Abstract

Terjadinya ketimpangan gender khususnya di indonesia dalam dunia ketenagakerjaan dapat dibuktikan dengan rendahnya partisipasi perempuan terhadap pasar kerja. Untuk mendukung peningkatan ekonomi maka dibutuhkan adanya kesempatan yang dibuka sebesar- besarnya dalam dunia ketenagakerjaan bagi perempuan maupun laki-laki. Ada banyak faktor yang menjadi alasan mengapa perempuan selalu termarginalkan dan tersubordinasi. Teknik yang penelitian deskriptif di mana memiliki tujuan untuk mengungkapkan fenomena sosial yang terjadi di kalangan masyarakat perempuan Indonesia khususnya berkaitan dengan ketenagakerjaan TPAK Perempuan di Indonesia Kesetaraan gender dalam bidang pekerjaan kesetaraan gender akan terwujud apabila tidak ada diskriminasi gender. Penanaman sikap pekerja keras harus ditanamkan kepada laki-laki maupun perempuan. Sebab, perempuan tidak dapat bergantung selamanya kepada laki-laki. Perempuan juga harus belajar untuk bekerja demi memenuhi kebutuhan hidupnya.

Abstract

Kesenjangan gender tetap menjadi isu penting di berbagai aspek kehidupan sosial, ekonomi, dan politik di era modern. Jurnal ini bertujuan untuk mengkaji kesenjangan gender melalui perspektif teoritis dan analisis kebijakan yang ada. Dengan menggunakan pendekatan multidimensional, penelitian ini mengeksplorasi berbagai teori gender, termasuk feminisme, konstruktivisme sosial, dan teori peran, untuk memahami akar penyebab kesenjangan tersebut. Selain itu, analisis kebijakan dilakukan untuk mengevaluasi efektivitas program-program yang dirancang untuk mengurangi kesenjangan gender, serta tantangan yang dihadapi dalam implementasinya. Hasil penelitian menunjukkan bahwa meskipun ada kemajuan dalam beberapa aspek, kesenjangan gender masih terwujud dalam berbagai bentuk, seperti ketidaksetaraan upah dan akses terhadap pendidikan. Oleh karena itu, diperlukan pendekatan yang lebih holistik dan kolaboratif dalam merumuskan kebijakan yang inklusif dan responsif terhadap kebutuhan gender. Jurnal ini diharapkan dapat memberikan wawasan baru dan rekomendasi bagi pembuat kebijakan serta peneliti untuk mengatasi kesenjangan gender di masyarakat modern

Abstract

The protection of personal data is becoming increasingly important in today's digital era, where information and communication technology is rapidly advancing. This raises the risk of data breaches that can have negative impacts, ranging from identity theft to harassment. The personal data protection law has become crucial for regulating the management and protection of such data, with the aim of providing a clear legal framework. Personal data protection includes the definition and scope of personal data as well as fundamental principles such as transparency, limitation of use, and data security. The regulation of personal data protection in Indonesia has evolved over time, with Law Number 11 of 2020 concerning Information and Electronic Transactions serving as a more comprehensive legal foundation. This research employs a descriptive approach, document analysis, and previous studies. Data analysis is conducted qualitatively to describe the implementation of the Personal Data Protection Law in Indonesia as well as the factors influencing it. The implementation of this law faces challenges, such as the gap between policy formulation and its execution, a lack of public awareness, and inadequate infrastructure. However, supporting factors like public campaigns and infrastructure improvements can strengthen the implementation of the law. Despite the challenges, the implementation of the Personal Data Protection Law in Indonesia can be improved through increased public awareness, investment in infrastructure, and collaboration among stakeholders. This recommendation is expected to effectively strengthen personal data protection in Indonesia.

Abstract

Humanitarian crimes against Uyghur Muslims in Xinjiang China have drawn increasing attention from around the world. This study aims to examine the regulation of individual criminal responsibility according to the 1998 Rome Statute and the possibility of Xi Jinping being punished for the persecution of Uighur Muslims. This study is a normative law study with a literature study to collect data. The data obtained is processed with a descriptive qualitative analysis method. The results of the study show that individual criminal responsibility for acts of persecution can be taken by the ICC if it fulfills the jurisdiction and flow stipulated in the Rome Statute in line with that Xi Jinping has the possibility of being punished for acts of persecution against Uighur Muslims based on complementarity jurisdiction.

Abstract

This study examines the effectiveness of the International Criminal Court (ICC) in addressing terrorism and its implications for international law enforcement. Based on the 1998 Rome Statute, the ICC has limited jurisdiction as terrorism is not explicitly categorized as an international crime. A normative legal research method with legislative and conceptual approaches was employed to analyze international legal instruments and the ICC’s role. Findings reveal that the ICC can indirectly address terrorism through crimes against humanity, but its effectiveness is hindered by the absence of a universal definition of terrorism, jurisdictional limitations, and insufficient ratification of the Rome Statute. The implications highlight the ICC’s contribution to strengthening international legal norms and fostering global cooperation, though amendments to the Rome Statute are needed to explicitly recognize terrorism as a core crime. The conclusion underscores the necessity of harmonizing terrorism definitions and legal reforms to enhance the ICC’s role in enforcing international law.

Abstract

This study examines how legal dualism and the lack of ratification of international instruments hinder the enforcement of cross-border human trafficking laws in Indonesia. Using a normative juridical method, the research analyzes national regulations and international instruments such as the Palermo Protocol and ACTIP. The findings reveal that legal dualism creates misalignment between domestic and international laws, obstructing cross-border cooperation, extradition, mutual legal assistance, and victim protection. The limited ratification of international instruments weakens Indonesia’s position in transnational collaboration. The study recommends harmonizing domestic laws, accelerating ratification, and strengthening law enforcement institutions to enhance the effectiveness of combating human trafficking.

Abstract

Genocide is a serious crime against human rights and is recognized as a norm of jus cogens in international law, binding all states without exception. The 1948 Genocide Convention obligates participating states to prevent and punish perpetrators of genocide, regardless of the location of the act or the nationality of the perpetrator. However, the implementation of this obligation is often hindered in international legal practice, particularly when citizens of a state commit genocide beyond its territorial jurisdiction. Issues of jurisdiction, sovereignty, and political complexities frequently pose challenges in enforcing justice and accountability for genocide perpetrators. This paper explores the responsibility of states regarding their citizens who commit genocide abroad, analyzing relevant international laws and principles.

Abstract

This study examines the interplay between the principle of state sovereignty and the jurisdiction of the International Criminal Court (ICC) in enforcing law against international crimes. Using a normative-qualitative method and literature review approach, the research finds that state sovereignty is no longer absolute due to the evolution of international law, particularly in human rights protection. The ICC serves as a complementary mechanism (complementarity) when national judicial systems are unwilling or unable to prosecute international crimes. However, the ICC's effectiveness remains constrained by political factors and resistance from non-party states to the Rome Statute.

Abstract

State sovereignty over airspace according to international law is complete and comprehensive. However, in practice, the use of unmanned aircraft (drones) has not been specifically regulated through international regulations or conventions. The slow development of drone regulations is due to the absence of laws and standards from the International Civil Aviation Organization (ICAO). This study aims to examine the legality of drones crossing state borders and Yemen's responsibility for the actions of the Houthi rebels. This study uses a normative legal method with a descriptive approach, using secondary data analyzed qualitatively, and drawing conclusions deductively. The results of the study show that although drones are equated with aircraft in their regulations, the term drone has not been explicitly regulated in national or international air law.

Abstract

This article discusses cybercrime as a form of war crime under international humanitarian law. Cyber crime is a phenomenon that is increasing along with the rapid development of information and communication technology. This crime includes various forms of illegal actions such as online fraud, data theft, data destruction, ransomware attacks, and illegal information dissemination that harm individuals, organizations, and countries. Handling cybercrime requires solid international cooperation and harmonization of legal norms at the national and global levels. International legal instruments such as the Budapest Convention and the 2001 Cybercrime Convention serve as an important basis in regulating and tackling these crimes. In addition, the role of international legal instruments such as the Budapest Convention and the 2001 Cybercrime Convention in regulating and tackling cybercrime at the global level is explained. The study emphasizes the need for international cooperation and harmonization of national laws in order to address the growing complexity of cybercrime. In general, this study highlights the challenges of law enforcement in the digital era and the importance of effective regulation in accordance with the principles of human rights and international humanitarian law. cybercrime that develops as a form of war crime requires a regulatory framework that is in accordance with the principles of international humanitarian law.
