Abstract

This article discusses the historical development of madrasas in Madura, where Islamic education has a long history that began during the time of the Prophet Muhammad (peace be upon him) with teaching methods in homes and mosques. Over time, Islamic education has undergone transformation, especially with the emergence of madrasas as formal institutions that integrate religious knowledge and general knowledge. In Madura, Islamic boarding schools are the oldest Islamic educational institutions and play a vital role in maintaining Islamic values, as well as being the beginning of the emergence of madrasas in Madura. With the influence of modernization, madrasas emerged as a form of renewal of Islamic education. This study discusses the rise of madrasas in Madura, their important role in shaping the character and religious identity of the community, as well as the challenges and opportunities faced. Madrasas in Madura have successfully combined traditional values with the demands of modernity, while also becoming agents of social change that maintain harmony between the two. Despite facing challenges such as limited facilities and teacher quality, madrasas in Madura continue to play a vital role in maintaining the balance between religious education and general knowledge, as well as in strengthening the cultural and religious identity of the Madurese community. This study uses a literature review method by examining articles related to this research.

Abstract

Intellectual Property Rights (IPR) are a crucial issue in the modern world, as the economic and social value of ideas, innovations, and human intellectual works increases. In the context of Islamic law, the discussion of IPR presents a unique challenge because it is not found explicitly in classical Islamic jurisprudence literature. This article aims to explore the Islamic legal perspective on IPR through the approaches of maqasid al-shari'ah, qiyas, and contemporary ijtihad. This study analyzes various types of IPR, such as copyright, patents, and trademarks, within the framework of basic Islamic principles such as justice, ownership, and the prohibition of unjust appropriation of others' rights. In addition, this article examines the implementation practices of IPR law in modern Muslim countries and the responses of contemporary Islamic scholars to the protection of intellectual works. The results of the study indicate that although IPR is a concept born from modern Western law, its basic principles can be synergized with Islamic values, as long as they do not conflict with sharia principles. Therefore, strengthening IPR regulations within the framework of Islamic law is important as a form of protection of the moral and economic rights of creators, as well as a means of maintaining the public interest in Muslim society.

One of the issues that arises is religious exclusivism, which means the tendency to see a particular religion as the only truth and way of salvation, accompanied by an attitude of rejecting or marginalizing the existence of beliefs. other. This research aims to find out the perspective of religious exclusivism in Generation Z based on age group. This research uses a quantitative approach by collecting data using the religious exclusivism instrument (Sukmayadi, 2024). The sample for this research consisted of 100 Generation Z who live in West Java, and used data collection techniques via Google Form, and processed with IBM SPSS 25.0. The results of the study show that there is no significant difference in religious exclusivism between those aged 17 - 21 years and those aged 22 - 26 years. Apart from that, it can be concluded that overall, the sample in this study has a religious exclusivism perspective which is dominated by the medium category. This reflects that generation Z is still in the process of an identity crisis because they still have to fulfill their developmental tasks.

Abstract

The Economic Analysis of Law (EAL) theory proposed by Richard A. Posner holds significant relevance in the regulation of Islamic banking, particularly in assessing the effectiveness and efficiency of regulations to achieve economic objectives. EAL emphasizes the importance of flexible and responsive regulations to market needs, as well as the integration of Sharia principles without hindering innovation. In the context of Islamic banking, regulations must adhere to Sharia principles such as the prohibition of riba and fairness in risk-sharing, while also promoting financial efficiency and stability. This study aims to analyze how EAL can assist in designing regulations that maximize economic benefits while ensuring social justice, in line with maqashid sharia. Using a qualitative and normative-analytical approach, this research compares the concepts of EAL with the principles of Islamic banking and identifies the challenges in aligning efficiency and justice in regulatory practice. The findings of this study suggest that the application of the Economic Analysis of Law (EAL) theory in the regulation of Islamic banking is crucial for achieving a balance between economic efficiency and social justice. While EAL focuses on optimizing resources for maximum economic benefit, in the context of Islamic banking, regulations must still consider Sharia principles such as the prohibition of riba and distributive justice. The main challenge lies in the need for regulations that are flexible and responsive to market dynamics, so they can integrate Islamic moral values with the need for efficiency. Therefore, well-designed regulations can support the sustainable and stable growth of Islamic banking, while meeting societal needs in accordance with maqashid sharia.

Abstract

Today, the role of fathers in raising children is a frequently discussed issue. In patriarchal cultures, fathers serve as breadwinners to meet the family's needs. Meanwhile, mothers play a larger role in childcare and household management. This contrasts with the ideal, where fathers, as heads of families, also play a significant role in childcare. Therefore, the phenomenon of fatherhood is important to study and research in greater depth, especially from the perspectives of gender-biased and gender-just commentators. The purpose of this study is to analyze the pattern of fatherhood in the Qur'an and to reveal the views of gender-biased and gender-just commentators on fatherhood. This research method uses a qualitative approach, utilizing a literature review to collect data. This research shows several results including the following; 1) fatherhood has the meaning as the role, function, condition and time of a person becoming a father. 2) in general, scholars of gender bias interpretation argue that the father has a role as a breadwinner and provider in the family, while according to scholars of gender fair interpretation the father has the same role as the mother in terms of caring for and educating children. 3) with gender analysis, it can be seen that the interpretation carried out by scholars of gender fair regarding fatherhood has reflected the spirit of tauhidullah and fulfilled the objectives of the five maqashid sharia, namely maintaining reason (hifz al-aql), maintaining oneself (hifzl an-nafs), maintaining offspring (hifz an-nasl), maintaining property (hifz al-maal) and maintaining religion (hifz ad-din).
