Abstract

Kaidah fikih al-masyaqqah tajlibut taysir (kesulitan mendatangkan kemudahan) merupakan prinsip penting dalam hukum Islam, terutama ketika seorang mukallaf menghadapi kondisi menyulitkan. Penelitian ini dilatarbelakangi oleh kebutuhan umat Islam untuk merespons dinamika kehidupan kontemporer yang sering diwarnai oleh dilema hukum, di mana dua keburukan tidak dapat dihindari sekaligus. Studi ini bertujuan mengkaji makna, dalil, syarat, dan penerapan kaidah dalam situasi darurat dan problematika kekinian. Penelitian dilakukan dengan pendekatan kualitatif dan kuantitatif melalui studi pustaka, wawancara, dan analisis data lapangan. Hasil kajian menunjukkan bahwa kaidah ini merupakan derivasi dari prinsip umum “ad-dharar yuzal” dan sejalan dengan maqashid al-syari’ah. Dalil-dalil dari Al-Qur’an dan Hadis, seperti QS. Al-Baqarah: 286 dan sabda Rasulullah “agama ini mudah”, menjadi landasan kuat dalam penerapannya. Kaidah ini juga diperkuat oleh pendapat ulama klasik dan kontemporer, serta memiliki hubungan erat dengan kaidah-kaidah fikih lainnya. Contoh aplikatif ditemukan pada kebolehan tayamum menggantikan wudhu, atau rukhsah saat safar dan sakit. Kesimpulannya, pemahaman dan penerapan kaidah ini menjadi penting dalam menjawab tantangan hukum Islam masa kini, dengan syarat tidak bertentangan dengan nash dan tidak disalahgunakan untuk kemaksiatan. Edukasi dan sosialisasi fikih kaidah harus ditingkatkan agar umat Islam mampu mengambil keputusan yang maslahat, proporsional, dan sesuai tuntunan syariah dalam situasi sulit

Abstract

This paper discusses the rules of jurisprudence regarding the combination of two similar acts of worship in one implementation with one intention. In the practice of worship, a Muslim is often faced with a condition where two acts of worship that have the same type and purpose occur at the same time. Based on the rules of jurisprudence: “If two similar acts of worship come together then their implementation is combined and it is sufficient to carry out one of them if both have the same purpose”, then this combination is permitted with certain conditions. This research uses a qualitative method based on literature study by reviewing relevant literature regarding the rules of jurisprudence and their application. The results of the discussion show that combining two similar worship services is permissible if it meets conditions such as: the type of worship is the same, the time is the same, it is not a qadha or accompanying worship service, and the intention of a larger worship service if there is a difference in degree. Examples of implementation include: janabah bathing at the same time as Friday bathing, tawaf ifadhah and tawaf wada’, as well as sunnah ablution, qabliyah and tahiyyatul mosque prayers simultaneously. In conclusion, this rule shows the ease in Islamic law while maintaining the validity and value of worship.

Abstract

Dalam realitas kehidupan yang kompleks, manusia sering dihadapkan pada dilema moral dan hukum yang melibatkan dua keburukan (mafsadat) yang tidak dapat dihindari sepenuhnya. Syariat Islam menawarkan solusi sistematis melalui kaidah fikih: “Jika dua mafsadat saling bertentangan, maka diperhatikan yang lebih besar bahayanya dengan melakukan yang lebih ringan.” Kaidah ini merupakan turunan dari prinsip dasar “kemudharatan harus dihilangkan” (al-darar yuzal) dan selaras dengan tujuan utama syariat (maqashid al-syari’ah), yaitu menjaga agama, jiwa, akal, keturunan, dan harta. Artikel ini mengkaji makna teoritis dan aplikatif dari kaidah tersebut dengan menelaah konstruksi bahasanya, landasan dalil dari Al-Qur’an dan Hadis, serta penguatan dari para ulama seperti Al-Suyuthi dan As-Syatibi. Hasil kajian menunjukkan bahwa kaidah ini menjadi kerangka penting dalam pengambilan keputusan hukum Islam, terutama dalam isu-isu kontemporer yang tidak memungkinkan penghindaran mafsadat secara total. Contoh penerapan termasuk kebolehan aborsi demi menyelamatkan nyawa ibu dan wacana etis tentang euthanasia pada penderita AIDS stadium akhir. Temuan ini menegaskan bahwa penerapan keburukan yang lebih ringan bukan bentuk pembolehan mutlak, melainkan sebagai langkah darurat untuk mencegah kerusakan yang lebih besar. Studi ini menyimpulkan bahwa pemahaman dan penerapan kaidah ini sangat penting agar umat Islam mampu membuat keputusan yang bijak dan sesuai syariat dalam situasi sulit. Diperlukan upaya edukasi dan sosialisasi kaidah-kaidah fikih agar umat mampu merespons tantangan etis masa kini dengan cermat.

Abstract

The concept of ‘illat in the proposal of fikih as the basis of the establishment and change of Islamic law. By raising the principle of “al-ḥukmu yadūru ma‘a ‘illatihi wujūdan wa ‘adaman” (the law revolves along with its ‘illat, existence or non-existence), the author explains that social change and cultural context can affect the applicability of Islamic law. ‘Illat is defined as a real property that is the rational basis of a Sharia law’. This article studies the various definitions of ‘illat according to the scholars usul fikih and describe the kinds of ‘illat based on the permanence of the Shari’ah’ and considerations of goodwill. Thus, an understanding of ‘illat becomes essential in order to ensure that Islamic law remains relevant, fair, and contextual in responding to the dynamics of community life. This article demonstrates that the flexibility of Islamic law does not conflict with divine principles, but precisely reflects the mercy and benevolence that are its goals.

Abstract

Makalah ini membahas kaidah fikih al-khurūj min al-khilāf mustaḥabb yang berarti "keluar dari perselisihan adalah sesuatu yang disukai". Kaidah ini merupakan prinsip penting dalam fiqih Islam yang bertujuan untuk menjaga kehati-hatian dan menghindari perbuatan yang berpotensi salah menurut sebagian pendapat ulama. Dalam konteks khilafiyah, kaidah ini menganjurkan umat Islam untuk memilih pendapat yang dapat mencakup semua pandangan agar ibadah dan amalnya terhindar dari kekurangan atau ketidaksahan. Pembahasan dalam makalah ini mencakup pengertian bahasa dan istilah kaidah, sumber-sumber syar’i dari Al-Qur’an, hadis Nabi SAW, serta contoh-contoh aplikatif dalam berbagai bidang fiqih seperti wudhu, shalat berjamaah, dan shalat Jumat yang bertepatan dengan hari raya. Melalui pendekatan normatif dan deskriptif, makalah ini menekankan pentingnya sikap bijak dan toleran dalam menghadapi perbedaan pendapat serta pentingnya mengedepankan prinsip kehati-hatian sebagai bentuk perlindungan terhadap keabsahan ibadah. Dengan demikian, kaidah ini tidak hanya bersifat teoritis, tetapi juga memiliki nilai praktis tinggi dalam kehidupan sehari-hari umat Islam

Abstract

Zakat as an Islamic financial instrument not only functions as worship, but also has a strategic role to embody social justice. The purpose of this research is to analyze the zakat management by BAZNAS Singkawang city based on the principle of distributive justice in the perspective of maqashid sharia. This research is an empirical research uses a descriptive qualitative approach with data collection techniques through interviews, observations, and documentation. The results indicate that the management of zakat by BAZNAS Singkawang has attempted to fulfill the principle of distributive justice through equal distribution to all ashnaf groups by direct assistance programs based on the needs and potential of mustahik. However, the management of zakat by BAZNAS Singkawang based on the principle of distributive justice in maqashid sharia  still faces obstacles and challenges in terms of equalizing the needs of mustahik so that comprehensive mapping is required in the distribution of zakat. Long term zakat management planning by prioritizing the maqashid sharia approach is also needed to create economic transformation and empowerment of mustahik.

Abstract

The fiqh principle of "ad-Dhararu yuzalu" (poverty must be removed), is one of the five main principles in ushul fikih that plays a central role in shaping welfare-oriented Islamic legal policies. This principle asserts that all forms of harm, hardship, and danger—both to the individual and to society—must be avoided or eliminated. Through the approach of syariah-evidence from the Qur’an and hadith, as well as an analysis of various derivative rules, this paper explains the forms of mudharat and the mechanisms of syariah in responding to them. Application examples from various fields such as ubudiyah, muamalah, and crime are presented to demonstrate the flexibility of this principle in daily life. This principle is also fundamental in granting rukhsah (legal relief) in emergency conditions, on the principle that an emergency cannot be overcome by another equal or greater emergency. Thus, the principle of “ad-Dhararu yuzalu” serves as an important guideline in responding to contemporary issues, while demonstrating the solutive and adaptive character of Islamic law to social dynamics.

Abstract

This study aims to examine the permissibility of charitable giving (ṣadaqah) in the context of political contests using the al-Umūr bimaqāṣidihā legal maxim approach. The phenomenon of political charity is often equated with money politics, sparking debate among scholars, government authorities, and the public. The discussion explores the concept of ṣadaqah in Islam and the role of intention (niyyah) as the foundation of legal rulings, based on al-Umūr bimaqāṣidihā and its derivative principles. This research employs a qualitative normative method through library research of classical and contemporary Islamic legal sources. The findings indicate that ṣadaqah during political contests is not inherently prohibited, but its legality depends heavily on the giver's intention. If the act is done sincerely for the sake of Allah’s pleasure, it is considered permissible. However, if it is meant to influence voters or gain political support, it is deemed unlawful. In conclusion, government regulations should not impose an absolute ban on political charity, but rather implement strict oversight to ensure that it aligns with sincerity and the principles of fair and honest elections

Abstract

Penelitian ini membahas relevansi perbedaan agama sebagai penghalang waris dalam hukum kewarisan Islam di Indonesia. Tujuan penelitian adalah menganalisis relevansi aturan tersebut, mengkaji penerapan konsep wasiat wajibah, dan memberikan rekomendasi pembaruan hukum. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis normatif, memanfaatkan kajian dokumen dan analisis literatur sebagai teknik pengumpulan data. Hasil penelitian menunjukkan bahwa meskipun perbedaan agama menjadi penghalang waris dalam Kompilasi Hukum Islam (KHI), penerapan wasiat wajibah telah menjadi solusi yang inklusif dan responsif terhadap pluralitas masyarakat Indonesia. Implikasi dari penelitian ini adalah pentingnya pembaruan regulasi untuk memperkuat keadilan substantif dan harmoni sosial, khususnya dalam konteks keluarga yang beragam secara agama. Rekomendasi mencakup revisi KHI, peningkatan kapasitas hakim, dan penguatan literasi hukum masyarakat.

Abstract

This study explores the permissibility and ethical considerations of contraceptive use, particularly sterilization methods like vasectomy and tubectomy, in Islamic law. The research focuses on how the Islamic legal principle al-ḍararu yuzāl (harm must be removed) applies to family planning practices, with an emphasis on temporary versus permanent contraceptive methods. It aims to offer a comprehensive understanding of how Islamic law addresses reproductive health while preserving marriage and family integrity. Using a qualitative, normative juridical approach, the study analyzes Islamic legal texts, including Qur'anic verses, Hadiths, and fatwas, in relation to contemporary contraceptive issues. A comparative analysis is employed to assess the views of Islamic scholars on contraceptive use, particularly on permanent methods like sterilization. The study also incorporates empirical data from fatwas, legal documents, and contemporary legal debates. The findings show that Islam allows the use of temporary contraceptives for birth regulation, especially for socio-economic reasons, such as ensuring adequate child care and education. However, permanent methods like sterilization are generally prohibited as they contradict the main purpose of marriage—procreation. Exceptions exist in cases of necessity, such as protecting maternal health or preventing hereditary diseases. The paper contributes to the field by offering a nuanced analysis of Islamic law regarding both temporary and permanent contraceptives, and it provides practical insights for policymakers and health professionals. The study suggests that Islamic law can offer a balanced approach to family planning, ensuring individual rights and societal welfare.
