Abstract

The customary practice of keduhei sudih kawan in traditional marriage ceremonies in Sebukar Village is considered a fundamental and mandatory ritual. However, there are no positive legal norms that explicitly recognize customary traditions as formal requirements for the validity of marriage. This study aims to examine the legal status and provide a juridical analysis of the keduhei tradition in the context of Indonesian customary law. This study employs an empirical juridical approach, utilizing data collection methods that include observation and in-depth interviews with members of the Sebukar Village Customary Council (Lembaga Kerapatan Adat Desa, LKAD). This research is prescriptive, with data processed systematically through editing and analyzed qualitatively. The results show that keduhei not only functions as a complement to the ceremony but also as an important legal affirmation in marriage based on customary norms, so it has a strong legal position. However, some elements of the custom, such as certain requirements and sanctions, can conflict with the provisions of national law, so a balance between customary law and national law is needed to ensure its sustainability and legal coherence.

Abstract

The environment is one of the sectors that has undergone a transformation since the Job Creation Law was passed. A number of clauses in Law No. 32/2009 were removed and amended by the Cipta Kerja Law. One of them is the elimination of Environmental Permits and replaced with environmental approvals that are integrated with business licensing. Government Regulation No. 22 of 2021 on the Implementation of Environmental Protection and Management is a derivative regulation of the Cipta Kerja Law. Many stakeholders are still unaware of the government regulation even though it has been in effect for two years. Therefore, the purpose of this article is to provide a brief explanation of how environmental approvals are issued. The method is normative legal research through a literature study of the mechanism for issuing environmental approvals listed in Government Regulation No. 22 of 2021. This research uses content analysis and flow charts as analysis techniques. The mechanism for issuing environmental approval has been regulated in detail in Government Regulation No. 22 of 2021 starting from self-screening by the person in charge of the business and/or activity, preparation of environmental documents, the process of examining and/or assessing environmental documents in the form of Environmental Impact Analysis (EIA) and Environmental Management Efforts and Environmental Monitoring Efforts (UKL-UPL) forms and Issuance of Environmental Approval.

Abstract

Undang-undang telah mengatur bahwa Jaminan Pelaksanaan dalam Kontrak Kerja Konstruksi Pemerintah bersifat mudah dicairkan dan tanpa syarat (unconditional), namun dalam prakteknya, pencairan jaminan ini kerap menimbulkan permasalahan baru diantara para pihaknya, salah satunya karena tidak dicairkannya jaminan. Penelitian ini bertujuan untuk menganalisis kedudukan hukum Jaminan Pelaksanaan dalam Kontrak Kerja Konstruksi dan bentuk perlindungan hukum bagi Pengguna Jasa dalam penyelesaian pencairan Jaminan Pelaksanaan. Dari hasil penelitian menunjukan Jaminan Pelaksanaan merupakan perjanjian tambahan dari perjanjian pokok (Kontrak Kerja Konstruksi) yaitu perjanjian yang pemenuhannya dijamin dengan perjanjian jaminan. Adapun perlindungan hukum bagi Pengguna Jasa dalam penyelesaian pencairan Jaminan Pelaksanaan ada 2 (dua) yaitu: (1). Perlindungan Hukum Preventif sebagaimana diatur dalam peraturan perundang-undangan maupun dalam perjanjian dengan maksud untuk mencegah suatu pelanggaran serta memberikan rambu-rambu atau batasan dalam melakukan suatu kewajiban; dan (2). Perlindungan Hukum Represif melalui Non-Litigasi dengan memanfaatkan APS, Layanan Pengaduan OJK, dan LAPS SJK; serta melalui Litigasi berupa gugatan wanprestasi ke Pengadilan Negeri.

Abstract

Prinsip Mengenali Pengguna Jasa (PMPJ), diatur pada Pasal 18 Undang-Undang Nomor 8 Tahun 2010. Kemudian ditindak lanjuti dengan Peraturan Pemerintah Nomor 43 Tahun 2015, yang dilaksanakan dengan Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 9 Tahun 2017. Berdasarkan peraturan perundang-undang tersebut di atas, Notaris merupakan salah satu Pihak Pelapor dalam pencegahan dan pemberantasan TPPU dan berkewajiban untuk menerapkan PMPJ bagi pengguna jasa Notaris. Penelitian ini akan mengkaji penerapan Prinsip Mengenali Pengguna Jasa oleh Notaris di Kabupaten Kampar dan tindak lanjut dari hasil audit kepatuhan oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Provinsi Riau terhadap penerapan Prinsip Mengenali Pengguna Jasa oleh Notaris di Kabupaten Kampar. Metode penelitian yang digunakan adalah yuridis empiris, dengan teknik purposive sampling. Hasil penelitian menunjukan bahwa Ppnerapan PMPJ oleh Notaris Kabupaten Kampar terhadap pengguna jasa belum terlaksana secara maksimal. Hal ini terlihat dari 119 jumlah Notaris Kabupaten Kampar, 15 orang Notaris terindikasi berisiko tinggi karena tidak menerapkan PMPJ sebagaimana yang telah ditetapkan dalam peraturan perundang-undangan, sehingga terhadap Notaris tersebut dilakukan audit kepatuhan langsung (on-site) oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia berkerjasam dengan Majelis Pengawas Daerah Notaris Kabupaten Kampar. Tindak lanjut hasil audit kepatuhan oleh Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Provinsi Riau terhadap Penerapan PMPJ oleh Notaris di Kabupaten Kampar, yaitu Notaris Kabupaten Kampar harus melaksanakan komitmen untuk menerapkan PMPJ sebagaimana yang telah disepakati bersama. Selain itu, juga disampaikan informasi hasil pengawasan kepatuhan dan surat pembinaan kepada Notaris terkait serta informasi hasil pengawasan kepada PPATK, dan PPATK akan melakukan pemantauan terhadap Notaris terkait.

Abstract

Dalam hukum adat Minangkabau, ruang lingkup hak adat tidak dapat dipisahkan Antara tanah, air, dan sumber daya alam yang terkandung di dalamnya. Bukan hal yang aneh, ketika isu tanah komunal menjadi sumber perselisihan dan penyumbang terbesar kasus pada sistem hukum di Sumatera Barat. Di sisi lain menurut tanah publik adalah undang-undang kontrol masyarakat adat bawaan yang benar, sedangkan sisi lain dengan segala bentuk teknologi pembuatan kebijakan dan kebijakan yang dimiliki lahan/lahan masyarakat yang dikategorikan sebagai Hutan Lindung. Saat ini keberadaan lahan hutan dikuasai oleh masyarakat adat dari generasi ke generasi. Masalahnya adalah bagaimana status hak adat masyarakat hutan yang dikategorikan sebagai kawasan lindung. Kawasan lindung sering dieksploitasi dalam skala besar untuk keuntungan cepat tanpa memperhatikan prinsip-prinsip pembangunan berkelanjutan. Dapat disimpulkan bahwa warga masyarakat yang tidak menjadi warga hukum adat pada umumnya tidak boleh turut menggarap tanah yang merupakan wilayah kekuasaan perekutuan. Kemudian, pengelolaan kawasan lindung di Indonesia umumnya masih dalam konteks pengamanan hutan/kawasan lindung semata, sementara manajemen secara intensif belum berkembang, termasuk dalam hal pelibatan masyarakat lokal dalam pengelolaan dan sharing manfaatnya.

Abstract

Kampar Regency currently has the largest number of palm oil mills in Riau Province, which has led to an increase in environmental pollution due to the by-products of these industrial activities. The objective of this research is to identify the issues associated with waste management in palm oil mills. The research employs a descriptive-qualitative method to systematically, factually, and accurately represent the data contained in the news text. The results indicated that rubber and oil palm plantations (1.8 and 1.5 hectares) were inundated with waste. It is recommended that palm oil mills implement waste treatment in accordance with quality standards before disposal. Furthermore, the application of the law as the basis for sanctions from this waste must be accompanied by an appeal to the public to monitor the level of environmental pollution. In addition, the role of public policy actors in monitoring and determining legal sanctions for environmental pollution is of great importance.

Abstract

This study was conducted to make blockboard using oil palm trunk waste as raw material. The purpose of this study was to determine the physical and mechanical properties of blockboard made from oil palm trunk raw materials and compared with the physical and mechanical properties of blockboard available on the market. The mechanical properties tested were tensile strength, flexural strength and air absorption. The oil palm trunk used was waste from rejuvenation that was 25-30 years old. The results showed that blockboard made from oil palm trunk waste had higher tensile strength and flexural strength values ??than market blockboard. Meanwhile, the water absorption capacity of market blockboard is better than the water absorption capacity of blockboard made from oil palm trunk waste. This study was conducted to implement one of the government policies in the context of utilizing oil palm waste, especially oil palm trunk waste as an effort to preserve the environment.

Abstract

Tujuan pendaftaran tanah menurut Pasal 3 huruf a Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah yaitu untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah, Surat Penyataan Fisik Bidang Tanah (Sporadik) merupakan gerbang awal dari pihak yang mendaftarkan tanahnya secara sporadik. Kegunaan dari surat ini ialah sebagai bentuk penegasan bahwa yang bersangkutan telah menguasai sebidang tanah tersebut secara sah sebelum memohon pengajuan hak atas tanah tersebut. Di sebagian besar Daerah Kabupaten Pasaman Barat Provinsi Sumatera Barat masih sangat banyak tanah-tanah yang belum terdaftar atau belum bersertipikat. Dalam penulisan ini menggunakan metode yuridis empiris. Dari hasil penelitian disimpulkan bahwa 1) Bank Bsi KCP Pasaman Barat menerima agunan berupa Surat pernyataan penguasaan fisik bidang tanah secara sporadic untuk dijaminkan sebagai anggunan untuk pinjaman KUR dibawah 100 juta 2). pihak Bank Bsi KCP Pasaman Barat hanya menjadikan surat sporadik tersebut sebagai pegangan untuk menjadi jaminan pada kredit KUR karena sporadik tidak bisa diikat hak tanggungannya dan tidak dibunyikan dalam akad kredit KUR tersebut.

Abstract

Rapid economic development has created various goods and/or services that can be used and consumed. With the increasing variety of goods and/or services in circulation, and supported by advances in information technology, the distribution is increasingly expanding across national boundaries. So this is also a new demand for the government to oversee the distribution of products that are widely circulated in the market, especially in the health sector. One of the important human needs and cannot be left behind in daily activities is medicine. People's fear of the negative stigma of using modern medicine increases people's desire to seek alternatives to traditional medicine. However, there are many distributions of traditional medicines without a Distribution Permit (TIE) from the Center for Drug and Food Control (BBPOM) in Pekanbaru. Based on this, the researcher examines 1) What is BPOM's responsibility for the circulation of medicinal products without distribution permits in the community. 2) What is the legal protection for consumers who use medicinal products without a Distribution Permit from BPOM. Writing this thesis using the approach empirical juridical. From the results of the study, it was found that the most cases were found at Licensed Drug Stores (TOB) facilities. There are 2 (two) responsibilities of BPOM in conducting supervision, namely: pre-market andpost-market, both are supported by the Drug and Food Control System (SisPOM). The form of legal protection by BPOM is preventive and repressive efforts. Establishing a distribution permit is a preventive action taken by BPOM in carrying out aspects of security, comfort and safety for consumers. Repressive protection, namely by carrying out enforcement operations or spot checks on various drug distribution facilities. Furthermore, if a dispute occurs, it will be resolved through the courts and out of court.

Abstract

Notaries as public officials have an obligation to apply the principle of recognizing beneficial owners in a corporation where this obligation is not regulated in UUJN. On the one hand, a notary does play an important role in disclosing beneficial ownership of a corporation, but on the other hand, the transparency of beneficial ownership disclosure must be based on honest and clear information from parties representing the corporation. This is due to the existence of beneficial ownership which cannot be fully detected by a notary. The problems are what are the legal consequences if the principle of recognizing beneficial owners (BO) is not implemented and what is the urgency of applying the principle of recognizing beneficial owners (BO) in carrying out notary duties. This legal research uses normative legal research, namely library research, which is a data collection method by studying books, laws and regulations, and writings related to this research. While the nature of the research is analytical descriptive, that is, it gives a clear and detailed description of an event that occurred. The results of research on legal consequences if the principle of recognizing beneficial owners (BO) is not implemented are given administrative sanctions, namely revoking the notary's license if violations are found, supervision in the implementation of the application of the BO principle is carried out by the Minister of Law and Human Rights through the Director General of General Legal Administration. Meanwhile, the notary's responsibility for the deed he made is that in civil terms the notary is only responsible for the head of the deed, meaning that it contains the authority of the appearers in signing the deed, then for the closing deed which contains the authority of the witnesses then the appearers are confronted with signing the deed, whereas against contents of the deed the notary is only responsible that the deed he made does not violate the clauses prohibited by law and the provisions stipulated in Article 1320 of the Civil Code. Criminally, a notary can be prosecuted in court if at a later date, the competent authorities can prove that the notary has consciously entered information that benefits one party and harms the other party. And the urgency of applying the principle of recognizing beneficial owners (BO) in carrying out notary duties is that basically the obligation to disclose beneficial ownership is carried out by parties who wish to use the services of a notary. The role and position of a notary is as a supporting system in disclosing beneficial ownership of a corporation, namely in this case during the process of inputting data related to the establishment or changes to the corporate statutes/bylaws. Thus the obligation related to disclosure of beneficial ownership cannot be borne by the notary but the service user.
