Abstract

Penelitian ini bertujuan untuk mendeskripsikan latar belakang serta menginterpretasikan fenomena penggunaan hijab fashionable di kalangan mahasiswi UIN Alauddin Makassar, dan mengetahui bagaimana perspektif fikih sosial tentang fenomena penggunaan hijab di kalangan mahasiswi Uin Alauddin Makassar. Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan menggunakan analisis fikih sosial. Sumber data primer ada 9 orang pengguna hijab fashionable di kampus UIN Alauddin Makassar. Sumber data sekunder berasal dari buku, majalah, artikel, media cetak, media sosial maupun elektronik. Metode pengumpulan data yang digunakan adalah observasi langsung turun ke lapangan,wawancara daring yang dilakukan secara mendalam, dan interpretatif melalui empat tahap, yaitu pengumpulan data, reduksi dan penyajian data serta penarikan kesimpulan.

Abstract

Konflik dasar dalam yurisprudensi Islam terbagi dalam beberapa hal pokok yang terus menjadi perdebatan para cendikiawan Islam. Konflik dasar tersebut antara lain, konflik dan ketegangan antara wahyu dan akal, konflik dan ketegangan antara kesatuan dan keragaman, konflik dan ketegangan antara idealisme dan realisme, konflik dan ketegangan antara otoritas dan kebebasan, konflik dan ketegangan antara moral dan hukum serta konflik dan ketegangan antara stablitas dan perubahan. Dengan melihat berbagai konflik dasar tersebut, ketegangan yang terjadi antara moral dan hukum menjadi salah satu hal penting untuk dikaji guna memahami secara mendalam interkoneksitas diantara moral dan hukum dalam penetapan terlebih lagi dalam penerapan hukum Islam. Pokok bahasan dalam artkel ini adalah konflik dan ketegangan dalam hukum islam: antara moral dan hukum dengan sub bahasan relasi antara hukum dan moralitas dan interkoneksitas hukum dan moralitas dalam konteks hukum Islam. Islam dalam pelaksanaannya sangat memperhatikan nilai akhlak (moral) dalam seluruh aspeknya yang merupakan akibat dari karakteristik rabbaniyah. Ruang lingkup hukum Islam mencakup semua bentuk hubungan, baik kepada Tuhan maupun manusia. Karena sumber, sifat dan tujuannya, hukum Islam secara ketat diikat oleh etika agama. Oleh karena itu, hukum Islam sama sekali dan selamanya tidak mengakui pemisahan peraturan perundang-undangan dari moralitas. Konflik antara hukum dan moralitas ini muncul sebagai hasil persinggungan dengan sistem hukum barat, yang memisahkan antara hukum dan moralitas. Dalam Al Quran sebagai sumber hukum Islam, tidak ada perbedaan yang jelas antara moratitas dan peraturan hukum. Al Quran menetapkan tentang baik dan buruk, pantas dan tidak pantas, disamping menetapkan peraturan hukum yang disertai dengan sanksi-sanksi.

Abstract

Penelitian ini membahas tentang pengaruh penerapan metode reading aloud terhadapketerampilan membaca peserta didik kelas III SD Negeri Mamajang I Kota Makassar. Tujuanpenelitian ini untuk mengetahui penerapan metode reading aloud terhadap keterampilanmembaca peserta didik sebelum dan setelah diajar dengan metode reading aloud danpengaruh penerapan metode reading aloud terhadap keterampilan membaca peserta didikkelas III SD Negeri Mamajang I Kota Makassar. Tujuan penelitian ini adalah Untukmengetahui keterampilan membaca peserta didik sebelum penerapan metode reading aloudkelas III SD Negeri Mamajang I Kota Makassar. Penelitian pre-eksperimen ini menggunakandesain penelitian one group pretest-posttest design. Populasi dalam penelitian ini adalahseluruh peserta didik kelas III SD Negeri Mamajang I Kota Makassar yang berjumlah 29peserta didik. Teknik pengambilan sampel yang digunakan adalah teknik sampling jenuh.Adapun instrumen yang digunakan pada penelitian ini adalah tes membaca, dan lembaranobservasi. Teknik analisis data yang digunakan statistik deskriptif dan statistik inferensial.Hasil penelitian menunjukkan terdapat pengaruh keterampilan membaca peserta didik setelahdiajar dengan metode reading aloud

Abstract

Islamic law is a system of law derived from the Qur'an and hadith, which subsequently evolved from legal philosophy. The result of legal thought is the production of legal documents based on the requirements of the community. In Indonesia, Islamic law grows and evolves in the form of four products of legal thought: fiqh, ulama fatwas, court rulings (jurisprudence), and laws. In Indonesia, the four products of legal thinking serve as rules for Muslims in national, state, and social life. This study sought to identify the outcomes of Islamic legal thinking in Indonesia. The technique employed is qualitative. According to the findings of this study, Islamic legal thought in Indonesia is comprised of the products of fiqh thought, fatwa thought, court decision thinking (jurisprudence), and legal thought. This product of Islamic legal philosophy touches on the order of Islamic society and, despite being independent of sharia law, can serve as a firm legal foundation.

Abstract

Ibn Qayyim invites and calls on Muslims to ijtihad and leave taklid, Ibn Qayyim al-Jauziyah is a scholar who is very persistent in fighting blind taklid and calling for freedom of thought, but still clinging to the main points of Islamic teachings and the creed of the Salaf. In Ibn Qayyim's view, ijtihad must develop in accordance with the development of situations and conditions in various places and times. Therefore he put forward a rule: Fi taghayyir al-fatawa wa ikhtilafiha bi hasbi taghayyir al-azminah wa al-amkinah wa al-ahwal wa al-niyat wa al-'awa'id. According to him, an important factor in formulating legal provisions or legal stipulations must be related to five things, namely al-azminah (the situation of the times), al-amkinah (the situation of the place), al-ahwal (the circumstances), al-niyat (the cause of desires), and al-awa'id (customs). All of this affects the development of law, so that Islamic law can truly be lived as a law that is rahmatan lil 'alamin, able to answer the challenges of changing social dynamics of society. Thus Islamic law remains suitable for all times and places.

Abstract

The purpose of this research is to reveal the history of the emergence of Ahmadiyya and its entry into Indonesia, the facts of violence against the Ahmadiyya Congregation in Indonesia and the government's role in protecting the Ahmadiyya Congregation, as well as social justice for the Ahmadiyya Congregation in Indonesia in the perspective of Islam and Pancasila. This qualitative research is a library research that collects data through literature such as journals and books. The results show that Ahmadiyya is a faith-based organization initiated and propagated by Mirza Ghulām Ahmad. There are two sects within this organization; Lahore and Qadian. The Lahore Ahmadiyah sect was spread to Indonesia through Mirza Wali Ahmad and Maulana Ahmad in 1924. Meanwhile, the Ahmadiyah Qadian sect was spread by Rahmat Ali in 1925. The Lahore sect stated that Ahmadiyah was born in 1888 while the Qadian sect stated that Ahmadiyah was born the next year. The existence of the Ahmadiyya Congregation in Indonesia is marked by a series of episodes in the form of neglected facts of social justice. Various acts of attacks, violence, persecution, and so on are portraits of the life of the Ahmadiyya Muslim Community in Indonesia as legal citizens before the law. It is understandable that the government's role in protecting the Ahmadiyya Congregation has not been maximized due to various acts of violence against the Ahmadiyya Congregation in Indonesia. Based on the fifth precept of Pancasila and from an Islamic perspective, in this case the preservation of life, lineage, property and reason, social justice has not been realized for the Ahmadiyya Congregation in Indonesia with violent attacks in the form of indiscriminate acts. vigilantes against the Ahmadiyya Congregation are still found.

Abstract

This paper aims to analyze the extent of the concept of overcoming conflict and physical clashes in the perspective of Islamic law. The results can be concluded that Islam as a perfect religion has a concept or guidance in tackling conflicts between fellow human beings, the concept is contained in the Qur'an and Sunnah as a guide for all Muslims. There are at least five concepts given by Islam in terms of conflict management. These concepts are tabayyun (clarifying news in order to seek clarity and clarification of information, especially information that is still unclear which can lead to slander and conflict), tahkim (mediation efforts by bringing in peacemakers to reconcile the two conflicting parties), deliberations ( conducting dialogue to make joint decisions to solve problems, namely forgiving each other to reduce conflict) and Al islah (making peace or spreading peace, for example doing good, advocating for people to make peace with one another respecting each other or Amar ma'ruf nahi mungkar)
