Abstract

This study aims to re-examine the normative foundations of the Qur’an and Hadith as the primary sources of Islamic law in responding to contemporary social dynamics and legal challenges. The Qur’an is positioned as a sacred text that contains universal and eternal principles for all humankind, while the Hadith serves as a methodological guide for applying Qur’anic laws to present-day contexts. The study is grounded in the Ma‘na-Cum-Maghza theoretical framework, a contextual approach that emphasizes understanding the substantive meaning and message of the divine texts. This research adopts a qualitative method, employing literature review techniques from both classical and contemporary Islamic legal sources. The findings indicate the necessity for a renewed methodology of istinbat (legal reasoning) that is more responsive to social change, without neglecting the normative authority of Islamic legal sources. These findings are contextualized within the theoretical framework, highlighting the epistemological and methodological implications for the development of fiqh in Indonesia’s legal landscape. This study contributes originality by integrating the Ma‘na-Cum-Maghza approach with istinbat methodology, thereby enriching the discourse of contemporary Islamic legal studies and offering a new direction for lawmaking grounded in maqashid shariah and social justice. The findings provide practical insights for academics, practitioners, and policymakers in the field of Islamic law.

Abstract

Abstract

The religious court institution in Indonesia plays a crucial role in implementing and upholding the application of law in the country. The research questions formulated in this study are: What is the religious court institution in Indonesia? And how has the dynamic of the religious court institution in Indonesia evolved? This study adopts a normative sharia approach with historical, legislative, and theoretical perspectives. The data sources are primarily documents and other relevant literature that support the research. The collected data is analyzed using content analysis. The results of this study indicate that the religious court institution in Indonesia is not a new phenomenon; it has existed since the era of kingdoms (pre-independence) and has continuously developed and evolved in line with the times, culminating in the enactment of regulations on Judicial Power, which form the legal basis for the religious court system in Indonesia. Furthermore, the dynamics of the religious courts in Indonesia involve various challenges related to contemporary social issues such as family resilience, gender equality, child and women's protection, and digitalization in response to modernization and globalization. The implications of this research are expected to serve as a foundation for historical reflection and highlight the need for further studies on current contemporary issues.

Abstract

The main problem of this research is how does the community understand the eclipse in Sumbang Village, Curio District, Enrekang Regency from a astronomical perspective? The main problem is then broken down into several sub-problems, namely: What is the reality of the community's understanding of eclipses in Sumbang Village, Curio District, Enrekang Regency. The type of research used is field research with the research approaches used are theological-normative (syar'i), juridical and sociological. The data sources for this research are traditional leaders, community leaders, religious leaders, Head of KUA and Village Imam. Furthermore, the data collection methods used were observation, interviews and documentation. Then, data processing and analysis techniques are carried out through three stages, namely: data reduction, data presentation and drawing conclusions. The results of this research show that there are people in Sumbang Village who do not know how the eclipse occurs, so their understanding still comes from the perspective of their ancestors. As the development of science changes people's opinions, for those who are educated, eclipses are considered a natural phenomenon that shows a sign of the power of Allah swt. From the astronomical perspective, an eclipse is considered a natural phenomenon destined by Allah swt. to show His majesty and greatness, which is not connected with certain myths or beliefs, as well as the time to carry out worship related to the eclipse as exemplified by the Prophet Muhammad. The implication of this research is that it is hoped that the public will be able to understand the eclipse well without associating this phenomenon with various beliefs or myths. And it is hoped that the attention of Falak experts will spread information and teaching about solar and lunar eclipses to the community in Sumbang Village widely.

Abstract

The Qibla is the direction to the house that Muslims need to pay attention to, because it is an obligation and a legitimate requirement in the practice of worship and the necessity to confront the body in its direction. Thus, over time, various methods of determination were born to make it easier for Muslims about where the Qibla is headed. This study further reviews the accuracy of rubu mujayyab refers to the classic method of the taqribul maqshad guidebook in the current era by using TPU Tombo-Tombolo coordinate data. This research is field-based, with Syar'i, sociological and astronomical approaches. Primary Data obtained from observations through the process of calibrating the direction of the Qibla. The results of this study indicate that the method of Qibla direction using rubu mujayyab refers to taqribul maqshad is fairly complicated for beginners when viewed from the past era, but in the present era is quite practical in the understanding by the public because latitude and longitude do not need to be calculated manually. after the measurement using TPU Tombo-Tombolo coordinate point produces Qibla azimuth with rubu mujayyab on taqribul maqshad which is 289° while kotemporer-based sun compass shows 292° so that the difference is 3°. The difference produced by the method of taqribul maqshad is also erratic and can change if using the coordinate data of other areas, this can happen because the calculation is based on the classical hisab Hakiki bi-al taqribi (approximately). The implications of this study hope to contribute to the educational understanding of determining the direction of Qibla to the surrounding community, both classical and modern that they can easily understand, it is also expected that students in the field of astronomy are not too inclined to modern tools, so that classical tools are not drowned by the times because they have an important history in the development of astronomy and are the legacy of muslim scientists who can still be used as scientific isnaad.
