Abstract

The region has the authority to manage and regulate its territory independently based on the mandate of Article 18 paragraph (2) of the 1945 Constitution. One such authority is to manage natural resources in this case conducting coal mining. The management of coal mining under the Minerba Act places the district/city government in authority in its management. Meanwhile, the Local Government Law places the provincial government also in possession of this management authority. This gave birth to the dualism of regulation in terms of the authority to manage coal, giving rise to a contradiction between one rule and another. The problem in this study is First, how is the condition of coal mining management by local governments in the perspective of regional autonomy? Second, what are the implications of the current coal mining arrangements by the regional government? The results of the study showed that coal mining authority from the district/municipal government under the Minerba Act then was transferred to the provincial government based on the Regional Government Law was reasonable because of various problems that arose from the authority of the district/city government. However, this fact puts the authority of coal mining management in dualism and disharmony in its regulation. This dualism has implications for the disruption of the pattern of authority relations between the central and regional governments, financial management between the central and regional governments, and the division of supervisory authorities between the central and regional governments.

Abstract

This paper aims to explore the legal basis and ethical reasoning for the revocation of parental rights due to domestic violence by placing the child's best interests as a compass and mapping the gap between norms and judicial practices. The method used is normative-doctrinal legal research based on a literature review of the Domestic Violence Law, the Marriage Law, the Child Protection Law, selected jurisprudence, and scientific literature, analyzed qualitatively through systematic interpretation, argument construction, and linking to the facts of the impact of domestic violence on children. The results show that positive law provides a firm basis for sanctions and protections including restrictions on interaction and revocation of custody rights, but implementation is often hampered by vague evidence of psychological violence, the victim's economic dependence, and weak execution of alimony; revocation effectively breaks the cycle when accompanied by a protection order, a post-decision parenting plan, and ongoing psychosocial support. Policy implications include guidelines for proving coercive control, expanding access to timely protection orders, integrating trauma-informed services in religious courts, and a mechanism for executing alimony that does not burden victims, with schools, community health centers, and communities as early detection nodes. Ultimately, legal work and social networks converge in one simple goal: that home again means a safe place for children to return.

Abstract

This research aims to examine the binding force of coastal border land regulations and the mechanism for issuing land certificates by the National Land Agency (BPN) in Botutonuo Village, Bone Bolango Regency. The background of this research is based on the increasing land ownership conflicts in coastal areas, particularly regarding the coastal boundary limits, which are regulated to be at least 100 meters from the highest tide line as stated in Presidential Regulation Number 51 of 2016. The research method used is empirical law with a qualitative approach, thru interviews with the community, village officials, and the National Land Agency (BPN), direct observation in the field, and literature studies. The research results show that the coastal community of Botutonuo has inherited land ownership, but when the certification process was carried out thru the PTSL, PRONA, or sporadic registration programs, problems arose because some of the land parcels for which certificates were issued were located in coastal buffer zones. This creates conflict between customary rights, the economic interests of the community, and the country's legal rules. On the one hand, land certificates provide legal certainty, access to capital, and improved well-being; however, on the other hand, their issuance has the potential to violate ecological aspects and cause disputes between residents. The findings of this research confirm the importance of harmonization between land regulations, environmental conservation, and the economic needs of coastal communities to achieve social justice and sustainable coastal space management.

Abstract

This research aims to analyze the basis of judges' considerations in decisions on illegal mining cases involving foreign nationals and their relevance to the effectiveness of the law in the context of consigning payments of Non-Tax State Revenue (PNBP). The study focuses on three interconnected legal instruments: Gorontalo District Court Decision No. 177/Pid.Sus/2022, Supreme Court Decision No. 1502 K/Pid.Sus/2023, and Gorontalo District Court Consignment Determination No. 1/Pdt.P-Kons/2023. The research method used is a normative legal approach supported by qualitative-descriptive analysis, which relies on the study of legislation, legal doctrines, and court decisions. The research findings indicate that the trial court's considerations at the first instance focused on proving the elements of the offense, while the Supreme Court emphasized the socio-economic legitimacy of small-scale mining activities that had not been formalized as a People's Mining Area (WPR), and rejected criminalization due to regulatory gaps. Furthermore, the court, thru a consignment ruling, proves its role as a harmonizing tool when the state's fiscal obligations must still be met even tho the technical collection mechanism is not yet available. These three legal products illustrate the harmony between legal certainty, the principle of justice, and utility, while also affirming that the effectiveness of law does not only depend on the existence of written norms, but also on the judiciary's sensitivity in responding to existing social and administrative realities.

Abstract

Islamic financial scheme in practice is still causing problems in the wider community due to differences in perceptions that exist in the community. The principle of freedom of contract in Law No. 2 of 1960 concerning agricultural product sharing and Islamic law, especially related to agricultural product sharing and Article 1338 paragraph (1) of the civil code which stipulates that a legally made Agreement will apply like a law for the maker (Pacta Sunt Servanda principle), the word “all” means that every legal subject can make an agreement whose contents are about anything, legal subjects have the freedom to determine the form of the agreement. This normative research aims to analyse the legal ramifications of violating the concept of freedom of contract in agricultural product sharing from the viewpoints of Islamic law.  This result of this article found that the implementing of the revenue sharing system did not get a fair share, this was because at the time of the contract, farmers were in a weak position due to the need for money for children's education and other emergency needs, especially during the Covid-19 pandemic.  The owner of the land has the right to obtain part of the crop on the farm managed by the cultivator and receive back the return of the land upon completion of the agreement.

Abstract

Penelitian ini bertujuan untuk menganalisis peran pengawasan terhadap gerai penjualan dalam perspektif perlindungan konsumen. Dalam era perdagangan modern, konsumen dihadapkan pada berbagai pilihan produk dan layanan, yang kadang kala berisiko terhadap keamanan dan kenyamanan konsumen. Penelitian ini mengeksplorasi bagaimana pengawasan yang dilakukan oleh pemerintah dan lembaga terkait dapat melindungi hak-hak konsumen, serta menilai efektivitas regulasi yang ada.Penelitian ini menggunakan metode studi literatur dan analisis terhadap kebijakan perlindungan konsumen yang berlaku. Hasil penelitian menunjukkan bahwa meskipun terdapat regulasi yang mengatur pengawasan gerai penjualan, implementasinya di lapangan masih kurang optimal. Faktor-faktor seperti rendahnya pengawasan rutin, ketidaktahuan konsumen tentang hak-hak mereka, serta kurangnya penegakan hukum yang tegas turut menjadi hambatan. Oleh karena itu, penelitian ini merekomendasikan peningkatan kerjasama antara pemerintah, pelaku usaha, dan masyarakat konsumen dalam meningkatkan pengawasan dan kesadaran akan perlindungan konsumen.

Abstract

Cartels, or secret deals among competitors to set prices, limit production, or divide markets, pose a significant challenge to healthy competition and market integrity around the world, including in Indonesia. This study examines the use of indirect evidence, such as economic data and communication patterns, in uncovering such covert operations under the Indonesian Competition Law (Law No. 5 of 1999), using the normative juridical approach. The study uses statutory analysis to understand the legal framework, case analysis to explore the use of indirect evidence in law enforcement, and conceptual analysis to enhance theoretical understanding. This study analyzes the decisions of the KPPU and District Courts, KPPU regulations, and relevant legal frameworks to understand the applicability and challenges of using circumstantial evidence in legal proceedings. The results of the study make it clear that, despite its important role, the study identifies legal uncertainty and the need for corroborating evidence as the main obstacles to the effectiveness of indirect evidence. It reveals a significant gap in the acceptance and interpretation of indirect evidence between the KPPU and the judiciary, highlighting the need for clarity and consistency in the law. This review recommends the revision of Law No. 5 of 1999 and related procedural laws to include provisions for the acceptance and utilization of circumstantial evidence, improving the adjudication process of both the KPPU and the courts. This research contributes to Indonesia's understanding of competition law enforcement and promoting fair business practices.

Abstract

There is a legal vacuum that regulates the settlement and legal consequences of pre-contractual promises between parties in Indonesia. This research aims to examine the legal application of the Promissory Estoppel Doctrine in filling legal gaps while comparing it with a number of Common Law countries, including England, which implemented this doctrine earlier. This research uses normative legal research using a comparative approach, case approach and conceptual approach. The sources of legal materials in this research consist of primary, secondary and tertiary legal materials. The application of the Promissory Estoppel doctrine to the Indonesian legal system can be done because there are similarities between the legal system in common law (England, the Philippines) and the legal system in Indonesia, so that courts in Indonesia can use this doctrine to fill legal gaps. Pre-contracts have been regulated in such a way both through legislation and the application of relevant legal doctrines in a number of developed countries. with the doctrine of promissory estoppel, an agreement that has not fulfilled certain conditions or objects, in this case a pre-agreement, can protect a party who has placed a trust in another party in the process of carrying out negotiations which causes him to carry out certain legal actions (rechtshandeling) and causes the birth of reliance. loss. Promissory estoppel is an important concept in English law however, the legal requirements for promissory estoppel may differ from country to country.

Abstract

This study analyzes legal sanctions against parties who do not comply with court decisions in post-divorce child custody cases. The main focus is to identify legal sanctions that can be applied in accordance with the laws and regulations in Indonesia, as well as to examine the inhibiting factors that cause non-compliance with court decisions. The results show that although child custody is expressly regulated in legal regulations such as the Marriage Law and the Compilation of Islamic Law, there are significant challenges in the implementation of judgments, especially when it comes to emotional aspects and protection of children. Hindering factors include ignorance of the law, conflicts between the parties to the dispute, and a lack of a firm law enforcement system. This study recommends strengthening enforcement mechanisms and increasing legal awareness to ensure the effective implementation of child custody.

Abstract

Keberadaan lembaga penyelesaian sengketa di tingkat desa merupakan hal  yang penting dalam upaya menyelesaikan berbagai sengketa yang terjadi di tengah-tengah masyarakat, selain sebagai sarana guna meminimalisir dampak sosial yang timbul pasca terjadinya sengketa. Maka dari itu, kegiatan ini dilakukan untuk menjawab (1) Bagaimana konsep Mediasai di Desa Molowahu, Kecamatan Tibawa, Kabupaten Gorontalo  ? dan (2) Bagaimana implementasi proses Mediasi oleh Mediator yang di perankan Lembaga Mediasi Desa ?. metode yang digunakan dalam kegiatan ini berupa penyuluhan dan sosialisasi. Hasil kegiatan menunjukkan dibutuhkan berbagai regulasi di antaranya berupa peraturan desa agar eksistensi lembaga penyelesaian sengketa terutama dari segi kelembagaan dan minat atau tingkat kepercayaan masyarakat terpelihara dengan baik di masa mendatang. Pengabdian ini dilakukan dengan cara mendeskripsi berbagai aspek tentang topik monitoring dan evalusai yang kemudian diakhiri dengan sesi diskusi. Diperoleh hasil bahwa draft peraturan Desa Desa Molowahu, Kecamatan Tibawa, Kabupaten Gorontalo tentang Lembaga Mediasi.
