Abstract

Halal certification is a series of processes that must be fulfilled by slaughterhouses. The aim is to provide comfort, security, safety and certainty of the availability of halal meat for the community, as well as increasing added value for business actors to produce and sell halal meat products. This research examines the provisions regarding halal certification rules for slaughterhouses in Indonesia, the halal certification mechanism and the consequences for slaughterhouses that are not halal certified. The research method used is the normative juridical method, namely research that focuses on legal norms contained in statutory regulations. The research results show that the provisions for halal certification for slaughterhouses in Indonesia are regulated in Law Number 33 of 2014 concerning Halal Product Guarantees, Law Number 6 of 2023 concerning Determination of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation, Government Regulation Number 39 of 2021 concerning the Implementation of the Halal Product Guarantee Sector, Decree of the Minister of Religion Number 748 of 2021 concerning Types of Products that must be halal certified, and detailed guidelines are regulated in the Decree of the Head of the Halal Product Guarantee Organizing Agency Number 77 of 2023 concerning Guidelines for Implementing the Product Guarantee System Halal in Slaughtering Ruminants and Poultry. The halal certification mechanism consists of the manager or business operator of the slaughterhouse registering and attaching the required documents; BPJPH will examine the requirements that have been attached; Next, an audit and inspection of the product will be carried out, submitting the inspection results to the MUI for a fatwa to be issued; and issue a halal certificate if it passes the audit. The consequences for slaughterhouses that do not implement halal product guarantees are that they will receive administrative sanctions in the form of reprimands, written warnings and revocation of halal certificates for those who already have halal certificates. The author suggests that these consequences be added in the form of slaughterhouses that do not have a halal certificate not being allowed to operate and slaughtered meat being prohibited from circulating.

Abstract

Initially, restitution was more popular in the field of civil law, but along with the development of criminal law, the term restitution was heard more often, especially in criminal cases involving children as victims. Child victims have the right to obtain compensation for the suffering they experience as a result of criminal acts. However, the implementation of this restitution cannot yet be said to be optimal, because there are still many children who are victims of criminal acts, especially sexual abuse, who do not receive restitution as they should, and some even do not know about it. This research is normative juridical by examining secondary data (library research). The results of this research provide an illustration of how the fulfillment of children's rights and protection is implemented in the decision of the Banda Aceh District Court in case Number: 132/Pid.Sus/2020/PN Bna, which is a case of sexual abuse committed by unscrupulous teachers at SD Negeri 64 Banda Aceh Ateuk Jawo Village , Baiturrahman District, Banda Aceh City to underage female students.

Abstract

This research delves into the discourse related to village restorative justice and customary law in the Province of Jambi in the context of the diversity of authority shifts between modern legal approaches and existing legal traditions. The research background refers to conceptual differences and perspectives on dispute resolution between the state and customary law. To examine the relationship between the concept of restorative justice and customary justice, this study employs a qualitative approach by conducting in-depth interviews with representatives from the prosecution, community leaders, as well as traditional leaders in several restorative villages in the Province of Jambi. The literature review involves a profound understanding of restorative justice, customary justice, and the interaction between state law and customary law. The research findings highlight the conflicts and convergences between the restorative justice approach and the existence of customary justice. Conflicts arise in the interpretation of rights, obligations, and authority held by each system. However, this research also reveals the potential synergy between these two approaches in resolving disputes with a more holistic and contextual approach. The findings of this research indicate the importance of dialogue and collaboration between the state and customary law in developing initiatives such as village restorative justice. In the context of the Province of Jambi, wise integration of state and customary law can bring benefits for the preservation of cultural values as well as the fulfillment of individual and community rights.

Abstract

Customary land rights are the highest form of land ownership under customary law, encompassing all land within a specific customary legal jurisdiction, jointly held by members of the indigenous community. The purpose of this research is to find a model for registering communal land in the land registration system and to determine the legal status of communal land in the land registration system. The research methodology used in this study is normative legal research, employing various approaches such as statutory approach and conceptual approach. The legal sources used include primary legal materials, secondary legal materials, and tertiary legal materials. The research findings indicate that the registration of communal land in the land registration system, both de facto and de jure, has been recognized and protected through two regulations that acknowledge the existence of communal land, namely Ministerial Regulation No. 10 of 2016 and the Complete Systematic Land Registration (PTSL) program. Essentially, communal land controlled by indigenous communities will be acknowledged through a decree issued by the regent/mayor/governor for the registered communal land at the local National Land Agency (BPN) office. However, the legal status of communal land in the Land Registration System shows that communal land is not included in the rights to land as regulated in Government Regulation No. 24 of 1997 concerning land registration. Therefore, a revision of the land registration regulation is necessary to ensure the legal certainty of communal land controlled by indigenous communities

Abstract

According to data from the anti-corruption education center released by Transparency International's Corruption Perceptions Index, Indonesia ranks 96th in 2021 in the corruption perception index with a score of 38 on a scale of 100. This study aims to determine the differences in the regulation and imposition of sanctions on perpetrators of corruption between Indonesia and Singapore. With Normative legal research, data is collected by literature study using secondary data which includes primary, secondary and tertiary legal materials which will be reviewed and studied one by one. This research provides results that show that there are several differences in preventing criminal acts of corruption in Indonesia and Singapore in terms of legislation, criminal sanctions, and anti-corruption institutions.

Abstract

Article 4 of Law of the Republic of Indonesia Number 33 of 2014 concerning Halal Product Guarantee states that "Products that enter, circulate, and are traded in the territory of Indonesia must obtain a halal certificate". However, in reality in the field there are still many products circulating in the territory of Indonesia that do not have halal certificates and do not apply these rules, especially in Drinking Water Depots in Meurebo District, West Aceh. The purpose of this study is, to determine the responsibility of Drinking Water Refill Depot business actors for the obligation of halal certificates in Meureubo District, West Aceh Regency. To find out the obstacles faced by Drinking Water Refill Depot business actors in carrying out halal certificate obligations. This research uses empirical juridical research methods, which is one type of legal research that analyzes and examines the operation of law in society. The results showed that drinking water refill depot business actors have not been responsible for the halalness of the products produced, because they do not yet have a halal certificate, the business actors believe that the water produced is halal because it has been laboratory tested by the West Aceh Health Office. Obstacles for drinking water refill depot business actors in carrying out halal certificate obligations are the lack of legal awareness of the community, and the lack of public knowledge. Consumers do not get protection in consuming refill drinking water, because business actors do not carry out obligations for halal certificates.

Abstract

Persoalan sengketa jasa keuangan apabila diselesaikan secara litigasi membutuhkan waktu yang lama, tidak efisien, dan tentunya menambah beban bagi institusi peradilan karena banyak sengketa lain yang menjadi tanggung jawabnya. Maka penyelesaian mediasi menjadi opsi yang dapat diandalkan, akan tetapi permasalahan muncul karena Perjanjian Mediasi sebagai bagian dari penyelesaian sengketa keperdataan, dalam praktiknya memiliki kekuatan mengikat yang berbeda-beda sesuai dengan proses akta yang digunakan.Metode penelitian yang digunakan dalam penelitian ini menggunakan pendekatan yuridis normatif dengan mempelajari dan menelaah data-data primer berupa Peraturan Perundang-Undangan terkait mediasi sengketa Pelaku Usaha Jasa Keuangan dengan konsumen, prinsip-prinsip hukum, doktrin dan studi kasus. Pengumpulan data dilakukan melalui studi kepustakaan yang diperoleh dari data primer dan sekunder, yang kemudian dianalisis secara kualitatif.Hasil penelitian ini berdampak terhadap efisiensi lembaga mediasi, mediator, dan pihak-pihak yang melakukan mediasi dengan hasil tepat terhindar dari pemborosan energi apabila ada pihak yang melakukan gugatan kembali, Model Perjanjian Mediasi berdasarkan kekuatan mengikat akta, yaitu: Acte Van Dading, mediasi di LAPS-SJK tembusan ke OJK / LAPS-SK tembusan ke BI, Akta Notaris, dan sukarela.

Abstract

In Indonesia, company executives is frequently held personally liable of any damages incurred through the business. Indeed, an analysis of the BJR reveals that director is afforded protection for their business decisions, as such decisions are seen to be made with the prudence expected of professionals in their capacity. The execution of BJR has been suboptimal in Indonesia. The research seeks to recognize the challenges and issues related to the application within the BJR principle in Indonesia and to determine whether the legal framework for limited liability companies has been comprehensively analyzed concerning the BJR principle as a protective measure for company directors.The study methodology employed is empirical juridical. The findings indicate that the persistent unsatisfactory implementation of the BJR stems from the inadequately detailed regulations concerning the BJR within the law, particularly regarding the constraints of the prudential standard, resulting in challenges in law enforcement.Uncertainty persists regarding the courts' interpretation of the BJR. The challenge in implementing BJR in Indonesia is the insufficient practical comprehension among directors and shareholders who do not fully grasp the concept of BJR. Strict rules impede the flexibility of decision-making by the committees of executives, resulting in conflicts between regulations and business practices.

Abstract

The use of circumstantial evidence in Indonesia's criminal justice system has sparked significant legal debate, particularly in complex cases like the Jessica Kumala Wongso trial. This research examines the application of Indirect evidence in criminal proceedings, focusing on its implications for proving criminal liability and ensuring justice. The study analyzes the Jakarta Central District Court's Decision No. 777/PID.B/2016/PN.JKT.PST, which heavily relied on circumstantial evidence to convict the defendant of premeditated murder. The research aims to evaluate the legal standing of circumstantial evidence in Indonesian criminal law, assess its impact on the principles of due process and presumption of innocence, and explore the challenges in balancing effective law enforcement with the protection of defendants' rights. Using a normative juridical approach with analytical descriptive characteristics, this study employs case study, statutory, and conceptual approaches to examine relevant laws, court decisions, and legal doctrines. The methodology involves comprehensive analysis of secondary data sources, including legislation, books, journals, and other pertinent literature. The findings highlight the need for clearer guidelines and stricter standards in the use of circumstantial evidence, emphasizing the importance of maintaining the integrity of the justice system while adapting to the complexities of modern criminal cases. This research contributes to the ongoing discourse on reforming Indonesia's criminal evidence system to better address challenges in contemporary legal practice.

Abstract

One of the fundamental problems with the second amendment to the Papua Special Autonomy Law is the presence of a special body called Badan Pengarah Percepatan Pembangunan Otonomi Khusus Papua as stipulated in chapter 68A. Which chapter was also reviewed to Indonesia Constitutional Court by the people’s assembly of Papua (MRP) and was considered contrary to the principle of the widest possible autonomy. This paper seeks to unravel the legal policy background of the second amendment to Papua Special Autonomy Law using three variables, namely technocracy, legal-philosophy, and participation. To answer the problem, the author uses juridical-normative research with a conceptual and statutory approach and uses secondary data. The result shows that the involvement of the Vice President as chairman of the special body is contrary to the constitution; there is an overlap with similar bodies that have been regulated by the Local Government Law; narrowing the implementation of governance by local governments in Papua. In addition, there are legal-philosophical problems in the interpretation of Article 68A which contradicts the constitutional basis for special autonomy in Article 18B of the 1945 Constitution of the Republic of Indonesia and the lack of participation in the process of amending the Papua Special Autonomy Law.
