the effectiveness of victim protection in the digital environment.  ABSTRAKMeningkatnya penyebaran konten intim tanpa persetujuan korban (revenge porn) sebagai bentuk Kekerasan Berbasis Gender Online (KBGO) menimbulkan persoalan mengenai ketiadaan nomenklatur revenge porn dalam Undang-Undang Informasi dan Transaksi Elektronik (UU ITE). Penelitian ini bertujuan menganalisis keberlakuan UU ITE dalam penanggulangan revenge porn di ruang siber serta mengidentifikasi implikasi hukum dari tidak diakomodasinya terminologi tersebut secara eksplisit. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa Pasal 27 ayat (1) UU ITE tetap dapat digunakan untuk menjerat pelaku berdasarkan asas lex specialis derogat legi generali, meskipun tidak memuat nomenklatur revenge porn. Namun, kondisi tersebut menimbulkan implikasi berupa perluasan diskresi aparat penegak hukum, belum optimalnya perlindungan korban, meningkatnya kompleksitas penegakan hukum, serta terbatasnya tanggung jawab platform digital. Penelitian menyimpulkan bahwa diperlukan penguatan pengaturan guna meningkatkan kepastian hukum dan efektivitas perlindungan korban di ruang digital.

Abstract

This study was motivated by the high number of cases of breach of contract by cooperative members in loan agreements, which has disrupted legal certainty and the financial stability of the cooperative. This study aims to analyze the forms of breach of contract by cooperative members and to assess the effectiveness of dispute resolution regarding such breaches at the Berkat Jaya Mandiri Cooperative in Tilongkabila Subdistrict, Bone Bolango Regency. The method used is empirical legal research employing both a statutory approach and a sociological-legal approach. Data were collected through interviews, observations, and documentation, and analyzed qualitatively. The results indicate that the forms of default include complete failure to fulfill obligations, fulfillment of obligations that do not conform to the agreement, and fulfillment of obligations that is delayed. Of the 77 members who received loans in 2025, 35 members defaulted. Dispute resolution is generally conducted through non-litigation channels using a family-oriented approach, negotiation, and informal warnings. Although this method is considered more cost-effective and helps maintain good relations between the cooperative and its members, its effectiveness has not been optimal because it does not fully provide legal certainty and has not been able to prevent repeated defaults. Thus, there is a need to strengthen the enforcement of rules, increase members’ legal awareness, and establish more rigorous dispute resolution mechanisms to ensure the proper implementation of agreements. ABSTRAKPenelitian ini dilatarbelakangi oleh tingginya kasus wanprestasi anggota koperasi dalam perjanjian pinjam meminjam yang berdampak pada terganggunya kepastian hukum dan stabilitas keuangan koperasi. Penelitian ini bertujuan untuk menganalisis bentuk wanprestasi anggota koperasi serta menilai efektivitas penyelesaian sengketa wanprestasi pada Koperasi Berkat Jaya Mandiri Kecamatan Tilongkabila Kabupaten Bone Bolango. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan perundang-undangan dan pendekatan sosiologis hukum. Data diperoleh melalui wawancara, observasi, dan dokumentasi, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa bentuk wanprestasi yang terjadi meliputi tidak memenuhi prestasi sama sekali, memenuhi prestasi tetapi tidak sesuai dengan perjanjian, dan memenuhi prestasi tetapi terlambat. Dari 77 anggota yang menerima pinjaman pada tahun 2025, sebanyak 35 anggota mengalami wanprestasi. Penyelesaian sengketa pada umumnya dilakukan melalui jalur non-litigasi dengan pendekatan kekeluargaan, negosiasi, dan peringatan nonformal. Meskipun cara ini dinilai lebih hemat biaya dan menjaga hubungan baik antara koperasi dan anggota, efektivitasnya belum optimal karena belum sepenuhnya memberikan kepastian hukum dan belum mampu mencegah terjadinya wanprestasi berulang. Dengan demikian, diperlukan penguatan penegakan aturan, peningkatan kesadaran hukum anggota, dan mekanisme penyelesaian sengketa yang lebih tegas agar pelaksanaan perjanjian pinjam meminjam di koperasi dapat berjalan lebih efektif.

Abstract

Illegal lending practices in Pinolosian Subdistrict raise legal issues concerning the validity of loan agreements and their consequences for contractual performance, collateral ownership, and debt collection. This study aims to analyze the invalidity of illegal loan agreements under Article 1320 of the Indonesian Civil Code and examine their legal consequences for loan principal, collateral, and the creditor’s civil liability. The research employs an empirical legal method with a socio-legal approach using interviews, observations, document analysis, and legal materials. The findings show that illegal loan agreements fail to satisfy the objective requirement of a lawful cause and are therefore null and void. Nevertheless, the principal amount received by the debtor remains repayable as actual performance, whereas interest, penalties, and additional charges have no binding legal effect. The collateral remains the debtor’s property, while debt collection through intimidation or unilateral seizure may constitute an unlawful act that gives rise to civil liability for the creditor. ABSTRAKPraktik pinjaman ilegal yang berkembang di Kecamatan Pinolosian menimbulkan persoalan mengenai keabsahan perjanjian dan konsekuensi hukumnya terhadap pelaksanaan prestasi, status barang jaminan, serta tindakan penagihan. Penelitian ini bertujuan menganalisis ketidaksahan perjanjian pinjaman ilegal berdasarkan Pasal 1320 Kitab Undang-Undang Hukum Perdata serta mengkaji akibat hukumnya terhadap uang pinjaman, barang jaminan, dan tanggung jawab perdata kreditur. Penelitian menggunakan metode hukum empiris dengan pendekatan yuridis-sosiologis melalui wawancara, observasi, studi dokumen, dan analisis bahan hukum. Hasil penelitian menunjukkan bahwa perjanjian pinjaman ilegal tidak memenuhi syarat objektif berupa sebab yang halal sehingga batal demi hukum. Meskipun demikian, pokok pinjaman tetap wajib dikembalikan sebagai prestasi nyata, sedangkan bunga, denda, dan biaya tambahan tidak memiliki kekuatan mengikat. Barang jaminan tetap menjadi milik debitur, sementara penagihan melalui intimidasi atau penguasaan sepihak dapat dikualifikasikan sebagai perbuatan melawan hukum yang menimbulkan tanggung jawab perdata bagi kreditur.
