Abstract

Permasalahan masalah dalam penulisan ini yakni apakah faktor penyebab dan bagaimana pertanggungjawaban tindak pidana pencurian dengan cara menggunakan kartu anjungan tunai mandiri (ATM) dalam Putusan Nomor: 556/PID.B/2022/PN.Tjk. Pendekatan yang dilakukan dalam penelitian ini adalah secara yuridis  normatif  dan empiris. Faktor penyebab terjadinya tindak pidana pencurian dengan menggunakan kartu ATM yang mengakibatkan kerugian bagi korban yang mencapai sebesar Rp. 8.550.000,- (delapan juta lima ratus lima puluh ribu rupiah) disebabkan oleh adanya kesempatan Terdakwa untuk melakukan tindak pidana pencurian. Hal tersebut dikarenakan saksi korban melakukan kelalaian dengan meninggalkan kartu ATM di dalam mobil tempat Terdakwa berada. Korban dan suami saksi korban telah memberikan kepercayaan kepada Terdakwa dimana pernah memberikan nomor Pin ATM tersebut kepada Terdakwa. Akibat sudah mengetahui nomor Pin ATM tersebut Terdakwa gelap mata melakukan penarikan uang yang berada di ATM tanpa seizin saksi korban. Hasil pencurian dengan menggunakan ATM tersebut Terdakwa gunakan untuk kebutuhan sehari-hari yang menyebabkan kerugian terhadap korban mencapai sebesar Rp.8.550.000,- (delapan juta lima ratus lima puluh ribu rupiah). Bentuk pertanggungjawaban pidana akibat perbuatan yang telah dilakukan oleh Terdakwa yang telah terbukti secara sah dan meyakinkan melakukan tindak pidana pencurian dengan menggunakan kartu ATM milik korban maka Majelis Hakim Pengadilan Negeri Tanjung Karang menjatuhkan hukuman pidana penjara kepada Terdakwa dimana perbuatan Terdakwa telah memenuhi unsur-unsur dalam Pasal 362 KUHP. Hal tersebut didasarkan pada fakta-fakta hukum yang didapat di dalam persidangan dan alat bukti yang dihadirkan saat persidangan. Dan selama proses persidangan Majelis Hakim tidak menemukan hal-hal yang dapat menghapuskan pertanggungjawaban pidana baik sebagai alasan pembenar dan atau alasan pemaaf maka Terdakwa harus mempertanggungjawabkan perbuatannya dengan pidana penjara selama 1 tahun 10 bulan.

Abstract

Salah satu jenis tindak pidana dalam kehidupan masyarakat adalah penguasaan dan kepemilikan senjata api secara ilegal adalah Pasal 1 Ayat (1) Undang-Undang Darurat Nomor 12 Tahun 1951. Contohnya adalah dalam Putusan Nomor: 102/Pid.Sus/2022/PN.Met, dengan terdakwa HK. Permasalahan penelitian ini adalah: (1) Apakah faktor penyebab pelaku melakukan tindak pidana tanpa hak membawa dan menguasai senjata api beserta amunisinya dalam Putusan Nomor: 102/Pid.Sus/2022/PN.Met (2) Bagaimana pertimbangan putusan hakim terhadap pelaku tindak pidana tanpa hak membawa dan menguasai senjata api beserta amunisinya dalam Putusan Nomor: 102/Pid.Sus/2022/PN.Met. Metode penelitian yang digunakan dalam penelitian ini ialah pendekatan yuridis normatif dan pendekatan empiris. Pengumpulan data dilakukan dengan studi kepustakaan dan studi lapangan. Data selanjutnya dianalisis secara kualitatif. Hasil penelitian ini menunjukkan: (1) Faktor penyebab terjadinya tindak pidana tanpa hak membawa dan menguasai senjata api beserta amunisinya dalam Putusan Nomor: 102/Pid.Sus/2022/PN.Met terdiri atas faktor internal dan eksternal. Faktor internal, yaitu pelaku dalam melakukan tindak pidana membawa dan menguasai senjata api beserta amunisinya bermaksud menjadikan senjata api tersebut sebagai alat untuk menjaga dirinya. Faktor eksternal, yaitu adanya pengaruh lingkungan pergaulan di sekitar tempat tinggal pelaku yang rawan tindakan kriminalitas dan adanya pihak-pihak yang memproduksi dan menjual senjata api secara ilegal kepada masyarakat. Pertimbangan putusan hakim terhadap pelaku tindak pidana tanpa hak membawa dan menguasai senjata api beserta amunisinya dalam Putusan Nomor: 102/Pid.Sus/2022/PN.Met adalah secara yuridis adalah perbuatan terdakwa terbukti secara sah dan meyakinkan melakukan tindak pidana sebagaimana didakwakan dalam dakwaan tunggal Jaksa Penuntut Umum. Secara filosofis Majelis hakim mempertimbangkan bahwa penjatuhan pidana selama 6 (enam) bulan sebagai bentuk pembinaan kepada pelaku. Secara sosiologis Majelis hakim mempertimbangkan bahwa adanya hal-hal yang meringankan dan memberatkan pidana terhadap terdakwa. Kata Kunci: Pertimbangan Hakim, Tindak Pidana, Senjata Api, Amunisi

Abstract

Dinamika geopolitik global telah mengalami perubahan signifikan dalam dekade terakhir, ditandai dengan meningkatnya kompleksitas ancaman bagi negara-negara di dunia. Pergeseran kekuatan dari unipolaritas menuju multipolaritas, dengan kekuatan besar seperti Amerika Serikat, Cina, dan Rusia yang bersaing untuk mendominasi sistem global, memicu tantangan baru. Dalam konteks Indonesia, bela negara memegang peranan strategis dalam mempertahankan kedaulatan dan integritas teritorial. Bela negara tidak hanya mencakup kemampuan pertahanan militer, tetapi juga keterlibatan masyarakat dalam memperkuat ketahanan nasional di beberapa bidang seperti politik, ekonomi, sosial, serta budaya. Strategi bela negara yang terintegrasi dengan filsafat ilmu pertahanan menjadi kunci untuk menghadapi ancaman internal dan eksternal. Filsafat strategi pertahanan menjadi hal yang penting untuk dipahami bagi para kader intelektual bela negara dalam situasi perkembangan geopolitik global saat ini, di mana ancaman yang ada tidak lagi hanya bersifat militer, namun juga acaman non-militer bahkan hibrida. Penelitian ini bertujuan untuk menjelaskan hubungan antara manajemen bela negara dan filsafat strategi pertahanan, serta memberikan rekomendasi bagi para pembuat kebijakan dalam merespons dinamika geopolitik global secara efektif dan berkelanjutan. Dengan pendekatan deskriptif dan analitis, artikel ini diharapkan dapat serta mampu memberikan kontribusi yang signifikan terhadap pengembangan teori dan praktik di bidang pertahanan nasional.

Abstract

The leadership of the Kiai in the midst of a society that is considered conservative-traditionalist does not even have capital, and is incapable of exercising its power and leadership, as well as bringing the community to progress amidst differences both in religion, culture and religious sects. This study aims to examine the modalities of kiai leadership in forming a ummatan washatan (moderate ummat). This research uses a qualitative approach with a type of phenomenological research by looking at and listening to closer and detailed individual explanations and understanding. The results of the study show that Kyai Abdul Qodir Syam and Kiai Junaidi have a wealth of modalities/capitals, which are used to fight in the arena or realm in Bondowoso Regency with the aim of creating a conducive and peaceful society. There are four modalities owned by the two kiai. First, Economic Modality. Second, Social Modality, socially, Third. Cultural Modality, this modality is the most powerful and affects the other modalities, the two clerics have cultural differences, Kiai Abdul Qodir Syam is of blue blood descent, while Kiai Junaidi Mu'thi is not, but the two clerics have total commitment, loyalty as well as noble, charismatic and authoritative morals in carrying out his da'wah. Fourth, Symbolic Modality, symbolically, he is both a kiai, caretaker, Rais Syuriyah and Tanfidziyah PCNU.

Abstract

The success of an organization, including the TNI in joint operations, is greatly influenced by various factors, one of which is Human Resources (HR). HR is the main driver in organizational dynamics, because the role and contribution of humans is very vital in achieving common goals. The quality of human resources, especially for combat pilots, is greatly influenced by educational background. With education at the D4 level and a fairly high class, combat pilots are expected to have comparable competence. However, variations in pilot education can result in different levels of competency. Therefore, consistent training and education standards are necessary to ensure that all pilots can operate effectively and efficiently in their duties. The research aims to discuss the influence of Competency on the Performance of TNI Combat Aviation Soldiers; the influence of training on the performance of TNI combat aviation soldiers; and the influence of Competency and Training together on the Performance of TNI Combat Aviation Soldiers. The research method uses quantitative, with the object studied being the influence of competency and training on soldier performance, with competency (X1) and training (X2) as independent variables, and soldier performance (Y) as the dependent variable. The research results show that there is a significant influence between Competency on Soldier Performance; There is a significant influence between Training on Soldier Performance and Competency and Training simultaneously has a significant influence on the Performance of TNI Combat Pilot Soldiers.

Abstract

This research aims to analyze the effect of implementing blended learning on increasing student literacy competence at Kulon City 1 Bondowoso State Elementary School. The research method used was quasi-experimental with a Pre-test-Post-test control group design. The research sample consisted of two groups: an experimental group that applied blended learning and a control group that used conventional learning methods, each consisting of 30 students. Data was collected through a literacy test and analyzed using descriptive statistics and the independent sample t-test. The results showed that there was a significant increase in students’ literacy scores in the experimental group compared to the control group (p < 0.05). The experimental group experienced an average increase in score of 20.34 points, while the control group only increased 6.66 points. The implementation of blended learning has proven effective in supporting the development of literacy skills, especially in the aspects of critical reading and argumentative writing. In addition, blended learning provides greater benefits for students with low initial abilities through a flexible and interactive learning approach. This research confirms that blended learning is an innovative solution in improving students’ literacy competencies in elementary schools. For program sustainability, strengthening technological infrastructure and teacher training is needed. Further studies are recommended to explore the long-term impact of blended learning as well as its application to various subjects.

Abstract

Leadership is a key element in the success of organizations, both in the public and private sectors. This article aims to comprehensively examine the definition, theories, and various types of leadership that have developed within the fields of management and organizational behavior. The discussion begins with a fundamental understanding of leadership as a process of influencing individuals or groups to achieve common goals. It then explores various leadership theories, including trait theory, behavioral theory, contingency theory, as well as transformational and transactional leadership. Each theory offers different approaches and focuses in explaining what makes a leader effective. The article also reviews several leadership types such as authoritarian, democratic, laissez-faire, charismatic, participative, and adaptive leadership—each with its own strengths and challenges depending on organizational context and member characteristics. This study is expected to serve as a reference for practitioners, academics, and policymakers in understanding the dynamics of effective leadership in the modern era.

Abstract

This article discusses the concept, boundaries, and paths of Islamic education as a fundamental framework in efforts to develop a complete Muslim individual. Islamic education is not only interpreted as a process of transferring knowledge, but also as character formation based on religious values. The concept of Islamic education includes efforts to foster faith, increase knowledge, and form noble morals. The boundaries of Islamic education include dimensions of space and time, starting from family, school, to society, and last a lifetime. Meanwhile, the path of Islamic education includes formal, non-formal, and informal paths that complement each other in achieving holistic educational goals. By understanding these three aspects, it is hoped that Islamic education will be able to answer the challenges of the times without losing its essence as a shaper of perfect human beings.

Abstract

This paper examines two main approaches to understanding religion, namely the textualist approach that emphasizes the literal meaning of religious texts, and the contextualist approach that considers the historical and social background in interpreting teachings. In addition, it also discusses the differences between an inclusive attitude, which is open to religious plurality and upholds interfaith dialogue, and an exclusive attitude that emphasizes a single truth and tends to reject outside views. This study aims to provide a comprehensive picture of the dynamics of religious understanding, as well as to encourage a more balanced, tolerant, and contributive approach in the life of a pluralistic society. An open and reflective understanding is expected to be the foundation for creating social harmony and harmony between religious communities. The main focus of this study is to understand how textual or contextual orientation influences a person's religious attitude, and how this understanding develops into inclusiveness or exclusivity in socio-religious life.

Abstract

This paper discusses communication and negotiation management in Islamic education within the context of a multicultural society. Amid Indonesia’s rich diversity of cultures, ethnicities, and religions, Islamic education faces the challenge of creating an inclusive, fair, and harmonious learning environment. Communication is not merely understood as the transmission of information but also as a medium for building cross-cultural understanding rooted in Islamic values such as ta’aruf (mutual recognition), tasamuh (tolerance), and tawazun (balance). Meanwhile, negotiation serves as a strategic instrument for resolving conflicts, fostering deliberation (musyawarah), and maintaining social justice in educational interactions. Through theoretical perspectives and implementation analysis, this paper highlights the importance of teacher training, the development of responsive educational policies, and the reinforcement of inclusive curricula. With effective communication and negotiation management, Islamic educational institutions are expected to become pioneers in nurturing a generation that is tolerant, dialogical, and appreciative of diversity as a national asset.
