Abstract

This study aims to examine and analyze related to the settlement of crimes of sexual violence against children based on positive law in Indonesia and Balinese customary law. This study uses normative legal research methods with factual approaches, statutory approaches, case approaches, and legal concept analysis approaches. The results of this study explain that arrangements related to sexual violence against children are regulated in Article 81 and Article 82 of the UUPA, regarding their settlement according to the criminal justice system according to the provisions of the Criminal Procedure Code. As well as the settlement of criminal acts of sexual violence against children in Balinese customary law is translated into two approaches to justice, namely criminal sanctions with a retributive approach or criminal sanctions with a restorative approach. And if the settlement is through a restorative approach, the rights of the victim need attention because the victim is an interested party who should have a (legal) position in the settlement process. However, in the criminal justice system in general, it is suspected that victims do not receive equal protection from the authorities in the criminal justice system, so that the true interests of victims are often neglected and even if they do exist, they are only fulfilling the criminal justice administration or management system.

Abstract

Abstract. The location of Indonesia which is between two continents and two oceans makes Indonesia vulnerable to criminal acts in the field of fisheries. This study aims to investigate the authority of state agencies in the investigation stage of illegal fishing crimes in Indonesian territorial waters. Research approach used in this study is through a normative juridical approach or the study of literature and documents aimed at written regulations or other legal materials related to the guarantee of legal certainty for the investigation of illegal fishing crimes in Indonesia. The results showed that for the handling of these criminal acts, legal politics in the formulation of Law No. 31 of 2004 concerning Fisheries stipulates that investigations into fisheries crimes are carried out by Civil Servants of Fisheries Investigators, Investigating Officers of the Indonesian Navy, and Indonesian National Police. The law does not provide strict limitations on the investigative powers of these three agencies, even with Law No. 45 of 2009 as an amendment to Law No. 31 of 2004 also does not clearly regulate the limits of the investigative authority of the three agencies. Therefore, in its implementation there may be overlap of authority. Therefore, it is necessary to harmonize law enforcement in the investigation stage. Letak Indonesia yang berada di antara dua benua dan dua samudera menjadikan Indonesia rentan terhadap tindak pidana di bidang perikanan. Penelitian ini bertujuan untuk mengetahui kewenangan lembaga negara dalam tahap penyidikan tindak pidana illegal fishing di wilayah perairan Indonesia. Pendekatan penelitian yang digunakan dalam penelitian ini adalah melalui pendekatan yuridis normatif atau studi literatur dan dokumen yang ditujukan pada peraturan tertulis atau bahan hukum lainnya terkait dengan jaminan kepastian hukum dalam penyidikan tindak pidana illegal fishing di Indonesia. Hasil penelitian menunjukkan bahwa untuk penanganan tindak pidana tersebut, politik hukum dalam rumusan Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan mengatur bahwa penyidikan tindak pidana perikanan dilakukan oleh Penyidik Pegawai Negeri Sipil, Penyidik TNI Angkatan Laut, dan Penyidik Perikanan. Kepolisian Negara Republik Indonesia. Undang-undang tidak memberikan batasan tegas mengenai kewenangan penyidikan ketiga lembaga tersebut, bahkan dengan adanya Undang-Undang Nomor 45 Tahun 2009 sebagai perubahan atas UU Nomor 31 Tahun 2004 juga tidak mengatur secara jelas batasan kewenangan penyidikan ketiga lembaga tersebut. Oleh karena itu, dalam pelaksanaannya mungkin terjadi tumpang tindih kewenangan. Oleh karena itu, perlu adanya harmonisasi penegakan hukum pada tahap penyidikan. Abstract

Although alternative method exists as stipulated in Article 3 paragraph (1) and Article 4 paragraph (3) of the Industrial Relations Dispute Settlement Law, in fact, the dispute resolution in Indonesia’s industrial relation has been focusing on litigation mechanisms. However, litigation is not the best way to fulfill both disputing parties’ desire for justice as the output is win-lose. As such, alternative method exists, puts forward the ‘win-win’ solution. Nonetheless, the current legal framework only sets the clear rule of the aforementioned alternative method to be conducted in person, despite the global pandemic Covid-19. Accordingly, ODR is established to enable virtual procurement. This article will analyze the conception and benefits of online dispute resolution, its implementation gaps in the context of industrial relations dispute resolution, and its regulatory formulation to gain legitimacy in Indonesian law. Applying normative legal research, this article uses statutory, conceptual and comparative approaches. From the research conducted, it is indicated that online dispute resolution is technically superior as it is simple, fast, and low in cost. Even under the Industrial Relations Dispute Settlement Law, its application is feasible, specifically through mediation and conciliation. In Indonesia, implementation of online dispute resolution is possible by amending the Industrial Relations Dispute Settlement Law, considering the prioritization of alternative dispute resolution based on practices in Cambodia, Spain, and ILO Guidelines, as well as the superiority of online dispute resolution based on practices in the United States and UNCITRAL Technical Notes.

Abstract

The COVID-19 pandemic had a significant impact on various countries, including Indonesia, in particular on the securing of the state budget and state financial stability in anticipation of the systemic and comprehensive impact of the pandemic. This deviation is not in line with the Indonesian constitution, welfare state principles, and even regulations based on the principles of good legislation. This article will examine three aspects of the problem: firstly, the formation of Government Regulation Number 1 of 2020 (Perppu) concerning State Financial Policy and Stability under COVID-19 countermeasures by the formation mechanism; secondly, the constitutionality issue in the drafting of Perppu; and thirdly, the legal issue of Article 27 on the immunity of officials who carry out financial policies. This paper employs a combination of normative legal research methods, including a statutory approach, a legal conceptual approach, a legal fact approach, and a relevant case law approach. The result of the research is  that Perppu is a policy in an emergency period that contains a policy of relaxation of the implementation of the APBN is constitutional. The form of deviation that appears from Perppu is that this Perppu implements financial relaxation or sets state financial policies without involving the DPR. This has been constitutionally confirmed by Article 12 of the 1945 Constitution that the government and the DPR must determine state financial policies together. Although the constitutionality of Perppu in terms of fiscal policy is not in question, the provisions of Article 27 of Perppu that are unconstitutional can be cancelled by the Constitutional Court. The legality of Perppu relating to immunity must be implemented by prioritising the principle of good faith in carrying out the duties and functions of each state financial stakeholder during the emergency period.

Abstract

In recent years, the blocking of internet sites with harmful content or those deemed to be (illegal content) has increased. The policy of blocking dangerous sites has pros and cons regarding freedom of expression. Blocking is considered to be carried out to control citizens' expression, which can impact all areas, especially freedom of opinion, which can be seen as a threat to certain parties. This research aims to compare criminalization policies for blocking dangerous content in electronic communications networks in the Netherlands, the United States, and Singapore and provide thoughts on law enforcement models for blocking dangerous content in more democratic electronic communication networks. This is normative legal research using a law and case approach and comparing several countries. The conceptual approach is directed at the concept of a democratic state and the protection of human rights to formulate relevant policy models. The results of blocking studies in the Netherlands, The USA, and Singapore already have regulations and policy directions for blocking dangerous content, or at least rules regarding law enforcement for cybercrime. The difference is in the level of sensitivity to the specifications of existing problems. The policy model for blocking dangerous content with special regulations outside the Criminal Code must be carried out in a non-repressive manner so that it does not violate the ultimum remedium principle and becomes over-criminalized. The formulation of policy model of all crime prevention plans using the criminal law system, which pays attention to the problem of formulating criminal acts (criminalization), criminal responsibility, and criminal regulations and punishment.

Abstract

Loans or credit are a commonly used financing model for new and existing businesses. The amount of credit granted is determined by the collateralized assets. However, problems often arise when the property used as collateral turns out to be valued below expectations. This occurs because property buyers become victims of price markup crimes. This study focuses on defining the boundaries of this crime in cases of price markup and the legal protections that can be provided to victims of property price markup. Consequently, the general public can avoid the risks of falling victim to such fraudulent schemes. This study delves into the intricacies of price markup crimes, aiming to delineate clear boundaries and legal protections for victims. By shedding light on these issues, we aim to empower the general public with knowledge to recognize and mitigate the risks associated with fraudulent schemes. Through a comprehensive understanding of the legal framework surrounding property price markups, individuals can make informed decisions and safeguard themselves against potential exploitation in property transactions. Ultimately, this research endeavors to foster transparency and accountability in the property market, fostering a fair and equitable environment for all stakeholders involved

Abstract

Bali's tourism plays a crucial role in Indonesia's economy but has negative environmental and socio-cultural impacts due to rapid growth. Law No. 15 of 2023 marks a significant step toward sustainable tourism governance by regulating natural, cultural, and social resource management. This study uses a qualitative descriptive approach, with literature reviews and interviews with policymakers, industry players, and local communities, to explore the strategy for transforming Bali's tourism governance under this law. Results show that the law strengthens community participation and conservation, yet challenges remain in implementation and the need for better collaboration among stakeholders. The study highlights the importance of consistent regulation and collaboration in achieving sustainable tourism in Bali.

Abstract

Indonesia’s energy sector continues to face persistent challenges in the context of rapid economic growth, increasing energy demand, and mounting environmental concerns. Despite the constitutional mandate requiring the state to ensure equitable access to energy and sustainability, existing regulatory frameworks frequently fall short of achieving these objectives. This research aims to examine the legal and policy frameworks governing the energy sector in Indonesia, where energy serves as a critical component of economic development and public welfare.The urgency of this study lies in addressing the disconnect between the normative ideals (das Sollen) of equitable and sustainable energy governance and their actual implementation (das Sein) in current policy practices. The research employs a normative legal method, relying on a literature review of both primary and secondary legal sources, coupled with conceptual and statutory interpretation.The findings indicate that current policies often fail to ensure equitable distribution, meaningful public participation, and adequate environmental protection. Accordingly, legal reforms are necessary to advance justice in energy access and to establish enforceable emission limits and environmental standards. The conclusion drawn from this study underscores the importance of bridging the gap between normative aspirations and practical realities in order to achieve inclusive, sustainable, and just energy governance.

Abstract

The objective of this study is to establish the business licensing arrangements in Indonesia after the enactment of the Undang-Undang Cipta Kerja and to find out the problems of implementing the business licensing system in the industrial sector through the Online Single Submission Risk-Based Approach (OSS-RBA) after the enactment of the Job Creation Act. The research method used in this research is empirical legal research, with a statute approach, analitical and conseptual approach, and facts approach. This research is descriptive by using qualitative analysis. The results of this study is business license or industrial license management system in Indonesia has experienced various dynamics which aim to continue to improve and become better in the future. This dynamic encourages various kinds of changes regarding business license and industrial license, starting from the laws and regulations to its practice. The use of online-based OSS-RBA when the verification process often experiences problems, so that in the future the government or authorized agencies are expected to be able to refine the OSS-RBA system therefore that problems would not be happened in its practice.

Abstract

The theoretical issues surrounding the Balinese Traditional Village levy (stand) arise when compared to Article 23A of the 1945 Constitution of Indonesia, which mandates that taxes and levies for state needs must be regulated by law. However, Traditional Village levies, based on perarem and Article 18B paragraph (2), are fees rooted in local customary law. Deconstruction theory suggests that the legal text and context of these levies can be reconstructed to meet community needs, promoting justice and legitimizing Balinese Traditional Villages. The clarity and constitutionality of Bali Regional Regulation No. 4/2019 are crucial in ensuring that these levies are recognized as legitimate and not deemed extortion, as long as they are conducted in accordance with customary law.
