Abstract

Government ethics in Islam provides a strong moral foundation for the administration of a modern state. This research examines the ethical principles of Islamic government and their relevance in modern times. Through qualitative analysis of the Al-Quran, Hadith, and related literature, this research identifies three main pillars: honesty as a manifestation of trust, integrity in acting, and deliberation as a decision-making mechanism. The results show that applying these principles can increase transparency, accountability and public participation in government. Although there are challenges such as westernization and corruption, technological advances and democratization open new opportunities to make this happen. This research contributes to understanding the influence of Islamic values on ethical and effective governance practices, while providing valuable information to policy makers, practitioners and academics about building good and sustainable governance. AbstrakEtika pemerintahan dalam Islam memberikan landasan moral yang kuat bagi penyelenggaraan negara modern. Penelitian ini mengkaji prinsip-prinsip etika pemerintahan Islam dan relevansinya di zaman modern. Melalui analisis kualitatif terhadap Al-Quran, Hadits, dan literatur terkait, penelitian ini mengidentifikasi tiga pilar utama: kejujuran sebagai manifestasi amanah, integritas dalam bertindak, dan musyawarah sebagai mekanisme pengambilan keputusan. Hasilnya menunjukkan bahwa penerapan prinsip-prinsip tersebut dapat meningkatkan transparansi, akuntabilitas, dan partisipasi masyarakat dalam pemerintahan. Meskipun terdapat tantangan seperti westernisasi dan korupsi, kemajuan teknologi dan demokratisasi membuka peluang baru untuk mewujudkannya. penelitian ini berkontribusi untuk memahami pengaruh nilai-nilai Islam terhadap praktik tata kelola yang etis dan efektif, sekaligus memberikan informasi berharga kepada pembuat kebijakan, praktisi, dan akademisi tentang membangun tata kelola yang baik dan berkelanjutan.

Abstract

Aceh is the only province in Indonesia that applies Islamic law, including Islamic criminal law with caning. The presence of Aceh with Islamic law in a secular country like Indonesia is an interesting phenomenon to be studied further. This research aims to provide a deeper understanding to the public regarding caning in Aceh, so that there are no misunderstandings in its interpretation. In this research, the method used is an Islamic legal approach with a normative juridical focus. The author analyzes cases of caning in Indonesia, linking them to the principles of Human Rights using data sources from the Koran, laws, journals and online media. The results of this research show that there is support from the Ulama Consultative Council and the Islamic Sharia Service Agency for the implementation of caning in Aceh. The reason is because caning is considered to originate from the aspirations of the community. Implementation according to procedures in Governor's Regulation Number 10 of 2005, shows compliance and is not arbitrary, is considered to be in accordance with the principles of justice and does not violate human rights, because the process of carrying out caning punishment really pays attention to the principles of justice and applicable regulations. Thus it can be concluded that Contemporary ulama support the existence of caning punishment in Aceh on the grounds that the application of this caning punishment will create a deterrent effect, not because of physical factors but because of psychological factors. Meanwhile there are ulama who do not support caning punishment, but it is not published because it is covered by many ulama who supports the caning punishment. Meanwhile, the implementation of caning punishment in Aceh is regulated so that it does not physically torture the convict, because caning punishment has more of an impact on psychological factors. This caning punishment also does not conflict with human rights because its implementation prioritizes aspects of justice in it. The novelty of this research is that it discusses the views of contemporary ulama and analyzes the correlation between caning punishment and human rights.

Abstract

Euthanasia is an attempt to end a person's life when they experience incurable pain, in order to end their suffering. In Indonesia, euthanasia cannot be carried out and is an illegal act. Both positive law and the medical code of ethics stipulate that euthanasia is not permitted. When studied from the perspective of Islamic law, it is regulated that active euthanasia is an act that is forbidden and is threatened by Allah SWT with the punishment of hell for those who do it. The author is of the opinion that Euthanasia is considered a criminal offense in Indonesia because it is a form of crime against life which is regulated in Article 344 of the Criminal Code (Criminal Code/KUHP: "Whoever takes the life of another person which is clearly done intentionally, is threatened with imprisonment for a maximum of twelve years" The Declaration of Human Rights has established the "right to life" which is fundamental and inherent in human nature. It is universally recognized and an eternal gift from God. However, there is no provision regarding the right to die and therefore Euthanasia is a violation of human rights and contrary to divine principles. However, the right to die is regulated in the laws of several developed countries, such as several countries in Europe. AbstrakEuthanasia merupakan upaya untuk mengakhiri hidup seseorang ketika mengalami sakit yang tidak dapat disembuhkan, guna mengakhiri penderitaannya. Di Indonesia, euthanasia tidak dapat dilakukan dan merupakan perbuatan yang ilegal. Baik dalam hukum positif maupun dalam kode etik kedokteran diatur bahwa melakukan euthanasia tidaklah diperbolehkan. Bila dikaji dalam perspektif Hukum Islam, diatur bahwa euthanasia aktif adalah perbuatan yang diharamkan dan diancam oleh Allah SWT dengan hukuman neraka bagi yang melakukannya. Penulis berpendapat bahwa Eutanasia dianggap sebagai tindak pidana di Indonesia karena merupakan salah satu bentuk kejahatan terhadap nyawa yang diatur dalam Pasal 344 KUHP (Kitab Undang-Undang -Undang Hukum Pidana/KUHP: “Barangsiapa mencabut nyawa orang lain yang jelas dilakukan dengan kesengajaan, diancam dengan pidana penjara paling lama dua belas tahun” Deklarasi Hak Asasi Manusia telah menetapkan “hak untuk hidup” yang bersifat fundamental dan melekat pada kodrat manusia. secara universal mengakui dan anugerah abadi dari Tuhan. Namun, tidak ada ketentuan tentang hak untuk mati dan oleh karena itu euthanasia merupakan pelanggaran hak asasi manusia dan bertentangan dengan prinsip ketuhanan. Tapi, hak untuk mati sudah diatur dalam beberapa undang-undang negara maju, seperti beberapa negara di Eropa.

Abstract

Child marriage has become prevalent in Indonesia due to various factors such as education, economics, personal desire, environment, and pregnancy outside of marriage. This paper aims to educate the public to avoid being influenced to marry off someone who is underage and to discuss the controversy surrounding child marriage. This research is developmental in nature, employing a scientific approach and Islamic legal methodology. The results show that child marriage not only violates individual rights but also breaches the law. The majority of scholars do not permit child marriage, with some explicitly forbidding it, and none expressly allowing it. Furthermore, the study identifies several factors leading to child marriage: education, economics, personal desire, environment, and pregnancy outside of marriage. To address these factors, this research offers the following solutions. Education, Enhance access to education through technology and free learning applications, and integrate curricula about the dangers of child marriage. Economics, Encourage marriage while ensuring continued education. Personal Desire, Collaborate with the National Population and Family Planning Board to provide education on child marriage. Environment, Supervise and enforce laws. Pregnancy Outside of Marriage, Tighten supervision of children and teach religious knowledge to prevent sinful behavior. With these solutions, it is hoped that the issue of child marriage in Indonesia can be effectively addressed. Abstrak Pernikahan dini telah banyak terjadi di Indonesia dengan berbagai faktor penyebab, seperti pendidikan, ekonomi, keinginan pribadi, lingkungan, dan kehamilan di luar nikah. Tulisan ini bertujuan untuk mengedukasi masyarakat agar tidak terpengaruh untuk menikahkan seseorang yang masih di bawah umur, serta membahas kontroversi pernikahan dini. Penelitian ini bersifat pengembangan dan menggunakan pendekatan keilmuan serta metodologi hukum Islam. Hasil penelitian menunjukkan bahwa pernikahan dini tidak hanya melanggar hak individu, tetapi juga melanggar hukum. Mayoritas ulama tidak membolehkan pernikahan dini, dengan beberapa ulama yang secara tegas melarangnya dan tidak ada ulama yang dengan tegas membolehkannya. Selain itu, penelitian ini mengidentifikasi beberapa faktor yang menyebabkan pernikahan dini, yaitu pendidikan, ekonomi, keinginan pribadi, lingkungan, dan kehamilan di luar nikah. Untuk menanggulangi faktor-faktor tersebut, penelitian ini menawarkan solusi-solusi yaitu, Pendidikan, Meningkatkan akses pendidikan melalui teknologi dan aplikasi belajar gratis serta memasukkan kurikulum tentang bahaya pernikahan dini. Ekonomi, Mendorong pernikahan tetapi tetap menempuh pendidikan. Keinginan Pribadi, Bekerja sama dengan Badan Kependudukan dan Keluarga Berencana Nasional (BKKBN) untuk memberikan edukasi tentang pernikahan dini. Lingkungan, Mengawasi dan menegakkan hukum. Kehamilan di Luar Nikah, Memperketat pengawasan terhadap anak-anak dan mengajarkan ilmu agama untuk menghindari perbuatan dosa.  Dengan solusi-solusi tersebut, diharapkan dapat menanggulangi permasalahan pernikahan dini di Indonesia. Abstract

This study aims to analyze the sociological measurement of the emergence of terrorism in Indonesia, as well as the development of terrorism and its prevention. The purpose of the research is to look at the sociological roots in more detail to find more comprehensive steps in preventing terrorism in Indonesia. This study uses qualitative description. The research method uses library research which obtains secondary data including literature books, laws and regulations, official documents, and other relevant data. In this writing, the author uses a sociological history approach. The result of this paper is that terrorism has many dimensions, namely the local dimension, the regional dimension, and the global dimension to unravel the sociological roots of the emergence of terrorism in Indonesia, then the overcoming steps need cooperation from all parties, the government, the community, and the international world because the overcoming action is not by using repression so that it can violate human rights, but also using a socio-cultural approach by inviting all components including the so that the seeds of terrorism that exist in society can be minimized, and cut off the roots of its development to grow radicalism in common life.

Abstract

Religion as a societal ideology is believed to enable it to become a paradigm for solutions to various conflicts. Islam is a religion that upholds he al-alamin in human life, builds conflict resolution in relation to customary law (ethics, moral values, morals and culture) and state law, which actually originates from Islamic legal discourse. Religion becomes a balancer for conflicts that arise from various indicators, because Islam is a legal consensus that covers various conditions and situations. Religion as an effort to mediate conflict and social friction for the benefit of society. Therefore, Islam as a principle, as a regulator of the order of human life, is a solution to the conflict theory of thought by several experts who show the existence of Islam in it.
