Perubahan jaman era ini banyak terjadi terutama pada perekonomian negara bidang perbankan. Bank merupakan tempat penyimpanan maupun penyaluran dana masyarakat. Hubungan antara bank dengan nasabah bersifat kerahasiaan, hal ini dipengaruhi karena adanya data diri nasabah yang harus dilindungi oleh bank. Perlindungan data diri dalam bidang perbankan sebagaimana diatur dalam Undang-Undang No 10 Tahun 1998 tentang Perbankan dan Peraturan Bank Indonesia No.7/6/PBI/2005 tentang Transparansi Informasi Produk Bank dan Penggunaan Data Pribadi Nasabah. Penelitian ini menggunakan penelitian secara non-doktrinal yang langsung turun ke lapangan serta dibantu dengan data sekunder. Secara praktik, implementasi perlindungan data diri pada PT BPR Dana Central Mulia diterapkan sesuai berdasarkan peraturan perundang-undangan yang telah ada.

Criminal deeds bring disaster to the life of the people in general, and rights of many are to be stripped of from them without their consent which is then becomes the urgency on why criminal law needs to be enacted and applied. In its provisions, criminal law regulates about sexual violences. It has a potential to caused harm both physically and mentally towards its victim. However, the problem with the system is that at some point, the ideal justice is not met in its enforcement. Indonesian constitution is yet to enact a regulation to restrain or to impose more assertive measures on sexual violences. One of the examples is how rape is recognized only if the victim is a woman who is not the wife of the perpetrator. This idea does not fully protect the right of others who becomes a victim of sexual assault which doesn’t fulfil the ideal justice within the constitution. Comparing to how the United Kingdom sentenced Reinhard Sinaga to prison for life as the consequences of his deed, the authors want to create a comparison on the criminal law in both countries based on Rome Statute of ICC and to discover in what way can Indonesia’s criminal law improve.

Abstract Historical records have admitted the labour law as a curative mechanism for the disparity of bargaining power in the labour market, with contemporary theories concentrating on essential rights protection and fixing inefficiencies. The emergence of the gig economy brings turmoil despite their beneficial nature. The methodology in this study utilises a normative juridical method. The study reveals that the gig economy is not a new phenomenon, but within the context of precarious work. Recommendations were put forward as the justified necessity for a new personalised labour regulation in Indonesia based on the two general principles of statutory efficiency. Intisari Catatan sejarah telah mengakui hukum ketenagakerjaan sebagai suatu mekanisme kuratif untuk mengatasi masalah disparitas daya tawar di bursa tenaga kerja dengan teori kontemporer saat ini yang berkonsentrasi pada perlindungan hak-hak esensial serta memperbaiki inefisiensi. Munculnya gig economy membawa gejolak hukum meskipun sejatinya tetap bersifat sangat benefisial. Metodologi dalam penelitian ini menggunakan metode yuridis normatif. Studi ini mengungkapkan bahwa gig economy bukanlah fenomena baru, melainkan masih tergolong ke dalam konteks pekerjaan tidak tetap. Rekomendasi juga diajukan sebagai suatu kebutuhan yang dijustifikasi untuk memperbarui peraturan ketenagakerjaan yang lebih dipersonalisasi di Indonesia berdasarkan dua prinsip umum efisiensi hukum.

Notaries in Indonesia have existed since the colonial period. Changes in technology and the continuous evolution of information bring a flow of change in all aspects of life, including the legal sector. However, the position of notaries in Indonesia has not undergone significant changes despite ongoing advancements. The promulgation of Law No. 2 of 2014 formally introduced the term “cyber notary” to Indonesian law. However, the idea of cyber notary is not practical because of legal obstacles that seem to form a legal paradox. This work analyzes the position of cyber notaries in Indonesia’s positive legal order and the challenges, adaptations, and compromises actually made to implement cyber notaries in Indonesia. Normative–juridical legal research is adopted as a research method by examining various legal theories and performing comparisons of related laws. This work also presents examples of successful cyber notary implementations from several countries. Results reveal that the implementation of cyber notaries in Indonesia has yet to meet expectations because interrelated laws still create legal paradoxes. This condition results in the inability of notaries in Indonesia to fully evolve into cyber notaries. Recommendations for stakeholders are presented as valuable insights.

Yayasan dapat memperoleh pengakuannya sebagai badan hukum jika akta pendirian yayasan telah mendapat pengesahan dari Kementerian Hukum dan Hak Asasi Manusia. Penginputan data ke Direktorat Jenderal Administrasi Hukum Umum dimungkinkan terdapat perbedaan diantara akta dan Surat Keputusan, perbedaan tersebut dapat terjadi karena faktor sumber daya manusia. Adanya perbedaan data tersebut menimbulkan suatu permasalahan hukum, oleh karena itu harus dilakukan perbaikan data badan hukum yayasan pada sistem AHU online. Metode pelaksanaan PkM dilaksanakan dengan observasi dan monitoring kemudian dikumpulkan berbagai informasi untuk menghasilkan sebuah flowchart. Pelaksana berharap apabila terdapat perubahan prosedur tata cara pengajuan perbaikan data badan hukum yayasan maka dapat dilakukan revisi sesuai dengan prosedur yang ada.

Finding research “gaps” is an important aspect that must always be done when starting research. Especially if the research is a sociological research. This article aims to shed light on the sociological approach in legal research into approaches, namely the Sociology of Law approach and the approach of Socio-legal Studies. These two approaches have different and unique ways of defining research “gaps.” This article will examine using empirical methods that rely on primary and secondary data, as well as inductive methods to analyze data. A comparison will also be made between Ehrlich’s “living law” and Pound’s “law in action” so that the differences between the two ideas can be found so that in the future, future researchers will not consider the two ideas identical.

The presence of the Company Law in Indonesia is a form of the government's special attention to the Company as one of the pillars of Indonesia's national economic development. Some regulations in the Company Law are recommendations, but some are orders that must be implemented. One of them is the agenda of the Annual General Meeting of Shareholders which is regulated in Article 78 paragraph (2) of the Company Law as a mandatory activity that has been neglected by the closed Companies. The Purposive sampling technique is used in this juridical-empirical research supported by interviews with several companies’ organs. The authors present the results of the research in descriptive form supported by analysis using the theory of legal effectiveness from Soejono Soekanto and the theory of sociological jurisprudence from Eugen Ehrlich. Through this research, the authors found a lack of information received and a low understanding by business actors especially in the obligations of the Annual General Meeting of Shareholders. This makes business actors underestimate the Annual General Meeting of Shareholders. Actually, it has a good influence on the Company in financial transparency and accountability for the performance of the Board of Directors and Board of Commissioners of the Company to shareholders. Government contributions are needed through various relevant institutions, such as the Ministry of Law and Human Rights of the Republic of Indonesia and Notary Public to implement the Annual General Meeting of Shareholders as mandated in the Company Law.

BPR Dana Nagoya merupakan lembaga perbankan yang berdiri selama tiga belas tahun lamanya, sebagai lembaga perbankan yang menyalurkan kredit kepada masyarakat, peristiwa kredit bermasalah merupakan hal yang lazim ditemukan dalam praktik perbankan. Terdapat beberapa cara dalam menyelesaikan kredit bermasalah, salah satu diantaranya adalah lelang. Namun, saat ini BPR Dana Nagoya belum memiliki prosedur lelang yang aplikatif dalam menyelesaikan kredit bermasalah. Dalam proses penyusunan laporan pengabdian kepada masyarakat ini, penulis telah melakukan survey lokasi dan mengumpulkan data dan bahan yang diperlukan dalam penyusunan laporan, Penyusunan prosedur lelang merupakan tahap pelaksanaan dalam laporan ini, laporan disusun dengan metode yuridis empiris yang mana data yang diperoleh penulis adalah melalui wawancara dan observasi dilapangan dengan didukung peraturan perundang-undangan dan karya ilmiah. Dalam laporan pengabdian kepada masyarakat ini, penulis diperkenankan untuk memberikan luaran proyek berupa diagram alir yang menjelaskan tentang prosedur lelang bagi BPR dan diharapkan luaran yang dihasilkan dapat bermanfaat bagi perusahaan dalam menyelesaikan kredit bermasalah.

Policies in company regulations are important so it is necessary to update the policies in a company regulation. We can notice this when there are reforms in the arrangements in the employment cluster, namely the Omnimbus law or Law no. 11 of 2020 concerning job creation. The renewal of these regulations certainly triggers issues that affect the welfare of workers in a company, starting from the arrangement of wages, severance pay, work agreements for a certain time or a lifetime contract. Some of the problems found when carrying out this practical work activity program are the absence of renewal of policies in a company regulation, so in this case the author thinks he wants to carry out this practical work activity by providing assistance in the preparation of new company regulations and fair for employees in the company.

Legal protection of workers is a guarantee of basic rights inherent and protected by law. Human rights are basic rights that must be protected. The legislation related to protection for workers is the Employment Cluster of Law No. 11 of 2020 on Job Creation. Honoree employees in the Batam Department of Transportation entered into a certain time work agreement (PKWT). Contract workers are legally defined as workers with a certain time status based on an agreement between the worker and the employer. Based on the title, topic, and background of the problem, the author made updates and improvements related to the employment contract of honorary employees (PKWT) of the Batam City Department of Transportation in the form of making employment documents. The renewal and improvement of the employment contract covers the duties and responsibilities of workers, workers' rights and obligations, salary payments and deductions, sanctions and compensation as well as the appointment and termination of employment (PHK) based on Employment Cluster of Law No. 11 of 2020 on Job Creation.
