Abstract

Credit collateral is a crucial aspect of loan agreements between banks and customers to ensure the certainty of debt repayment. However, the execution of collateral often triggers legal disputes, especially when customers feel disadvantaged. This journal examines the role of credit collateral in dispute cases between customers and PT Bank Central Asia (BCA), focusing on the controversy surrounding the auction execution of the Persil Wilis certificate as credit collateral. Using a normative juridical approach, this study analyzes the legal basis and execution procedures of credit collateral conducted by BCA, including compliance with banking regulations and legal protection for customers. The research findings indicate that although banks have the right to execute credit collateral through auctions, issues related to transparency, procedures, and customer rights often arise, potentially leading to legal claims. This case reflects the imbalance of power between banks and customers in banking practices and highlights the need for stronger regulations to prevent the misuse of execution rights by creditors. Therefore, this study recommends enhanced supervision of the credit collateral auction process, increased transparency in providing information to customers, and stronger legal protection to ensure fairness in resolving banking disputes.

Abstract

The legal profession of advocacy plays a crucial role within Indonesia’s legal system as a guardian of justice and protector of human rights. However, ethical violations, particularly document forgery, pose significant challenges that threaten the integrity of the profession. This study aims to analyze the regulation of the Advocate’s code of ethics concerning document forgery, the applicable sanctions, and the impact on the judicial system and public trust. Using a normative juridical approach, this research examines provisions from the Advocate Law, the Indonesian Advocate Code of Ethics (KEAI), and the Indonesian Criminal Code (KUHP). The findings reveal that advocates involved in document forgery may face criminal, ethical, and administrative sanctions. Such violations not only harm clients but also establish a negative precedent for the rule of law. Therefore, stricter oversight, consistent enforcement of sanctions, and the enhancement of ethical awareness among advocates are essential to maintain the profession’s integrity. Preventing and addressing ethical violations are critical steps in preserving public confidence in Indonesia’s legal system.

Abstract

Pembelajaran menjadi suatu hal yang sangat penting dalam pendidikan. Karena memudahkan pembelajaran bagi peserta didik merupakan tugas mulia bagi seorang guru. Pendidik ditantang untuk menjadi seorang yang profesional, yang mampu menjadi administrator dan komunikator pada pembelajaran yang dilakukan secara daring meskipun dalam situasi yang terbatas. Para pendidik dituntut untuk menggunakan media pembelajaran daring sehingga pembelajaran dan interaksi dengan peserta didik tetap berlangsung secara efisien dan efektif serta dapat mencapai tujuan pembelajaran. Artikel ini menggunakan metode literature review, yaitu pendekatan sistematis untuk mengumpulkan, mengevaluasi, dan mensintesis berbagai literatur terbaru yang membahas pembelajaran jarak jauh dan kemandirian belajar siswa. Pembelajaran Jarak Jauh (PJJ) bukan hanya sekadar sarana alternatif pembelajaran, tetapi juga instrumen strategis untuk melatih kemandirian belajar siswa. PJJ juga bisa mengajarkan siswa untuk lebih belajar mandiri yang dimana bisa mencari sumbernya dari manapun. Namun, keberhasilannya menuntut pendekatan yang holistik, mencakup penguatan motivasi internal siswa, penyediaan dukungan teknis dan emosional dari lingkungan, serta penerapan strategi pembelajaran yang adaptif terhadap kondisi masing-masing siswa.

Abstract

Penyimpangan sosial merupakan perilaku atau tindakan yang melanggar norma-norma sosial di dalam suatu masyarakat. Dalam konteks penyimpangan sosial, penggunaan dan pengedaran narkotika tergolong ke dalam perilaku menyimpang dari norma dan hukum yang disepakati. Narkotika berasal dari tumbuhan, zat di dalam tumbuhan tersebut mampu menimbulkan efek halusinasi, menurunnya tingkat kesadaran dan menyebabkan kecanduan. Penelitian ini bertujuan untuk mengetahui motif pelaku pengedaran narkoba sebagai bentuk dari manifestasi anomi sosial. Penelitian ini menggunakan metode deskriptif dengan pendekatan kualitatif melalui wawancara mendalam (In-depth Interview) dan observasi. Hasil analisis menyatakan bahwa adanya tekanan sosial yang membuat pelaku menggunakan cara yang tidak sah untuk mencapai tujuan budaya tersebut. Demikian, fenomena ini menunjukkan adanya anomi sosial.

Abstract

Reading ability is a fundamental foundation in the learning process at the primary education level. However, many early grade students still face difficulties in reading, either due to monotonous teaching methods or a lack of active student involvement in the learning process. This research aims to find out how the strategies implemented by teachers enhance reading skills among first-grade students and to identify the inhibiting factors that affect the development of these skills. The method used in this research is a descriptive qualitative approach, with data collection techniques including observation, interviews, and documentation. The subjects of the research are first-grade teachers, students, and the principal. The research results indicate that the use of flashcard-based learning strategies significantly enhances students' reading abilities. Students become more enthusiastic, active, and show progress in recognizing letters and reading short sentences. However, there are still challenges such as a less conducive learning environment, minimal parental involvement at home, and low student motivation. The implications of this study emphasize the importance of implementing interactive, creative learning strategies that align with students' characteristics to optimize reading skills in early elementary school.

Abstract

Penelitian ini membahas hukum puasa bagi ibu hamil dan ibu nifas dalam perspektif syariat Islam. Ibu hamil dan nifas memiliki kondisi fisiologis dan psikologis khusus yang memengaruhi kemampuan mereka untuk menjalankan puasa secara penuh. Ibu hamil diberikan rukhsah (keringanan) untuk tidak berpuasa apabila khawatir kesehatannya atau janinnya terganggu, sedangkan ibu nifas wajib berbuka selama masa pemulihan pasca-persalinan. Kajian ini menggunakan pendekatan library research dengan metode kualitatif deskriptif, menelaah Al-Qur’an, Hadis, pendapat ulama, dan literatur fikih modern. Hasil penelitian menunjukkan bahwa syariat Islam menekankan prinsip kemudahan (taysir), rahmat (rahmah), dan perlindungan nyawa (hifzh al-nafs), sehingga ibu tetap dapat memenuhi kewajiban ibadah tanpa membahayakan kesehatan. Penggantian puasa (qada) atau pembayaran fidyah menjadi mekanisme untuk menyeimbangkan kewajiban ibadah dengan kondisi nyata. Temuan ini memiliki implikasi praktis bagi ibu, keluarga, dan tenaga medis dalam mendukung pelaksanaan puasa yang aman, bijaksana, dan penuh hikmah

Abstract

This research was a qualitative case study aimed at investigating how teachers implement digital games in teaching English vocabulary and how these games impact young learners. The research subjects consisted of one English teacher and 20 fifth-grade students at SD Islam Athirah Bukit Baruga. Data were collected through observation checklists, field notes, interviews, and documentation, and were analyzed using four steps: data collection, data condensation, data display, and conclusion drawing/verification. The findings showed that the teacher implemented the Wordwall digital games systematically, starting from preparation, implementation, to evaluation. The use of Wordwall improved students’ vocabulary retention, participation, and confidence in learning English. Although some students preferred traditional methods such as textbooks, most found game-based learning more enjoyable and easier to understand. Challenges such as differences in student ability and technical issues were overcome through teacher support. Overall, digital games had a positive impact on vocabulary learning for young learners.

Abstract

This research examines the conflict of interest arising from the exercise of property rights over another person’s assets within Indonesia’s civil law system. Property law not only protects ownership rights but also serves as a legal instrument to guarantee creditors and third parties in the modern economy. The core issue emerges when absolute ownership rights conflict with limited real rights that grant preferential status to creditors. Using a normative juridical method through analysis of legislation, legal doctrines, and court decisions such as Supreme Court Rulings No. 2911 K/Pdt/2019 and No. 1248 K/Pdt/2007, this study finds that the existence of real rights has transformed ownership from an absolute concept into a relative or functional one. While owners retain their rights, these rights are limited by the existence of real rights to ensure legal certainty for creditors. The study concludes that harmonization is needed between ownership protection and creditor certainty through clearer regulations, strict procedural enforcement, and increased legal awareness to achieve a balance between legal certainty and substantive justice in property law practice.

Abstract

Premeditated murder is a grave criminal offense and is classified as a grave crime because it directly violates the constitutional right to life as one of the most fundamental and non-derogable human rights. This study aims to provide an in-depth analysis of the criminal liability of military personnel involved as perpetrators of premeditated murder, using a normative juridical method through a case approach and an examination of the court’s decision. The discussion focuses on the application of general criminal law provisions to active soldiers tried within the military court system, which has its own distinctive characteristics. The findings show that although the two defendants played different roles one carried out the shooting directly while the other issued the instruction both were considered to share a common will and awareness in committing the criminal act. The court determined that the elements of intent and premeditation were fulfilled, rendering both defendants equally responsible. The author argues that when viewed through the lens of criminal law doctrine, which emphasizes a calm and deliberate mental state as an indicator of premeditation, the defendants’ psychological condition, which was influenced by situational pressure, may give rise to different interpretations of this element. Nevertheless, the court’s decision affirms that military status does not exempt an offender from criminal liability and may even serve as an aggravating factor, as the conduct is deemed to undermine the discipline, honor, and integrity of the armed forces.
