Abstract

This study aims to examine the legality of using QR-Codes as a validation mechanism and a substitute for signatures on copies of notarial deeds within the Indonesian legal system and to formulate directions for regulatory reform. The research is motivated by the increasing risk of forgery of notarial deed copies and the limitations of the Notary Law (UUJN), which has not explicitly accommodated electronic authentication mechanisms, despite the recognition of electronic signatures under the Electronic Information and Transactions Law (UU ITE). This research employs a normative juridical method using statutory, conceptual, comparative, and philosophical-progressive approaches. The findings indicate that under the current legal framework (lex lata), QR-Codes cannot yet be fully recognized as a substitute for notarial signatures on deed copies. However, normatively and conceptually, QR-Codes possess strong potential to be legalized as an electronic authentication mechanism, provided that they are synchronized with the UU ITE and supported by an official state verification system. The novelty of this study lies in proposing a normative synchronization model between the UUJN and the UU ITE that positions QR-Codes as a form of electronic validation, as well as in formulating a regulatory blueprint for QR-Code-based verification of notarial deed copies integrated with the AHU Online system. This study recommends regulatory reform in notarial law to enhance legal certainty, prevent document forgery, and improve efficiency and public trust in notarial practices in the digital era.   Penelitian ini bertujuan menganalisis legalitas penggunaan QR-Code sebagai validasi dan pengganti tanda tangan pada salinan akta notaris dalam sistem hukum Indonesia serta merumuskan arah pembaruan pengaturannya. Penelitian ini dilatarbelakangi oleh meningkatnya risiko pemalsuan salinan akta notaris dan keterbatasan Undang-Undang Jabatan Notaris (UUJN) yang belum secara eksplisit mengakomodasi mekanisme autentikasi elektronik, meskipun Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) telah mengakui keabsahan tanda tangan elektronik. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, komparatif, dan filosofis-progresif. Hasil penelitian menunjukkan bahwa secara hukum positif (lex lata), QR-Code belum dapat diposisikan sepenuhnya sebagai pengganti tanda tangan notaris pada salinan akta, namun secara normatif dan konseptual memiliki potensi kuat untuk dilegalkan sebagai mekanisme autentikasi elektronik sepanjang disinkronkan dengan ketentuan UU ITE dan didukung oleh sistem verifikasi resmi negara. Kebaruan penelitian ini terletak pada perumusan model sinkronisasi norma antara UUJN dan UU ITE yang menempatkan QR-Code sebagai instrumen validasi elektronik, serta penyusunan blueprint regulasi verifikasi salinan akta notaris berbasis QR-Code yang terintegrasi dengan sistem AHU Online. Penelitian ini merekomendasikan pembaruan regulasi kenotariatan guna memperkuat kepastian hukum, mencegah pemalsuan dokumen, dan meningkatkan efisiensi serta kepercayaan publik terhadap praktik kenotariatan di era digital.

Abstract

The increasing use of forged documents in the establishment of a Limited Liability Company raises significant concerns regarding the legal liability of directors and the vulnerable position of notaries. This study aims to analyze the legal responsibility of directors for forging signatures in supporting documents for the deed of establishment and to examine the scope of legal protection afforded to notaries. This research employs a normative legal method, utilizing statutory and case-based approaches. The findings reveal that directors may incur both criminal and civil liability for fulfilling the elements of forgery and breaching their fiduciary duties, whereas notaries who act in good faith and exercise due diligence are entitled to legal protection. In conclusion, there is a need to clarify the boundaries of liability and to strengthen verification mechanisms in order to ensure legal certainty and justice.

Abstract

In a limited liability company, the General Meeting of Shareholders serves as the highest corporate organ authorized to determine strategic matters, including the transfer of shares. This study examines the legality of share transfer conducted without fulfilling the quorum requirements, as reflected in Surabaya District Court Decision No. 7/Pid.B/2020/PN.Sby in conjunction with Surabaya High Court Decision No. 1476/Pid/2020/PT.Sby. This research employed a normative juridical method with qualitative analysis based on statutory and case approaches. The findings indicate that such transfer is legally defective unless justified through the Circular Resolution of Shareholders mechanism. Notaries play a crucial role in ensuring legal certainty and the validity of the transaction.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh substitusi ransum komersial dengan tepung keong mas (TKM) terhadap performa puyuh periode grower yang meliputi konsumsi ransum, pertambahan bobot badan dan konversi ransum. Penelitian ini dilaksanakan pada bulan Mei 2017 di UIN Agricultural Research and Development Station (UARDS), Fakultas Pertanian dan Peternakan UIN Suska Riau. Penelitian ini menggunakan rancangan acak lengkap (RAL) dengan menggunakaan 4 perlakuan yaitu: T0= Ransum komersial, T1= 5% TKM + 95% ransum komersial, T2= 10% TKM + 90% ransum komersial dan T3= 15% TKM + 85% ransum komersial. Hewan percobaan yang digunakan adalah puyuh petelur umur 14 sampai 42 hari yang dipelihara dalam 16 petak kandang dan tiap kandang terdiri dari 4 ekor puyuh. Hasil penelitian menunjukkan bahwa substitusi TKM sampai level 15% tidak berpengaruh terhadap konsumsi, pertambahan bobot badan dan konversi ransum. Kesimpulan dari penelitian ini adalah substitusi ransum komersial dengan TKM sampai level 15% dapat diaplikasikan di dalam dalam ransum puyuh periode grower. Abstract

Sanctions against notaries suspected of violating the code of ethics or violation of the exercise of office are carried out through tiered examination stages by the Supervisory Board in accordance with the organizational structure of notary supervision. The procedure starts from the regional Supervisory Council (MPD) which forms an examination team to trace reports or complaints against notaries. After the examination, the MPD prepares the minutes of the examination and provides recommendations for sanctions, which are then submitted to the regional Supervisory Council (MPW). MPW conducts a follow-up hearing and, if sufficient evidence is found, can impose light sanctions such as a written reprimand or moderate sanctions in the form of temporary dismissal for three months. The nature or type of research used in this study is normative research, which aims to examine the principles of legality, justice, and legal certainty using legislation, positive legal norms, and professional ethics, while the nature of the research used in this study is descriptive. Descriptive research is intended to describe data as accurately as possible about humans, conditions, or other phenomena.  The functions and responsibilities of the regional Supervisory Council (MPW) in monitoring and coaching notaries have not been running optimally. In practice, MPW tends to focus only on repressive aspects in the form of sanctions without being balanced by coaching and education. MPW is also less ensure the fulfillment of the right of notaries to defend themselves, so the role of supervision does not provide a balanced protection between the public interest and the rights of the profession. Weaknesses in the coordination and implementation of supervisory procedures have an impact on the declining effectiveness of the notary supervision system at the regional level.

Abstract

Perkembangan teknologi informasi telah mendorong transformasi berbagai sektor, termasuk bidang kenotariatan, menuju digitalisasi layanan hukum. Salah satu inovasi yang muncul adalah konsep Cyber Notary, yakni pemanfaatan teknologi digital dalam proses pembuatan akta notaris tanpa kehadiran fisik penghadap. Permasalahan utamanya adalah ketidakhadiran fisik penghadap dalam proses pembuatan akta yang berpotensi bertentangan dengan prinsip formalitas kehadiran sebagaimana diatur dalam Undang-Undang Jabatan Notaris (UUJN). Penelitian ini menempati posisi penting dalam wacana pembaruan hukum kenotariatan, terutama dalam merespons kebutuhan masyarakat akan layanan hukum berbasis teknologi. Pertanyaan utama yang dibahas adalah: bagaimana permasalahan hukum terkait ketidakhadiran fisik penghadap dalam pembuatan akta notaris melalui Cyber Notary, dan bagaimana Teori Hukum Pembangunan dapat mengakomodasi hal tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa belum terdapat regulasi yang jelas dan komprehensif mengenai pelaksanaan Cyber Notary, sehingga menimbulkan ketidakpastian hukum. Namun, melalui pendekatan Teori Hukum Pembangunan, konsep ini dapat diterima sepanjang hukum mampu beradaptasi dengan perubahan sosial, melalui pembaruan regulasi, kesiapan infrastruktur digital, dan perlindungan hukum yang menyeluruh.
