Abstract

Economic transactions, such as buying and selling goods or services, often place consumers at a disadvantage due to an unequal position compared to business actors. An example is the FIT HUB membership agreement, which contains an exoneration clause. This study examines the form and content of such clauses under Law No. 8 of 1999 and the legal protection available to consumers. Using normative legal research based on secondary data, the study result and concludes that while the FIT HUB membership agreement does not violate Article 18 paragraph (2) of the Consumer Protection Law—since it is easy for consumers to read—it is invalid under the Civil Code. The agreement fails to meet the objective requirements of Articles 1320, 1337, and 1338. Article 18 paragraph (1) of the Consumer Protection Law prohibits exoneration clauses, with legal consequences being that such clauses are null and void, as stipulated in Article 18 paragraph (3). Legal protection for consumers can be preventive, through sectoral regulations and the Consumer Protection Law, or repressive, through civil and criminal sanctions.

Abstract

The global economy requires Indonesia to grow as a force in the new economy. This is expected to support national development and create a competitive market situation among them. This condition causes competition, can run in a healthy and unhealthy way.  One of the activities that can cause unfair business competition is the process of procurement of goods and/or services, known as tenders. In fact, many business actors run tenders with bad intentions, which is called tender conspiracy. Using normative legal methods by collecting library materials from primary, secondary and tertiary materials to produce descriptive data, then ending with a conclusion using the concept of agreement based on the Civil Code that conspiracy is a prohibited agreement. . In determining the winner of the tender, what is considered to be a violation of Article 22 is vertical conspiracy because it results in unhealthy business competition. This shows that there must be updates in the provisions regarding business competition, especially provisions regarding bid rigging, and tender selection must be carried out through appropriate and accurate procedures. For example, the selection of the tender committee must be qualified, have integrity and be honest in carrying out the tender. Settlement in cases of conspiracy to determine tender winners can be implemented using a per se illegal approach carried out by the KPPU to assess business activities that violate the provisions of Law Number 5/1999

Abstract

Competition law has rapidly evolved alongside the dynamics of trade conducted by businesses. One notable development in Indonesia is the understanding of the Single Economic Entity (SEE) doctrine. This doctrine is often opposed by corporate law regimes that uphold the independence of companies. Therefore, it is crucial to examine how companies can be considered a single economic entity and how regulations differ between Indonesia and the European Union. This study employs a normative approach, using descriptive legal comparison with secondary data such as literature, regulations, and competition authority decisions from both regions. Data is analyzed qualitatively with deductive conclusions. The findings indicate that a group of companies is considered a single entity if its strategic policies are controlled by the holding company. There are both similarities and differences between Indonesia and the EU in their approach to this doctrine. The similarity is that both implicitly regulate SEE, while the difference lies in its application: in Indonesia, it was first applied in the Temasek Holding case in 2007, while the EU used it in the 1972 Deystuff case. To reduce misinterpretations, clearer explanations for business actors are necessary to prevent violations by business groups.

Abstract

Indonesia is the largest archipelago, which makes the port an essential means for mobilizing the infrastructure that supports the country's economic growth. The port sector, which is operated by state-owned enterprises, has the potential to maximize economic growth. However, in reality, there have been numerous instances of state-owned companies operating in the port sector violating business competition laws. It is thus imperative to comprehend the doctrine of essential facilities and the potential transgressions perpetrated by business actors who are state-owned enterprises. This research adheres to a descriptive normative methodology, utilizing secondary data. The findings indicate that the doctrine of essential facilities espouses the notion that essential facilities are crucial facilities that the state must facilitate and nurture to enable optimal economic activities benefiting the community. Essential facilities are established by state-owned enterprises (SOEs) as a means of implementing Article 33 of the 1945 Constitution of the Republic of Indonesia. In their operations within the port sector, SOEs are required to adhere to the standards set forth in Law Number 17 of 2008 concerning shipping. SOEs as business actors in carrying out their business activities must also pay attention to the principles and norms contained in Law Number 5 of 1999, especially the prohibition of monopolistic practices and market control so as to create healthy business competition.

Abstract

Advances in financial technology bring convenience and efficiency in electronic payment systems, one of which is the electronic wallet that is popular among people today. Electronic wallets are storage of payment instruments using cards or electronic money, holding funds and making payments. Behind the convenience of using electronic wallets, there are also frequent security problems, namely balance breaches, hacking of information data and illegal access to electronic wallet accounts in an application so that a comparison of electronic wallet security system arrangements in Indonesia and Singapore is carried out. The research was conducted normatively in the form of comparative law using secondary data sources, descriptive research nature, data analysis with qualitative methods, and deductive inference. In Indonesia, the regulation of electronic wallet security systems in several regulations and in Singapore is regulated in the Payment Service Act 2019 and its statutory guidelines. The results showed that there are 4 similarities and 6 differences in electronic wallet security arrangements seen from the aspects of licensing, cybersecurity, auditing, personal data protection, risk management, information system security, access control and anti-money laundering. With the similarities and differences in the arrangements, Indonesia can adopt the arrangements from Singapore to develop regulations for electronic wallet security systems to overcome growing technological crime.

Abstract

Discriminatory practices are standard in business competition and are not prohibited as long as they do not cause unfair competition. This paper will discuss three Business Competition Supervisory Commission (KPPU) decisions in 2020 related to alleged discriminatory practices committed by business actors. The subject matter in this paper is how the actions of business actors can fulfil the elements of violation and how the application of the rule of reason approach in Article 19 letter d of the Competition Law (1999) in the 2020 KPPU Decisions. This research is descriptive normative research. The data used in the book, articles, the new paper analyzed the Competition Law (1999), the Airlanes law (2009), the Electronic Information and Transactions Law (2008, amendments 2016 & 2024), and the Hajj and Umarah Law (2019), as well as interview an expert and KPPU. The interesting findings found that acts of discrimination cause obstacles in vertical business relations in different but interrelated relevant markets and often occur in the essential facilities sector. By using the rule of reason approach, KPPU found that discriminatory practices will be more effective if the business actor is in a dominant position or even occupies a monopoly position. Then, the three decisions in this discussion are equally suspected of violating Article 19 letter d on discriminatory practices. Then, related to the relevant market, the three cases have different markets, and also all three have vertical relationships with other business actors.

Abstract

The labeling of processed food and medicines is needed as an effort to fulfill consumers' rights related with correct, clear and honest information in accordance with Article 4 of Law No. 8/1999 concerning Consumer Protection (UUPK). However, in practice it is not easy for Micro Small and Medium Enterprise (MSME) business actors to fulfill production requirements considering the level of understanding and the cost of labeling. Therefore, it is necessary to know the form of consumer protection for processed food and medicines, especially for MSME business actors in the novice business community; and increasing the literacy culture among the community regarding processed food and medicine labels, particularly in Kebon Jeruk area, West Jakarta. Implementation of Community Service activities is carried out online through zoom meeting using counseling techniques. This theme is intended to provide education to novice MSME businessmen so that manufacturers of processed food and medicines carry out their obligations in accordance with regulatory provisions and policies of the relevant authorities. The target subject of this activity is carried out in the Kebon Jeruk area, West Jakarta, by involving the head partner of the local MSME entrepreneur association which is generally engaged in the processed food business. Counseling participants were so enthusiastic about the theme given considering that this information had never been conveyed to business actors or the public. Disseminating information on labeling obligations on food products is the duty and function of the food authority and all stakeholders in consumer protection. It requires the involvement of all parties, including the government, business actors, and observers of consumer protection to increase further understanding regarding clear, correct and honest labeling. In this way, it is hoped that it can improve the community's literacy culture towards achieving the consumer empowerment index at a more critical level.Pelabelan pangan olahan dan obat-obatan diperlukan sebagai upaya pemenuhan hak konsumen atas informasi yang benar, jelas, dan jujur sesuai Pasal 4 UU No. 8/1999 tentang Perlindungan Konsumen (UUPK). Namun pada praktiknya tidak mudah bagi pelaku usaha UMKM untuk memenuhi persyaratan produksi mengingat tingkat pemahaman dan biaya pencantuman label. Karenanya perlu diketahui bentuk perlindungan konsumen pangan olahan dan obat-obatan khususnya bagi pelaku usaha UMKM pada komunitas pebisnis pemula; dan peningkatan budaya lliterasi bagi masyarakat terkait label pangan olahan dan obat-obatan khususnya di wilayah Kebon Jeruk Jakarta Barat. Pelaksanaan kegiatan Pengabdian kepada Masyarakat dilakukan secara daring melalui media zoom meeting dengan menggunakan teknik penyuluhan. Tema ini dimaksud untuk memberikan edukasi kepada pebisnis pemula UMKM agar produsen pangan olahan dan obat-obatan melaksanakan kewajibannya sesuai ketentuan regulasi dan kebijakan otoritas terkait. Sasaran subyek kegiatan ini dilaksanakan di daerah Kebon Jeruk Jakarta Barat dengan melibatkan mitra ketua asosiasi pengusaha UMKM setempat yang pada umumnya bergerak di bisnis pangan olahan. Peserta penyuluhan sangat antusias dengan tema yang diberikan mengingat informasi tentang hal ini belum pernah disampaikan kepada pelaku usaha maupun masyarakat. Penyebarluasan informasi kewajiban pelabelan pada produk pangan merupakan tugas dan fungsi otoritas pangan dan semua pihak pemangku kepentingan perlindungan konsumen. Perlu keterlibatan semua pihak, baik pemerintah, pelaku usaha, dan pemerhati perlindungan konsumen untuk meningkatkan pemahaman lebih jauh terkait pelabelan yang jelas, benar dan jujur. Dengan demikian diharapkan dapat meningkatkan budaya literasi masyarakat menuju pencapaian indeks keberdayaan konsumen ke tingkat lebih kritis.

Abstract

Indonesian people often rely on public transportation, including people with disabilities, who frequently encounter obstacles in accessing Transjakarta bus transportation.  Several Transjakarta bus stops have no ramps, wheelchair lanes, or guide lanes. The Identification problem is analyzes the suitability of public service accessibility facilities, as outlined in DKI PERDA and Law No. 8 of 2016, and their consequences. This research employed the Normative Law research method, which is descriptive and then the data were analyzed qualitatively to facilitate deductive conclusions. It is result and concluded that the accessibility of public services provided by Transjakarta is unable to regulations and policies. This is shown by the inadequate facilities available for people with disabilities and the legal consequences for Transjakarta that does not provide special facilities for passengers with disabilities can result in sanctions by applicable laws and regulations, most of the sanctions are in the form of administrative sanctions such as written warnings, administrative fines, license suspension, and license revocation, and provide compensation for losses experienced. The author suggests that Transjakarta pay attention to facilities, laws, regulations, and local governments to ensure the APBD budget for the development of accessibility services for passengers with disabilities.

Abstract

Personal data theft is a form of cybercrime that is rampant in Indonesia, especially with the main target of the e-commerce sector. The identification of this research problem, namely: how is the legal protection of Shopee consumers' personal data based on Law No. 8 of 1999 concerning Consumer Protection (UUPK) and how is the responsibility of business actors in the event of a Shopee consumer data leak according to the provisions of the UUPK. This research uses normative juridical methods, descriptive in nature, data collected through literature studies and interviews, analysed qualitatively, and deductive conclusions. The results showed that the GCPL guarantees consumers' rights to obtain comfort, security, and safety in utilising the services offered by business actors. This is reinforced by Minister of Communication and Informatics Regulation No. 20/2016 on the Protection of Personal Data in Electronic Systems which gives consumers the right to file reports and demands to the competent authority in the event of a violation of personal data. The author recommends that the Ministry of Communication and Digital (Komdigi) take concrete steps in the form of temporary suspension of transaction activities on platforms proven to violate personal data protection.

Abstract

The phenomenon of high demand for music concert tickets in Indonesia raises various challenges, including problems in the electronic ticket sales system. The Coldplay concert in Jakarta in 2023 faced various consumer complaints related to ticket duplication, audience mobility issues, and security. The writing of this article aims the problem to examine the responsibilities of Coldplay concert promoters based on Law Number 8 of 1999 on Consumer Protection and Jakarta Governor’s Regulation No. 18 of 2019. The writing of this article uses a normative juridical method with a legislative and case study approach. The results of the discussion and the conclusion of this article suggest that violations of consumer rights occur as a result of promoters’ negligence in meeting consumer protection standards, giving rise to claims for damages. Recovery of consumer rights can be done through both litigation and non-litigation mechanisms. Therefore, there is a need for strengthening regulation and strict supervision in the entertainment industry to guarantee legal certainty for consumers.
