Abstract

The implementation of the rule of law principle in the enforcement of Human Rights (HR) in Indonesia has become a major focus in constitutional governance. This study aims to analyze the role of the Constitutional Court (MK) in implementing the rule of law principle through rulings that focus on human rights protection. By using a normative juridical approach and analyzing MK rulings, this study reveals that although MK has successfully upheld human rights through judicial review, significant challenges remain, especially in terms of the implementation of these decisions in practice. Limited legal culture and political commitment are the main obstacles to the successful and comprehensive application of the rule of law principle. Therefore, strengthening synergy among state institutions and improving legal literacy for the public are essential to achieving the rule of law principle that upholds human rights.

Abstract

Air pollution in big cities, including Depok City, is becoming an increasingly pressing environmental issue, with one of the main contributors being carbon dioxide (CO₂) emissions from motor vehicles. One of the factors influencing the increase in CO₂ emissions is unorganized parking management, which causes congestion and increased vehicle travel time. This study aims to analyze the implementation of parking regulations in Depok City and its impact on the level of CO₂ gas pollution produced by motor vehicles. The study was conducted using a quantitative method, through direct measurement of CO₂ gas concentrations at several crowded parking spots in urban areas, and analyzing the effectiveness of the implementation of existing parking regulations with applicable government regulations, especially those related to controlling motor vehicle emissions. The results of the study showed that locations with poor parking management had much higher CO₂ gas concentrations, with an average value reaching 350 ppm (parts per million), while locations with good parking management were recorded at 220 ppm. This increase in emissions was caused by longer travel times due to congestion caused by unorganized parking. In addition, although there is PP No. 22 of 2021, the implementation of parking regulations in Depok City is still not optimal, so that supervision of vehicle emissions and parking arrangements need to be improved. This study suggests the need for more structured parking management and strict supervision of motorized vehicles operating in Depok City. Thus, it is expected to reduce congestion, reduce CO₂ emission levels, and improve air quality in Depok City, in line with the government's goals in controlling air pollution.

Abstract

This article examines coastal erosion management policies in Demak Regency, Central Java, one of the most severely affected regions by coastal abrasion in Indonesia. Coastal erosion, driven by both natural factors and human activities, threatens the sustainability of coastal ecosystems as well as the social and economic livelihoods of local communities. Using a Systematic Literature Review (SLR) approach, this study analyzes various policies implemented, ranging from hard infrastructure development to ecosystem-based approaches such as mangrove rehabilitation. The findings reveal that although some policies have shown effectiveness, challenges such as weak inter-agency coordination, limited funding, and low community participation continue to hinder optimal implementation. This article highlights the importance of integrated and sustainable policies, as well as the need for cross-sectoral collaboration to protect coastal spaces and support the welfare of coastal communities. The findings are expected to serve as a reference for policymakers in formulating more effective strategies to address the issue of coastal erosion.

Abstract

Penelitian ini mengkaji tantangan dan solusi dalam pengelolaan dan pengangkutan sampah di Kota Cilegon, Indonesia, yang menghadapi peningkatan volume sampah akibat pola konsumsi masyarakat yang tinggi. Meskipun terdapat regulasi yang mengatur pengelolaan sampah, seperti UU No. 18 Tahun 2008, implementasinya masih terhambat oleh keterbatasan infrastruktur, rendahnya kesadaran masyarakat, dan lemahnya pengawasan. Metodologi yang digunakan adalah Systematic Literature Review (SLR) untuk mengevaluasi dan menganalisis studi-studi terdahulu terkait pengelolaan sampah. Hasil penelitian menunjukkan bahwa sistem pengangkutan sampah di Cilegon masih belum efektif, dengan cakupan pelayanan yang rendah dan inefisiensi operasional yang tinggi. Dampak lingkungan yang serius, termasuk pencemaran air dan udara, serta risiko kesehatan masyarakat, menjadi perhatian utama. Penelitian ini merekomendasikan pendekatan holistik yang melibatkan optimalisasi infrastruktur, penguatan regulasi, pemberdayaan masyarakat, dan adopsi teknologi digital untuk menciptakan sistem pengelolaan sampah yang berkelanjutan. Dengan demikian, penelitian ini diharapkan dapat memberikan kontribusi strategis bagi pemerintah daerah dan pemangku kepentingan dalam meningkatkan kualitas hidup dan lingkungan di Kota Cilegon

Abstract

Air pollution in urban areas is a multidimensional threat with systemic impacts on the environment and public health. Carbon monoxide (CO), as a toxic gaseous pollutant from the incomplete combustion of fossil fuels, is the focus of this study which evaluates the spatial-temporal distribution of CO concentrations in public spaces of Padang City during 2020-2024. Using a Systematic Literature Review (SLR) approach and longitudinal environmental data from four strategic points, a significant decrease in CO levels was found from 14,596 µg/m³ (2020) to 286 µg/m³ (2024). Peak concentrations occurred in the dry season, reinforcing the influence of meteorological variables. These results emphasize the importance of real-time digital monitoring systems, multi-sectoral emission policy reformulation, and integration of green open spaces in urban planning. In the future, monitoring should be expanded to other pollutants, congestion locations, and linked to public health early warning systems to support urban sustainability and resilience.

Abstract

West Sumatra Province has an area of approximately 4,229,730 hectares, with approximately 54.43% or approximately 2,300,000 hectares being state forest areas. This forest area consists of conservation forests, protected forests, and production forests. The authority of the West Sumatra Provincial Government based on regional autonomy is to manage protected forest areas and production forests, namely with an area of 2.3 million hectares. Based on data from the West Sumatra Provincial Forestry Service in 2023, the area of forest areas managed through the social forestry program reached 50,410 hectares. The management area of KPHL Agam Raya is 39,285 hectares with a social forestry permit area of 16,247 hectares. To enforce environmental law and resolve conflicts by communities around the forest, with the presence of a social forestry program that provides space for communities around the forest for communities who have already or are trying in protected forest areas and production forests so as not to violate the law, the community can properly manage the area legally which is given management rights by the government through the Ministry of Environment and Forestry to utilize the potential of the forest without having to reduce the protection and conservation functions. The role of social forestry in the context of conflict resolution and environmental law enforcement in the forestry sector is as follows: Prevention of Land Conflicts and Forest Damage: Government programs in the form of social forestry programs can provide legal certainty for communities in managing forests through schemes such as Village Forests, Community Forests, People's Plantation Forests, Forestry Partnerships, and Customary Forests. With this legal certainty, land conflicts between communities and other parties, including companies, can be minimized. In addition, communities who have the legal right to manage forests tend to be more committed to maintaining the sustainability of forest areas rather than encroaching, burning or illegal logging that can damage the area. In West Sumatra, there are several examples of the success of the Social Forestry program in resolving conflicts. For example, in the Agam and South Solok areas, community-based forest management has succeeded in reducing tenure conflicts and improving local welfare. In some cases, recognition of customary forests has also helped reduce conflicts with large companies. Social Forestry in West Sumatra has made a positive contribution to resolving conflicts, but it needs ongoing support from various parties to ensure its long-term impact.

Abstract

Indonesia, endowed with abundant natural resources, bears a constitutional obligation to ensure a healthy environment for all citizens as mandated by Article 28H of the 1945 Constitution. However, the ongoing environmental crisis—characterized by ecosystem degradation and the impacts of global warming—demands stronger legal instruments for the prevention and control of environmental pollution and destruction. Environmental law plays a crucial role in this regard, particularly through the Environmental Impact Assessment (AMDAL), which has historically served as a preventive planning tool and a primary prerequisite for business licensing. Significant changes have emerged following the enactment of Law No. 11 of 2020 on Job Creation, which shifts the licensing framework from a permit-based to a risk-based approach. This shift has downgraded the status of AMDAL from a primary requirement to a supplementary one, raising concerns about the weakening of its preventive function. Moreover, the perceived relaxation of environmental criminal sanctions under the new law has sparked questions about the state’s commitment to constitutional mandates for environmental protection. These concerns are further compounded by the conditional unconstitutionality status of the Job Creation Law, creating uncertainty regarding the effectiveness of environmental law enforcement. This study employs a normative-juridical approach to analyze the regulatory changes introduced by the Job Creation Law and its implementing regulation, Government Regulation No. 22 of 2021, in comparison with the previous framework under Law No. 32 of 2009 on Environmental Protection and Management. The focus lies on examining the urgency and effectiveness of AMDAL as an instrument for controlling environmental degradation and pollution, as well as its implications for potential environmental criminal acts under the new legal regime. The findings of this study are expected to provide a deeper understanding of the impact of legislative changes on environmental protection in Indonesia and to identify legal gaps that may exacerbate the environmental crisis. The study aims to inform policymakers in striking a balance between economic development and sustainable environmental protection.

Abstract

A notary is a public official who is authorized to make authentic deeds and has other authority as referred to in the Notary Position Law or based on other laws. The Notary has an obligation to keep everything confidential about the deed he makes and all information obtained for the preparation of the deed in accordance with the oath/promise of office, unless the Law specifies otherwise. In maintaining the confidentiality of personal data in the digital era, it is very important considering that personal data can be used by unauthorized parties for various interests, the formulation of the problem in this study is first, how is the legal protection of the confidentiality of the data of the person facing in the digital era, the second is how the role of technology in helping notaries to maintain the confidentiality of the data of the person who is confronted in the digital era, and the third is how is the responsibility of the notary for the confidentiality of the data of the person who is facing in the digital era. The research method used is normative juridical, with a legislative, conceptual and case approach, a type of secondary research, with additional interviews with the Regional Supervisory Council (MPD) of the Padang Region and Notaries in Padang City. The legal protection of the confidentiality of personal data in the digital era aims to ensure that the right to privacy is respected, prevent the misuse of personal data for various purposes, prevent misuse by establishing rules on how personal data can be collected, stored and used. The role of technology in helping notaries to maintain the confidentiality of client data is very crucial in the notary profession, by utilizing various security systems, notaries can provide more optimal protection of the client's personal data. Notary's responsibility for the confidentiality of client data in the digital era of notaries will face various legal and ethical consequences. By understanding their responsibilities and taking preventive measures, notaries can minimize the risks and negative impacts of data leaks. There are no rules regulating the confidentiality of client data and sanctions for notaries if there is a leak of client data in the digital era, creating a void in norms. So that the confidentiality of the data of the person has not been guaranteed.

Abstract

The enactment of the Law on Access to Financial Information for Tax Purposes (Access to Financial Information) created a new paradigm in applying the principle of bank secrecy. The Law on Access to financial information has given authority to the Director General of Taxes to open taxpayer data at a bank even though the taxpayer is not being audited, billed, and investigated for tax crimes. This causes taxpayer data to be accessible at the bank if it meets predetermined criteria. The state must provide legal protection to secure bank customer data, so irresponsible parties do not misuse it. This study aims to determine and analyze the form of legal protection for customer data in implementing the Financial Information Access Law. This research method uses a normative juridical approach, analyzed normatively and qualitatively. The research results show that the Law on Access to Financial Information does not explicitly regulate the legal protection of customer data, and there are no administrative and criminal sanctions for parties who misuse customer data. Protection of customer data in implementing access to financial information is only found in the Regulation of the Minister of Finance. This Regulation of the Minister of Finance should regulate the technical implementation of the law. In the future, the government can conduct studies and change the Financial Information Access Law to guarantee legal protection for customer data regulated by law.

Abstract

Dalam hukum adat Minangkabau, ruang lingkup hak adat tidak dapat dipisahkan Antara tanah, air, dan sumber daya alam yang terkandung di dalamnya. Bukan hal yang aneh, ketika isu tanah komunal menjadi sumber perselisihan dan penyumbang terbesar kasus pada sistem hukum di Sumatera Barat. Di sisi lain menurut tanah publik adalah undang-undang kontrol masyarakat adat bawaan yang benar, sedangkan sisi lain dengan segala bentuk teknologi pembuatan kebijakan dan kebijakan yang dimiliki lahan/lahan masyarakat yang dikategorikan sebagai Hutan Lindung. Saat ini keberadaan lahan hutan dikuasai oleh masyarakat adat dari generasi ke generasi. Masalahnya adalah bagaimana status hak adat masyarakat hutan yang dikategorikan sebagai kawasan lindung. Kawasan lindung sering dieksploitasi dalam skala besar untuk keuntungan cepat tanpa memperhatikan prinsip-prinsip pembangunan berkelanjutan. Dapat disimpulkan bahwa warga masyarakat yang tidak menjadi warga hukum adat pada umumnya tidak boleh turut menggarap tanah yang merupakan wilayah kekuasaan perekutuan. Kemudian, pengelolaan kawasan lindung di Indonesia umumnya masih dalam konteks pengamanan hutan/kawasan lindung semata, sementara manajemen secara intensif belum berkembang, termasuk dalam hal pelibatan masyarakat lokal dalam pengelolaan dan sharing manfaatnya.
