Abstract

orced marriage is not something new, it has even become a tradition in several regions in Indonesia. So, sometimes people make this a natural thing because it is part of local customs. However, in reality, the tradition of forced marriage has the potential to cause sexual violence in the household. In this article we will discuss aspects of women's protection in the forced marriage tradition in Indonesia. Apart from that, it will also be discussed regarding how Indonesian laws and regulations view the tradition of forced comrades in Indonesia. The research method used is library research with a normative juridical approach. Based on the results of the study, it shows that forced marriage in Indonesia violates women's freedom to choose their partner. Apart from that, forced marriage is also part of sexual violence so it violates human rights and is contrary to various regulations in Indonesia. Looking at these facts, aspects of legal protection that victims of forced marriage must obtain include repressive and preventive legal protection. This repressive legal protection aims to prevent forced marriages in accordance with Indonesian laws and regulations. Meanwhile, preventive legal protection aims to resolve problems that have arisen as a result of forced marriage. This last handling of legal protection is carried out by the court in accordance with Indonesian laws and regulations.

Abstract

In the long history of the science of hadith criticism, it can generally be divided into two phases: the riwayah phase, also known as the mutaqadimin phase, and the post-riwayah phase, also referred to as the muta'akhirin phase. According to several Muslim scholars, including Sharif Hatim al-Auni, there has been a distortion of the scientific knowledge of hadith between these two phases. This is because the mutaqadimin phase represents the application (marhalah tatbiq) of the science of hadith, while the muta'akhkhirin phase represents the theoretical (marhalah tandhir) aspect. As a result, the theories (tandhir) of the muta'akhkhirin scholars often fail to accommodate the practical applications (tatbiq) of the scholars in the mutaqadimin phase. This research aims to explain one example of this distortion, namely in the issue of 'ilal (hidden defects) in hadith. Using library research by collecting relevant data, this study concludes that there is a distortion in the interpretation of 'illat (hidden defect). The mutaqadimin scholars had a broader definition of 'illat than the muta'akhkhirin scholars.

Abstract

Behind the many developed and educated societies, it turns out that there are still people who are far from this. Where in the community there is still early marriage, especially for women. With this being a counter to the current era and regulations that require marriage at least 18 years and compulsory education 12 years. The research method used is qualitative. The results show: 1) Parents' Views on Early Marriage Actually nothing wants to happen. Parents want their daughters to stay in school and work, but because of the economy, they marry early in the hope that their daughters can be useful and ease the burden on parents. 2) The existence of early marriage due to internal factors and external factors which include environmental, social, economic, cultural and so on. Of the many factors, economic and educational factors are the main ones. The economy with a small income and education that is indeed very far access reach, especially junior high school, makes the culture to marry off their daughters early.

Abstract

Latar belakang penelitian ini adalah pentingnya penerapan Pembelajaran Berbasis Masalah (PBL) dalam meningkatkan pemahaman dan penerapan nilai-nilai Akidah Akhlak di kalangan siswa. Akidah Akhlak merupakan mata pelajaran yang membutuhkan pendekatan pembelajaran yang mampu menghubungkan teori dengan praktik kehidupan sehari-hari. Namun, terdapat kendala dalam penerapan PBL di MTsN 4 Sragen, khususnya terkait kesiapan siswa dan efektivitas metode ini dalam menyampaikan materi Akidah Akhlak. Penelitian ini bertujuan untuk menganalisis efektivitas PBL dalam meningkatkan pemahaman dan penerapan nilai-nilai Akidah Akhlak pada siswa kelas IX MTsN 4 Sragen, serta mengidentifikasi faktor pendukung dan penghambat dalam pelaksanaannya. Metode penelitian yang digunakan adalah penelitian kualitatif dengan desain studi kasus, di mana data dikumpulkan melalui wawancara dengan guru dan survei terhadap 248 siswa. Hasil penelitian menunjukkan bahwa mayoritas siswa (86,3%) merasa paham terhadap materi Akidah Akhlak yang diajarkan menggunakan PBL, sementara 13,7% siswa mengalami kesulitan. Faktor pendukung keberhasilan PBL meliputi keterlibatan aktif siswa dan penggunaan studi kasus yang relevan, sementara hambatan utamanya adalah kesiapan siswa yang bervariasi serta keterbatasan sumber daya belajar. Selain itu, frekuensi penerapan PBL juga berpengaruh, di mana 79,8% siswa melaporkan PBL digunakan secara rutin.

Abstract

The study aims to determine and analyze the communication uncertainty experienced by new students (sighar) at the Darussalam Gontor Modern Islamic Boarding School. The theory used in this study is the uncertainty reduction theory pioneered by Charles Berger and Richard Calabrese, using a qualitative case study design method. Data collection techniques were carried out through interviews with 7 informants using purposive sampling. This study produced information that new shigar students in the Al-Azhar building experienced communication uncertainty, which they experienced was cognitive uncertainty such as imagining violence in the boarding school, imagining difficult boarding school lessons, differences between teachers in the boarding school and teachers outside. In addition, the students experienced behavioral uncertainty, thinking that all friends in the boarding school would be kind and caring, thinking that in the boarding school they were free to use Indonesian, and having difficulty adapting to the discipline of the boarding school. To reduce communication uncertainty, sighar students used strategies, namely passive, active, and interactive strategies. Passive strategies are carried out by observing friendly friends, observing friends who are not emotional, observing homeroom teachers and teachers in the class. Active strategies are used by searching for information on Islamic boarding schools in BIMAGO, asking for information on Islamic boarding schools to ustadz in PRIMAGO, asking for solutions to each problem to administrators and teachers. Interactive strategies are used by consulting with ustadz consulate telling stories with friends in the consulate.

Abstract

This study argues that education of Sufism values ​​in the teaching of the Syadziliyyah order is able to form a moderate religious attitude of former thugs in Solo. Humanist and family values ​​make this group of former thugs accept diversity and various Nusantara traditions. Teachings that do not focus on Islamic politics make them accept the 1945 Constitution and Pancasila. They can cooperate with various elements of government from the center to the lowest level. Group activities that show a moderate attitude are activities based on social and personal benefits that include charity and disaster rescue activities by forming team called Juba Rescue. This study is a qualitative study with data collection techniques including interviews, observations and documentation. Determination of respondents using purposive sampling techniques with the criteria of founder, mentor, and active members. Data is analyzed through three stages, namely; data reduction, presentation and drawing conclusions.

Abstract

Penelitian ini bertujuan menelaah pengaruh Kemampuan berfikir kritis dam kecerdasan emosional terhadap etika bermedia sosial remaja serta peran mediasi kedekatan orang tua dalam hubungan kedua variabel tersebut. Metode peneltian yang digunakan yaitu pendekatan kuantitatif dengan metode survei untuk mengkaji konstruksi variabel etika bermedia sosial remaja. Penelitian ini menggunakan teknik random sampling dengan memilih 56 anak usia remaja di Desa Klagen Gambiran. Teknik pengumpulan data dilakukan melalui kuesioner dengan empat variabel menggunakan skala Likert. Hasil penelitian menunjukkan bahwa Kemampuan berfikir kritis memiliki pengaruh postif namun tidak signifikan terhadap etika bermedia sosial pada remaja. Di sisi lain, kecerdasan emosional dan kedekaran orang tua memiliki pengaruh positif dan signifikan terhadap etika bermedia sosial. Implikasi penelitian menunjukkan bahwa kecerdasan emosional memiliki dampak yang signifikan dalam meningkatkan etika bermedia sosial pada remaja. Juga melalui Kedekatan orang tua dengan anak memainkan peran krusial dalam perkembangan emosi dan moral remaja. Orang tua yang dekat dengan anak-anak mereka cenderung lebih terlibat dalam kehidupan sehari-hari anak, memberikan dukungan emosional, dan menanamkan nilai-nilai etika yang kuat. Rekomendasi penelitian mencakup adanya kolaborasi antara pihak sekolah dengan orang tua, dorongan melalui program non akademik, dan pengembangan budaya literasi

Abstract

This research argues that the paylater payment method in some e-commerce in Indonesia that contains usury is a violation in the perspective of Islamic shariah. However, we found differences and similarities between MUI Fatwa and Aceh Qanun in directing the Indonesian Islamic Community in general and the Aceh Province region in particular to direct the community in taking an attitude towards buying and selling transactions with the buy now pay later method or commonly called paylater.

Abstract

Penelitian ini bertujuan untuk mengkaji penerapan metode talaqqi sebagai upaya menjaga kefasihan bacaan Al-Qur'an para murid di Markaz Lughoh Al Iman, Hadramaut, Yaman, tahun ajaran 2023/2024. Talaqqi merupakan metode tradisional yang melibatkan interaksi langsung antara guru dan murid, di mana murid mendengarkan bacaan yang fasih dari guru dan menirunya secara langsung. Latar belakang penelitian ini adalah pentingnya menjaga kualitas dan kefasihan bacaan Al-Qur'an di tengah perkembangan teknologi dan metode pengajaran modern yang cenderung lebih bebas. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan dan observasi langsung. Data dikumpulkan melalui wawancara dengan guru-guru pengajar dan observasi pada proses pengajaran talaqqi. Hasil penelitian menunjukkan bahwa metode talaqqi sangat efektif dalam meningkatkan kefasihan bacaan murid, terutama dalam hal tajwid dan makharijul huruf. Murid yang terlibat dalam metode ini menunjukkan peningkatan signifikan dalam kepercayaan diri dan ketepatan dalam membaca Al-Qur'an. Penelitian ini menyimpulkan bahwa penerapan metode talaqqi sangat relevan dan efisien dalam menjaga kualitas bacaan Al-Qur'an meskipun dihadapkan pada tantangan zaman modern.

Abstract

This study aims to analyze the differences and gaps between Islamic law and positive law in Indonesia regarding the status and rights of illegitimate children, particularly in matters of lineage, inheritance, and guardianship. It also explores the legal and social implications faced by illegitimate children and formulates efforts for regulatory harmonization to protect their rights more fairly and comprehensively. The research employs normative or dogmatic legal methods, focusing on the analysis of primary legal materials such as the Qur'an, Hadith, Marriage Law, and Constitutional Court decisions, along with secondary legal materials including scholarly literature and supporting documents. The findings reveal fundamental differences in the recognition of the rights of illegitimate children between the two legal systems. Islamic law limits lineage and inheritance rights to the mother, whereas positive law provides opportunities for recognizing civil relationships with the biological father. The social implications of this status include stigma, discrimination, and limited access to basic rights. Therefore, harmonization between Islamic law and positive law is necessary, through cross-sectoral dialogue and regulatory reform, to ensure comprehensive protection of children's rights.
