Abstract

Indonesia, as one of the largest archipelagic states, possesses a vast and strategically significant airspace intersecting some of the busiest international flight routes in the Asia-Pacific region. The management of this airspace is critical to upholding national sovereignty and security. However, parts of Indonesia’s strategic airspace, particularly over the Riau Islands and Natuna, remain under Singapore’s control through the delegation of the Flight Information Region (FIR). The 2022 FIR boundary adjustment agreement between Jakarta and Singapore is seen as a diplomatic milestone that expands Jakarta FIR coverage. Nonetheless, it controversially extends the delegation of air navigation management up to 37,000 feet to Singapore in sectors A and B. This situation raises concerns over the full exercise of Indonesia’s air sovereignty, as mandated by Article 1 of the 1944 Chicago Convention and Article 458 of Law No. 1/2009 on Aviation. This normative legal research, based on literature and interviews, finds that the agreement does not significantly alter Indonesia’s legal sovereignty. It also highlights disparities in FIR management and recommends that Indonesia develop a revised roadmap toward full FIR control, treating the Riau and Natuna airspace as a critical border area requiring absolute sovereignty.

Abstract

WIPO Treaty 2024 was adopted by WIPO Member States on May 24, 2024, and will enter into force three months after there are 15 ratifications and accessions. The treaty is open for signature by any eligible party for one year after its adoption, i.e. until May 23, 2025. The first WIPO Treaty 2024 recognizes the rights of indigenous peoples and local communities to their genetic resources and knowledge and their right to be included in the implementation of the treaty. Recognition of the rights of indigenous peoples such as their traditional knowledge is part of human rights. Indigenous peoples as holders of intellectual property rights. This paper is a legal research, namely normative legal research. Research that reflects on applicable norms. In addition, the research also uses literature both from books and journals as a source of research data. The normative legal research method uses a statutory approach and a conceptual approach. The articles in the WIPO Treaty 2024 that are closely related to traditional knowledge and indigenous peoples/local communities are Article 3, Article 5, and Article 6. Article 3 deals with disclosure requirements related to patents and traditional knowledge. Article 5 regulates sanctions and maintenance and Article 6 on the availability of information systems of traditional knowledge. The provisions in the WIPO Treaty 2024 do not maximize the protection of traditional knowledge, but this could be the first step towards the recognition of traditional knowledge in international agreements relating to intellectual property rights.

Abstract

Explanation of the Convention On Nuclear Safety 1994 Article 16 Number 1, 2 and 3 that States that have or will build Nuclear Power Plants (NPPs) in their territory must take appropriate measures related to facilities, security, emergency plans carried out in the event of an emergency in the vicinity of the NPP. Construction of Fukushima NPP The existing nuclear reactor at the nuclear plant was built with insufficient power to withstand the Earthquake and Tsunami that occurred in Japan on March 11, 2011 causing explosions and leaks in 4 nuclear reactors. Japan announced that tanks used to hold waste from leaking nuclear reactors could no longer hold it, so the waste had to be dumped into the sea. The main problem in this study is about the regulation of International Law violated by Japan based on its decision to dump nuclear waste into the Sea, and how the impact will be on the environment. The type of research used in this study is normative legal research or can also be called doctrinal legal research. Normative legal research is literature law research. The action that will be taken by Japan who want to dispose of nuclear waste that they have stored for years due to the Earthquake and Tsunami event has received a lot of resistance from various elements. Especially from the Japanese people themselves to protests from neighboring countries who are afraid that they will also be affected by the waste if it is thrown into the sea. It is hoped that Japan can take appropriate action before doing so because it will not only harm its country but also harm other countries that are disappointed with the actions that Japan will take.

Abstract

ABSTRACT The development of national space law has surpassed international space law. International space law needs to be developed because the exploitation of natural resources from the moon and other celestial bodies is closer than ever to becoming a reality. There is an urgency to develop existing international law or create new regulations that can accommodate resource mining activities in space. So the purpose of writing this thesis are: First, to know the urgency of modernize space law regarding resource exploration and exploitation activities on the moon. Second, find a solution to fill the legal gaps regarding the use of resources on the moon. This research is normative legal research, namely legal research carried out by examining library materials with secondary data. Then, the data that has been collected will be processed and analyzed using descriptive methods by sorting the data so that a conclusion can be drawn. From the results of the research problem there are two main things that can be concluded. First, there is an urgency to develop international regulations regarding the use of resources in space, especially on the moon because it has not been specifically discussed in the 1967 Space Treaty and the 1979 Moon Agreement. Second, solutions that can be taken to fill legal gaps regarding the use of resources in outer space, especially on the moon, are by using analogies with the law of the sea in developing space law, improving the international space legal framework, and developing institutions tasked with supervising exploitation activities. resources and space mining. Abstract

Abstrak Masa jabatan Kepala Desa tidak diatur secara explisit dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 seperti halnya masa jabatan Presiden dan Wakil Presiden serta masa jabatan kepala daerah, tetapi hanya diatur dalam Pasal 39 UU No.6/2014. Mahkamah Konstitusi (MK) dalam Putusan Perkara Nomor 15/PUU-XXI/2023 menyatakan dinamika perubahan pada pengaturan mengenai masa jabatan Kepala Desa sangatlah tergantung pada faktor filosofis, yuridis, dan sosiologis yang memengaruhi pada saat ketentuan tersebut dibuat. Masalah pokok dalam penelitian ini adalah: Apakah yang menjadi pertimbangan dari putusan mahkamah konstitusi Nomor 15/PUU-XXI/2023 terhadap masa jabatan Kepala Desa dan Bagaimanakah implikasi putusan mahkamah konstitusi Nomor 15/PUU-XXI/2023 terhadap masa jabatan Kepala Desa. Jenis Penelitian penelitian hukum normatif Penelitian ini merupakan penelitian yang akan mengkaji sistematika hukum, yaitu penelitian yang dilakukan terhadap peraturan perundang-undangan tertentu atau hukum tertulis, Dalam pengumpulan data untuk penelitian hukum normatif digunakan metode kajian kepustakaan. Analisis Data dalam penelitian hukum normatif data dapat dianalisis secara kualitatif dengan menguraikan secara deskriptif dari data yang telah diperoleh. Mahkamah Konstitusi dalam pertimbangan hukum Putusan Nomor 15/PUU-XXI/2023 menyatakan beberapa alasan. Ada sedikitnya lima alasan Mahkamah Konstitusi kemudian menyatakan masa jabatan Kepala Desa tetap 6 tahun, dengan maksimal 3 periode.  Keywords: Kepala Desa, Mahkamah Konstitusi, Masa jabatan. Abstract The term of office of a village head is not explicitly regulated in the 1945 Constitution of the Republic of Indonesia as is the term of office of the president and vice president and the term of office of regional heads, but is only regulated in Article 39 of Law No.6/2014. The Constitutional Court (MK) in Case Decision Number 15/PUU-XXI/2023 stated that the dynamics of changes to regulations regarding the term of office of village heads really depend on the philosophical, juridical and sociological factors that influenced the time the provisions were made. The main problem in this research is: What are the considerations of the decision of the constitutional court Number 15/PUU-XXI/2023 regarding the term of office of the village head and what are the implications of the decision of the constitutional court Number 15/PUU-XXI/2023 for the term of office of the village head. Types of research: normative legal research. This research is research that will examine legal systematics, namely research carried out on certain statutory regulations or written laws. In collecting data for normative legal research, the literature review method is used. Data Analysis In normative legal research, data can be analyzed qualitatively by describing descriptively the data that has been obtained. The Constitutional Court in its legal considerations on Decision Number 15/PUU-XXI/2023 stated several reasons. There are at least five reasons why the Constitutional Court then stated that the term of office for village heads remains 6 years, with a maximum of 3 terms.  Keywords: Village Head, Constitutional Court, Term of Office.

Abstract

The purpose of this study is to analyze the regulation related to community participation in the formation of village regulations as well as the ideal form of community participation in the formation of village regulations based on Article 24 of Law Number 6 Year 2014 on Villages. The type of research used by the author is normative legal research with qualitative data analysis that produces descriptive data. The results of this study state that the regulation of community participation in the formation of village regulations based on Article 24 of Law Number 6 of 2014 concerning Villages has failed because the level of community participation is still minimal. The author in this discussion provides an explanation of legal derivatives related to community participation in the formation of village regulations and the ideal form of participatory and transparent village regulations.

Abstract

The entry of Covid-19 requires the government to make policies and regulations. A number of existing rules cannot in fact be in accordance with what is mandated in the Article. The goal of this study are to knowing the regulation of Rapid Test and Polymerase Chain Reaction (PCR) Corona Virus Disease-19 in positive law in Indonesia and the rules of Rapid Test and Polymerase Chain Reaction (PCR) in Positive Law are in accordance with the theory of Legislation Formation. This research was prepared using a normative legal method that focuses on vertical legal synchronization. As a result, the creation of rules regarding the use of rapid antigen and PCR tests through the Decree of the Minister of Health needs to be strengthened and expanded again considering that this Ministerial Decree is limited to recognition and has not touched a more substantive dimension of protection and the regulations and policies issued regarding rapid antigen and PCR tests do not have permanent legal force and are weak and also not in accordance with existing positive law. The Government should pour regulations in one format of laws and regulations that are included in the hierarchy of laws and regulations

Abstract

Pemilihan Kepala Daerah Sebelum dan Sesudah Perubahan UUD 1945, dimana pemilihan kepala daerah bervariasi mulai dari masa Orde Baru sampai dengan masa reformasi saat ini. Dalam penyelenggaraan pemerintahan, Indonesia dikenal sebagai negara kesatuan yang dikelola berdasarkan paham demokrasi dimana daerah yang bersangkutan dipimpin oleh seorang kepala daerah, baik di daerah provinsi maupun kabupaten/kota. Untuk daerah provinsi, kepala daerah disebut Gubernur dan untuk daerah kabupaten kepala daerah disebut Bupati dan untuk daerah kota kepala daerah disebut Wali Kota. UUD 1945 menjadi dasar penyelenggaraan pemerintahan nasional, termasuk pemerintahan daerah. Pemilu merupakan perwujudan demokrasi yang sesungguhnya dan merupakan sarana bagi rakyat untuk menyatakan kedaulatannya terhadap Negara dan Pemerintahan. Kedaulatan rakyat dapat diwujudkan dalam suatu proses pemilihan umum yang berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dilaksanakan berdasarkan asas langsung, umum, bebas, rahasia, jujur, dan adil dalam Negara Kesatuan Republik Indonesia (NKRI). Penelitian ini bertujuan untuk mengetahui bagaimana pemilihan kepala daerah sebelum dan sesudah amandemen UUD 1945 dilihat dari perspektif demokrasi dan pemilihan kepala daerah yang ideal di masa mendatang. Metode yang digunakan dalam penelitian hukum normatif ini dalam melakukan analisis data adalah dengan melakukan analisis dengan ukuran kualitatif yang bertumpu pada substansi dengan pengumpulan data yang menarik simpulan. Hasil penelitian ini dapat disimpulkan bahwa politik hukum pemilihan kepala daerah sebelum dan sesudah amandemen UUD 1945 terus mengalami proses restrukturisasi sistem dari yang awalnya tidak demokratis menuju ke arah yang lebih demokratis sesuai dengan konfigurasi politik yang melatarbelakanginya

Abstract

Through this study, the author explores the challenges and potentials that arise from granting mining licences to religious organisations, including potential conflicts between economic objectives and moral values held by religious organisations. On the one hand, mining activities can provide economic opportunities for religious organizations and neighbouring communities, but on the other hand, these activities risk damaging the environment and contradicting religious teachings that prioritise nature conservation. The article also identifies the importance of clear policies and strict supervision to ensure that mining activities by religious organisations are not only financially beneficial but also socially and environmentally responsible. Thus, this research uses a normative method to seek truth coherence, with a statutory approach, conceptual approach and case approach. In conclusion, this article recommends the need for stricter regulations, transparency in the licensing process, as well as strengthening dialogue between the government, religious organisations and the community to ensure the sustainability of these activities in line with existing religious and social values.
