Abstract

Sexual violence is a serious problem that affects many individuals throughout the world. In this context, drivers associated with acts of sexual violence are often the focus of attention. The responsibility of third parties, such as transportation service providers or application platforms, can be an important factor in providing compensation to victims who have experienced sexual violence by drivers. This research aims to analyze the responsibilities of third parties, especially companies providing transportation services or application platforms that facilitate meetings between drivers and passengers, in providing compensation to victims of sexual violence. This research uses an analytical approach by collecting data and information related to the policies and practices implemented by the Maxim company. The results of the analysis show that the responsibility of third parties, in this case Maxim, has an important role in providing compensation to victims of sexual violence. Maxim is expected to have a clear and transparent policy in handling reports of sexual violence involving their drivers. They should also provide safe and reliable communication channels for victims to report incidents. Apart from that, Maxim must also ensure that there is a fair and thorough investigation process for reports of sexual violence. They must cooperate with law enforcement authorities to ensure that legal action is taken against drivers involved in sexual violence. In addition, Maxim must provide support and assistance to victims of sexual violence, including access to counseling and mentoring services. This research concludes that the responsibility of third parties, such as Maxim, is very important in providing compensation to victims of sexual violence by drivers. Such companies must have clear policies, effective procedures, and open channels of communication so that victims feel heard and protected. In an effort to prevent sexual violence, such companies must also continue to increase awareness and training for their drivers regarding policies and prohibited actions in the context of sexual violence.

Abstract

The granting of marriage dispensation by judges experienced a discourse from the age of marriage, which originally occurred because of the age difference between men and women, which caused family conditions that were not solid, with the younger age of women causing marriage to look more discriminating against women in the purpose of marriage. Then it changed to a regulation that equalized the age limit for marriage for both men and women. In the treatment of deviations from the rules of marriage age, it is also emphasized that there is equal treatment. However, this cannot limit the judges' ability to render judgments. The examination of marriage dispensation must be carried out thoroughly, so the focus of this study is on how the dynamics present in each decision by judges need to be analyzed. The research method is a study of normative law related to the provisions of the marriage dispensation. The analysis is carried out with the theory of judicial power, which includes legal justice, legal certainty, and legal expediency. The results showed that every judge's decision is affected by the disparity of the judgment on the granting of marriage dispensation when the judge does not examine all the offenses of the application for dispensation in the search for the application for dispensation, which becomes the basis for the judge to consider the decision. So that stigma for urgent reasons does not become unclear and clear. Therefore, every trial must systematically follow the judicial process in order to realize the purpose of marriage

Abstract

The problem of land ownership in Buntulia Village is influenced by the lack of knowledge and awareness of the community about land ownership rights because of the total population of 549 families, 463 people have not registered their own land. This of course raises a fairly basic problem by the village government to be resolved. Therefore, in this downstreaming, the service team provides understanding and legal knowledge to the community about the importance of registering property rights and providing assistance to the community together with the Land Agency through the Border Marks Post Community Movement (GEMA PATAS) in order to increase community participation in installing boundary markings, making it easier for BPN officers to take measurements, as well as being able to accelerate the government program on Complete Systematic Land Registration. Thus the community could see the importance of legalizing property rights to the land in order to avoid disputes and thereby give legal certainty to the parties.

Abstract

This research aims to determine legal protection for consumers regarding differences in display prices at the Indomaret and Alfamart checkout counters. In this research the author uses the type of Juridical-Empirical Law research. Data from the objects studied in this research are classified as primary, secondary and tertiary data. In this thesis, the location where the researcher conducted the research was Gorontalo City, Gorotnalo Province. The choice of research location was based on the consideration that Gorontalo City is the central point for most retail businesses including Alfamart and Indomaret. In this legal research the author uses a statutory approach. The data collection technique was carried out by means of observation and interviews with parties related to the materials studied which were then analyzed using qualitative methods. The results of this research show that in carrying out preventive efforts to protect consumers, the Department of Cooperatives, MSMEs, Industry and Trade (Diskumperindag) of Gorontalo Province carried out several things, such as inspection, counseling and education, and giving warnings or warnings. However, these efforts are not optimal and need improvement, such as inspections that are not regularly scheduled and are often only carried out when receiving complaints from the public, as well as education and counseling which is only carried out to shop owners or employees and less to the public as consumers. Apart from that, researchers also found that preventive efforts to minimize incidents of price display differences were also carried out by Alfamart and Indomaret, such as updating master data, printing price changes as quickly as possible, placing prices on the display accordingly and then changing prices for items that were no longer valid. Regarding repressive efforts, researchers found that in efforts to resolve consumer disputes there are clear regulatory rules and a BPSK institution that handles consumer protection disputes including differences in display prices on Alfamart and Indomaret shelves and cashiers such as mediation, conciliation and legal settlement efforts. However, the problem that arises is the public's ignorance regarding where to complain or report violations as well as the public's negative perception regarding the costs of resolving cases which are considered expensive. To overcome this, researchers believe it is necessary to better educate the public about efficient and affordable complaint and dispute resolution processes.
