Abstract

Penelitian ini bertujuan untuk mengetahui penemuan dan penalaran hukum dalam proses penyetaraan ijazah pendidikan luar negeri dengan pendidikan Sekolah Lanjutan Tingkat Atas (SLTA)/SMA atau sederajat sebagai salah satu syarat pencalonan dalam lembaga eksekutif menurut Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Persoalan muncul ketika calon peserta pemilu memiliki ijazah luar negeri yang belum atau tidak disetarakan oleh instansi berwenang di Indonesia, sehingga menimbulkan perbedaan penafsiran dalam penerapan syarat administratif pencalonan. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai syarat pendidikan bagi calon lembaga eksekutif serta menelaah bentuk penemuan dan penalaran hukum yang digunakan oleh hakim dalam menyelesaikan sengketa terkait kesetaraan ijazah luar negeri terhadap ketentuan Undang-Undang Pemilu. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pengaturan syarat pendidikan dalam Undang-Undang Pemilu masih bersifat umum dan memerlukan penafsiran terhadap ijazah luar negeri. Hakim dalam praktiknya menggunakan penemuan hukum melalui interpretasi sistematis dan argumentasi hukum berbasis asas keadilan serta kepastian hukum untuk menentukan kesetaraan ijazah luar negeri dengan pendidikan SLTA/SMA atau sederajat. Temuan ini menunjukkan pentingnya harmonisasi antara peraturan penyetaraan pendidikan dengan ketentuan hukum pemilu agar tidak terjadi ketidakpastian dalam proses pencalonan lembaga eksekutif. Kata kunci: Penemuan Hukum, Penalaran Hukum, Penyetaraan Ijazah.

Abstract

Banyak usaha kuliner di Indonesia berkembang menggunakan pola cabang non-waralaba yang hanya didasarkan pada kesepakatan sederhana antara pemilik dan mitra. Kondisi ini menimbulkan persoalan hukum terkait hak, kewajiban, dan kepastian hukum para pihak. Penelitian ini bertujuan menganalisis akibat hukum dari perjanjian kerja sama cabang non-waralaba serta merumuskan bentuk perlindungan hukum yang ideal. Metode yang digunakan ialah penelitian hukum normatif dengan pendekatan kualitatif melalui studi kepustakaan dan analisis kasus Bakso Hebat Mataram di Pekanbaru. Hasil penelitian menunjukkan bahwa perjanjian non-waralaba yang tidak komprehensif menimbulkan lemahnya perlindungan hukum dan potensi sengketa. Oleh karena itu, dibutuhkan kontrak tertulis yang memenuhi syarat sah perjanjian menurut Pasal 1320 KUHPerdata dengan memuat klausul pembagian hasil, penggunaan merek, standar operasional, dan penyelesaian sengketa.

Abstract

The use of standard clauses in an agreement is based on the needs that exist in society. The purpose of making a standard agreement at the Bank is to provide practicality to the parties so as to facilitate and save time in transactions. However, the absence of customer involvement in the preparation of the standard agreement puts the customer in a weak position. In this case the customer does not have the opportunity to negotiate it so that he only has the choice to accept or reject it. However, the standard agreement will only apply if the consumer is willing to obey and submit to any provisions prepared by the business actor.  The purpose of this research is to see the legal consequences of banks in the inclusion of standard clauses and the prudential principles of banks in the inclusion of standard clauses in the agreement. The method used in this thesis is normative juridical research, with data collection by library research and related laws and regulations. Based on the results of the research conducted, the form of agreement at the Bank is usually set in a standard form, based on the essence of the agreement, the parties involved have rights and obligations in creating the desired legal relationship. Standard clauses are allowed as long as the contents do not lead to an exoneration clause. In other words, the condition of exoneration is “a condition that specifically relieves the employer from responsibility for adverse consequences arising from the execution of the agreement. An agreement must be executed in good faith”. This means that in every agreement, basically all parties are free in determining the contents of the agreement, deciding with whom to make an agreement, but it must always be based on the principle of good faith, not violating laws and regulations, and not violating the interests of the community. This aims to achieve justice for the parties to the agreement so that there is no exploitation of the weak party.

Abstract

Halal certification has a strategic position in the food industry, including SheShallBake products, as it serves as a mechanism to protect consumers from ingredients that do not comply with Islamic law. How are the regulations for halal certification registration for SheShallBake products, and what are the responsibilities of business actors and the legal consequences for food products that do not have halal certification. This study uses a normative juridical approach to analyze positive legal provisions, as well as an empirical juridical approach through interviews with business owners to understand practices in the field. The findings show that halal certification provides safety guarantees for consumers through a comprehensive verification process and serves as a means of legal protection against potential violations. This research encourages increased awareness among business actors regarding the importance of halal certification and the need for more transparent and accountable regulations. Thus, the implementation of halal certification on SheShallBake products is expected to increase consumer confidence while strengthening the halal food industry sector in Indonesia.

Abstract

The determination of child custody rights after divorce is an important issue in family law in Indonesia because divorce can have an impact on the mental condition and growth and development of children. Therefore, clear regulations are needed to ensure that children's rights are protected. This study aims to analyze the determination of child custody after divorce based on the perspective of Indonesian civil law and the forms of legal protection provided to children. The research method used is normative juridical, examining relevant legislation, doctrine, and legal literature. The results of the study show that the determination of child custody is not only based on the biological relationship between parents and children, but also prioritizes the principle of the best interests of the child. These provisions are regulated in Law Number 1 of 1974 concerning Marriage, Law Number 23 of 2002 in conjunction with Law Number 35 of 2014 concerning Child Protection, and the Compilation of Islamic Law (KHI). Even in the event of divorce, both parents remain obligated to care for, educate, and provide for the child. Legal protection of children encompasses all activities to guarantee and protect children and their rights so that they can live, develop, and grow properly and receive protection from violence and discrimination. Child protection in the event of parental divorce is closely linked to the parents' authority, even if the marriage ends due to divorce initiated by both parents. Therefore, legal protection for children after divorce is not solely the responsibility of one parent, but rather of both parents, the father and mother of their children. The state also has a responsibility through the courts to provide legal certainty and guarantee the future of children so that they do not become victims of their parents' divorce.

Abstract

This study aims to analyze legal protection for companies experiencing boycott practices from the perspective of Indonesian economic law enforcement, particularly through Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition. The research employs a normative juridical method with a literature-based approach, utilizing statutory regulations, books, official documents, publications, and prior research findings as supporting materials. The results indicate that the mechanisms of the Business Competition Supervisory Commission (KPPU) are effective in protecting affected parties through investigations and binding decisions. However, challenges remain, including legal uncertainty arising from MUI Fatwa No. 83 of 2023 and the spillover effects of losses along supply chains, which necessitate normative synchronization. The conclusion emphasizes the need to balance consumer rights and economic efficiency, and recommends the establishment of boycott verification guidelines and the strengthening of enforcement mechanisms to ensure business certainty.
