Abstract

PT Amartha Micro Fintech comes with the aim of increasing UMKMthrough a group of underprivileged women by providing financing services aimedat business capital. The financing provided by Amartha to the underprivilagedwoman’s group uses sharia principles with a mudharabah. In Beringin MakmurVillage, especially the Amartha Beringin assembly, only 5 out of 30 customerscarry out their obligations using financing for business capital, even though thisprovision has been stated in Article 1 paragraph (4) of the Funding Agreement –Special Requirements of PT Amartha Micro Fintech, Article 1paragraph (11) ofLaw Number 20 of 2008 Concerning Mikro, Small, and Medium Enterprises, andNational Sharia Council Fatwa on Mudharabah (Qiradh).This type of research is empirical juridical research, while the pupulationand sample are PT Amartha Micro Fintech Pangkalan Kuras Branch and thecustomers of the Amartha Beringin assembly in Beringin Makmur Village. Thepurpose of this research is to find out the obligation of customers to use thefinancing received as business capital which aim to increase Micro, Small, andMedium Enterprises (UMKM).The conclusion of this research is the obligation of PT Amartha MicroFintech customers, especially the Amartha Beringin assembly, has not beenmaximizes due to several factors from the customer’s side as well as from the sideof field officers. The weak economic situation of customers is one of the obstaclesfor customers to establish a business through capital loans given and the largetarget that must be achieved by field officers also result in giving loans tocustomers even though they do not meet their obligations optimally. The author’sadvice for customers is given socialization related to rights and obliggations aswell as literacy to improve the business that is being run and balanced withregular monitoring of customers after the disbursement of financing.Keywords: Model – Mudharabah Financing – Application – Capital Loan.

Abstract

The purpose of this study is, First, to find out the factors that cause land disputes atPT. Arara Abadi which was claimed by migrant communities from Sungai GondangVillage, Minas District, Riau Province. Second, to find out the obstacles in resolving landdisputes by PT. Arara Abadi which was claimed by migrant communities from SungaiGondang Village, Minas District, Riau Province.This research uses the type of sociological legal research. The sample in this researchis Public Relations of PT. Arara Abadi, Head of DLHK Riau Province, Head of district ofWest Minas, community leaders and the community itself. The analytical tool in this studyis a qualitative method. This study found that there were things that were less than optimalin reality on the ground, so it was necessary to anticipate them with maximum effort.The results of this study, the factors causing land disputes in PT. Arara Abadi, whichwas claimed by migrant communities in Sungai Gondang Village, Minas District, RiauProvince, consisted of several factors. First, because of a certificate issued by anunscrupulous village. Second, there is an acknowledgment that the area has long beenhanded down from generation to generation. Besides that, the constraints in resolving landdisputes by PT. Arara Abadi which is claimed by the people of Sungai Gondang Village,Minas District, Riau Province consists of several points. First, due to the unclear legalityof community land ownership. Second, the reported condition of the land does not matchwhat is claimed with the reality on the ground. Third, there are differences in demandsfrom society. To prevent similar incidents from happening, the important role of PublicRelations is to routinely conduct outreach to the local Village apparatus and thecommunity about the boundaries of the company's territory and the dangers of carryingout illegal activities in forest areas. In order for this problem to be resolved, it is better forthe company's public relations to be more intense in approaching the community andrelated parties so that it is important to preserve forests and respect the provisions thathave been given by the government to companies to manage these forests. Apart from that,other forms of corporate social responsibility can also be carried out with the aim ofcreating welfare for the community and minimizing the loopholes for reclaim by a groupof irresponsible people.Keywords: Land Disputes - Company - Communit

Abstract

In sea transportation agreements, there are no escape from disputes such as whatoccurred in the agreement between PT. Pelayaran Kurnia Samudra and PT.Ancara Logistics Indonesia. In the implementation of the agreement, a forcemajeure event occurred which resulted in the fulfilment of achievements beinghampered by PT. Pelayaran Kurnia Samudra. Therefore, the purpose of writingthe thesis is first, to find out the application of force majeure in the study seatransportation agreement between PT. Pelayaran Kurnia Samudra and PT.Ancara Logistics Indonesia. Second, to find out the legal rules in determiningforce majeure in the sea transportation agreement between PT. Pelayaran KurniaSamudra and PT. Ancara Logistics Indonesia.This type of research classified as a type of sociological juridical research. Thelocation located in the office of PT. Pelayaran Kurnia Samudra in Batam City,while the population and sample are all parties related to the problem understudy. This study uses data sources in the form of primary data and secondarydata, and data collection techniques are carried out by interviews.There are two main things that can be concluded. First, the non- fulfillment offorce majeure elements by PT. Pelayaran Kurnia Samudra caused them to have topay for the late delivery of goods due to a lack of sufficient evidence to convincePT. Ancara Logistics Indonesia that there has been a force majeure. Second, todetermine force majeure events, Article 41Paragraph 2 of Law Number 17 of2008 Concerning Shipping can be used a reference that can be used by theparties. The author's suggestion is: Firstly, the parties should pay attention to theimportance of including a force majeure clause clearly in the agreement tominimize losses borne by the parties if a force majeure event occurs. Second, it isrecommended that the government include special provisions governing forcemajeure so that it can be used as reference to protect the interests of the parties sothat there is a balance in the severity of responsibilities and rights.Keywords: Force Majeure – Agreement – Ocean Freight

Abstract

The increasingly rapid development of technology is currently influencingproduction activities so that they are able to meet the increasing and diverseneeds of consumers. On the one hand, increasing the use of more advancedtechnology can benefit consumers because their needs will be easily met with avariety of choices. On the other hand, increasingly sophisticated technology doesnot always produce products that comply with safety standards that can beconsumed by consumers and often harms consumers. Like home industry businessactors engaged in buying and selling food products. Home industry businessactors sell food products that do not include expiration date labels in order tomake a profit by not providing clear information to consumers.This type of research can be classified as empirical legal research or whatis usually called sociological research. With the research location being at theFood and Drug Monitoring Center (Loka POM) and Home Industry, BatangTuaka District, Indragiri Hilir Regency, the population and sample are all partiesrelated to the problem under study. This research uses data sources in the form ofprimary data and secondary data, and data collection techniques are carried outby interviews.From the research results it can be concluded that. Firstly, as regulated inArticle 19 of the UUP.. Second, there are legal remedies that consumers can take,namely through litigation and non-litigation. The advice from the author is:Firstly, business actors in running their business should show good faith andprovide clear information regarding the goods and/or services being distributedand try to pay attention to consumer rights and obligations as business actors andthe need for additional human resources as needed to be able to improveperformance of the Food and Drug Monitoring Station. Second, consumers shouldbe more careful in purchasing and consuming food products to avoid danger.Keywords: Home Industry-Expiration Date-Responsibility.

Abstract

Ownership rights to land are regulated in Article 20 of the Basic Agrarian Law, whichstipulates that land ownership is an hereditary, strongest, and fullest right that individuals canhave over land, with a social function. The issuance of Minister of Environment and ForestryDecree Number 903/MENLHLK/SETJEN/PLA.2/12/2016 regarding the Forest Area in Riau Province changes the status of theregion to a forest area. One of the areas affected by this change is the Lubuk Batu Jaya Sub-district in the Indragiri Hulu Regency, where the residents have settled prior to the reform in1997 and received goverment assistance, such as land for residence and cultivation, especiallyfor transmigrants. As of now, there is still no clarity regarding the status of land ownership forthe community whose land falls within the forest area based on the ministerial decree. Theobjective of this research is to understand and analyze the impacts resulting from the issuance ofMinister of Environment and Forestry Decree Number 903/MENLHK/ SETJEN/PLA.2/12/2016on land ownership in the Lubuk Batu Jaya Sub-District. Additionally, the research aims toidentify efforts to resolve land ownership issues for the community after the implementation ofthe aforementioned decree.The research methodology employed in this study is sociological. The study is conductedin The Lubuk Batu Sub-district, Indragiri Hulu Regency, Riau. The population and samplesinclude Section 2 of the land office in the Indragiri Hulu Regency, the sub-district head of LubukBatu Jaya, the community of Lubuk Batu Jaya Sub-district (Pondok Gelugur Village, RimpianVillage, and Lubuk Batu Tinggal Village), and the founders of the Non-GovermantalOrganization Forest Rescue Network Riau (JIKALAHARI). The Data sources include primary,secondary, and tertiary data, with data collection techniques involving interviews and literaturereviews.The impacts related to land ownership for the residents of Lubuk Batu Jaya Sub-districtwithin the Riau Province Forest Area after the issuance of Minister of Environment and ForestryDecree Number 903 include the inability of of residents to obtain funds for Smallholder Oil PalmRejuvenation (PSR), inability to apply for loans with Land Certificate (SHM) collateral, andinability to engage in land transcaction. This is due to the lack of clarity regarding the legalityof land ownership certificates held by the community, preventing them from performing legalaction that require SHM legality.Keywords: Land Ownership, Forest Area, Legal Certainty

Abstract

An agreement is a law for the parties entering into it and the implementation of theagreement must not conflict with public order. The agreement must be adhered to if one partydoes not carry out the obligations that have been stipulated then that party has committed abreach of contract. Retribution is a regional levy as payment or certain services or gifts that arespecifically provided and/or given by the regional government for the benefit of individuals orentities.The problem that occurs in this thesis is that market traders have defaulted where marketstall tenants have not carried out one of their obligations as stipulated in the agreement. It hasbeen stipulated in the market stall rental agreement that Article 6 paragraph (2), in Article 7paragraph (1) Article 7 paragraph (5) In fact, in the field, traders still violate the agreementagreed upon by both parties. The method used in this research is a sociological type of research.The research was conducted at traditional markets managed by the Industry and Trade Office ofBatam City. The samples taken in this study were 10 people. Data collection techniques areinterviews and literature study.The results of this study are, the provisions stipulated in the market stall rentalagreement are in accordance with the law as well as the terms and elements of an agreement. theimplementation of the market stall rental agreement did not go well where there were still manymarket stall tenants who defaulted from 28 kiosk tenants, 21 kiosk tenants who violated the termsof the agreement. the efforts made by the relevant department of not fulfilling this achievementare by giving verbal reprimands and giving Warning Letters One to Three Warning Letters.Keyword:Default,Lease-Agreement,Retribution

Abstract

Tujuan penelitian ini untuk menjelaskan peranan Lembaga Adat Melayu Riau (LAMR) dalam penyelesaian konflik tanah ulayat di Provinsi Riau. Jenis penelitian yang digunakan yuridis sosiologis (penelitian hukum empiris), yaitu studi empiris untuk menemukan teori mengenai proses terjadinya dan proses bekerjanya hukum dalam masyarakat. Penelitian ini termasuk ke dalam yuridis sosiologis karena langsung dilakukan di lokasi penelitian. Hasil dari penelitian ini bahwa di Provinsi Riau terdapat Lembaga Adat Melayu Riau yang dibentuk untuk mewadahi dan berfungsi melakukan pembinaan, pengembangan dan penerapan serta mengawal nilai-nilai adat Budaya Melayu. Dalam melaksanakan fungsinya, Lembaga Adat Melayu Riau juga diberikan peran untuk menyelesaikan berbagai konflik yang terjadi, termasuk sengketa tanah ulayat di Provinsi Riau yang selalu menimbulkan konflik secara terus-menerus. Kesimpulan penelitian ini dapat dijelaskan peranan Lembaga Adat Melayu Riau menyelesaikan konflik tanah ulayat di Provinsi Riau adalah mengkoordinir Lembaga Adat Melayu yang ada di tingkat kabupaten/kota serta berperan aktif memproses konflik, ikut mendampingi masyarakat dan turun langsung ke lokasi. Terdapat sejumlah hambatan yang dihadapi Lembaga Adat Melayu Riau dalam menyelesaikan konflik tanah ulayat di Provinsi Riau. Upaya yang dilakukan oleh Lembaga Adat Melayu Riau menyelesaikan konflik tanah ulayat di Provinsi Riau dengan membentuk gabungan LAMR yang ada di tingkat kabupaten/kota se-Provinsi Riau untuk melakukan mediasi yang sifatnya sementara. Karena hak-hak konstitusional yang masih kabur/tidak jelas di atas lahan yang disengketakan. LAMR juga bersifat aktif dalam mendorong penyelesaian sengketa tanah ulayat agar tidak timbul konflik.

Abstract

Revolving economic loans are an activity carried out by Community Self-SufficiencyAgencies/Institutions through the Activity Management Unit (UPK) to provide capital to poorpeople through a group mechanism and returned in installments. The advantage of this pro-gram is that there is no collateral requirement as a condition for entering into a credit agree-ment. Unsecured loans are very vulnerable to failure to pay credit. The aims of this researchare; Firstly, to find out what factors cause problematic credit to occur in the Revolving Fundloan agreement between the Fajar Gemilang Community Self-Help Institution UPK and theMuara Fajar Timur Village Community Self-Help Group, Pekanbaru City. And secondly,knowing how to resolve problem loans in the Revolving Fund loan agreement between theFajar Gemilang Community Self-Help Institution UPK and the Muara Fajar TimurCommunity Self-Help Group, Pekanbaru City.The type of research used is sociological research, sociological research is a study thatexamines legal aspects by looking at applicable laws and regulations and comparing themwith implementation in the field. The location of the research was at the Activity ManagementUnit of the Fajar Gemilang Community Self-Reliance Institution, Muara Fajar Timur Vil-lage, Pekan Baru City. The data sources used are Primary Data, Secondary Data and Ter-tiary Data with Data Collection Techniques using Interviews and Literature Review.The results of this research conclude that the factors causing problematic credit in theFajar Gemilang Activity Management Unit are; First, misuse of credit funds, second, debtorsnot in good faith, third, crop failure in the agricultural sector, fourth, decline in businessturnover, fifth, decline in agricultural selling prices, sixth, absence of BI Checking, seventh,lack of collateral in the loan application process. Efforts to resolve the problem of debtorswho are in default are first, collecting arrears from the debtor's house and giving warningletters I, II and III. Second, settling arrears by forming a debt collection team. As well as res-cuing problematic loans by; Rescheduling (rescheduling), Reconditioning (reconditioning),and Restructuring (rearranging). Collection through legal channels is not recommended inresolving problem loans, prioritizing deliberation and amicable channelKeywords: Credit agreement, Problem Credit, and Revolving Funds.

Abstract

Wanprestasi adalah tidak dipeuhinya kewajiban oleh debitur terhadap kreditur sebagaimana yang telah di perjanjikan sebelumnya atau di dalam perjanjian yang mana salah satu atau kedua belah pihak yang terikat dalam suatu perjanjian tidak melakukan kewajiban atau prestasi yang tertulisa didalam perjanjian tersebut. Menurut Pasal 1338 ayat (1) perjanjian yang dibuat oleh para pihak adalah undang- undang bagi mereka yang membuatnya. Dalam Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Kedua Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai developer terjadi wanprestasi yang mana pihak developer tidak melaksanakan kewajibannya yaitu tidak kunjung membangun unit perumahan yang telah dijanjikan akan dibangun sebagai bentuk dari pelaksanaan perjanjian mengakibatkan pasal-pasal lain yang ada di dalam perjanjian juga tidak terlaksana. Wanprestasi yang terjadi mengakibatkan kerugian bagi pemilik tanah. Penelitian ini bertujuan untuk mengetahui pelaksanaan serta penyelesaian wanprestasi dalam Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Pertama Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai Developer. Metode penelitian yang digunakan adalah penelitian sosiologis atau empiris yaitu dengan wawancara kepada para pihak yang terdapat didalam perjanjian sebagai alat pengumpul data. Pada penelitian ini penulis melakukan penelitian langsung pada lokasi penelitian untuk mendapatkan data-data, bahan serta informasi yang berhubungan dengan penelitian ini. Kesimpulan yang bisa diperoleh dari hasil penelitian ini bahwa terkait pelaksanaan Perjanjian Kerjasama Pembangunan Rumah Tinggal antara Pihak Pertama Sebagai Pemilik Tanah dengan Pihak Kedua Sebagai Developer, yang disepakati oleh para pihak tidak dapat terlaksana dengan baik dikarenakan pihak developer melakukan wanprestasi dengan tidak membangun unit perumahan tersebut. Penyelesaian wanprestasi yang terjadi pada perjanjian kerjasama pembangunan rumah tingal antara pihak pertama sebagai pemilik tanah dengan pihak kedua sebagai developer adalah dapat di tempuh dengan cara penyelesaian secara litigasi dan non litigasi, yang mana secara litigasi yaitu melalui pengadilan dan secara non litigasi atau diluar pengadilan yaitu melalui Negosiasi, koniliasi, konsultasi, mediasi dan pendapat para ahli.

Abstract

In the implementation of the sale and purchase agreement at Optik Citra Pekanbaru, there were several buyers who committed default so that the seller suffered losses due to the actions of the buyer. This study is a sociological legal research. Research results First, the sale and purchase agreement between the seller and the buyer at Optik Citra Pekanbaru was carried out verbally and in writing. The verbal agreement of the goods to be ordered and the price to be paid and the written agreement written in the payment note and in the note explained the date when the goods were ready to be picked up and the remaining bill. Second, a number of buyers did not complete the bill and pick up the goods that had been ordered and there was a default by the buyer to the seller so that the form of settlement carried out was non-litigation or out of court and accepted a number of losses.
