Abstract

This study explores the philosophical values and human rights implications within the Bajapuik tradition, a distinct matrimonial practice of the Padang Pariaman tribe in Sumatra. Explores the philosophical values of the unique amalgamation of local wisdom and Islamic law as an example of integrating cultural heritage with religious principles in marriage. As qualitative descriptive field research, data were gathered from interviews and documentation from a diverse group of informants, including religious leaders, traditional leaders, community leaders, and the people of Padang Pariaman. By utilising a sociological approach, the study examines the social realities of the Bajapuik tradition, mainly focusing on its dowry practice, particularly the maslahah (general welfare) concept. Contrary to typical dowry practices, in the Bajapuik tradition, the bride’s family provides the dowry to the groom, symbolising respect and equality rather than economic burdens. This study highlights that the Bajapuik tradition is not merely a transactional stage in the marriage process but a more profound expression of community bonds and shared values. The findings emphasise the strong philosophical values of mutual respect and companionship inherent in the Bajapuik tradition, demonstrating its alignment with Islamic law and human rights values. This research reveals how the Minangkabau’s adherence to religious and local wisdom significantly reinforces human rights within traditional practices. Furthermore, the study examines the extent to which the Bajapuik tradition achieves the objectives of maslahah in marriage. The results show that the Bajapuik tradition supports general welfare (maslahah) by strengthening social bonds, upholding the dignity of women, and ensuring justice and equality in marital relationships, offering a new perspective rarely explored in previous studies.

Abstract

This study aims to analyze the philosophy of the Tabot ritual, commemorating the death of Ḥasan in the fields of Karbala, rooted in the traditions of Shia and Sunni, from the perspective of Islamic law. The Tabot ritual embodies noble Islamic values intertwined with local wisdom and cultural acculturation in Bengkulu society. This study employs a field research approach, collecting data through in-depth interviews and documentation with religious leaders, traditional leaders, community figures, and residents in Bengkulu. The findings reveal that the nine stages of the Tabot ritual—Mengambik Tanah, Duduk Penja, Menjara, Meradai, Arak Penja, Arak Serban, Gam, Arak Gedang, and Tabot Tebuang—are imbued with profound philosophical meanings in line with Islamic principles. These include the value of acculturation in Mengambik Tanah, self-purification in Duduk Penja, the spirit of Islamic brotherhood in Menjara, and self-reflection in Tabot Tebuang. From an Islamic legal perspective, the Tabot ritual illustrates a harmonious adaptation of ritual practices while adhering to respect and coexistence within Islamic teachings. The ritual’s symbolic modifications, such as removing elements deemed offensive to the Companions of the Prophet Muḥammad SAW, reflect a commitment to maintaining Islamic unity. Although originating from a Shiite tradition, the Tabot ritual has been contextualized and accepted broadly, including by Sunni communities, showcasing its alignment with Islamic jurisprudential values. AbstrakPenelitian ini bertujuan untuk menganalisis filosofi Tabot sebagai ritual memperingati wafatnya Ḥasan di padang Karbala yang berakar pada tradisi Syiah dan Sunni dari sudut pandang hukum Islam. Ritual Tabot merupakan perwujudan nilai-nilai luhur Islam yang terjalin dengan kearifan lokal dan akulturasi budaya masyarakat Bengkulu. Penelitian ini menggunakan pendekatan penelitian lapangan, yaitu pengumpulan data melalui wawancara mendalam dan dokumentasi terhadap tokoh agama, tokoh adat, tokoh masyarakat, dan warga di Bengkulu. Hasil penelitian menunjukkan bahwa sembilan tahapan ritual Tabot—Mengambik Tanah, Duduk Penja, Menjara, Meradai, Arak Penja, Arak Serban, Gam, Arak Gedang, dan Tabot Tebuang—memiliki makna filosofis yang mendalam dan sejalan dengan prinsip Islam. Di antaranya adalah nilai akulturasi budaya dalam Mengambik Tanah, penyucian diri dalam Duduk Penja, semangat persaudaraan Islam dalam Menjara, dan refleksi diri dalam Tabot Tebuang. Dari sudut pandang hukum Islam, ritual Tabot menggambarkan adaptasi praktik ritual yang harmonis dengan tetap berpegang pada rasa hormat dan hidup berdampingan dalam ajaran Islam. Modifikasi simbolik ritual tersebut, seperti menghilangkan unsur-unsur yang dianggap menyinggung para Sahabat Nabi Muhammad SAW, mencerminkan komitmen untuk menjaga persatuan Islam. Meski berasal dari tradisi Syiah, ritual Tabot telah dikontekstualisasikan dan diterima secara luas, termasuk oleh komunitas Sunni, yang menunjukkan keselarasan dengan nilai-nilai yurisprudensi Islam.

Abstract

The 2019 General Election (Pemilu, Indonesia) divided Indonesian society into two sides, namely the #2019GantiPresiden and the #Jokowi2Periode. The situation between the two sides was tense, which could potentially cause a commotion and worsen the public's situation. Supporters of Jokowi's camp describe the #2019GantiPresiden movement as an attempt to commit makar (treason) against the legitimate government, while the government's opposing side describes the accusation of treason as a violation of democratic freedoms. Based on the foregoing, the question arises as to whether going against the government can be considered makar, which is a criminal act. The type of this study is normative research that uses library research to collect data. This study concludes that opposing the government (Oposisi) or criticizing the government is not makar, but rather the right to free expression. Makar as a negative brand image should not exist in a democratic post-reform environment. It should be used sparingly so that no arbitrariness violates human rights. This corresponds to the definition of al-bughah in Islamic criminal law. Pemilihan umum (Pemilu) pada tahun 2019 telah memecahkan masyarakat dengan dua kubu/ dua gerakan, yaitu gerakan #2019GantiPresiden dan gerakan #Jokowi2Periode. Situasi pun mencekam antara kedua belah pihak yang berpotensi mengarah kepada keributan, dan menyebabkan kondisi masyarakat semakin memanas. Pendukung kubu Jokowi menyebut gerakan #2019GantiPresiden merupakan upaya makar terhadap pemerintahan yang sah, sementara kubu diseberang pemerintah (oposisi) menyebut tuduhan makar tersebut merupakan pelanggaran terhadap kebebasan demokrasi. Berdasarkan latar belakang diatas timbul pertanyaan apakah bersebrangan dengan pemerintah dapat dikatakan sebagai makar yang merupakan tindak pidana?. penelitian ini termasuk jenis penelitian normatif dengan teknik pengumpulan data melalui penelusuran kepustakaan (method of library). Penelitian ini menyimpulkan bahwa bersebrangan dengan pemerintah (oposisi) atau mengkritik pemerintah belum bisa dimaknai sebagai makar melainkan hak kebebasan berpendapat. Makar sebagai brand image negative tidak sewajarnya muncul dalam suasana berdemokrasi pasca reformasi. Seharusnya makar dimakanai secara limitative agar tidak ada kesewenang-wenangan yang merugikan hak asasi manusia. Hal tersebut sejalan dengan makna al-bughah dalam hikum pidana Islam.

Abstract

The phenomenon of unregistered marriage in Tanah Datar, West Sumatra, reflects the complex interplay between customary traditions (adat), Islam, and the state within contemporary Minangkabau society. This article investigates how the traditional triadic authority—Tungku Tigo Sajarangan, consisting of ninik mamak (customary leaders), alim ulama (religious scholars), and cadiak pandai (intellectuals)—understands and responds to the increasing prevalence of unregistered marriage. Employing a qualitative approach through in-depth interviews and field observations, the study reveals that unregistered marriage is perceived not merely as a bureaucratic irregularity due to its absence in the state legal registry, but also as a deviation from both communal norms and the socio-cultural structure of the Minangkabau. This practice signals a broader shift in societal authority, wherein the influence of Tungku Tigo Sajarangan has diminished amid the rise of individualistic religious interpretations, the pressures of modernity, and the weakening of customary mechanisms of social control. The article argues that unregistered marriage serves as an indicator of the delegitimation of local cultural values, contributing to social fragmentation within the community. Addressing this issue necessitates a revitalization of customary institutions to restore their mediating role in balancing customary norms, Islamic principles, and national legal frameworks. Reinforcing local authority is thus imperative to counteract social disintegration and reestablish harmony within the marital order of Minangkabau society. [Fenomena nikah siri di Tanah Datar, Sumatera Barat, merupakan cerminan dari kompleksitas relasi antara adat, agama, dan negara dalam masyarakat Minangkabau kontemporer. Artikel ini mengeksplorasi bagaimana Tungku Tigo Sajarangan—yakni ninik mamak (pemimpin adat), alim ulama (otoritas agama), dan cadiak pandai (kaum intelektual)—memahami dan merespons praktik nikah siri yang kian marak. Penelitian ini menggunakan pendekatan kualitatif melalui wawancara mendalam dengan tokoh-tokoh adat dan observasi di lapangan. Hasil penelitian menunjukkan bahwa nikah siri tidak semata-mata dianggap sebagai pelanggaran administratif karena tidak dicatatkan dalam sistem hukum negara, melainkan juga sebagai bentuk penyimpangan terhadap norma adat dan struktur sosial komunal. Praktik ini menandai terjadinya pergeseran otoritas dalam masyarakat: peran Tungku Tigo Sajarangan semakin terpinggirkan akibat dominasi tafsir individual atas ajaran agama, pengaruh modernitas, serta melemahnya fungsi pengawasan sosial dari institusi adat. Lebih jauh, artikel ini mengemukakan bahwa nikah siri merupakan salah satu indikator delegitimasi terhadap nilai-nilai kultural lokal, yang berdampak pada disintegrasi sosial dalam komunitas Minangkabau. Situasi ini menuntut adanya revitalisasi peran lembaga adat agar dapat menjalankan fungsi mediasi antara kepentingan adat, syariat Islam, dan regulasi negara secara seimbang. Dengan demikian, penguatan otoritas lokal menjadi langkah strategis dalam menanggulangi fragmentasi sosial dan mengembalikan harmoni dalam tatanan perkawinan masyarakat Minangkabau.]

Abstract

This article discusses the concept of I'jaz al-Qur'an and its relationship with Arabic as a form of criticism of the logos concept put forward by Louis Awad. This research is a literature review conducted by collecting related data sources to analyze the character's thought in question. The concept of I'jaz al-Qur'an is a study related to the faith of Muslims, in this case the existence of the al-Qur'an as Kalamullah. Among the Islamic scholars, two views have been very influential since this issue was raised, namely the Asy'ariyah and Mu'tazilah circles. These two groups agree to believe that the Qur'an is Kalamullah. However, in this case, Dr. Louwis expresses this opinion and relates it to the concept of Christian Logos, in which the concept of al-Qur'an, as the eternal Kalamullah (qadim) put forward by two major groups in Islamic Theology, is an adoption of the Christian Logos concept. The misappropriation of the information provided by Dr. Louwis shows his lack of understanding and mastery regarding the issues he addresses in his book. Not supported by historical facts and correct scientific studies, he conveyed in his book a form of hatred against Islam, the Koran and the Arabic language in particular and the Arab nation in general.

Abstract

This paper aims to find out the provisions of polygamy in Malaysia and Indonesia related to the protection and fulfillment of wife's rights from a gender perspective. The method of writing this article uses a comparison, by comparing the provisions of polygamy in the two countries then analyzing it with a gender approach. The result is that both countries allow polygamy. However, the provisions on the permissibility of practicing polygamy in Malaysia and Indonesia place more emphasis on physical conditions. Such as reasons because they are barren, aged, crazy and cannot serve and carry out their obligations as a wife. The ability of polygamy prioritizes the fulfillment of the husband's rights by providing solutions for channeling the husband's sexual desire. Whereas in the historical context, polygamy was carried out on the grounds of religious preaching and protection of widows and orphans. This provision is a form of injustice and discrimination against wives. The wife in a weak position has no choice and is the victim of these regulations. For this reason, it is necessary to add polygamy permissibility requirements where the prospective wife to be married is a widow who has orphans.

Abstract

This study aims to analyze the sale and purchase of Monstera Adansonii plants in Indonesia according to Islamic law. This research is motivated by a phenomenon that occurs in Indonesian people buying and selling ordinary ornamental plants Monstera Adansonii at fantastic prices, even though these plants are not difficult to obtain, are not difficult to maintain, nor do they have extraordinary intrinsic value. The phenomenon of soaring crop prices is influenced by inflated prices by unscrupulous sellers and several parties they cooperate with and use good strategies so that the price of this plant soars (irrational). This study used a qualitative descriptive method, the data sources used were phenomena that occurred in the field and some news on the internet about the phenomenon of buying and selling Monstera Adansonii plants, the data analysis used deductive analysis. The result of this research is the sale and purchase of Monstera Adansonii plants which contain elements of fasid legal price engineering, even though they meet the principles and requirements of buying and selling in Islam, because there is an element of fraud by manipulating prices. This buying and selling includes buying and selling which is prohibited in Islamic law because it is included in the sale and purchase of najasy. From the maqashid syari’ah, buying and selling of monstera adansonii plants is included in the necessity of tahsiniyayyat, because this sale and purchase is not to meet primary or secondary needs and is in the ishraf category (excessive attitude in spending assets).

Abstract

This research aims to provide educational insight for netizens on how to get smart ways to counteract negative information on social media, especially Instagram as the object of this discussion. The method used by the author in this discussion is a literature study with the main sources being documentation, news, articles that are in accordance with the topic of study. The results of this study are that there are several groups of netizens who are easily influenced by negative news, they are also easily provoked based on social media behavior. Digital jihad strategies on Instagram accounts using the istihsan method as a step to combat misinformation or news; negative by verifying or "tabayyun", then filtering the news sources and measuring in terms of benefits and harm, so that valid conclusions can be found regarding the source of the news circulating on social media Instagram.

Abstract

This study aims to determine the urgency of Ahl as-Sunnah wal-Jamaah Based Islamic Jurisprudence in Maintaining Cohesiveness of the Indonesian Republic. This study is literature research, which uses documentation techniques in collecting research data. At the same time, the analysis technique used in this research is the descriptive inductive technique. After conducting in-depth research, a conclusion was found that ahlus sunnah wal jamaah Based Islamic Jurisprudence is urgently disseminated and practiced. Ahlus sunnah wal jamaah Based Islamic Jurisprudence can be a strong binder of unity and integrity because there are ahlus sunnah wal jamaah Based Islamic Jurisprudence values of hubul wathon (love of the homeland), unity, and tolerance among religious believers. This teaching is more accepting of the differences in the broader community than radical and liberal Islam teachings, which divide the unity among Muslims and often create commotion and quarrels in society. Ahl as-Sunnah wal-Jamaah Based Islamic Jurisprudence can block Islamic sharia that deviates and leaves the corridor of the principle of tasriul ahkam, namely realizing the benefit of human life. The benefit will be easily realized if in a country the people are united, in harmony, live in peace, and are not hostile to each other.
