Abstract

Solar energy has emerged as a promising renewable energy source with significant potential to address energy challenges in developing countries. This paper aims to explore the potential and implementation of solar energy in these regions, focusing on both the opportunities and challenges associated with its adoption. A qualitative approach is used, examining case studies and existing literature on solar energy deployment in developing countries. The findings highlight that while solar energy offers a cost-effective and sustainable solution, barriers such as high initial investment, lack of infrastructure, and limited technical knowledge still hinder widespread adoption. The paper emphasizes the importance of supportive government policies, international partnerships, and education to accelerate the implementation of solar energy technologies. The significance of this research lies in providing insights for policymakers and stakeholders to design effective strategies that promote the use of renewable energy in developing countries, ultimately contributing to sustainable development.

Abstract

Effective Financial Self-Efficacy (EFSE) and Digital Financial Inclusion (DFI) significantly impact financial behavior, particularly among younger generations like Generation Z, who are increasingly familiar with digital financial services. This research seeks to examine the impact of EFSE on financial behavior (FB) using DFI within Generation Z in Medan City. A quantitative methodology was employed to gather data via an online survey of 147 Generation Z respondents who regularly utilize digital financial platforms, including digital wallets, mobile banking, and fintech loans. The Partial Least Squares–Structural Equation Modeling (PLS-SEM) method was used to examine the relationship between the proposed variables and analyze the data. The findings indicate that EFSE exerts a positive and significant impact on FB, with DFI serving as a mediator that enhances the influence of EFSE on financial behavior. These results indicate that Generation Z individuals with elevated financial self-efficacy are more judicious in their financial decision-making, particularly when facilitated by access to digital financial services. This study enhances the behavioral finance literature by emphasizing the essential roles of EFSE and DFI in cultivating sound financial practices among youth in the digital era. The findings indicate the necessity to create extensive digital and financial literacy initiatives to enhance self-efficacy and the use of digital financial services within Generation Z

Abstract

Legal politics constitutes the fundamental state policy that determines the direction, substance, and implementation of law in order to achieve national objectives. In the Indonesian constitutional system, the 1945 Constitution of the Republic of Indonesia serves as the supreme legal foundation guiding the formulation and development of national legal politics. This study examines legal politics from the perspective of the 1945 Constitution and analyzes its implications for the formation of national law. Employing a normative legal research method, this study applies statutory, conceptual, and historical approaches by analyzing constitutional provisions, legislation, legal doctrines, and scholarly opinions. The findings reveal that the 1945 Constitution provides normative guidance and clear limitations for national legal politics, particularly in upholding the principles of the rule of law, democracy, constitutional supremacy, and the protection of human rights. The Constitution not only functions as the highest legal norm but also as a philosophical and juridical framework that directs legal policy toward achieving justice, legal certainty, and social welfare. Furthermore, legal politics grounded in constitutional values significantly influences the substance of legislation, the legislative process, and mechanisms of constitutional review. A constitutional-oriented legal politics ensures that laws are formulated in a democratic, participatory, and accountable manner while remaining consistent with the objectives of the state as stipulated in the Preamble of the 1945 Constitution. Therefore, strengthening constitutional compliance in legal politics is essential to develop a just, responsive, and socially equitable national legal system in Indonesia.

Abstract

Abstract Fiduciary guarantee agreements are a legal instrument widely used in financing practices in Indonesia to provide legal certainty and protection for parties, particularly creditors and debtors. Fiduciary guarantees are regulated by Law Number 42 of 1999 concerning Fiduciary Guarantees, which grants preferential rights and executorial powers to creditors. However, in practice, the execution of fiduciary guarantees often raises issues, particularly related to unilateral actions by creditors that could potentially harm the debtor. This study aims to analyze the forms of legal protection for creditors and debtors in fiduciary guarantee agreements and examine the implications of legal changes following Constitutional Court Decision Number 18/PUU-XVII/2019. The research method used is normative legal research with a statutory, conceptual, and case-based approach, utilizing primary and secondary legal materials. The results indicate that legal protection for creditors lies in the preferential rights and executorial powers of the fiduciary guarantee certificate, while protection for debtors is realized in the right to use the collateral and protection from arbitrary actions. The Constitutional Court's ruling has transformed the fiduciary guarantee enforcement mechanism by emphasizing the importance of default agreements and voluntary surrender of the collateral, thus creating a balance of legal protection between creditors and debtors. Thus, it can be concluded that legal protection under fiduciary guarantee agreements has evolved towards fairer outcomes, although regulatory refinements and increased public legal understanding are still needed for effective implementation. Keywords: legal protection, fiduciary guarantee, creditors, debtors, guarantee enforcement.
