Abstract

Riau Province is one of the areas with natural resources is very high. The condition is directly aligned with the number of criminal acts of illegal trade in wildlife. Based on this understanding, the authors formulated two formulation of the problem, namely: First, Do causes of the illegal trade in wildlife is protected pursuant to Act No. 5 of 1990 on Conservation of Natural Resources and Ecosystems in the jurisdiction Ditreskrimsus Riau Police ?. Second, How the criminal responsibility of the perpetrators of criminal acts illegal trade in wildlife is protected pursuant to Act No. 5 of 1990 on Conservation of Natural Resources and Ecosystems in the jurisdiction Ditreskrimsus Riau Police ?.This type of research can be classified in this type of sociological juridical research, because this research author directly conduct research on the location or point examined in order to provide a complete and clear picture of the problems to be studied. This research was conducted in Ditreskrimsus Riau Police, while the sample population is a whole party with regard to the issues examined in this study, the data source used, primary data, secondary data, and the data terier, technical data collection in this study with interviews and literature study then analyzed qualitatively and process data and generate descriptive data and then infer deductively.From the research problem there are two main things that can be summed up as follows: First, the factors that cause illegal trade in wildlife is protected pursuant to Act No. 5 of 1990 on Conservation of Natural Resources and Ecosystems in the jurisdiction Ditreskrimsus Riau Police, Lack on public awareness and knowledge of wildlife, economic factors being one of the very important, conflict between people and wildlife, high demand from buyers, and less specifically punishment or sanctions given to the perpetrators of criminal acts. Abstract

Business opportunities to hold umrah services are very interesting becausethe majority of the population of Indonesia is Muslim. Fraud cases carried out bythe Hajj and Umrah Travel bureau companies are not the only corporate criminalacts that occur in Indonesia, Fraud Cases of the First Travel Hajj and Umrahtravel agencies, Abutours, fraud cases of the Hajj and Umrah travel agents JoePentha Wisata, Fraud travel agency cases Hajj and Umrah, PT Solusi BaladLumampah (SBL). The rarity of corporations that are made as suspects ordefendants is certainly interesting to study and study.This type of research can be classified in normative legal research, namelylegal research conducted by researching library materials. This study examinesthe subject matter in accordance with the scope and identification of the problemthrough a statute approach carried out by examining the laws and regulationsthat relate to the legal issue under study. In this study the authors conducted astudy of the principles of law by utilizing descriptive methods. Data collectiontechniques used in the Normative Legal Research are library research methods(library research) which uses the library as a means of collecting data, bystudying books as reference material related to the problems to be studied.The conclusion that can be obtained from the results of the study isCriminal Crime Accountability by the Company Hajj and Umrah Travel Agenciesexperiencing obstacles. There is no uniformity of understanding among lawenforcement officials ranging from the police, prosecutors to the judiciary aboutthe criminal responsibility of the corporation. The Ideal Setting of Fraud CrimeAccountability by Hajj and Umrah travel agency companies must provide legalcertainty. Abstract

Law Number 22 Year 2001 concerning Oil and Gas regulates upstream business and downstreambusiness in the commercial sector and can be implemented after obtaining permission from the government.This study raises the issue of retailers of fuel oil who do not have permission from the government but do notimplement criminal law enforcement processes. The purpose of this research is also to first discuss how lawenforcement against retail oil fuel sellers is linked to Law Number 22 Year 2001 concerning Oil and Gas.The second is what is the reason for the seller of oil-based fuels to do fuel oil trading without permissionfrom the government. Researchers use research methods with juridical sociological approaches.This research method uses primary data, namely data obtained directly from the field, and alsosecondary data, namely literature studies using primary legal materials secondary legal materials, andtertiary legal materials. The data is then used to describe an object problem in the form of synchronizing thefacts that occur with the applicable laws and regulations.Based on the results of the study, it can be seen that the criminal act of selling retail fuel has notbeen running as it should because of a lack of socialization between the government and the publicregarding the procedures for trading fuel oil, then a lack of legal awareness in this case the retailercomplies with criminal provisions 22 of 2001 concerning oil and gas, increasing economic needs is thereason people sell fuel in retail and the length of the process of making business licenses is the reason forconducting ecran fuel trading without permission.Keywords : Law Enforcement, Retail Fuel Seller, Justice

Abstract

There are many ways to get this job mainly illegally through brokers recruitment of civil servants. In this case relates to the role of the Criminal Investigation Unit Pekanbaru City resort in Deeds Cheating Crime Investigation Conducted by Calo candidate for Civil Servants. The purpose of this thesis, namely; first, the role of the Criminal Investigation Unit Pekanbaru City resort in the investigation of criminal acts committed by fraudulent brokers civil servant candidates, second, barriers experienced by the Criminal Investigation Unit Pekanbaru City resort in the investigation of criminal acts committed by fraudulent brokers prospective civil servant , third, the efforts made by Satreskrim resort town of Pekanbaru in overcoming the obstacles that arise in the investigation of criminal acts committed by fraudulent brokers civil service candidates. This type of research can be classified into types of sociological research. This study was performed in Pekanbaru City Police , while the overall population and the sample is related to the issues examined in this study, the data source used, primary data , secondary data and data tertiary data collection techniques in this study with questionnaires, interviews and literature study. From the research there are three basic problems that can be inferred. First, Role Satreskrim resort city of Pekanbaru in the investigation of criminal acts committed by fraudulent brokers civil servant candidates accomplished in accordance with the Code of Criminal Procedure. Second, barriers experienced by Satreskrim resort town of Pekanbaru in the investigation of criminal acts committed by fraudulent brokers civil service candidates, namely the lack of evidence of the complainant, witnesses were difficult to come by, no clear division of tasks between the units Satreskrim as well as the suspect who had escaped. Third, efforts made by Satreskrim resort town of Pekanbaru in overcoming the obstacles that arise, namely to disseminate the importance of awareness of the law, not give sufficient evidence, find suspects, increasing the number of investigators. Suggestions writer, first, the expected role Satreskrim Pekanbaru City resort in the investigation of criminal offenses fraudulent acts committed by brokers candidates Civil servants should be implemented with Effective in accordance with the duties and responsibilities, Second, barriers experienced by Satreskrim Pekanbaru City resort in the investigation of criminal acts The cheaters must be completed properly. Abstract

The progress of the transportation system has driven a person towards lifestyle, namely application-based transportation, called online transportation, which has been characterized by hatred for moving places, fluency in the exchange of goods and services, and the high level of employment and high social mobility. Motorcycle taxis have become alternative transportation for some people because they are flexible in their activities, can reach places that are not passed by public transportation such as city transportation, buses, or other types of four-wheeled public transportation.This type of research can be classified in the type of sociological legal research,because in this study the authors immediately conduct research on the location or place under study in order to provide a complete and clear picture of the problem under study. This research was conducted in Pekanbaru City, while the population and samples were Head of Unit Then in Pekanbaru City Police, Members of Pekanbaru City Police, application-based motorcycle taxi management in Pekanbaru City and application-based motorcycle taxi drivers in Pekanbaru City.The conclusion that can be obtained from the results of the study is the implementation of Article 283 of Law No. 22 of 2009 concerning traffic and road transportation for application-based motorcycle taxi drivers in the city of Pekanbaru has not yet proceeded as it should. Abstract

Class IIA Penitentiary institutions Pekanbaru also not independent security and public order disturbances. Types of security problems found in the Institute Penitentiary Class IIA Pekanbaru include: runaway, fights between fellow prisoners and detainees, theft of goods belonging to fellow inmates, riots and so forth. The purpose of writing this essay to examine the implementation of security for inmates at the Penitentiary Class II A Pekanbaru, obstacles in the implementation of security for inmates at the Penitentiary Class II A Pekanbaru and efforts made in overcoming obstacles to the implementation of security inmates at Penitentiary Class II A Pekanbaru.This type of research is legal research sociological research that is done by holding the identification law and how the effective implementation of the law in force in the community, or reviewing the situation through field problems associated with aspects applicable law. Source data used primary legal materials, secondary and tertiary.From the results of this study concluded, the implementation of security for Prisoners in Penitentiary Class II A Pekanbaru carried out in accordance with Standard Operating Procedures SOPs or owned by any guard or any security and guarding and supervision by cooperating with the Mobile Brigade and the Police. Obstacles in the implementation of security for inmates at the Correctional Institution Class IIA Pekanbaru are: lack of personnel security officer Pekanbaru Penitentiary Class IIA, not all of them armed security officers in perform duty to secure the inmates at the Correctional Institution Class IIA Pekanbaru dn their uncooperative behavior such prisoners , attempt to escape. Efforts to overcome obstacles in the implementation of security for inmates Penitentiary Class II A Pekanbaru is to increase the number of personnel security officer Pekanbaru Penitentiary Class IIA, improving Human Resources for security officers prisons, limiting the space for inmates. Abstract

The smuggling that occurs in Bengkalis District, Bengkalis Regency is due to the Bengkalis islands, so that there are many official and unofficial port lines directly bordering several neighboring countries such as Malaysia and Singapore.So it becomes a crossing in and out of people smuggling. Bengkalis District Police Department in 2019 succeeded in arresting 1 suspect and securing 8 (eight) people who came from Sumatra and Java. In 2018 the police also secured 4 suspects in human smuggling cases, all of whom were the majority of original Bengkalis residents.This type of research is classified as sociological research, because in this study the author directly conducts research at the location or place in order to provide a complete and clear picture of the problem under study. This research was conducted at Bengkalis Resort Police, while the population and sample are all parties related to the problem examined in this study, the source of the data used, primary data, and secondary data, and tertiary data, the data collection techniques in this study were carried out by interview, and literature study.The results of the study include: First, the investigation of human smuggling crimes in Bengkalis District handled by the Bengkalis District Police is not optimal. Second, the factors of this smuggling activity are organized, the mode of operation is interrupted, the budget, the lack of legal awareness in the community.Third, efforts to deal with human trafficking crimes that are effective and efficient in handling this case by conducting strict safeguards on official and unofficial channels, adding costs, completing facilities and infrastructure, providing protection to victims, and approaching the community regarding the dangers of smuggling crimes. human.Keywords: Invistigation-People Smuggling- suspect

Abstract

One criminal sanctions in felony obscenity against children is a criminal sanction fines. criminal fines imposed and then pulled by the Prosecutor General and submitted to the state. In this case the fine is not good for the victim because the victim did not get anything out of that has been levied by the state. In this case the penalty is only useful for the country but not beneficial to the offender and the victim. Based on the Law of the Republic of Indonesia Number 31 of 2014 on the Amendment of Act No. 13 of 2006 on the Protection of Witnesses and Victims in section 7A and 7B stated that crime victims can get restitution and compensation,This type of research will author is a normative legal research (legal research) or also called the research literature, the research done with normative juridical approach under study is library materials or secondary data, which consists of primary legal materials, secondary law, and tertiary legal materials. The type of research that I use is the study of the principles of law.The results of research by the author is the first, setting the penalty contained in Law No. 35 of 2014 concerning amendments to the Law No. 23 of 2002 on the protection of children. Abstract

Salah satu problem yang dihadapi bangsa Indonesia saat ini adalah kelebihan muatan atau ruang yang tidak cukup di Lembaga Pemasyarakatan (LAPAS) karena pemidanaan yang selalu berujung penjara dan masuk LAPAS. Bahkan beberapa kasus tindak pidana ringan sekalipun terkadang juga berujung masuk Lapas. Para narapidana yang sudah bebas dari tahanan yang tidak memiliki kemampuan atau keahlihan apapun selain melakukan kejahatan, saat bebas maka tetap akan mengulang kembali tindak pidana yang pernah dilakukannya (residivis) dan kembali masuk Rutan atau Rumah tahanan. Harusnya kondisi Rumah Tahanan sudah ada pengurangan narapidana namun akibat residivis maka bertambah lagi. Kelebihan muatan dari ruang yang disediakan di Lembaga Pemasyarakatan di Indonesia sudah banyak terjadi. Untuk itu pidana berujung penjara yaitu beberapa tindak pidana ringan harapannya bisa diahlikan ke alternatif lain yaitu pidana kerja sosial.Penelitian ini adalah penelitian hukum Normatif, dimana penelitian hukum normatif ini dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier, yaitu mengkaji mengenai perbandingan hukum antara pidana penjara dengan pidana kerja sosial sehingga dapat diformulasikan di Indonesia. Pidana. Penelitian ini menggunakan sifat peneltian deskriptif, karena penulis bermaksud memberikan gambaran secara jelas dan rinci mengenai pidana kerja sosial.Dari hasil penelitian, disimpulkan bahwa pidana kerja sosial dapat diterapkan atau dicoba untuk diformulasikan juga di Indonesia. Beberapa negara seperti Belanda, Jerman dan Denmark yang telah mengenal pidana kerja sosial sejak lama namun dikatakan sebagai hukuman kerja sosial. Meskipun dalam Kitab undang-undang hukum pidana negara Indonesia Pasal 10 belum diatur mengenai pemidanaan jenis pidana kerja sosial, namun di RKUHP Indonesia telah disinggung mengenai menerapkan pidana kerja sosial ini sebagai salah satu jenis pemidanaan yang dapat diberlakukan. Mempelajari beberapa keahlihan atau tambahan keterampilan di luar Lapas perlu dilakukan sehingga tujuan pemidanaan juga dapat terwujud yaitu memperbaiki si terpidana dan mencegah terjadinya kejahatan di masa mendatang.Kata kunci: Formulasi, Kapasitas, Lembaga Pemasyarakatan

Abstract

Excise also known as state’s charge imposed for some specific commodities which have characteristics written in law, it functions as state’s income for the need of public welfare. The distribution of illegal Alcohol without excise in Tanjungpinang uses some operating mode such as the distribution of plain Alcohol without excise and the distribution of Alcohol in the free trade zone, until now none of the cases related to the distribution of illegal Alcohol processed in the trial. Hence, there are a lot of questions related to the cases and the public are wondering why the distributions seems so legal among the society even though there are some distributors that have been arrested. The objectives of this research are; first, the law enforcem ent of the distribution of illegal Alcohol without excise. Second, the obstacles found during the law enforcement of the distribution of illegal Alcohol without excise. Third, the efforts made to overcome the obstacles in law enforcement of the distribution of illegal Alcohol without excise.The conclusion of this research are; First, the Directorate General of Customs and Excise did some preventive actions such as conducting a law counselling, observation and patrolling, whereas in the repressive way they arrest the litigants, confiscating or prohibiting the distribution of illegal commodities and market operation. Second, the obstacles found during the law enforcement are internal factors such as lack of staffs and operational facilities. While, the external factors are the boundaries of free trade zone are not clear, role of society and small traders which is less and the difficulty in finding the illegal distributors of Alcohol. Third, the efforts made to fix the problems related to customs and excise are by proposing the addition of staffs in the Directorate General of Customs and Excise and adding the operational facilities. In addition, other external parts that have to be considerate are by improving the security of Sri Bintan Pura Tanjungpinang as an international harbour, patrolling and coordinating with The Indonesian Navy, raising the awareness, law-abiding and doing some observation with the intelligence team.The writer’s suggestions related to the problems of this research are; first, the writer hopes the solutions may reach the small traders and the distributors of illegal Alcohol without excise. Second, for the government as the policy maker may find some ways to make the boundaries of free trade zone become clearer.
