Abstract

This research aims to measure the democratic culture of local communities in West Sulawesi Province in the Digital Era. This research uses a qualitative method with a phenomenological approach, the data sources in the research are primary data sourced from interviews and observations and secondary data sourced from literature studies both from journals and books related to the research objectives. Data collection techniques were carried out through focus group discussion (FGD) activities. After the data is collected, the next step is data analysis to produce conclusions. The results of this research are that the local community in West Sulawesi Province is the Toliutang community who live on one of the islands in Mamuju Regency, West Sulawesi Province. Even though this tribe lives on the sea and depends on the open sea for their livelihood, they secretly have quite good democratic behavior and culture. The use of digital technology in developing political culture and democracy is starting to become embedded in their lives. One of these values ​​is helping each other and humanizing humans. These are all values and belief systems held in society. So political activity is used as a means of fulfilling the basic needs of citizens in creating mutual benefits. In the future, the political participation shown by the Toliutang community or tribe will be biased because the behavior of the political elite is not balanced in realizing improvements in people's lives as a consequence of political responsibility towards the people, but is ignored and forgotten

Abstract

The central issue of this study was the concept of restorative justice for children in confrontation with the law from an Islamic legal standpoint. This was a qualitative study employing a normative (syar'i) methodology. This study utilized primary data sources, including information from the Police, Prosecutors, Judges, and Social Institutions. And secondary sources such as books, journals, and articles. This study utilized observation, interviews, documentation, and reference tracking to acquire its data. Data processing and analysis procedures were implemented in a series of processes, including data selection, data examination, data classification, and data compilation. Based on the findings of this study, the fundamental elements of restorative justice in resolving criminal cases involving children in confrontation with the law are child protection, the best interests of the child, and kinship. In criminal cases involving children in dispute with the law, the concepts of restorative justice were implemented through mediation, deliberation, consensus, direction, and supervision of children. In criminal cases involving children in dispute with the law, the practice of restorative justice has the social effects of eradicating the stigma or labeling of children as mischievous, as well as promoting child growth and child development.

Abstract

This study aims to enrich and develop understanding of the status of non-Muslim citizenship in Indonesia from the perspective of Nahdlatul Ulama (NU) as the largest community organization in Indonesia. The type of research used is library research, with a theological-normative, sharia and historical approach. This study uses data collection methods in the form of quoting, filtering and analyzing using content analysis of representative literature that is relevant to the problem discussed, then reviewing and concluding it. The results of this study are an analysis of the status of non-Muslim citizenship in Indonesia according to Nahdlatul Ulama categorized as non-Muslim citizens. In fiqh that limits the rights of non-Muslims does not apply in the concept of a nation state implemented in Indonesia. Therefore, this study recommends that political and religious categorization not be monopolized by one particular entity or group. In addition, this study also suggests that the government, the Indonesian Ulema Council (MUI), as well as community organizations such as Nahdlatul Ulama or Muhammadiyah need to re-knit the threads that have become tangled due to identity politics, and reconstruct the understanding of classical fiqh teachings and doctrines into a contemporary perspective that is more in line with the concept of an inclusive nation state, as implemented in Indonesia.

Abstract

This study explores the application of Artificial Intelligence (AI) based on Islamic principles within the small and medium-sized enterprises (SMEs) sector in Indonesia. With a focus on ethical aspects aligned with Sharia values, the research identifies AI's potential to enhance operational efficiency, consumer trust, and business reputation for SMEs operating in predominantly Muslim markets. Using a qualitative literature review approach, the study analyzes previous findings related to Sharia-compliant AI applications, highlighting benefits such as increased consumer loyalty through principles of fairness, transparency, and integrity. The results reveal that Sharia-based AI can contribute to sustainable business practices, providing a competitive advantage in markets sensitive to ethical considerations. Additionally, the research emphasizes that Sharia-compliant AI design is more accessible to SMEs with limited resources, supporting smoother adoption and increased operational sustainability. Recommendations include developing supportive policies for ethical AI integration, fostering affordable AI solutions, and further encouraging empirical research to evaluate the long-term financial and social impacts of Sharia-based AI on SMEs. This study contributes to the growing body of knowledge on ethical AI in business and provides practical guidance for policymakers, technology developers, and SMEs seeking to integrate Sharia-compliant AI for enhanced competitiveness and consumer loyalty.

Abstract

This study delves into the definitions and historical emergence of two early Islamic sects, al-Khawarij and al-Murjiah, and contrasts their core teachings. Al-Khawarij, derived from the term "kharijah," signifying rebellion, formed after a faction of Ali bin Abi Talib's followers ended up disagreeing with his decision to arbitrate during the Battle of Siffin. This group believed that any deviation from divine will was unacceptable, thus condemning arbitrations like those accepted by Ali. On the other hand, al-Murjiah, from the root "Irj?’," meaning deferral, emerged as a response to the religious and political fragmentation in early Islam. This group proposed that faith alone suffices for salvation, detaching actions from faith and delaying judgment for grave sins to the Last Day. Through historical analysis, this paper examines the socio-political dynamics that led to the rise of these factions and their lasting impact on Islamic jurisprudence, theology, and community cohesion.

Abstract

The Asy'ariyah and Al-Maturidi groups emerged because of the dissatisfaction of Abul Hasan Al-Asy'ari and Abu Manshur Muhammad ibn Muhammad ibn Mahmud Al-Maturidi with the arguments and opinions expressed by the Muktazilah group. In its journey, Asy'ari itself experienced three periods in understanding its creed, namely Muktazilah, contra Muktazilah, and Salaf. Between Asy'ariyah and Maturidiyah themselves there are several differences, including in the following matters: About the nature of God, about deeds humans, about the Koran, God's obligations, the perpetrator of major sins, God's form, and also God's promises. The main points of Al-Maturidiyah's teachings basically have many similarities with the al-Ash'ariyah school of reforming Mu'tazilah opinions. The differences that arise can be said to be only in the explanation of their teachings or in branch issues. If al-Maturidi's thoughts are studied more closely, it will be found that al-Maturidi gives greater authority to human reason compared to Ash'ari. However, among the Maturidiah themselves there are two groups that also have different tendencies of thought, namely the group Samarkand, namely the followers of al-Maturidi himself whose theological understandings are closer to the Mu'tazilah understanding and the Bukhara group, namely the followers of al-Bazdawi who tend to be Ash'ariyah.

Abstract

AbstrakPraktik investasi bodong telah menjadi masalah serius di Kota Makassar, yang dapat merugikan masyarakat dan mengganggu stabilitas ekonomi. Penelitian ini menggunakan jenis penelitian kualitatif dengan pendekatan syar’i dan pendekatan yuridis empiris, melalui wawancara dan observasi terhadap pihak terkait dengan praktik investasi bodong di Kota Makassar. Hasil penelitian menunjukkan bahwa Pemerintah Kota Makassar telah melakukan beberapa upaya untuk mengatasi praktik investasi bodong, seperti meningkatkan transparansi dan akuntabilitas dalam pengelolaan investasi. Namun, faktor-faktor seperti kurangnya kesadaran masyarakat dan kelemahan dalam implementasi regulasi masih menjadi tantangan signifikan. Penelitian ini menunjukkan bahwa peran Pemerintah Kota Makassar harus lebih komprehensif dan berintegrasi dengan nilai-nilai syariat Islam untuk mengatasi praktik investasi bodong. Berdasarkan perspektif siyasah syar’iyah, penelitian ini memberikan rekomendasi untuk meningkatkan kesadaran masyarakat dan memperbaiki implementasi regulasi terkait penanganan investasi bodong. AbstractFraudulent investment practices have become a serious problem in Makassar City, which can harm the community and disrupt economic stability. This research uses qualitative research with a shar'i approach and empirical juridical approach, through interviews and observations of parties related to fraudulent investment practices in Makassar City. The results show that the Makassar City Government has made several efforts to overcome fraudulent investment practices, such as increasing transparency and accountability in investment management. However, factors such as lack of public awareness and weaknesses in regulation implementation still pose significant challenges. This research shows that the role of the Makassar City Government must be more comprehensive and integrated with Islamic values to overcome fraudulent investment practices. Based on the perspective of siyasah shar'iyah, this study provides recommendations to increase public awareness and improve the implementation of regulations related to handling fraudulent investments.

Abstract

Istinbat hukum merupakan proses penarikan hukum dari dalil-dalil syariat untuk menjawab permasalahan hukum yang muncul di tengah masyarakat. Artikel ini membahas istinbat hukum dalam konteks kebolehan mengqashar shalat bagi musafir. Dengan menggunakan pendekatan normatif dan analisis terhadap dalil Al-Qur'an, hadis, serta pandangan para ulama, kajian ini mengungkapkan bahwa kebolehan mengqashar shalat memiliki landasan yang kuat dalam syariat Islam. Artikel ini juga menjelaskan kriteria perjalanan yang membolehkan pengqasharan shalat, seperti jarak minimum, niat perjalanan, dan tujuan yang tidak bertentangan dengan syariat. Melalui analisis istinbat hukum, disimpulkan bahwa kebolehan mengqashar shalat adalah bentuk kemudahan (rukhsah) yang diberikan oleh Allah kepada hamba-Nya untuk menjaga keseimbangan antara kewajiban ibadah dan kondisi perjalanan yang sering kali melelahkan. Penelitian ini diharapkan dapat memberikan kontribusi dalam memperkuat pemahaman umat Islam tentang hukum-hukum perjalanan dalam ibadah shalat.

Abstract

Abstract

Pilkada sering menimbulkan konflik horizontal di masyarakat karena dalam pelaksanaan Pilkada secara langsung jarak emosi antara figur calon dan massa pendukung atau massa pemilihnya sangat dekat. Hal ini dapat memicu lahirnya fanatisme yang sangat kuat terhadap masing-masing calon. Selain itu, masyarakat juga merasakan kepentingannya secara riil arus lokal. Akibatnya, kadar dan rasa kepemilikannya (sense of belonging) serta keterlibatannya terhadap agenda-agenda politik masing-masing calon sangat tinggi. Faktor-faktor tersebut dikhawatirkan dapat menjadi pemicu munculnya konflik horizontal. Di sisi lain, pilkada dapat menumbuhkan kredo demokrasi di tanah air termasuk di kota Makassar. Hal ini dapat diukur dari keterlibatan warga negara dalam setiap pelaksanaan pilkada, atau dalam bahasa lain secara psikologis warga negara terlibat dalam politik atau peduli dengan persoalan publik. Oleh karena itu pilkada yang dilakukan secara langsung merupakan suatu yang baik dalam proses pertumbuhan dan perkembangan demokrasi di tanah air, termasuk di kota makassar. Melalui pelaksanaan otonomi daerah yang dijadikan sebagai media untuk mendesentralisasikan sistem demokrasi yang semakin disempurnakan. Melalui pilkada ini diharapkan akan menggairahkan dan merangsang tumbuhnya kekuatan-kekuatan baru yang pro demokrasi di daerah. Dalam pengertian lain, melalui pemilihan kepala daerah yang secara langsung ini, akan lahir aktor-aktor demokrasi di daerah, yang kemudian diharapkan akan sanggup membuat kontrak politik dengan segenap komponen masyarakat, serta mampu melakukan gerakan-gerakan baru bagi perubahan.
