Abstract

This research aims to analyze and examine the implementation of the obligation to use Indonesian language labels on goods traded domestically as regulated in Article 8 paragraph (1) letter j UUPK Jo Article 20 paragraph (1) PP Number 29 of 2021 concerning the Implementation of the Trade Sector Jo Article 97 paragraph (3) of Law Number 18 of 2012 concerning Food and the legal consequences for business actors who do not include Indonesian language labels on goods traded domestically in Singaraja City. The type of research used is descriptive empirical juridical research. The sample used was purposive sampling. Data collection techniques include document study, observation and interviews. Data processing and analysis was carried out qualitatively. Based on the research conducted, it is known that the implementation of the obligation to use Indonesian language labels on goods traded in Singaraja City has not been implemented well by food product business actors. The legal consequences for business actors who violate are subject to sanctions as stated in Article 62 paragraph (1) UUPK in conjunction with Article 26 paragraph (1) PP Number 29 of 2021 concerning the Implementation of the Trade Sector.

Abstract

The purpose of this study is to determine and analyze the implementation of the provisions of Article 9 Paragraph 1 Letter a of Law No. 8 of 1999 concerning Consumer Protection and to determine the legal consequences for business actors who offer goods incorrectly as if the goods have a discount. The type of research used is empirical legal research with a descriptive research nature. The location of this research was conducted in Singaraja City. The data collection technique used was by means of document study, observation and interview. The sampling technique used was the Non Probability Sampling technique and the determination of the subjects used the Purposive Sampling technique. The data processing and analysis techniques were qualitative. The results of the study indicate that the provisions of Article 9 Paragraph 1 Letter a of the Consumer Protection Law have not been implemented properly. This is reflected in the fact that there are still business actors who offer goods incorrectly as if the goods have a discount. The legal consequences for business actors who offer goods as if there is a discount, namely based on Article 62 Paragraph 1 of the Consumer Protection Law, can be subject to criminal sanctions in the form of imprisonment for a maximum of 5 (five) years and/or a maximum fine of IDR 2,000,000,000.00 (two billion rupiah). If the offer of goods that appear to include a discount is made in electronic media, then based on Article 45a Paragraph 1 of the UUITE, the business actor can be sentenced to a maximum of 6 (six) years and/or a maximum fine of IDR 1,000,000,000.00 (one billion rupiah).

Abstract

This research aims to (1) analyze and examine the form of dispensation for the use of helmets for motorbike riders and passengers based on the Decree of the Governor of the Regional Head of Level I Bali Number 217 of 1986 Article 4 Paragraph (1) and Paragraph (2) with Article 106 Paragraph (8) of the Law -Law Number 22 of 2009 concerning Road Traffic and Transportation, (2) analyzes the regulations on the use of helmets in terms of traditional clothing which is more appropriate to use in the Decree of the Governor of the Head of the Level I Region of Bali Number 217 of 1986 Prodi Ilmu Hukum 1 Article 4 Paragraph (1) and Paragraph (2) With Article 106 Paragraph (8) of Law Number 22 of 2009 concerning Road Traffic and Transportation. The type of research used in this research is normative juridical research which aims to identify forms of norm conflict that occur between the two laws and regulations. Using a statutory approach and a conceptual approach. The sources of legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The legal material collection technique used is through document study techniques. The legal material analysis technique used is a vertical synchronization analysis technique. The results of this research show (1) The form of dispensation for the use of helmets for motorbike riders and passengers based on the Decree of the Governor of the Regional Head of Level I Bali, namely when there is a head injury, use traditional clothing within a radius of 10 Km with a maximum speed of 40 Km per hour, (2) Regulations The more appropriate use of a helmet when wearing traditional clothing is Law Number 22 of 2009 concerning Road Traffic and Transportation because it is a law that is at a higher level than the Decree of the Governor of the Level I Regional Head of Bali.

Abstract

This study aims to analyze and review the implementation of the provisions of Article 18 Paragraph (1) of Law Number 8 of 1999 concerning Consumer Protection against the Use of Exoneration Clauses in goods businesses in Singaraja City. In practice, business actors reject the demands of consumers who experience losses due to the products they sell. The refusal of business actors is stated in the form of an exoneration clause on the proof of transaction. The type of research used in this study is empirical juridical research that is descriptive. The determination of the sample used is non-probability sampling in the form of snowball sampling. Data collection techniques are carried out by observation, interviews, questionnaires, and document studies. Based on the research conducted, it can be seen that the implementation of the provisions of Article 18 Paragraph (1) of Law Number 8 of 1999 concerning Consumer Protection has not been effectively implemented by goods business actors in Singaraja City in Singaraja due to weak supervision carried out by legal structures and weak legal culture of the community, namely business actors and consumers related to understanding of the provisions for the use of standard clauses. The factors that cause business actors to include exoneration clauses in their transaction proofs are business actors' concerns about consumer behavior in bad faith, business policies, lack of legal awareness of business actors on the use of exoneration clauses, and the absence of socialization regarding the use of standard clauses.

Abstract

The state of Indonesia is a state of law, which means that Indonesia establishes the law as the basis of power in the state and the legal administrator of its power is also exercised in the rule of law. Law is a law that regulates the way in which state or government instruments carry out their duties and obligations properly, so that their application can be accepted by the community. In this case the law is very important for the whole community, because the law makes the country better and more prosperous. Law is used as a regulator, servant, and protector of society. Therefore, the law is expected to be a forum for justice for all Indonesian people.

Abstract

This study aimed to determine: (1) The definition of international law, (2) The history of international law, (3) The role of international law in resolving conflicts between countries. The data processing and analysis techniques in this article used a qualitative method with a literature review design. The results of the study indicated that International Law is one type of law that is important in its existence in a legal system. Therefore, we as students majoring in law, need to know the basics of this international law such as knowing the meaning, history and sources of law. In addition, international law is also useful for every country in the world, especially for countries that are experiencing conflict. This international law can be used to solve these problems so that peace between countries can be created.

Abstract

Abstract

Human trafficking is one of the transnational crimes that is a threat to global security which is one type of transnational crime coupled with illicit drug trafficking, maritime piracy, arms smuggling, money laundering, terrorism, international banking crimes and cybercrimes. The forms of trafficking in persons are divided based on the purpose of delivery, based on the victim, and based on the form of exploitation. Because of the massiveness of this crime, the United Nations formulated a protocol called the Palermo Protocol. In Indonesia, there are also special regulations regarding the criminal act of trafficking in persons, namely Law Number 21 of 2007. Although there are already laws and regulations that regulate this crime, in fact it is still not able to provide a sense of justice as well as security and comfort for victims of the crime of trafficking in persons. Other legal protections are still needed for victims of this crime.

Abstract

The purpose of this study is to examine and analyze the factors that cause the occurrence of criminal acts of sexual violence against children and the prevention efforts made by law enforcement officers. The type of research used is an empirical legal research type with a descriptive research nature. The location of this research was conducted in Buleleng Regency. Data collection techniques used are document studies, observations and interviews. The sampling technique used is the Non Probability Sampling technique and the subject determination using the Purposive Sampling technique. Qualitative data processing and analysis techniques. The results of the study indicate that the factors causing the crime of sexual violence against children in Buleleng Regency are caused by internal factors and external factors. The internal factors consist of weak self-control and the perpetrator's morale. While the external factors are family factors, environmental factors and technological development factors. The efforts to overcome the crime of sexual violence against children are carried out with pre-emptive (non-penal), preventive (non-penal) and repressive (penal) efforts, namely by providing legal understanding to the community and establishing a good cooperative relationship with the community and conducting various kinds of supervision. As well as efforts made by conducting investigations and investigations in accordance with applicable legal provisions, using forensic assistance, carrying out all kinds of actions according to procedures.
