Abstract

ABSTRACT This Field Work Practice report raises the theme of the dynamics of accountability of the Bali Provincial Financial and Development Supervisory Agency within the framework of Good Governance. With an emphasis on the importance of transparency and accountability in financial and development supervision, this research explores the underlying background, formulates the problems faced, sets the objectives and benefits of the report, and presents the results of the reporting work along with in-depth analysis. Through a comprehensive review, it was found that Supervisory Bodies have a crucial role to play in ensuring accountability and transparency in financial and development oversight. In conclusion, stronger synergies between agencies and improved evaluation mechanisms are needed to enhance good governance. Suggestions include increasing public participation, upholding the rule of law, and improving the effectiveness and efficiency of financial and development oversight institutions. Abstract

Data on the availability of beds, especially for class three in healthcare facilities, particularly in NTT, shows the unpreparedness of hospitals to implement KRIS until June 30, 2025. Various controversies that may arise after the implementation of KRIS, especially if Healthcare Facilities are unable to meet KRIS standards by June 30, 2025. This research aims to analyze the implementation of KRIS provisions and the legal consequences for hospitals collaborating with BPJS Kesehatan. This research is normative in nature. The enactment of Presidential Regulation No. 59 of 2024 regarding KRIS. The policy related to the implementation of KRIS has not yet provided protection and legal certainty for the parties involved, including the payment system, so the Ministry of Health must review the rules and sanctions that will be imposed if healthcare providers are unable to meet the criteria outlined in the Presidential Regulation. There has not yet been a more in-depth explanation regarding the sanctions and legal consequences that will arise if, by June 30, 2025, healthcare facilities are unable to meet KRIS standards. The government must provide an explanation of the legal consequences if healthcare facilities are unable to meet the criteria outlined in the Presidential Regulation. BPJS Kesehatan must also prepare the derivative regulations from the Presidential Decree and review the Cooperation Agreement with hospitals to minimize the risk of legal consequences in the implementation of KRIS.

Abstract

Pandemi COVID-19 telah memberikan dampak signifikan terhadap berbagai sektor ekonomi, termasuk usaha mikro, kecil, dan menengah (UMKM). Di Pantai Jerman, Kuta - Bali, mayoritas pelaku UMKM yang merupakan masyarakat lokal mengalami penurunan omzet yang drastis akibat berkurangnya kunjungan wisatawan dan pembatasan aktivitas ekonomi. Dalam rangka mengatasi tantangan ini, program pengabdian masyarakat yang berfokus pada peningkatan motivasi dan semangat berwirausaha bagi komunitas UMKM di Pantai Jerman dilaksanakan. Program ini bertujuan untuk mendorong kemandirian ekonomi dan meningkatkan kesejahteraan hidup para pelaku UMKM melalui serangkaian kegiatan pelatihan dan pendampingan. Hasil dari program ini menunjukkan adanya peningkatan motivasi dan semangat berwirausaha yang signifikan di kalangan peserta, yang berdampak pada peningkatan omzet dan keberlanjutan usaha mereka. Dengan demikian, pengabdian masyarakat ini diharapkan dapat menjadi model pemberdayaan ekonomi lokal yang efektif dalam menghadapi tantangan ekonomi pasca-pandemi.

Abstract

Land has a very important role for human life because everyone needs land during life until death. Land in Indonesia has a very important role to support life in society. The need for land will increase along with the growth of the population, all of whom need land to live and continue their lives, therefore there are more and more processes of buying and selling land, but in the process of buying and selling land there is still a breach of contract in the sale and purchase agreement. after the sale and purchase process should proceed to the land registration process to obtain a certificate, but this has not been done. The importance of registering land that has changed ownership so that the plot of land has legal certainty and avoids a dispute.

Abstract

Women's participation in democracy in Indonesia has historically faced challenges, especially at the local level such as in villages. PKK (Family Welfare Empowerment) had great potential as a forum for women's participation, but education on elections and active roles in democracy was often inaccessible to them. Community service activities was one form of community service by university students that could be used to enhance peaceful election education in PKK Banjar Pucak Sari Village, Dangin Puri Kauh. Through this program, women were expected to become active agents of change in disseminating democratic values and campaigns for peaceful elections through social media. Community service activities involved discussions, experimentation with link and barcode creation, brochure preparation, and training in using social media for peaceful election campaigns. Informative and engaging brochures on peaceful election education were also created and distributed to the public. Thus, it was hoped that women's participation in local elections and politics would be increased, creating a more inclusive and representative society. This study identified challenges and solutions in program implementation, providing a comprehensive overview of implementation stages, methods, challenges, and solutions. The results were expected to serve as a guide for other institutions or organizations wishing to implement similar programs to enhance women's participation in democracy.Keywords: Women's Participation, Democracy, Election Education, PKK, Community Service Activities.

Abstract

Global health issues drive the importance of philosophically based health law reform, with Europe prioritizing social justice and human rights, while Asia combines local traditions and modernization to respond to health challenges adaptively and inclusively. The purpose of this study is to analyze the differences in the principles of health law reform between European and Asian countries and the influence of each region's philosophy on the reform approach based on a review of the philosophy of legal realism. This study uses a normative legal method with a conceptual and legislative approach, analyzing primary, secondary, and tertiary legal materials through document studies and legal interpretation to understand the philosophy, norms, and concepts of health law reform in Europe and Asia based on the philosophy of legal realism. The results of the study show differences in the main principles of health law reform between Europe and Asia, where Europe emphasizes equality, universal access, and social justice, while Asia is more pragmatic by integrating local cultural values and market efficiency; European philosophy focuses on social solidarity and the welfare state, while Asia prioritizes collectivism and adaptation to local contexts, with both reflecting the application of legal realism to meet the needs of society according to their respective social and cultural contexts

Abstract

Introduction: In the modern business world, John Stuart Mill's paternalistic legal philosophy, especially the "harm" principle, is very relevant to balance market freedom and protection of public interests, such as consumers, workers, and the environment, through regulations aimed at reducing the negative impacts of business activities.Purposes of the Research: The purpose of this study is to analyze the application of John Stuart Mill's paternalistic principles in business law and to evaluate the relevance of Mill's legal philosophy to modern business regulation.Methods of the Research: This study uses normative legal methods to analyze the application of John Stuart Mill's paternalistic principles in business law, with conceptual, legislative, and case approaches, and utilizing primary, secondary, and tertiary legal materials analyzed qualitatively and deductively.Results Main Findings of the Research: John Stuart Mill’s paternalistic principles, particularly the harm principle, are highly relevant in modern business regulation as they balance market freedom with protection of the public interest, as seen in consumer protection, employment, corporate social responsibility (CSR), and environmental regulations, which aim to protect consumers, workers, and ecosystems. Despite challenges such as resistance from business actors, the application of this principle remains essential to ensure that freedom in business does not harm society and the environment, and supports sustainability and public welfare.

Abstract

The protection of geographical indications (GIs) and trademarks represents a crucial instrument within intellectual property law, serving not only as a mechanism of legal protection but also as a means of economic empowerment, particularly for micro, small, and medium enterprises (MSMEs). Nevertheless, the effectiveness of such protection is often constrained by limited access to legal services and advocacy. This study aims to analyze the ideal legal framework for the protection of GIs and trademarks in Indonesia, the Philippines, and Oman, emphasizing the importance of integrating legal services and advocacy to strengthen MSME empowerment. The research employs a normative juridical approach combined with comparative analysis, examining statutory provisions, institutional practices, and the legal cultures of each country. The findings reveal that the Philippines has developed a relatively ideal framework through the active role of the Intellectual Property Office of the Philippines (IPOPHL), which implements the IP Academy, Innovation and Technology Support Offices (ITSO), and the affirmative Juana Make a Mark initiative. By contrast, Indonesia and Oman continue to face challenges, as their regulatory structures remain heavily focused on administrative procedures without explicit provisions on legal advocacy. This study contributes by highlighting the necessity of embedding legal advocacy within substantive regulations and institutionalizing MSME support programs as a state obligation. It concludes that the protection of GIs and trademarks will be more effective if supported by structured and sustainable legal advocacy mechanisms. The key recommendation is for Indonesia and Oman to adopt the Philippines’ best practices, particularly the integration of advocacy and legal services into formal regulations, thereby strengthening MSME empowerment through the protection of geographical indications and trademarks.

Abstract

The purpose of this research is to analyze related to dispute resolution on the validity of digital document signatures in proving civil procedural law. The formulation of the validity of digital document signatures in proving civil procedural law can refer to several provisions but when examined contains conflicts of norms. The research method used is normative research method. The results showed that the characteristics of signatures on digital documents as valid evidence in civil procedure law trials in Indonesia, but with a note that it has been applied in accordance with the relevant legal provisions. Then against the conflict of norms can be used the principle of lex specialist derogate lex generalis, so that the provisions of a specific rule of law can override a general rule of law. Furthermore, based on this, it can be understood that dispute resolution can be carried out through filing a lawsuit with the court as a plaintiff by attaching digital document evidence or answering in a duplicative lawsuit as the defendant by attaching digital document evidence, considering that signatures on digital documents are possible to be used as valid evidence, but that situation with the limit has met the minimum limit of proof in accordance with the provisions of the legislation and must be supported by expert witness testimony to the extent that it can be proven by a valid digital certificate. Tujuan penelitian ini dilakukan untuk menganalisis terkait dengan penyelesaian sengketa terhadap keabsahan tanda tangan dokumen digital dalam pembuktian hukum acara perdata. Rumusan keabsahan tanda tangan dokumen digital dalam pembuktian hukum acara perdata dapat merujuk beberapa ketentuan namun apabila dicermati memuat pertentangan norma. Metode penelitian yang digunakan adalah metode penelitian normatif. Hasil penelitian menunjukkan bahwa karakteristik tanda tangan pada dokumen digital sebagai alat bukti yang sah dalam persidangan hukum acara perdata di Indonesia, namun dengan catatan telah diterapkan sesuai dengan ketentuan hukum. Kemudian terhadap pertentangan norma dapat digunakan asas lex specialist derogate lex generalis, sehingga ketentuan suatu aturan hukum yang bersifat khusus dapat mengesampingkan suatu aturan hukum yang bersifat umum. Selanjutnya berdasarkan hal tersebut dapat dipahami bahwa penyelesaian sengketa dapat dilakukan melalui pengajuan gugatan ke pengadilan sebagai penggugat dengan melampirkan bukti dokumen digital ataupun menjawab dalam duplik gugatan sebagai pihak tergugat dengan melampirkan bukti dokumen digital, mengingat tanda tangan pada dokumen digital dimungkinkan untuk dipergunakan sebagai alat bukti yang sah, namun keadaan itu dengan batasan telah memenuhi batas minimal pembuktian sesuai ketentuan peraturan perundang-undangan serta haruslah didukung dengan keterangan saksi ahli hingga dengan batasan sepanjang dapat dibuktikan dengan sertifikat digital yang valid.

Abstract

In the current era of globalization and modernization, trademarks play a crucial role in distinguishing products or services in the market. Valid and protected trademark rights are valuable assets for their owners. However, the phenomenon of unregistered trademarks often poses a challenge in trademark protection. This research aims to analyze the legal construction of unregistered trademarks and the conflicts that arise from the perspective of inclusive law. The focus of this research is on the analysis of legal aspects, rights of trademark owners, consumer rights, public policies, and socio-economic aspects. The research method used is normative legal research with a dogmatic legal approach. Data sources include laws, regulations, court decisions, and legal literature related to trademarks. Data analysis techniques use a deductive approach with the application of relevant theoretical frameworks. The results of the research indicate that the inclusive legal construction in the Trademark Law provides broader protection for unregistered trademarks. Owners of unregistered trademarks can obtain protection if consistent use of the trademark in trade can be demonstrated. The inclusive approach in trademark supervision also encompasses unregistered trademarks that have potential rights to protection. Conflicts between protection of unregistered trademarks, consumer rights, and indigenous communities can be resolved through consultation and participation of relevant parties. Specific regulations that acknowledge the traditional knowledge of indigenous communities and the responsibilities of producers can also help resolve these conflicts. Mediation and arbitration mechanisms can also be used as alternative dispute resolution methods.
