Abstract

Abstract. Labor market discrimination in Indonesia remains a significant structural challenge, particularly regarding gender, age, disability, and social status issues, despite the implementation of anti-discrimination regulations. This study aims to evaluate labor market discrimination from the perspective of Islamic economics, assuming that the principles of justice, equality, and worker protection inherent in Islamic economics can offer solutions to prevailing structural injustices. The research employs a qualitative document-based approach, analyzing normative and regulatory narratives from academic literature, positive law, and religious documents. The findings reveal a persistent gap between legal norms and actual practices, with women and people with disabilities frequently facing discrimination in recruitment, promotion, and wage distribution. The integration of maqāṣid sharia principles into labor regulations is considered effective in strengthening worker protection and fostering a more just and inclusive labor market. The study recommends labor regulation reform, the strengthening of sharia-based supervisory institutions, and the enhancement of Islamic economic literacy as strategies for transforming Indonesia’s labor system towards greater equity.
