Abstract

The law is expected to be able to protect the rights that should be given tocitizens who are carrying out the imprisonment criminal liability process. Thispunishment of imprisonment is also a form of crime of deprivation of liberty, butthis punishment of confinement is lighter in some respects than imprisonment.Similar to imprisonment, imprisonment is also a crime in the form of limiting thefreedom of movement of a convict which is carried out by closing that person in acorrectional institution. There are privileges for convicts who carry outimprisonment, convicts have gun rights, namely at their own expense they can seekconveniences for their lives while in correctional institutions, for example takingcare of food and or sleeping equipment through correctional officers In theCriminal Code (KUHP), the right to a gun is emphasized in Article 23 which reads:“A person in prison may improve his fate at his own expense.This research is included in the category of normative legalresearch/approach. Namely research that is focused on examining the applicationof the rules or norms in positive law. In collecting data for normative legalresearch, the library research method is used which includes studies by reviewing,analyzing and analyzing information obtained from various literature such asbooks, legislation, scientific papers, the internet and other sources, in terms of Inthis case, a researcher is required to be observant and precise in finding data thatis related to the subject matter.The author concludes that, the granting of Pistole rights or special rights isa right owned by a prison convict in the form of certain facilities; for example abed, or own food and medicine. Pistole rights are only owned by convicts in prison,while those who are sentenced to prison terms do not have that right. And 2.Regarding the obstacles faced in law enforcement granting gun rights to convictsin social confinement, namely: the human resource factor, the lack of facilitiesfactor and the community's legal awareness factor.Keyword : Provision, Gun right, Confinement.

Abstract

In the rule of law, the state guarantees equality before the law and recognizes and protects humanrights, so that all people have the right to be treated equally before the law, as in the provision of legalassistance to suspects or defendants either free of charge. The provision of free legal assistance itself hasbeen regulated in the Kitap Law of Criminal Procedure, which is the basis of formal criminal law inIndonesia. With the existence of Law of the Republic of Indonesia Number 39 of 1999 concerning HumanRights, it makes the interpretation that the Criminal Procedure Code has not been able to providecomprehensive legal assistance so that it can cause a narrowing in the fulfillment of Human Rights inobtaining equality before the law in court. Based on this understanding, the author formulates 2 problemformulations. First, whether the arrangement for the provision of free legal assistance based on Article 56 ofthe Code of Criminal Procedure in Indonesia is in accordance with the perspective of human rights, second,what is the ideal idea of providing free legal assistance to fit the perspective of human rights.This type of research is normative juridical legal research, which is research conducted withliterature review or literature study in searching for data. This research is descriptive in nature that providesdata that is as thorough and detailed as possible on existing problems. In this writing using qualitative dataanalysis which means explaining and concluding about the data that has been collected by the author. Thisresearch uses secondary data or scientific data that has been codified.From the results of this study, it is found that, there is something that can be concluded is that theprovision of free legal assistance as stipulated in article 56 of the Criminal Procedure Code is not thoroughlygiven to suspects or defendants who are considered economically disadvantaged, so that there is a neglect ofhuman rights for those who are not accompanied by legal assistance in trial. In this case, ideal ideas areneeded, such as revising the Criminal Procedure Code or reforming laws by the government so that there areno human rights that are improved, especially in obtaining justice before the law.Keywords: Free Legal Aid-Human Rights

Abstract

Amendments to the 1945 Constitution have resulted in several new state institutions,one of which is the Regional Representative Council (DPD). The basic idea behind theformation of the DPD is the desire to accommodate regional aspirations and at the same timegive the regions a bigger role in the process of making political decisions on matters that areprimarily directly related to the regions. With the authority possessed by the DPD manythings can be done. Now many people don't know what the DPD is, why this happenedbecause the performance of the DPD has not been optimal. Many discussions and seminarshave been held by the DPD, both with legal and political experts and with their constituentsin their respective regions, the context of these discussions always discusses the weakness ofthe authority possessed by the DPD, as if this authority is the main obstacle in carrying out itsduties and obligations. .This type of research is normative legal research. Normative legal research is legalresearch conducted by examining literature or secondary data consisting of primary legalmaterials, secondary legal materials and tertiary legal materials. Normative legal research isalso called doctrinal legal research, also referred to as library research or document study.This research examines the subject matter in accordance with the scope and identification ofproblems through a statutory approach (Statute approach). related to the legal issue understudy.The ineffectiveness of the DPD as a representative institution in carrying out its dutiesis suspected to have occurred due to several factors. First, misconceptions in applying thebicameral concept. Second, the authority of the DPD is very limited and is only related toregional matters. Third, the DPD was formed to prevent the hegemony of the executivebranch from returning, but then the balance of power did not work effectively because of thelarge amount of authority possessed by the DPR. The ideal mechanism related to theimplementation of regional community aspirations in the field of supervision carried out bythe DPD is divided into two ways in conveying aspirations, namely by formal and informalmeans. DPD members are expected by their voters to fulfill the will of the people'saspirations, provide services and provide various other forms of satisfaction even if they areonly symbolic, in carrying out their duties it is not uncommon for differences to occurbetween the representatives of the people and the people who elect them.Keywords : DPD – Authority – Settings

Abstract

Visit visa free has a positive impact on increasing foreign tourists to West Sumatra in the tourism sector. The granting of a visit visa-free can be interpreted as freeing the recipients of a visit-free visa from the obligation to have a visit visa to enter Indonesian territory. The visit visa-free arrangement is expected to increase the number of foreign tourist visits to Indonesia so that it will have an effect on increasing state revenues, as well as advancing the nation's welfare. However, in reality this policy creates problems, namely the implementation of visit visas is widely misused. And the next problem is the lack of human resources on the part of immigration in carrying out supervision. The objectives in writing this thesis are: First, to find out in the application of Presidential Regulation Number 21 of 2016 concerning Visa-Free Visits, whether it is in line with the government's expectations. Second: find out what efforts have been made by related parties under the supervision of foreign nationals in misusing Presidential Regulation Number 21 of 2016 concerning visa-free visits in the province of West Sumatra. The type of research used is sociological juridical, namely research conducted by identifying the law and how the effectiveness of the implementation of the law applies in society. Because in this study the authors directly conducted research at the location or place under study to provide a complete and clear description of the problem under study. From the results of the study, it was found that the Implementation of Presidential Regulation Number 21 of 2016 concerning Visa-Free Visits to Supervision of Foreign Citizens in the West Sumatra region has not been maximized in its implementation because it will indirectly reduce non-Tax state income from the sector of purchasing visas by foreigners. The visit visa-free policy is also considered to add to TPI Padang's Class I Immigration work which basically lacks Human Resources to carry out surveillance of foreigners in the quite extensive area of West Sumatra. Immigration Control against foreigners carried out with involving relevant agencies in the field of supervision foreigners like establishment The foreigner monitoring team (TIMPORA) which Its members consist of immigration, police, prosecutors, tourism office, employment agency, BIN, BNN and agencies or institutions that have direct contact with foreigners. Author's suggestion, First, there is a need for an assessment of the policy Presidential Regulation Number 21 of 2016 regarding visa-free visits which are considered to have a threatening impact on state security. Second Increase the ability of resources officers not only in terms of quantity but also quality.

Abstract

Legal protection for children is defined as an effort to protect the law against the freedom and human rights of children related to their welfare. Children as human beings are treated equally regardless of gender, age, race, and ethnicity. However, in practice, children of perpetrators of criminal acts of terrorism often experience discrimination, stigmatization and persecution in their lives. Stigmatization and labeling that are not handled properly will lead to resentment and adjustments in a child's behavior according to what is labeled, namely being a terrorist. This research uses normative legal research or also known as doctrinal legal research which uses secondary data sources using primary legal materials, secondary legal materials, and tertiary legal materials. In this normative research, researchers conducted research on vertical and horizontal legal synchronization. This study discusses legal protection arrangements for children at risk of experiencing secondary prisonization, the impact of secondary prisonization on children and efforts to overcome stigmatization of children at risk of experiencing secondary prisonization

Abstract

Economic crisis of Sri Lanka is the lowest point in the history of this country, therefore chaos cannot be avoided. It makes Sri Lanka have to ask for help from The IMF, to provide financial assistance in overcoming the crisis. In accordance with the provisions of the IMF formation charter, the granting of assistance funds to member countries is one of the tasks of the IMF. However, the assistance must be accompanied by the terms and conditions that Sri Lanka must follow before finally receiving the assistance. The goal of this study is to identify the role of the IMF as an international organization that helps the Sri Lanka economy. This type of research is normative legal research, namely legal research carried out through examining library materials in the form of binding legal rules and secondary data such as other literature related to this research. As a result, according to the charter for the establishment of the IMF, the role of the IMF in providing financial assistance is in accordance with the duties of the organization and is a right for member countries. In the end the IMF did provide aid funds but the provision of these funds in reality seemed to hang Sri Lanka for about a year even though the country was in a state on the verge of collapse. The provision of assistance is also accompanied by various conditions on the grounds that the borrowing country must be able to ensure that they can return the funds according to the agreement, considering that these funds are the result of the quota of each member country. Sri Lanka as a borrowing country must follow the standards set by the IMF regarding the conditions of countries entitled to receive loans by implementing policies.

Abstract

The relocation of the capital city dominates the country due to the country's regional development goals, mitigation of the risk of rebellion, decisions of the country's leaders, the problem of flooding in the capital, the country's former low, and infrastructure development. The discourse on moving the capital city has appeared several times during the presidential administration. Then during the administration of President Joko Widodo, discourse reappeared to move the national capital. President Joko Widodo decided to make parts of North Penajem Paser and Kutai Kartanegara in East Kalimantan the location for Indonesia's new capital. Law Number 3 of 2022 concerning the State Capital is a legal political form of moving the national capital. The urgency of relocating the capital as expressed by President Joko Widodo at the Annual Session of the People's Consultative Assembly, is based on the fact that economic activity is concentrated in Jakarta and Java, which has created an economic gap between Java and outside Java. This inequality causes a concentration of economic investment. The concentration of economic investment in Jakarta has resulted in a very low poverty rate in Jakarta compared to other regions. Therefore, it is necessary to examine how the legal politics of placing the Indonesian state capital in East Kalimantan are related to national economic development. The type of research used by the author is normative legal research. Normative legal research is carried out by examining library materials or secondary data. The data collection technique in this research is library research. This technique can be used to limit the use of document studies or library materials, namely secondary data. In writing this thesis, the author uses qualitative data analysis which produces descriptive data. With qualitative analysis, a researcher aims to understand or understand the symptoms he is studying. The results of this thesis research state that the placement of the Indonesian state capital from Jakarta to East Kalimantan is based on the philosophical, sociological, and juridical foundations of Law Number 3 of 2022 concerning the State Capital. Then the legal politics of placing the national capital in East Kalimantan is linked to national economic development so that in the future, the burden on the island of Java, especially Jakarta, can be reduced. In addition, the placement of the capital city in East Kalimantan is to balance the Indonesian economy, including to the eastern part. The government believes that this will bring a number of benefits in the economic field. However, moving the nation's capital should have been done when the country was ready. Abstract

Artikel ini bertujuan untuk menganalisis efektivitas kegiatan sosialisasi pendaftaran merek bagi pelaku usaha di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis. Pendaftaran merek merupakan langkah krusial dalam melindungi hak kekayaan intelektual dan menciptakan keunggulan kompetitif bagi pelaku usaha, terutama di tingkat lokal seperti desa. Namun, kesadaran dan pemahaman akan pentingnya pendaftaran merek seringkali masih kurang di kalangan pelaku usaha skala kecil di daerah pedesaan. Metode yang digunakan adalah metode diskusi dan praktek (learning by doing) dan hasil kegiatan menunjukkan bahwa sebagian besar pelaku usaha di Desa Semunai pada awal kegiatan belum memiliki pemahaman yang baik tentang pendaftaran merek dan manfaatnya, sehingga dengan dilaksanakannya kegiatan ini telah meningkatkan pemahaman dan kesadaran peserta terkait regulasi, urgensi, dan tatacara pendaftaran merek. Upaya sosialisasi yang lebih intensif dan berkelanjutan akan membantu melindungi hak kekayaan intelektual pelaku usaha, meningkatkan daya saing, dan mendorong pertumbuhan ekonomi di tingkat desa, khususnya di Desa Semunai, Kecamatan Pinggir, Kabupaten Bengkalis.

Abstract

implementasi sanksi pidana dalam perlindungan terbatas jenis ikan terubuk di provinsi riau. Metodologi menggunakan metode sosiologis. Proses pelaksanaan Keputusan Menteri Kelautan dan Perikanan di provinsi riau masih hanya berupa pemberian teguran baik secara lisan maupun tertulis disertai dengan dilakukannnya proses sosialisasi secara berkelanjutan dengan melakukan penempelan stiker kepada kapal-kapal nelayan dan pembagian brosur tentang pelarangan pnagkapan ikan terubuk pada tempat tertentu dan pada waktu tertentu. Diharapkan dari adanya proses pemberian teguran dan sosialisasi secara berkelanjutan dapat dicapainya tujuan dari Keputusan Menteri Kelautan dan Perikanan berupa perlindungan ikan terubuk.

Abstract

Dalam menyelenggarakan usaha Sehat Pakai Air (SPA) pelaku usaha harus memiliki izin sebagaimana diatur berdasarkan Peraturan Menteri Kesehatan Republik Indonesia Nomor 8 Tahun 2014 tentang Pelayanan Kesehatan SPA , namun ternyata masih banyak ditemukan pelaku usaha SPA yang tidak memiliki izin. Sehingga dalam kajian ini akan di bahas mengenai bagaimanakah pelaksanaan perizinan usaha SPA berdasarkan Peraturan Menteri Kesehatan Republik Indonesia Nomor 8 Tahun 2014 Tentang Pelayanan Kesehatan SPA? Apakah faktor-faktor yang menyebabkan banyaknya usaha SPA yang tidak memiliki izin di Kota Pekanbaru? Bagaimanakah upaya yang dilakukan untuk mengatasi banyaknya usaha SPA yang tidak memiliki izin? Jenis penelitian ini adalah yuridis empiris, sehingga sumber data yang digunakan berupa data primer dan data sekunder dengan teknik pengumpulan data dilakukan dengan cara observasi, wawancara dan kajian pustaka.
