Abstract

Introduction: Waste management in Pekanbaru City has received national attention because it is not handled properly. Pekanbaru City can produce 42 tons of plastic waste a day, which is around 20 percent of the total daily waste production. Purposes of the Research: To understand the legal politics and ideal concept of regulating restrictions on the use of single-use plastic bags in regional legal products in the city of Pekanbaru. Methods of the Research: The type of research used is normative legal research, namely using library research to search for data. Results Originality of the Research: The research results show that Article 7 paragraph (1) of Pekanbaru Mayor Regulation Number 6 of 2023 concerning Reducing the Use of Plastic Bags is still not a solution in overcoming the problem of plastic waste in the city of Pekanbaru.

Abstract

Introduction: The World Trade Organization (WTO), as a World Trade Organisation, has a dispute settlement system that allows member countries to comply with the results of the dispute decision through several stages of settlement, namely consultations, panels and the Appellate Body. Since 2017, one of the WTO's member countries, the United States, has not agreed to the appointment of Appellate Body members, resulting in a vacancy in the Appellate Body and its inability to resolve appeals since 2019. To provide a temporary solution to the Appellate Body's dysfunction, several WTO members have established an alternative dispute settlement body, the Multi-Party Interim Appeal Arbitration Arrangement. The establishment of this body is intended to fill the temporary void created by the Appellate Body's dysfunction. Purposes of the Research: The purpose of this study is to determine the existence of the Multi-Party Interim Appeal Arbitration Arrangement in the WTO dispute settlement system. Methods of The Research: The type of research used is normative research by conducting a literature study through data sources derived from legal materials. Results of the Research: The results of this study indicate that the existence of the Multi-Party Interim Appeal Arbitration Arrangement as arbitration after the vacancy of the WTO Appellate Body members does not provide a real solution and instead creates uncertainty among WTO member countries because the Multi-Party Interim Appeal Arbitration Arrangement is not binding and is outside the WTO dispute settlement system. The position of the Multi-Party Interim Appeal Arbitration Arrangement which is outside the system causes a lot of uncertainty and the resulting decisions are not binding.

Abstract

In Law Number 48 of 2009 concerning Judicial Power, it is stated that justice must be based on simplicity, speed and low costs. However, in reality the process of trying in court in Indonesia is very inversely proportional, considering the large number of cases that have to be resolved at a very high cost, very long queues and the buildup of cases in Indonesian courts which is increasing. This research will understand the concept of plea bargaining which will be added to the criminal justice system in Indonesia. This type of research can be classified as normative juridical research, because this research is carried out by examining secondary data and approaches to law. This normative research examines the applicable regulations and links them with legal politics in the formation of rules to achieve the ideal concept in implementation of Plea Bargainig. The results of this research examine and analyze the rules relating to plea bargaining in the United States and several other countries to obtain the urgency and ideal concept for implementing plea bargaining in Indonesia. The fundamental element for the author to research is Law Number 48 of 2009 Article 2 paragraph (4) concerning judicial power considering that this law contains the principles of justice which is carried out quickly, simply and at low cost. So this is very much in conflict with the reality that exists in the court process in Indonesia.

Abstract

UNCLOS 1982 provides guidelines in the event of enforcement of international maritime law, one of which is Arbitration whose decision is final and binding. However, in practice, rejection and disobedience to arbitration decisions are not uncommon. In this study, the case of rejection of an arbitration decision occurred between China which rejected the decision of the Permanent Court of Arbitration filed by the Philippines against maritime rescue in the South China Sea region. This study aims to examine the legal force of arbitration decisions in enforcing maritime territory between the Philippines and China and the efforts that the Philippines can make against China's rejection of international arbitration decisions. The research method used in this study is normative legal research. Based on the research results, it can be concluded that first, the legal force of the arbitration award, in accordance with the nature of the arbitration award is final and binding and has binding legal force for the parties, especially China, because the submission of the settlement by the Philippines to the PCA is in accordance with the settlement procedure contained in UNCLOS 1982. Second, the efforts that can be made by the Philippines, the Philippines in dealing with China's rejection can prioritize diplomatic and negotiation methods rather than strict law enforcement, because success in resolving this settlement requires a comprehensive approach, involving collaborative efforts between the countries concerned and the international community as a whole.

Abstract

Article 27 letters (g) and (h) of the 2006 Convention on the Rights of Persons with Disabilities regulates that state parties must employ persons with disabilities in the government sector and promote employment for persons with disabilities in the private sector through appropriate policies and measures which may include concrete action programs, incentives and other steps. Based on data from the Ministry of Manpower in 2021 and 2022, less than 1% of people with disabilities can work in the public and private sectors. The main problems in this research are: How is Article 27 of the Convention on the Rights of Persons with Disabilities 2006 implemented in Law Number 8 of 2016 concerning Persons with Disabilities; What is the solution to the weakness in implementing Article 27 of the 2006 Convention on the Rights of Persons with Disabilities in Law Number 8 of 2016 concerning Persons with Disabilities. The theories used in this research are the theory of monism and the theory of legal positivism.The type of research used in this research is normative legal research. Normative legal research is a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced. This research focuses on legal synchronization, namely examining the harmony of positive law (legislation) so that it does not conflict based on the hierarchy of laws and regulations.The results of this research are that the implementation of Article 27 of the Convention on the Rights of Persons with Disabilities 2006 in Law Number 8 of 2016 concerning Persons with Disabilities has weaknesses, where none of this law regulates sanctions for the government, regional governments, State-Owned Enterprises, Regional-Owned Enterprises and private companies that do not meet the quota for disabled workers as regulated in Article 53 of Law Number 8 of 2016 concerning Persons with Disabilities. Therefore, the government needs to formulate government regulations as soon as possible as implementing regulations for Law Number 8 of 2016 concerning Persons with Disabilities, so that there is legal clarity and certainty, especially for law enforcers and people with disabilities.

Abstract

Cases of human rights violations in the state's internal conflict occurred in Myanmar, where the Myanmar military took over the Myanmar government again. The coup, which began on February 1, 2021, was the beginning of the military's return to power in Myanmar. In the past, the coup was carried out on the grounds that the government in power at that time was unable to maintain the integrity of the country because there were many problems such as ethnic conflicts and failure to maintain economic stability. The UN should have changed the existing situation and in a state of many human rights violations that occurred, could carry out Humanitarian intervention or humanitarian intervention. Based on this presentation, two main problems arise that need to be examined, first related to how the role of the United Nations in handling cases of human rights violations in internal state conflicts according to the 1998 Rome Statute. while the second is how the form of intervention carried out by the United Nations in an effort to deal with cases of killings of protesters in the internal state conflict in Myanmar. This study uses a typology of normative legal research, which more specifically examines legal principles. In this study the author uses the nature of descriptive research, because the author describes the role of the United Nations in handling cases of demonstrator killings in Myanmar based on the 1998 Rome Statute. The result of the research conducted by the author is, The role of the UN is through the UN Charter, through various international agreements under the auspices of the UN, through its Security Council both by providing Security Council resolutions to the country, sending peacekeepers, using defense tools both land, sea, and air in protecting civilians, and intervening directly with regional organizations in those conflict areas. Furthermore, the form of intervention carried out by the United Nations (UN) in an effort to deal with cases of killing demonstrators in the internal state conflict in Myanmar is to issue Security Council Resolution Number 2669 of 2022 which asks Myanmar to immediately stop its actions. The resolution also asked ASEAN to help resolve internal conflicts in Myanmar. As for the International Criminal Court (ICC), Myanmar cannot be dragged to the ICC because Myanmar is not a country that ratified the 1998 Rome Statute.

Abstract

Secara internasional, belum adanya perjanjian internasional yang berbentuk perlindungan hukum secara khusus terhadap kesejahteraan satwa, sehingga perlindungan kesejahteraan satwa tersebut hanya mengandalkan kajian pedoman internasional yang terkait. Oleh karena itu, tidak ada standar internasional yang dapat memastikan adanya perlindungan hukum terhadap kesejahteraan satwa. Dalam penulisan ini penulis berfokus pada upaya perlindungan hukum terhadap para satwa yang berada di dalam tempat wisata yang nasibnya terancam oleh adanya konflik perperangan antara Palestina dan Israel.Penelitian ini merupakan penelitian hukum terhadap asas-asas hukum, yaitu suatu penelitian hukum yang bertujuan untuk menemukan asas hukum atau doktrin hukum positif yang berlaku. Munculnya pre-draft The United Nations Convention on Animal Health and Protection (UNCAHP) yang digagasi oleh asosiasi Global Animal Law (GAL) dapat menjadi solusi atas perlindungan kesejahteraan satwa. Secara konsep, baik atau tidaknya pengaruh dari asosiasi Global Animal Law dengan relevansinya terhadap pre-draft The United Nations Convention on Animal Health and Protection (UNCAHP) dan juga berhubungan dengan Hukum Humaniter Internasional, khususnya Konvensi Jenewa 1949 mempunyai keterkaitan dengan pencapaian indikator dalam teori kesejahteraan satwa. Bentuk perlindungan hukum terhadap kesejahteraan satwa di tempat wisata akibat konflik perang Palestina dan Israel adalah dibentuknya berbagai konvensi dan juga organisasi internasional yang bertanggung jawab atas perlidungan kesejahteraan satwa. Diharapkan agar asosiasi Global Animal Law dapat mengupayakan semaksimal mungkin untuk merampungkan pembentukkan The United Nations Convention on Animal Health and Proctection (UNCAHP) sehingga menjadi sebuah produk hukum yang sah. Abstract

The protection of products with potential geographical indications (GIs) is closely tied to the economic benefits they offer to both communities and governments, particularly at the regional level. Local governments play a key role in this effort, as they possess a deep understanding of their region’s superior products. In Riau Province, the government has the authority—under Government Regulation No. 56 of 2022 on Communal Intellectual Property and Law No. 20 of 2016 on Trademarks and Geographical Indications—to inventory, register, and supervise GI products. Notable examples from Riau include Rangsang Liberika coffee and Rangsang sago, which have been successfully registered and now require quality and reputation maintenance. Using empirical legal research, this research finds that the Riau Provincial Government can strengthen the regional economy by mapping GI potential, facilitating registrations, developing protected products, and promoting legal protection and recognition at national and international levels. Although steps have been taken, current efforts remain suboptimal and should be further enhanced to fully realize the economic potential of GI protection in the province.

Abstract

Coastal abrasion is a growing global concern, particularly for Indonesia, a country with one of the longest coastlines in the world. Abrasion poses significant challenges to coastal ecosystems and the livelihoods of local communities. Bengkalis Island, one of Indonesia's outermost and foremost islands, has experienced intensified abrasion in recent decades. Located in Riau Province and facing the Strait of Malacca, this peat-contoured island serves as a basepoint for Indonesia's archipelagic baselines. This research aims to: (1) analyze the legal implications of peat erosion on Indonesia's baselines post-erosion, and (2) describe the Indonesian government's efforts to address the issue.  This normative legal research examines the synchronization between national regulations and international standards regarding peatland conservation and erosion mitigation, particularly in strategically important foremost islands. The study reveals two key findings. First, peat abrasion on Bengkalis Island has serious legal implications for determining Indonesia's archipelagic baselines and maritime boundaries under UNCLOS 1982. Abrasion also threatens the island's status as an outermost and foremost island, potentially leading to the loss of Indonesia's rights over natural resources in the area. Failure to protect peat ecosystems may be considered a violation of Indonesia's international obligations to preserve marine and wetland environments under UNCLOS 1982 and the Ramsar Convention. Second, the Indonesian government has implemented legal and technical measures, such as issuing Government Regulation No. 57 of 2016 on Peat Ecosystem Protection and Management, constructing breakwaters, planting mangroves, and implementing the 3R program (Rewetting, Revegetation, and Revitalization) through the Peat and Mangrove Restoration Agency (BRGM). These efforts have shown positive results in reducing erosion rates and protecting coastalines.

Introduction: Discrimination in employment and occupation through the Law of the Republic of Indonesia Number 21 of 1999 concerning Ratification of the ILO Convention No. 111 Concerning Discrimination In Respect Of Employment And Occupation by implementing it in Article 5 of Law Number 13 of 2003 concerning Employment. However, Article 5 Law 13 of 2003 concerning Manpower have not specifically defined discrimination so that there is still discrimination against job seekers in company job vacancies. Purposes of the Research: To find out how the implementation of ILO Convention No. 111 into the Indonesian Manpower Act regarding legal protection for job seekers from discriminatory work requirements and find out what Indonesia's policies are after ratifying ILO Convention No. 111. Methods of the Research: The type of research used is normative legal research, namely using literature studies in searching the data. Results Originality of the Research: The results showed the application of the ILO Convention No. into the Indonesian Manpower Law regarding Legal Protection for Job Seekers. Indonesia's labor regulations are still not specific in terms of discrimination in the field of employment, so it is necessary to make more detailed and specific rules regarding this matter which can later become a clear legal basis in terms of discrimination in the field of employment and protect the rights of Indonesian job seekers.
