Abstract

The company must have a Mining Business Permit,a Special Mining Business Permit (IUPK),and Business Permit to Transport and Sell Coal.One of the decisions regarding the criminal act of abusing mining business permits is in the decision Number:550/Pid.B/LH/2020/PN.Tjk.The problems in this study are what are the factors causing and how judges consider criminal acts to provide opportunities for other people to use Mining Business Permits (IUP),IUPK and Business Permits to transport and sell coal.Decision Study Number:550/Pid.B/LH /2020/PN.Tjk).This study using secondary data sources and primary data.Factors causing the crime to provide opportunities for other people to use IUP,IUPK,and Business Permits to transport and sell coal were carried out by the Defendant because the Defendant was a worker who was ordered by his superior named Limanto to submit documents on behalf of PT.Prisma Jaya to the truck driver for transport and deliver coal.The judge's consideration of criminal act provides an opportunity for other people to use the IUP,IUPK and business permits to transport and sell coal where the Judge gives a verdict that the defendant is subject to imprisonment for 10 months and the Defendant remains detained and determines that the Defendant is burdened with paying court fees in amount of Rp.5,000.00

Abstract

Sniffer dogs as police partners can ease the task of investigators because of the expertise of dogs. Dogs have special abilities in their sense of smell, which include being able to detect indications that someone is carrying explosives or narcotics. The research method used in this study is a normative juridical approach so that it only examines the contents of the Indonesian National Police Regulation No. 14 of 2018 concerning changes to the Regulation of the Republic of Indonesia National Police No. 22 of 2010 concerning the organizational structure and work procedures of the regional police, and sources, namely secondary data sources, primary data and tertiary data. In this study, the technique of collecting data obtained from library research and field studies was carried out by means of observation and interviews. The results of this study explain that the role of the K-9 Animal Police Unit in Drug Crimes Based on the Regulation of the Indonesian National Police No. 14 of 2018, sniffer dogs in investigations have a very large role, because they are very helpful for investigating officials to uncover criminal events, but dogs Drug trackers owned by the Ditsamapta Police Unit of the Lampung Police are very limited. The lack of sniffer dogs and handler personnel makes the role of the animal police unit less effective.

Abstract

Perkembangan anak pada usia prasekolah sangat penting karena anak akan mampu menyesuaikan dirinya dengan lingkungan. Salah satu kejahatan yang terjadi dalam masyarakat adalah kejahatan yang menggunakan senjata tajam, Belakangan ini kejahatan yang marak terjadi adalah kejahatan yang disertai dengan penggunaan senjata tajam yang dillakukan oleh anak. Dimana penggunaan senjata tajam tidak sesuai fungsinya maka akan menimbulkan masalah dan tindakan kriminal. Permasalahan pada kasus ini apakah faktor-faktor penyebab tindak pidana anak dibawah umur yang membawa senjata api atau benda tajam dan dasar pertimbangan hakim dalam menjatuhkan putusan pidana dalam kasus Tindak Pidana Anak Dibawah Umur Yang Membawa Senjata Api atau Benda Tajam berdasarkan Studi Putusan Nomor : 17/Pid-Sus-Anak/2023/Pn TJK. Metode penelitian menggunakan pendekatan yuridis normatif dan empiris, pendekatan yuridis normatif dilaksanakan dengan studi kepustakaan (Library Research) terhadap hal-hal yang bersifat teoritis, sedangkan pendekatan empiris dilakukan dengan wawancara terhadap narasumber.

Abstract

AbstrakSalah satu hak Dosen Tetap Bukan PNS pada Perguruan Tinggi yaitu memperoleh tunjangan profesi atau sertifikasi dosen. Belum terpenuhinya hak tersebut merupakan suatu perbuatan yang bertentangan dengan kepentingan hukum. Permasalahan penelitian ini adalah: bagaimana implementasi tentang hak dan kewajiban Dosen Tetap Bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016 serta apakah faktor penghambat implementasi tentang hak dan kewajiban Dosen Tetap Bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016. Metode penelitian secara yuridis normatif dan empiris, menggunakan data sekunder dan primer, yang diperoleh dari studi kepustakaan dan studi lapangan, dan analisis data dengan analisis yuridis kualitatif. Hasil penelitian membahas implementasi hak dan kewajiban dosen tetap bukan PNS berdasarkan Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016 sudah dilaksanakan tetapi belum dilaksanakan secara maksimal dikarenakan terdapat salah satu hak Dosen Tetap Bukan PNS tidak tepenuhi, yaitu pemberian tunjangan profesi atau serdos. Ada 6 (enam) faktor penghambat dari implementasi Pasal 8 Peraturan Menteri Agama nomor 3 Tahun 2016, yaitu anggaran, SK Inpassing, belum tersedianya kuota bagi Dosen Tetap Bukan PNS untuk mengikuti sertifikasi dosen hingga saat ini, tidak adan aturan yang tegas mengenai sanksi atau lainnya yang mengharuskan (memaksa) agar pemberian hak Dosen Tetap Bukan PNS yaitu tunjangan profesi atau serdos, status kepegawaian bagi Dosen Tetap Bukan PNS di Perguruan Tinggi Negeri, dan kebijakan atau kewenagan pimpinan. Saran yang dapat diberikan antara lain kepada Pimpinan UIN Raden Intan Lampung beserta jajarannya hendaknya perlu diperhatikan mengenai kesejahteraan bagi Dosen Tetap Bukan PNS. Kepada Biro Kepegawaian diharapkan akan ada pengaturan mengenai pemberian tunjangan profesi bagi dosen tetap Bukan PNS. Kepada Kepala Bagian Kepegawaian diharapkan Dosen Tetap Bukan PNS bisa diikutsertakan atau bahkan menjadi “prioritas” untuk mengikuti seleksi PNS atau PPPK, sehingga status mereka pada Perguruan Tinggi Negeri lebih jelas dan bisa mendapatkan hak-haknya yang sesuai.Kata Kunci: Implementasi, Hak dan Kewajiban, Dosen Tetap Bukan PNS UIN Raden Intan Lampung AbstractOne of the rights of Permanent Lecturers Not Civil Servants in Universities is to obtain professional allowances or lecturer certification. The non-fulfillment of this right is an act that is contrary to the interests of the law. The problem of this research is: how to implement the rights and obligations of Non-Civil Servant Permanent Lecturers based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016 and whether the inhibiting factors for the implementation of the rights and obligations of Non-Civil Servant Permanent Lecturers based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016. Research methods are juridically normative and empirical, using secondary and primary data, obtained from literature studies and field studies, and data analysis with qualitative juridical analysis. The results of the study discussed the implementation of the rights and obligations of permanent lecturers who are not civil servants based on Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016 has been implemented but has not been implemented optimally because there is one of the rights of Non-Civil Servant Permanent Lecturers is not fulfilled, namely the provision of professional allowances or serdos. There are 6 (six) inhibiting factors from the implementation of Article 8 of the Minister of Religious Affairs Regulation number 3 of 2016, namely the budget, the Inpassing Decree, the unavailability of quotas for Non-Civil Servant Permanent Lecturers to follow lecturer certification until now, there are no strict rules regarding sanctions or others that require (forcing) the granting of the rights of Permanent Lecturers Not Civil Servants, namely professional allowances or serdos,  employment status for Permanent Lecturers Not Civil Servants in State Universities, and the policy or authority of the leadership. Suggestions that can be given, among others, to the Head of UIN Raden Intan Lampung and his staff should need to be considered regarding welfare for Permanent Lecturers Not Civil Servants. To the Bureau of Personnel, it is hoped that there will be arrangements regarding the provision of professional allowances for permanent lecturers Not civil servants. To the Head of the Civil Service Section, it is hoped that Permanent Lecturers Not Civil Servants can be included or even become a "priority" to take part in the selection of civil servants or PPPK, so that their status at State Universities is clearer and can get their rights accordingly.Keywords: Implementation, Rights and Obligations, Permanent Lecturers Are Not Civil Servants UIN Raden Intan Lampung

Abstract

AbstrakSertifikat merupakan surat tanda bukti hak milik atas suatu benda, seperti misalnya tanah, bangunan, dan lain-lain. Permasalahan dalam penelitian ini faktor penyebab terjadinya perbuatan melawan hukum oleh prumnas way halim akibat kelalaian pembuatan sertifikat hak atas tanah dan apakah yang menjadi pertimbangan hakim dalam perkara perbuatan melawan hukum oleh prumnas way halim. Metode penelitian yang digunakan dalam penelitian skripsi ini ialah pendekatan yuridis normatif dan pendekatan empiris. Pengumpulan data berdasarkan studi kepustakaan dan studi lapangan. Narasumber dalam penelitian ini adalah Hakim pada Pengadilan Negeri Tanjung Karang. Dasar pertimbangan hakim dalam menjatuhkan putusan perkara perbuatan melawan hukum oleh prumnas way halim dikabulkan sebagian dan yang menjadi dasar pertimbangan tindakan Tergugat yang telah melakukan perbuatan melawan hukum yang mana mengakibatkan timbulnya kerugian terhadap Penggugat disebabkan tindakan Tergugat yang tidak memiliki arsip dokumen atas tanah objek sengketa yang diperkuat dengan keterangan saksi dan bukti-bukti surat dalam persidangan maka tuntutan kerugian adalah patut dan wajar, dan beralasan hukum untuk dikabulkan. Perumnas Way Halim, Developer perumahan dan Perusahaan yang bergerak dalam bidang pengadaan perumahan untuk senantiasa mentaati segala undang-undang maupun peraturan yang berlaku di Indonesia serta harus beritikad baik dalam menjalankan aktivitas usahanya.Kata Kunci: Pertimbangan Hakim, PMH, Sertifikat Tanah. AbstractA certificate is a letter of proof of property rights to an object, such as land, buildings, and others. The problem in this study is the factor causing the occurrence of unlawful acts by prumnas way halim due to negligence in making land rights certificates and what is considered by the judge in cases of unlawful acts by prumnas way halim. The research methods used in this thesis research are normative juridical approaches and empirical approaches. Data collection is based on literature studies and field studies. The resource person in this study was a Judge at the Tanjung Karang District Court. The basis for the judge's consideration in passing the judgment of the case of unlawful acts by prumnas way halim is partially granted and which is the basis for consideration of the actions of the Defendant who has committed an unlawful act which results in the occurrence of losses against the Plaintiff due to the actions of the Defendant who does not have a document archive on the land of the object of dispute which is strengthened by the testimony of witnesses and evidence of letters in the trial, the claim for loss is appropriate and it is reasonable, and it is reasonable for the law to be granted. Perumnas Way Halim, a housing developer and company engaged in housing procurement to always comply with all applicable laws and regulations in Indonesia and must have good faith in carrying out their business activities.Keywords: Judge Considerations, PMH, Land Certificates.

Abstract

AbstrakBeredarnya pupuk dengan label palsu ini sangat berkaitan dengan perlindungan hukum terhadap konsumen Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, yang dimana sesuai pasal 4 Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen yaitu ada konsumen yang harus dilindungi hak-haknya yaitu hak atas kenyamanan, keamanan, dan keselamatan dalam memakai atau mengkomsumsi barang/jasa. Salah satu bentuk tindak pidana pengedaran pupuk yang tidak terdaftar adalah pada Putusan Nomor: 64/Pid.Sus/2021/PN Gns. Pada penelitian ini penulis mengunakan Penelitian yuridis normative dengan mengumpulankan berupa data-data dengan melakukan membaca buku hukum, mempelajari buku yang terkait akan kasus tersebut yang tersedia di kepustakaan yang ada hubungannya dengan penelitian ini, selain itu penulis juga mengunakan website yang memiliki hubungan dengan masalah yang penulis ambil, sehingga dikumpulkan data tersebut secara konkrit dan akurat dan penulis juga mengunakan Pendekatan secara empiris yaitu dilakukan dengan melihat pada objek yang diteiti dan melakukan wawancara. Faktor penyebab pelaku tindak pidana. adalah faktor untuk mencari keuntungan sebesar-besarnya dengan modal yang minimal, selain itu faktor lainnya adalah sifat tamak pelaku sehingga melakukan tindakan di luar ketentuan hukum serta kurangnya pengawasan terhadap peredaran di pasaran oleh pupuk yang tidak terdaftar di Kementerian Pertanian Republik Indonesia. Penerapan sanksi pidana terhadap pelaku tindak pidana memproduksi pupuk kompos merk Aneka Mitra Sejahtera (AMS) yang tidak terdaftar berdasarkan Putusan Nomor: 64/Pid.Sus/2021/PN Gns adalah dengan pidana penjara selama 1 (satu) tahun dan denda sebesar Rp700.000,00 (tujuh ratus ribu rupiah) dengan ketentuan apabila pidana denda tidak dibayar maka akan diganti dengan pidana penjara selama 3 (tiga) bulan.Kata Kunci: Tindak Pidana, Pupuk Kompos, Tidak Terdaftar. AbstractThe circulation of fertilizers with fake labels is closely related to the legal protection of consumers Law Number 8 of 1999 concerning Consumer Protection, which is in accordance with article 4 of Law Number 8 of 1999 concerning Consumer Protection, namely there are consumers who must be protected by their rights, namely the right to comfort, security, and safety in wearing or consuming goods/services. One of the forms of criminal acts of fertilizer circulation that is not registered is in Decision Number: 64 / Pid.Sus / 2021 / PN Gns. In this study, the author uses normative juridical research by collecting data by reading legal books, studying books related to the case that are available in literature that has something to do with this research, besides that the author also uses a website that has a relationship with the problem that the author took, so that the data is collected concretely and accurately and the author also uses an empirical approach, which is carried out by looking at the objects being determined and conducting interviews. Factors causing the perpetrator of the criminal act. is a factor to seek the greatest profit with minimal capital, besides that another factor is the covetous nature of the perpetrator so that he takes actions outside the provisions of the law and the lack of supervision of circulation in the market by fertilizers that are not registered with the Ministry of Agriculture of the Republic of Indonesia. The application of criminal sanctions against criminals producing compost under the Aneka Mitra Sejahtera (AMS) brand that is not registered based on Decision Number: 64 / Pid.Sus / 2021 / PN Gns is with imprisonment for 1 (one) year and a fine of RP700,000.00 (seven hundred thousand rupiah) provided that if the fine is not paid, it will be replaced with imprisonment for 3 (three) months.Keywords: Criminal Act, Compost, Unregistered.

Abstract

West Lampung Regency is one of the Robusta coffee producing areas. Lampung Robusta Coffee is registered by obtaining a Geographical Indication Certificate Number: ID G 000000026 dated May 13, 2014. The problems in this study are a) How is the implementation of legal protection for Lampung Robusta coffee geographical indications in improving the economy of West Lampung coffee farmers and b) What are the factors What are the obstacles in implementing legal protection for Lampung Robusta coffee geographical indications in improving the economy of West Lampung coffee farmers? The research method used is juridical normative and juridical empirical. The conclusion of this study is the implementation of legal protection for Lampung Robusta coffee geographical indications in improving the economy of West Lampung coffee farmers is to provide preventive and repressive forms of protection with reference to the theory of Intellectual Property Rights Robert M. Sherwood. Abstract

The value of West Lampung's traditional cultural expressions has not been maximized for the local inhabitants. This article will explain how to implement the local government-requested preservation of West Lampung traditional expressions and their use in accordance with the Economic Analysis of Law framework. The results of the discussion indicate that the Protection and Utilization of Traditional Cultural Expressions has only reached the inventory stage, based on Law No. 28 of 2014 regarding Copyright, Law No. 5 of 2017 regarding Promotion of Culture, Law No. 11 of 2010 regarding Cultural Conservation and Regulations Government No. 6 of 2015 regarding Museums, and Regulation of the Minister of Culture No. 106 regarding Intangible Cultural Heritage of Indonesia. The Economic Analysis of Law demonstrates that West Lampung's traditional cultural expressions must be optimized in order to boost the region's income. This can be maximized through the collaboration of the local government with academics in the arts, artists, Youtubers, artists, and other parties who are already aware of what the global community desires as connoisseurs, so that professional processing can affect the welfare of the people of West Lampung

Abstract

This research aims to find legal protection against digital signature users as consumers associated with the principle of justice. This research uses a normative juridical approach by focusing on secondary data. The research specification used is descriptive-analytical. The research stages were carried out through library research and field research as support. Data collection techniques were carried out through document studies and interviews. While data analysis is carried out in a qualitative, juridical manner. The results showed that since the enactment of Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE), the legal force and legal certainty of electronic information, electronic documents, and electronic signatures as valid evidence in electronic transactions such as e-commerce and e-business have the same legal force and legal certainty as the original. As a suggestion, in an effort to increase the effectiveness of the enactment of Law Number 11 of 2008 in conjunction with Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE), it is necessary to immediately issue a Government Regulation (PP) as an implementing regulation so as not to cause confusion for the community and, of course, the government itself in its law enforcement
