Abstract

Diverse views among Indonesian Islamic mass organizations’ figures over the existence of the Republic of Indonesia and obedience issue to the government became a topic of discussion, particularly when the government’s decision about religious issues differs from that of organization. This study aimed to find out in depth about views on ulī al-amr among figures from some Indonesian Islamic mass organizations and the issue of obedience to it within a democratic state system. This research is descriptive qualitative, using focused interviews in data collection. It is inductive in nature, which aims at developing process-oriented theories or values and data. The findings of the research showed that the representative figures recognize the Indonesian government as ulī al-amr, including ahlu al-bayt Indonesia, who prefer not to use the term because it is related to the requirement of chastity (‘ismah). This recognition implied an obligation to obey the Indonesian government, even though it is run by a democratic system, not Islam. As for matters related to specific religious regulations, such as determining the beginning of Ramadan, Shawwal, etc., differences from the government are not deemed as deviating from ulī al-amr, considering the democratic nature of the state, in which it provides opportunities to be diverse and recognizes those differences.

Abstract

Kenagarian Air Bangis is located in West Pasaman Regency, West Sumatra Province, one of the heterogeneous areas in Minangkabau. Therefore, it is important to instill and teach the values of religious moderation to students from an early age so that it is easy to appreciate and respect other people of different ethnicities, races, and religions. This study aimed to see whether the understanding of religious moderation has been instilled in students. The study results concluded that the Al-Qur'an Learning Center For Children (TPA) in Kenagarian Air Bangis had shown its role as a non-formal educational institution in instilling and implementing religious moderation values in students. Teachers on faith, morals, and adab have delivered teaching materials related to religious moderation. Even though it has not been structured and managed properly, the values contained in national commitment, tolerance, anti-radicalism and violence, and accommodating local culture have been conveyed to students, such as respecting followers of other religions and respecting people of different ethnicities, races, and religions. It is proven that they have never received discriminatory treatment, harassment, and inter-religious bullying in the Kenagarian Air Bangis; they live side by side even though the non-Muslim community is far from the Muslim community, but in social relations and service to the community, they are treated the same as their rights as a citizen.

This is proven by the fact that many unregistered marriage practices exist. This study is a literature and field research. Data was collected through documentation and interviews. This study found that the States of Indonesia and Malaysia have issued policies regarding the mandatory registration of marriages. Even so, there are still many unregistered marriages. There are many factors behind the occurrence of unregistered marriages, besides also causing problems. The government needs to reform the marriage registration policy, one of which is through digitalization. The State of Indonesia has innovated marriage registration, namely, online registration of marriages. However, this policy was implemented less effectively below. Meanwhile, the Malaysian state still needs to renew its marriage registration policy. Therefore, in this digital era, it is necessary to have a policy for registering marriages in the direction of complete digitization so that problems can be appropriately resolved.
