Abstract

The promulgation of Law Number 1 of 2023 concerning the national Criminal Code (KUHP), replacing the Dutch Criminal Code, is a fundamental reform of Indonesian criminal law because of the recognition of laws that live in society. The purpose of this study is to find out and describe the position of customary criminal settlement in Indonesian laws and regulations and the process of resolving customary crimes according to the law that lives in the community in Bengkulu City. In Bengkulu City, the customs used are the Lembak custom, the Malay custom, the Serawai custom, and the Rejang custom. The enforcement of Bengkulu City customs was confirmed with the issuance of Regional Regulation Number 29 of 2003 concerning the Enforcement of Bengkulu City Customs.   The method used in this study is an empirical legal research method, where data is obtained directly from the community. This research is important because there is no uniformity in the process of resolving customary crimes that occur in Bengkulu City. The contribution given will benefit law enforcement officials in resolving customary crimes in accordance with the laws that live in the community, especially in Bengkulu City as an effort to enforce the law.

Abstract

The application of the ITE Law in defamation cases is closely related to how the state maintains a balance between protecting press freedom and respecting individual rights to a good name, with the creation of this scientific work which focuses on the discussion, How Press Freedom Affects Criminal Liability in Defamation Crimes in Online Media and Why the Application of the ITE Law Affects Reporting Accountability in Online Media which will later aim at studying how press freedom guaranteed by law in Indonesia, such as Law No. 40 of 1999 concerning the Press, affects criminal liability in defamation cases in online media, and how the limits of press freedom are applied in the digital space. This study uses a normative juridical method with a statutory and conceptual approach. The primary legal sources used are Law No. 40 of 1999 concerning the Press and Law No. 19 of 2016 concerning Information and Electronic Transactions (UU ITE). Freedom of the press plays a vital role in democracy, but in the context of online defamation crimes, limits must be applied to maintain a balance between freedom of expression and protection of an individual’s reputation. Law Number 40 of 1999 concerning the Press and Article 27 paragraph (3) of the ITE Law provide the legal framework governing these freedoms and limits.

Abstract

Rendahnya pengetahuan masyarakat mengenai kesehatan reproduksi menjadi isu krusial yang merugikan suatu gender tertentu, terutama kaum perempuan. Kesenjangan gender dalam masyarakat yang menganut budaya patriaki yang kuat, membuat perempuan sering kali tidak memiliki hak untuk mengambil keputusan kesehatan yang menyangkut tubuh mereka sendiri. Hal ini pada akhirnya memengaruhi kesejahteraan perempuan secara keseluruhan dan berdampak negatif pada kesehatan fisik, mental, dan sosial mereka. Dari hasil penelitian ini menunjukkan bahwa ketidaksetaraan gender dalam pengambilan keputusan reproduksi memiliki resiko yang besar terhadap perempuan, seperti kehamilan yang tidak diinginkan, kompikasi kehamilan, dan kurangnya akses ke layanan kesehatan. Dampak psikologis yang ditimbulkan mencangku peningkatan stress dan rendahnya kualitas hidup akibat keterbatasan hak dalam pengambilan keputusan. Beberapa upaya yang bisa dilakukan yaitu, pemberdayaan perempuan, peningkatan pendidikan kesehatan reproduksi, dan kebijakan yang mendukung hak perempuan untuk berpartisipasi dalam keputusan kesehatan reproduksi. Dari hasil penelitian ini diharapkan agar penelitian ini dapat memperluas pengetahuan bagi laki-laki dan perempuan agar saling berkontribusi dalam pengambilan keputusan mengenai kesehatan reproduksi kedepannya.

Abstract

This research discusses the legal protection of women from violence in Indonesia in the context of gender equality. Women in Indonesia are often victims of violence, both in the domestic and public spheres, with patriarchal culture dominating as one of the main factors. Although various laws and regulations exist to protect women, the implementation of the law still faces various obstacles, such as a lack of response to evolving forms of sexual violence, as well as legal interpretations that tend to blame the victim. This research uses a normative juridical method to analyze existing legal regulations, as well as to identify gaps in regulations that affect the protection of women's rights. An in-depth literature review was conducted of relevant laws, court decisions and agency reports, to assess the effectiveness of legal policies in providing appropriate protection. This research aims to identify more effective measures in the fight for gender equality and the protection of women through a more responsive and sensitive legal approach to gender issues. The results of the research are expected to contribute to the improvement of legal policies in Indonesia to further enhance the protection of women and realize gender equality.

Abstract

The gender gap refers to significant differences between men and women in opportunities to participate in, among other things, employment. The gender gap in the world of work is a complex and relevant issue in the legal context. Although there is a legal framework that supports gender equality, its implementation is still hampered by patriarchal culture, systemic discrimination, and low legal awareness among workers. This gap is often caused by social and cultural norms that shape gender roles, where women often experience discrimination and injustice. This research aims to analyze the concept of gender gap in a legal perspective, by referring to various theories and related laws. Through a qualitative method with desk study, literature review and case analysis, this research will identify common forms of gender inequality in the workplace, such as wage disparity, discrimination in promotion, and inequality in access to employment opportunities.

Abstract

Women's representation in student organizational structures is an important issue that reflects the gender gap that still exists, even though the number of female students is often greater than male. This research uses normative juridical methods to explore the legal and social challenges that hinder women from occupying leadership positions in student organizations, such as gender stereotypes and lack of support from the social environment. The results of this research show that even though there are regulations that support gender equality, such as Law Number 39 of 1999 concerning Human Rights, practice in the field still shows the dominance of men in strategic positions. Therefore, it is important to increase women's representation so that student organizations can create more inclusive policies and encourage women's empowerment, so that they can form a future generation of leaders who value equality and social justice more.

Abstract

Gender discrimination is still a significant issue in many countries, including Indonesia. This trend is caused by a variety of factors, the most notable of which being the general public's lack of knowledge on gender equality. The purpose of this article is to examine how much knowledge about gender equality contributes to gender discrimination in the general population. Using literature and research, this article will examine gender discrimination, its causes, and the impact of a lack of understanding of gender in various aspects of life. The findings of the study indicate that increasing public understanding of gender equality can have a significant impact on reducing discrimination.

Abstract

This research highlights the gender gap in the Bengkulu Class II B Correctional Institution), especially in terms of providing facilities, health services and support for female prisoners. Prisons are generally designed to meet the needs of the majority of male prisoners, so the specific needs of female prisoners are often overlooked. This study uses a qualitative approach through interviews and observations to understand the experiences of female prisoners in prison. The research results show that the available health facilities do not support the reproductive and psychological health of female prisoners, who often face mental and emotional stress during their detention. These limitations have a negative impact on the welfare of female prisoners and demonstrate the need for correctional policies that are more sensitive to gender needs. It is hoped that these findings will encourage reform of the prison system to make it more inclusive, so that all prisoners, regardless of gender, receive fair treatment and adequate facilities.

Abstract

Gender gap in the workplace is a global issue that is still relevant, with significant impacts on the economy and society. This article discusses the role of education as a strategic tool in reducing gender gaps, focusing on how education can empower women and prepare them for an equal workplace. Through an analysis of various educational programs and policies that have been implemented, this article shows that equal access to quality education can improve women's skills, self-confidence, and employment opportunities. In addition, this article also highlights the importance of gender-sensitive education, which not only educates women but also men about gender equality. By providing recommendations for the integration of inclusive curricula and relevant skills training, this article argues that education is an important foundation in creating a fair and equal work environment. Through collective efforts in education, it is hoped that gender gaps in the workplace can be minimized, thereby promoting more inclusive and sustainable economic growth.

Abstract

ini membahas ketidakadilan gender dan peran hukum sebagai instrumen untuk mencapai kesetaraan gender di Indonesia. Ketidakadilan gender yang dihadapi perempuan meliputi subordinasi, marjinalisasi, beban ganda, stereotip negatif, dan kekerasan berbasis gender. Pemerintah Indonesia telah mengeluarkan sejumlah regulasi, seperti Undang-Undang Ketenagakerjaan, UU Penghapusan Kekerasan dalam Rumah Tangga (PKDRT), dan UU Tindak Pidana Kekerasan Seksual (TPKS), sebagai bentuk perlindungan hukum terhadap perempuan dan langkah menuju kesetaraan gender sesuai dengan Sustainable Development Goals (SDGs). Melalui pendekatan yuridis normatif dan studi literatur, artikel ini mengevaluasi efektivitas hukum dalam menangani ketidakadilan gender. Meskipun terdapat kemajuan dalam regulasi, tantangan dalam implementasi tetap ada. Artikel ini berkontribusi pada pemahaman perlindungan hukum yang efektif dan solusi yang dapat mengurangi kesenjangan gender di masyarakat Indonesia.
