Abstract

This study analyzes Decision Number 66/Pid.B/2014/PN.Amp in a murder case, highlighting the alleged inconsistencies in judicial considerations with legal provisions. A normative approach was used to evaluate the consistency of the judge's considerations with the available evidence, adherence to legal procedures, and principles of justice. The analysis reveals that the District Court of Amlapura applied Article 338 of the Criminal Code (ordinary murder), despite evidence suggesting premeditation that should be categorized under Article 340 (premeditated murder). The High Court of Denpasar corrected this by applying Article 340 and increasing the prison sentence to 13 years. This correction aligns better with the facts and principles of justice, setting a better legal precedent for judicial practices in Indonesia.

Abstract

The issue regarding the minimum age requirements for presidential and vice presidential candidates as stated in Constitutional Court Decision No. 90/PUU-XXI/2023 has been on the public's lips continuously in the past year. There have been many reports regarding the results of this decision, and most recently violations of the Constitutional Court judges' code of ethics were discovered in the decision-making process. This case has been widely researched (especially in the 2024 time period), but this case has never been formulated in a research problem formulation from the perspective of Islamic constitutional law, which actually has an intensity regarding the conception of the head of state (president and vice president). Therefore, the question regarding how Islamic constitutional law views this case is important to formulate as a research problem. Based on the research results, the Constitutional Court Decision No. 90/PUU-XXI/2023 according to Islamic constitutional law is not contradictory because the criteria for the head of state in Islamic constitutional law do not refer to age limits but to physical and spiritual perfection. As for the head of state's conception, Islamic constitutional law is very dependent on the system of government adopted by the country. So the decision of the Constitutional Court case was returned to the discussion of constitutional law that applies in Indonesia.

Abstract

Marriage is a profound bond between a man and a woman aimed at forming a harmonious, loving, and compassionate family, grounded in the belief in the Almighty God. The Marriage Law No. 1 of 1974 governs marriage as a means to build a happy family, addressing both physical and spiritual needs. In practice, marriage involves the element of dowry or mahar, which varies by region. In Samarinda, the Banjar ethnic group has a tradition called "maantar jujuran," where the dowry is tailored to the bride’s preferences and local cultural practices. This tradition is not merely a requirement but also a symbol of respect and commitment from the groom. The process of delivering the jujuran involves negotiations between the families of the bride and groom to determine the amount and timing of the dowry. This study employs qualitative methods and case study approaches, using descriptive and analytical techniques to explore the maantar jujuran tradition. Although not part of Islamic law, this tradition is significant in Banjar culture as a form of cultural and local wisdom-based da'wah. The findings indicate that maantar jujuran serves as a symbol of commitment and financial support for the newlyweds, while preserving social norms and cultural traditions within the Banjar community.

Abstract

The community empowerment program which focuses on innovation in processed fish products at the AB Banteng KKSS Palangkaraya Pool aims to overcome the problem of stunting among children by increasing nutritional intake. This initiative utilizes freshwater fish as an abundant source of local protein, by processing them into nutritious products such as nuggets, sausages and fish balls. The method used is the Asset-Based Community Development (ABCD) approach, which identifies and exploits local potential and involves the community in the entire production process. The program results show a significant reduction in the prevalence of stunting from 30% to 18%, an increase in children's daily protein intake from 35 grams to 60 grams, and an increase in average height of 2 cm. This program has also succeeded in increasing community skills and knowledge in fish processing, as well as providing economic benefits through job creation and increased income. Local government support to include processed fish products in school food programs also ensures the sustainability and expansion of program benefits. Challenges faced include changes in eating habits and environmental conditions, which are addressed through intensive nutritional education and pond management training.

Abstract

Sea and Coast Guard (SCG) Indonesia has an important role in maintaining Indonesian maritime security and safety. SCG operations require a reliable and efficient electrical system to support various missions, such as patrol, search and rescue, maritime law enforcement, and disaster management. This research aims to develop a ship electrical system that meets the operational needs of SCG Indonesia. This research begins with an analysis of the power requirements and load characteristics of SCG Indonesia. Based on the analysis results, the ship's electrical system was designed by considering several factors, such as energy efficiency, reliability and redundancy. This research also develops operational and maintenance strategies for ship electrical systems to ensure optimal performance. The research results show that the ship electrical system developed is able to meet SCG Indonesia's operational needs with high energy efficiency and good reliability. What are the power requirements and load characteristics of SCG Indonesia? What are the factors that need to be considered in designing a ship's electrical system for SCG Indonesia? What is the optimal operation and maintenance strategy for the SCG Indonesia ship electrical system? Analysis of the power requirements and load characteristics of SCG Indonesia shows that the ship's electrical system must be able to provide sufficient power for SCG Indonesia's various missions. A ship's electrical system is designed with energy efficiency, reliability and redundancy in mind.
