Abstract

Presidential Regulation Number 13 of 2018 concerning the Principle of RecognizingBeneficial Owners of Corporations in the Context of Preventing Crimes of MoneyLaundering and Terrorism Financing is the highest legal umbrella for implementing theprinciple of recognizing beneficial ownership in Indonesia today. Reporting data onbeneficial owners of a corporation is mandatory, so data validation is a very crucial thing todo. In this presidential regulation, only matters of an administrative nature are regulated andno threat sanctions have been regulated as a means of prevention and providing a deterrenteffect to every perpetrator of violations in terms of validating data on the beneficial ownersof a corporation.This research is normative legal research supported by secondary data,carried out by using library materials as the main focus. Also called doctrinal legal research,namely legal research that uses data based on library research by taking quotations fromreading books, or supporting books that are related to the problem to be researched. Thus,this research uses secondary data sources consisting of primary, secondary and tertiary legalmaterials. This research also uses qualitative data analysis and produces descriptive data.From the results of the discussions and research carried out, several conclusionswere obtained, namely: First, the regulation regarding Reporting of Beneficial Owners of aCorporation is regulated by Presidential Regulation Number 13 of 2018. In terms of law-making procedures, a Presidential Regulation is not justified in containing criminalprovisions , because there is a principle of No Punishment Without Representatives, criminalprovisions are only included if the Regulation is issued by the Legislative Body. Second,criminalization must be created through legality which will be included later in a new law,raising the level of the Presidential Regulation to a law which contains provisions forimprisonment and fines which are prepared taking into account the outlook on life,awareness and legal ideals, as well as philosophy. the Indonesian nation which originatesfrom Pancasila and the Preamble to the 1945 Constitution of the Republic of Indonesia.Keywords: Criminalization - Corporation – Beneficial Owner

Abstract

In contrast to positive law, customary law does not recognize the distinction between criminal law and civil law. The settlement of cases in the community is carried out by means according to customary law. One of the cases resolved according to Riau Malay customary law was a case of insulting the Malay tribe in Dumai City. Using empirical juridical research methods, based on the results of the study, it was found that the settlement of cases of insults to the Malays was carried out by deliberation and sanctions ranging from light to severe sanctions, namely making yellow rice, slaughtering animals in the form of chickens, goats and buffaloes and disposing of the country which was divided into two, namely disposing of the country within a specified time and disposing of the country that was not determined.

Abstract

The purpose of this research is to find out the concept of criminal law renewal to place restorative justice as ultimum remedium in certain crimes with a prison sentence of under five years. This type of normative legal research with the type of legal synchronization. Collecting data on normative legal research uses data collection techniques from a literature study. In drawing conclusions the author uses the deductive thinking method, namely a way of thinking that draws conclusions from a general statement or argument into a specific statement. the results of research and discussion can be concluded. First; The restorative justice approach to criminal acts with the threat of imprisonment for under five years finds its footing in the basic philosophy of Pancasila, namely in accordance with the 4th precept of Pancasila "Deliberation to reach consensus". Currently, restorative justice has been regulated in various regulations/policies. The contents of this internal policy show that there is no uniformity in understanding and boundaries of criminal acts that can be resolved through restorative justice and does not create an Integrated Criminal Justice System. and the imposition of criminal sanctions on perpetrators.

Abstract

This study aims to examine the policy of criminalizing sexual intercourse with corpses within the framework of Indonesian criminal law. The primary focus lies in comparing the old Criminal Code, which did not explicitly regulate such acts (only through Article 181 on mistreatment of corpses), with the new Criminal Code, which explicitly criminalizes the act under Article 271. Employing a normative juridical approach, this research is analyzed using the principles of legality, the theory of culpability, and supported by non-legal theories such as morality, legal sociology, and forensic psychology to strengthen the rationale for criminalization. The findings demonstrate that penalizing sexual acts with corpses is legally justifiable, both from the perspective of substantive and procedural criminal law, as it reflects the protection of human dignity even after death. This study also identifies several challenges in the implementation, including low public awareness and evidentiary difficulties, and proposes enhancing legal education and inter-agency collaboration as potential solutions. The research contributes to the development of a more humanistic and responsive Indonesian criminal law in addressing contemporary crimes.
