Abstract

The purpose of this study was to determine: (1) the concept of ithaqah for those observing the Ramadan fast according to Islamic law, and (2) the views of the Tanjung Bale village community, Sosa District, Padang Lawas Regency, regarding the ithaqah for the Ramadan fast. This study is field research, namely research conducted with the aim of intensively studying the background and environment that occurs in a social unit, using a descriptive research approach. The conclusion is that the concept of ithaqah for the Ramadan fast according to Islamic law is the ability to fast without harming the body and internal organs. This means being able to restrain oneself from hunger and thirst, and the genitals from lust. Ithaqah for fasting is a Muslim who is sane, mature, healthy, and settled. The opposite of ithaqah is excuse. Therefore, excuses for fasting in Ramadan include illness, pregnancy, breastfeeding, travel, old age, extreme hunger and thirst, and coercion. Therefore, whenever a sick person misses a fast, they should make up for the missed fast when they have recovered and are healthy. The view of the people of Tanjung Bale village, Sosa District, Padang Lawas Regency regarding the Ithaqah of Ramadhan fasting is to restrain the stomach from food and drink and the genitals from sexual urges or the desire to perform sexual intercourse. Likewise, restraining hearing, sight, speech, hands, feet and all body parts from various sins. Meanwhile, people who have the excuse to fast must have good manners. Because fasting will train oneself and one's desires from evil things within oneself. Because fasting will train oneself and one's desires from evil things within oneself.

Abstract

The Manganan tradition is one of the local wisdoms that continues to be preserved by the people of Banjarjo Village, Padangan District, Bojonegoro Regency. This tradition symbolizes the community’s gratitude for the harvest, safety, and prosperity bestowed by God Almighty. This study aims to explore the symbolic meanings embodied in the Manganan tradition and to understand its role as a cultural identity of the local community. The research employed a qualitative approach with an ethnographic method. Data were collected through observation, in-depth interviews with community leaders and tradition participants, and documentation of the Manganan activities. The findings reveal that each element of the tradition such as offerings, communal prayers, and shared meals contains symbolic meanings reflecting religiosity, togetherness, and gratitude. Furthermore, the Manganan tradition serves as a medium to strengthen social solidarity and maintain the continuity of cultural values across generations. Therefore, Manganan functions not only as a religious ritual but also as a form of cultural identity that reinforces the social cohesion and cultural resilience of the Banjarjo community amid modernization

Abstract

Penelitian ini untuk melihat dampak Perkawinan di Bawah Umur dalam Perspektif  Fikih Kontemporer. Metode yang digunakan yaitu kualitatif dengan kajian literatur. Hasil kajian didapati bahwa empat madzhab memiliki pandangan yang bervariasi mengenai treshold usia yang membuat seseorang dikatakan baligh. Menurut pandangan Imam Syafi’i, seorang pria dianggap telah baligh pada usia 15 tahun, sedangkan bagi perempuan adalah 9 tahun. Sementara itu, Imam Hanafi berpendapat bahwa seorang anak perempuan dinyatakan baligh saat berusia 17 tahun, dan anak laki-laki pada usia 18 tahun. Lain halnya dengan Imam Malik, yang menekankan tanda kedewasaan seseorang adalah adanya pertumbuhan rambut halus di bagian tubuh tertentu, yang berlaku untuk kedua jenis kelamin. Di sisi lain, Imam Hanbali menentukan bahwa kedewasaan untuk pria dan wanita terjadi saat mereka mencapai usia yang sama, yaitu 15 tahun. Banyak ulama juga telah menegaskan bahwa meskipun seorang ayah dapat menikahkan anaknya yang belum baligh, dalam madzhab Imam Syafi’i lebih baik jika calon mempelai perempuan sudah diyakini dewasa yang ditandai dengan baligh, dan orang tua disarankan menanyakan persetujuan putrinya agar tidak ada paksaan dalam proses pernikahan

Abstract

This article discusses the implementation of polygamy permits in the Samarinda Religious Court, using a case study of Decision Number 2007/Pdt.G./2024/PA.Smd. Polygamy in Islam is permitted under certain conditions, as long as the husband is able to act fairly, has financial means, and obtains permission from the first wife. This research uses a qualitative, normative method with a library study approach to examine the legal basis, procedures, and judges' considerations in granting permission for polygamy. The results show that the judge in the case granted the applicant's request for permission for polygamy because the legal requirements, both alternative and cumulative, were met, as stipulated in Law Number 1 of 1974 and the Compilation of Islamic Law (KHI). This decision reflects that permission for polygamy is not granted freely, but rather through legal, moral, and social considerations to safeguard the family's well-being and protect the rights of the wife and children.

Abstract

This study examines the concept of tazkiyatun nafs (purification of the soul) according to Ibn al-Qayyim as a solution to juvenile delinquency. Employing a qualitative method with a library research approach, this study explores Ibn al-Qayyim’s major works, such as Madarij as-Salikin and Ighatsat al-Lahfan, to formulate principles of soul education relevant to the modern context. The findings reveal that tazkiyatun nafs consists of three main pillars: strengthening faith, controlling desires, and habituating righteous deeds. The application of these principles is believed to foster morally upright youth, reduce deviant behavior, and encourage the formation of a generation with integrity.

Abstract

Penelitian ini menganalisis bagaimana prinsip moderasi beragama diintegrasikan dalam desain kebijakan keuangan syariah yang berkeadilan di tengah masyarakat multikultural Indonesia. Secara normatif, negara melalui penguatan moderasi beragama menegaskan komitmen kebangsaan, toleransi, penolakan terhadap kekerasan, dan sikap akomodatif terhadap budaya lokal sebagai rujukan etis kebijakan publik, sementara ekonomi dan keuangan syariah bertumpu pada maqasid al-syariah, keadilan distribusi, dan kemaslahatan sosial. Namun, ketimpangan ekonomi yang masih tinggi serta literasi dan inklusi keuangan syariah yang belum merata menimbulkan pertanyaan kritis mengenai sejauh mana dua kerangka nilai tersebut telah bertemu di tingkat kebijakan. Dengan pendekatan kualitatif dan desain studi kepustakaan normatif-sosiologis, penelitian ini menganalisis dokumen regulasi moderasi beragama, aturan otoritas keuangan syariah, strategi pengembangan ekonomi syariah, serta data statistik terkait ketimpangan dan perkembangan industri keuangan syariah. Analisis isi dan analisis komparatif-konseptual digunakan untuk memetakan titik konvergensi dan kesenjangan, sekaligus merumuskan prinsip-prinsip desain kebijakan keuangan syariah berbasis moderasi beragama yang lebih inklusif, adil, dan sensitif terhadap keragaman agama.

Abstract

This research is entitled "Legal Protection for Minors Victims of Online Prostitution Through the Michat Application in Kendari City." The actual situation that is intended to be realized through the Child Protection Law is the protection and guarantee of children's rights from all actions or deeds that are detrimental to them. Children, as the next generation of the nation's ideals in their growth and development, have the right to protection from sexual violence, torture, and treatment that degrades their dignity as human beings. Children must receive protection so that they do not become victims of any crime, including sexual violence committed directly or indirectly by individuals, groups, or the government. The very rapid development of information technology has both positive and negative impacts on people's lives. One of the most disturbing negative impacts is the increase in sexual crimes against children in cyberspace. Children as a vulnerable group require special legal protection due to their inability to defend themselves physically and mentally. This study aims to determine how the regulation and implementation of legal protection for children as victims of prostitution through the Michat application in Kendari City. This research is interesting for examining the legal protection model, as legal protection is key to realizing the ideals of law itself: legal certainty, justice, and utility. This article employs a normative, empirical legal research approach, drawing on primary and secondary legal sources, utilizing three approaches to the problem: the statute approach, the conceptual approach, and the case approach.

Abstract

Marriage is a sacred institution that serves as the primary foundation for the formation of families and social order. In the context of Indonesia, which is rich in cultural and religious diversity, the issue of interfaith marriage has given rise to a long discourse on the relationship between religious principles, legal provisions, and human rights values. This study aims to conceptually examine the legal status, legitimacy, and socio-legal implications of the practice of interfaith marriage from the perspective of Islamic law and Indonesian positive law. By applying library research methods and a qualitative descriptive approach, this study analyzes various literature sources, laws and regulations, and the views of scholars from various schools of thought. The results show that, according to both Islamic law and Law Number 1 of 1974, interfaith marriage is not legally valid because it contradicts the provision that marriage must be conducted in accordance with the teachings of each religion. The Indonesian Ulema Council (MUI) fatwa also affirms its prohibition, including for Muslim men marrying women from the People of the Book. However, there is a legal loophole that allows for the registration of interfaith marriages through a district court ruling. In conclusion, the practice of interfaith marriage in Indonesia faces a dilemma between individual freedom and adherence to religious norms. Therefore, clear regulations are needed to avoid future legal dualism.

Abstract

Perbedaan pemahaman dalam beragama merupakan hal yang tidak dapat dihindari di tengah masyarakat yang majemuk. Mahasiswa, sebagai bagian dari kelompok intelektual muda, memiliki peran strategis dalam membangun sikap toleransi dan moderasi beragama. Penelitian ini bertujuan untuk mendeskripsikan bagaimana peran mahasiswa dalam menyikapi perbedaan pemahaman keagamaan agar tidak menimbulkan konflik sosial. Metode penelitian yang digunakan adalah studi pustaka (library research), yaitu dengan mengkaji berbagai sumber seperti jurnal ilmiah, buku, dan artikel yang relevan dengan tema moderasi beragama dan peran mahasiswa. Hasil kajian menunjukkan bahwa mahasiswa berperan sebagai agen perubahan yang dapat menyebarkan nilai-nilai toleransi, menghargai keberagaman, serta menjadi penggerak dialog antar umat beragama. Selain itu, mahasiswa juga berperan dalam memberikan edukasi kepada masyarakat melalui kegiatan akademik maupun sosial. Dengan demikian, mahasiswa diharapkan mampu menjadi contoh dalam menerapkan sikap saling menghargai dan menjaga keharmonisan antar umat beragama di lingkungan kampus maupun masyarakat luas.

Abstract

The issue of Interfaith Marriage presents a complex discourse in Islamic law, creating tension between nash (sacred texts) and contemporary social realities. This research aims to analyze the perspective of Contemporary Fiqh regarding the law on Interfaith Marriage and identify its relevance to the Religious Moderation agenda in Indonesia. Employing a qualitative research method with normative-juridical and comparative approaches, this article examines legal texts (fiqh) and concepts of socio-religious ethics. The analysis shows that the majority of Contemporary Fiqh establishes an absolute prohibition (haram). This prohibition is strongly based on the principle of sadd az zari'ah, which means 'blocking the means to evil,' aligning with the ushul fiqh rule: (Preventing harm takes precedence over attaining benefit), in order to safeguard faith (hifz ad-din) and progeny (hifz an-nasl). This ruling is further supported by the Quranic prohibition (Q.S. Al-Baqarah: 221) and Indonesian positive law regulations, specifically Article 40 letter (c) and Article 44 of the Compilation of Islamic Law (KHI). Meanwhile, Religious Moderation serves as a manhaj as-shifat (methodology of attitude) that demands the implementation of tawassuth (balanced) and i'tidal (just) principles in addressing social realities. In conclusion, the relevance of Religious Moderation lies in ensuring that these fiqh differences are not implemented fanatically (ghuluw) but are managed proportionally to foster social harmony (tasāmuh) in Indonesia.
