Abstract

This study aims to find out how the concept of Case Termination Based on Restorative Justice at the Gowa District Attorney's Office (Siyasah Syar'iyyah Study). The main problem is divided into several sub-problems, namely: How to stop cases based on restorative justice at the Gowa State Prosecutor's Office, What are the forms of cases related to restorative justice, and what is the siyasa syariyyah perspective on ending cases based on restorative justice. The research method used is data collection in the form of observation, interviews, documentation and reference tracing. The results of this study indicate that the implementation of restorative justice focuses more on conditions for creating justice and balance for the perpetrators of criminal acts and their victims themselves, and the perpetrators of criminal acts do not need to be sentenced to death but can be carried out with restorative justice efforts, in order to reduce the excess capacity of correctional institutions. or state prisons, restorative justice can also eliminate grudges for potential perpetrators of crimes so that they will not repeat their actions and can embrace and provide an understanding to the wider community about the dangers of committing a crime. In the perspective of siyasa syar'iyyah, termination of cases based on restorative justice can be carried out using the method of forgiving and paying diyat and law enforcers are not justified in acting arbitrarily in resolving cases, but must uphold justice in accordance with the regulations.

Abstract

Terlaksananya penelitian ini ditujukan untuk mendalami dan memahami lebih lanjut tentang Pemikiran dan Perkembangan Mu’tazilah dalam dunia Islam yang mana memiliki pengaruh cukup luas dalam dunia Islam. Adapun metode yang diimplementasikan dalam penelitian untuk menelaah dan mendalami tentang tokoh-tokoh penting dalam pemikiran Mu’tazilah serta pengaruhnya dalam dunia Islam yaitu metode kualitatif deskriptif. Penelitian ini berjenis library research yaitu peneliti melakukan pengumpulan data dan mengevaluasi materi dari artikel, buku, maupun sumber relevan lainnya yang selaras dengan tema penelitian. Hasil penelitian menunjukkan bahwa aliran Mu’tazilah memiliki sederet tokoh yang sangat berpengaruh dalam keberlangsungan aliran Mu’tazilah Adapun tokoh-tokoh yang mempengaruhi dalam perkembangan aliran Mu’tazilah yaitu, Abu Ali Muhammad ibn Ali al-Jubba’i, Abul al-Huzail al-Allaf, Jarullah Abul Qasim Muhammad bin Umar, Ibrahim bin Syyar an-Nazza, Bisyir ibn al-Mu’tamir, Abu Musa al-Mudrar, Washil bin Atha’ al-Ghazzal, dan Abul Hasan Abdul Jabbar ibn Ahmad ibn Abdullah al-Hamazani al-Asadi, Hisyam bin Amr al-Fuwati dan juga pengaruh aliran Mu’tazilah dalam dunia Islam yaki pengaruh teologis, adanya Kontroversi dan Perdebatan, Pengaruh pada hukum dan etika, perkembangan ilmu pengetahuan serta adanya penerimaan dan penolakan atas aliran Mu’tazilah.

Abstract

The research aims to discuss the debate between the Asy'ariyah and Mu'tazilah about the nature of God. The method used literature study from various sources. The results of this research show that there are the differences between Mu`tazilites  and al-Ash`ari   in Divine Aspects in Theology. First, The Nature of God. The Mu`tazilites stated that Allah is All-Knowing with His substance, not with knowledge, power and life because all of these are qualities while nature is something outside of substance. Meanwhile, the Asy` believe that God has attributes. Second, The God's Justice, the Mu`tazilites elive that all of God's actions are good, God does not do bad, and does not forget what He must do. On the other hand al-Ash`ari they are not realized by humans themselves, but are created by God. Three, God's Absolute Power and Will , the Mu`tazilah argued that God's power is actually no longer absolute. On the other side, the Asy'ariyah were unable to reach the depth of monotheism fi'li while the Mu'tazilah were unable to resolve issues of justice in the right way.

Abstract

The death of the Prophet Muhammad (peace be upon him) gave rise to political and theological dynamics within the Muslim community. The conflicts during the period of the Rightly Guided Caliphs, particularly following the arbitration (tahkim) between Ali ibn Abi Talib and Muawiyah ibn Abi Sufyan, resulted not only in political fragmentation but also in the emergence of various theological schools in Islam. This study aims to examine the historical background and main doctrines of the Khawarij, Murji’ah, Jabariyah, and Qadariyah, especially concerning issues of faith, major sins, and divine decree (qada and qadar). This research employs a qualitative-descriptive method with a library research approach by analyzing relevant books, journals, and scholarly articles. The findings indicate that the Khawarij and Murji’ah emerged as responses to political conflict, while the Jabariyah and Qadariyah developed due to differing interpretations of human will and freedom within God’s decree.

Abstract

Mental health issues are among the major challenges faced by modern society. Technological development, academic and occupational pressures, urbanization, and rapid lifestyle changes have increased the incidence of stress, anxiety, depression, and loss of meaning in life. Various scientific approaches in modern psychology and psychiatry have been developed to address these problems; however, moral and spiritual dimensions often receive insufficient attention. In this context, the ideas of classical Islamic philosophers, particularly Ibn Sina, provide important contributions to developing a more holistic understanding of the human person and mental health. This study aims to examine the relevance of Ibn Sina’s concept of the soul to modern mental health. The method used is library research through analysis of Ibn Sina’s works and contemporary psychological literature. Ibn Sina classifies the soul into vegetative, animal, and rational faculties, and emphasizes the balance between intellect, emotion, and human appetites. The results of this study indicate that Ibn Sina’s concept of psychic balance is highly relevant to modern mental health, especially in integrating rational, ethical, and spiritual aspects into the process of healing and maintaining psychological well-being.
