Abstract

Penelitian ini memiliki fokus dalam mengetahui dan menganalisis faktor penyebab tindak pidana pemberian keterangan palsu objek jaminan fidusia pada PT BFI Finance terhadap Putusan Nomor :533/Pid.Sus/2022/PN.Tjk serta mengetahui pertanggungjawaban tindak pidana keterangan palsu objek jaminan fidusia pada PT BFI Finance pada Putusan Nomor :533/Pid.Sus/2022/PN.Tjk. Pendekatan yuridis normatif dan pendekatan empiris ialah metodologi penelitan yang digunakan pada studi ini. Studi kepustakaan (library reseach) ialah data yang diperoleh melalui studi kepustakaan dan digunakan sebagai data sekunder. Contoh studi kepustakaan ialah buku literasi dan karya ilmiah terkait fokus penelitian. Data sekunder memuat tiga bahan hukum, di antaranya adalah bahan hukum primer, sekunder dan tersier. Penelitian lapangan terhadap subjek penelitian yang dilakukan dengan cara mengamati langsung subjek penelitian dan mengajukan pertanyaan sambil menulis penelitian merupakan Data primer. Penelitian menunjukkan bahwa dengan sengaja melakukan pemalsuan, perubahan, menghapus ataulmenghilangkan, dan memberikan informasi yang menyesatkan, dapat dipidana antara kreditur dan debitur terbukti dapat dituntut secara adil, bagi yang bertindak akan dimintai pertanggungjawaban atas perbuatannya dan pertanggungjawaban pidana didasari dengan asas kesalahan. Dan penjatuhan pidana bukan hanya sebagai metode penghukum subjek yang melakukan tindak pidana, melainkan juga sebagai instrument untuk mendidik subjek ang melakukan tindak pidana agar tidak mengulang perbuatannya di masa mendatang.

Abstract

Artikel ilmiah ini bertujuan untuk mengetahui faktor–faktor penyebab terdakwa melakukan tindak pidana informasi dan transaksi elektronik yang memiliki muatan yang melanggar kesusilaan dan dasar pertimbangan hakim dalam menjatuhkan putusan pidana dalam kasus tindak pidana informasi dan transaksi elektronik yang melanggar kesusilaan (studi putusan nomor: 468/pid.sus/2022/pn tjk). Metode penelitian dalam penulisan artikel ilmiah ini memakai metode yuridis empiris. Hasil penelitian menunjukkan bahwa faktor penyebab terjadinya tindak pidana mendistribusikan informasi elektronik yang melanggar kesusilaan adalah faktor sakit hati dan ingin balas dendam, dan faktor untuk mengancam korban agar korban ingin melakukan perbuatan asusila lagi. Dasar pertimbangan hakim dalam menjatuhkan putusan terdiri dari dua faktor, yaitu faktor yuridis dan faktor non yuridis. Faktor yuridis pertimbangan hakim terdiri dari dakwaan jaksa penuntut umum, serta alat bukti dan barang bukti. Dalam dakwaan jaksa penuntut umum, jaksa akan menuntut terdakwa dengan pasal tertentu serta tuntutan hukuman untuk pelaku, tuntutan hukuman yang diajukan jaksa ini dapat berbeda pada tiap pelaku meski mereka di dakwa pasal yang sama. Sedangkan faktor non yuridis pertimbangan hakim terdiri dari motif terdakwa melakukan kejahatan, serta hal-hal yang memberatkan dan meringankan terdakwa.

Abstract

Adoption of a child is a legal act, because it must have legal consequences. Some of the legal consequences of adopting a child are regarding the position or status of the adopted child as heirs to the adoptive child's parents. Adopted children can not become heirs of adoptive parents, but adopted children have the right to become heirs if the adoptive parents submit a will to the child, this called testament wajibah. The researcher used library research and interview methods. By using this method, the researcher obtained the result that the adopted child could inherit with the determination that it was not more than 1/3 of the inheritance of the adoptive parents. Based on the provisions of Islamic law, adopted children cannot be appointed as heirs, because in the provisions of Islamic law, those who can be appointed as heirs are those who are related by blood to the heir. A will (testament) is different from a gift or what is called a "grant". The difference between a testament and a grant is that a will, even though it has been made when the testator is still alive, is only enforced after the testator has died, while the grant itself is valid when the grantor is still alive.

Abstract

Industrial design is a part of the intellectual property created by tasteful and corrosive thought and imagination. Protection against industrial design was indispensable to the certainty of laws to designers. This research issue to find out how the protection of industrial design that has conforms to industry design is listed in the general list under the 31st year 2000 act. This method of research USES the yuridis normatif and empirical approaches. The type of data used is secondary and primary data. The study concluded that a designer who lists industrial design products in the registry, has the exclusive rights granted to him by the republic of Indonesia. It can forbid anyone without his consent to use, sell, manufacture, export, import. When using bad faith, as holders of exclusive rights may file a civil suit and/or criminal charges. The conclusion is that the industrial design that industrial design could provide with the design of science-based on the design of science-based, should fill with novelty of that industry's design and yet no public announcement was made

Abstract

Literally, children are a mandate as well as a gift from God Almighty, even children are considered the most valuable wealth compared to other property assets. Therefore children as a mandate from God must always be guarded and protected because in children inherent dignity and rights as human beings which must be upheld, but crimes are increasingly occurring regardless of who the object is. Indonesia has laws to protect children in the legal context of perpetrators who commit crimes against minors. The purpose of this research is to analyze the arrangement of criminal responsibility for the perpetrators of the murder of minors.

Abstract

Article 28B, Paragraph 2 of the 1945 Constitution explains that every child has the right to survival, growth, and development, as well as the right to protection from violence and discrimination. Not all children are born perfectly; some are born imperfect. One example is a child with a disability, such as autism. Nevertheless, they possess the right to receive education, healthcare, and freedom of expression. Additionally, children also have the entitlement to preserve their cultural and religious identity and engage in social, cultural, and political aspects of life without facing discrimination. Their rights go beyond just receiving protection; they also have the right to inherit assets in accordance with their entitlement. The purpose of this study is to identify the factors that necessitate the inheritance of these assets and to explore how judges consider the guardianship of inheritance for individuals with autism, based on decision number 121/Pdt.P/2023/PN.Tjk. The research methodology employs a normative juridical approach, involving the examination of applicable laws and regulations. Additionally, an empirical approach is used, involving on-site observations and interviews to address research-related issues. The results of this study indicate that the factors driving the need for inheritance representation stem from the fact that the petitioner's child is a minor and has a mental disability, namely autism. This is grounded in Article 330 of the Civil Code. Consequently, the appointment of a guardian is necessary to sell one of the assets left by the deceased husband, in order to finance the medical treatment of the petitioner's child with autism or mental disability. Furthermore, in deciding this case, the judge considers that pursuant to Article 360 of the Civil Code, the appointment of a guardian is deemed necessary based on requests from blood relatives of the underage child, creditors, or other relevant parties to ensure the continuity of the trial process.

Abstract

The main focus of this research is the factors that cause criminal acts, participate in marketing timber from illegal logging and the application of environmental criminal law to the perpetrators of criminal acts and participate in marketing timber from illegal logging. The research method used in this research is juridical normative and empirical. Based on the research results, it was found that the causes of illegal logging in Cikolak Teluk Pandan Village, Pesawaran District, included internal factors including educational factors, personal factors, biological pathogenic factors and pneumonia. External factors include environmental factors, lack of protection, lack of community empowerment, global development factors and economic factors. Enforcement of environmental criminal law against perpetrators of criminal acts by participating in marketing timber from illegal logging, namely imprisonment for 1 (one) year and a fine of Rp. 500,000,000.00 (five hundred million rupiah) provided that if the fine is not paid, it will be replaced by imprisonment for 2 (two) months.

Abstract

Abstract Land is the most important element for humans to be able to live, this is because it is where natural and man-made resources grow and are also built. Indonesia regulates land ownership through this land law so that land use or management can be carried out carefully now and in the future. The land issue concerns the most basic rights of the people. The purpose of the study was to determine the consignment process in the District Court as a form of settlement of compensation for toll road land acquisition and its legal consequences. The results showed that the consignment process for compensation began with an application for consignment safekeeping, then an offer was made by the court bailiff accompanied by 2 (two) witnesses at the respondent's residence. The consignment waives the obligation as the debtor, because the consignment can be equated with making payments. All processes must be carried out in a manner that has been regulated by laws and regulations. Consignment is carried out so that government projects continue to run, through a deliberation mechanism that should be a means to find a middle way in determining the amount of compensation, often no agreement is reached. Abstract

The embodiment of West Lampung Traditional Cultural Expressions has not been optimal both in terms of intellectual property protection and in terms of its usefulness for the local community of West Lampung. In this article, we will discuss how intellectual property legal protection is implemented if it is implemented in the protection of traditional cultural expressions and how far has the West Lampung Regency Government tried to protect and utilize the potential of traditional cultural expressions. This article aims to identify a model of protection against traditional cultural expressions in West Lampung by using normative and empirical legal research methodologies. The results of the discussion show that the Protection of Traditional Cultural Expressions is carried out based on Law Number 28 of 2014 concerning Copyright, Law Number 5 of 2017 concerning the Advancement of Culture, Law Number 11 of 2010 concerning Cultural Conservation and Government Regulation Number 6 of 2017. 2015 concerning Museums, and Regulation of the Minister of Culture Number 106 concerning Indonesian Intangible Cultural Heritage in addition to the autonomy of the Regional Government of West Lampung Regency has also made efforts to preserve istiadar custom through the Regional Regulation of West Lampung Regency Number 14 of 2000 concerning the Guidance, Preservation, and Development of Indigenous Peoples. and Customary Institutions. The West Lampung Regency Government also seeks to protect and preserve traditional cultural expressions by participating in activities such as traditional festivals organized by the Lampung Provincial Government so that the existence of traditional cultural expressions in West Lampung Regency is known to the public. However, overall the protection of the majority of traditional cultural expressions has not been inventoried and utilized optimally, including the traditional cultural expressions of West Lampung. There should be immediate efforts to regulate the protection of traditional cultural expressions in a sui generis manner apart from the Copyright Law.

Abstract

Ekspresi Budaya Tradisional (EBT) adalah segala bentuk ekspresi karya cipta, baik berupa benda maupun tak benda, atau kombinasi keduanya yang menunjukkan keberadaan suatu budaya tradisional yang dipegang secara komunal dan lintas generasi. Salah satu bentuk EBT adalah sastra lisan, sastra lisan merupakan salah satu jenis karya sastra yang ada di dunia ini. Di lihat dari segi pengertian etimologinya, sastra Lisan berarti sebuah karya sastra yang berbentuk abstrak dan disampaikan dengan cara moral. Provinsi Lampung memiliki kebudayaan yang sangat khas dan beragam salah satunya adalah sastra lisan, sastra lisan lampung sangat beragam fungsi dan kegunaanya salah satu nya adalah sebagai media Pendidikan dan pertunjukan seni yang di kemas dalam bentuk buku, video, serta media hiburan lain. Adapun yang menjadi permasalahan dalam penelitian ini adalah Bagaimana Upaya pemerintah dan tokoh adat untuk melakukan perlindungan terhadap ekspresi budaya tradisional sastra lisan lampung kekayaan intelektual Masyarakat lampung serta Bagaimana bentuk komersialisasi ekspresi budaya sastra lisan lampung. Metode penelitian yang digunakan dalam penelitian skripsi ini ialah Pedekatan yuridis normative dan pendekatan empiris. Data sekunder adalah data yang diperoleh melalui studi kepustakaan (library research) seperti buku-buku literature dan karya ilmiah yang berkaitan dengan permasalahan penelitian. Data sekunder terdiri dari 3 (tiga) Bahan Hukum, yaitu, bahan Hukum Primer, sekunder dan tersier. Data Prime adalah data yang diperoleh dari hasil penelitian dilapangan secara langsung pada objek penelitian (field research) yang dilakukan dengan cara observasi dan wawancara secara langsung mengenai kepada objek dalam penulisan skripsi ini. Berdasarkan hasil penelitian yang didapat, dapat disimpulkan bahwa Pemerintah Provinsi Lampung telah mengambil langkah dalam melindungi sastra lisan melalui Peraturan Daerah Nomor 2 Tahun 2008 tentang Pemeliharaan Kebudayaan Lampung. Pasal 23 menetapkan perlindungan budaya melalui pendidikan, penelitian, pengembangan, pembinaan, dan kodifikasi, yang meliputi penyusunan tata bahasa, kamus, dan rekaman tuturan. Kodifikasi ini penting untuk mendokumentasikan dan menyebarluaskan sastra lisan, dengan pemerintah berperan dalam memfasilitasi penerbitannya untuk memastikan pengetahuan budaya tetap terjaga. Pasal 24 mendukung perlindungan hukum dengan pendaftaran hak cipta untuk karya seni dan sastra Lampung, mencegah penyalahgunaan dan melindungi hak pencipta. Tokoh adat juga berkontribusi besar dalam pelestarian sastra lisan dengan mendidik generasi muda, menyebarluaskan sastra melalui acara budaya, dan bekerja sama dengan pemerintah serta LSM dalam kebijakan pelestarian budaya, termasuk pendanaan dan penelitian. Serta Komersialisasi ekspresi budaya sastra lisan Lampung bertujuan untuk memperkenalkan dan mempertahankan kekayaan budaya khususnya sastra lisan. Komersialisasi melibatkan berbagai bentuk media dan produk yang dapat menjangkau audiens yang lebih luas, serta berpotensi untuk meningkatkan apresiasi dan pelestarian budaya Lampung. Terdapat tiga bentuk utama komersialisasi ekspresi budaya sastra lisan Lampung, yaitu meliputi rekaman audio atau video, buku atau penerbitan teks, serta produksi film atau pertunjukan teater. Adapun saran yang dapat disampaikan dalam penulisan ini ialah Saran Penulis Perlu adanya upaya meningkatkan kesadaran masyarakat mengenai peraturan mengenai hak cipta dengan program sosialisasi, guna memastikan perlindungan hukum bagi karya daerah, Optimalisasi komersialisasi sastra lisan melalui riset pasar dan strategi pemasaran yang tepat, sehingga dapat menarik audiens khususnya masyarakat Lampung. Perlu adanya pengembangan kurikulum pendidikan yang mencakup sastra lisan.
