Abstract

Peminangan merupakan langkah pendahuluan perkawinan antara seorang pria dan seorang wanita, sehingga masing-masing calon mempelai dapat saling mengenal dan memahami pribadi masing-masing, namun peminangan mesti mengikuti batasan-batasan yang disyariatkan termasuk tidak melamar seorang wanita yang telah dilamar. Penelitian ini bertujuan untuk mengetahui dampak yang ditimbulkan beserta proses penyelesaian terkait menikahi wanita yang telah dipinang, khususnya di Desa Tuju Kecamatan Bangkala Barat Kabupaten Jeneponto. Penelitian ini merupakan penelitian kualitatif. Hasil penelitian menunjukkan bahwa dampak sosial yang akan ditimbulkan jika menikahi seorang wanita yang telah dipinang oleh lelaki lain, khususnya di Desa Tuju Kecamatan Bangkala Barat Kabupaten Jeneponto akan menimbulkan permusuhan, bahkan dapat berakibat pada tindakan kekerasan fisik. Baik hukum Islam maupun hukum adat yang berlaku di Desa Tuju secara tegas melarang seseorang menikahi wanita yang telah dipinang. Secara adat, upaya penyelesaian terhadap peristiwa pernikahan terhadap wanita yang telah dipinang akan diinisiasi oleh pemangku adat dengan mempertemukan kedua pihak, dan pihak wanita diminta untuk mengutarakan alasan menerima pinangan kedua, jika alasan pihak wanita diterima, maka pihak wanita diminta mengembalikan cincin pengikat dan peminangan dianggap batal.Kata Kunci: Nikah; Pinangan; Wanita

Abstract

The existence of leaders is needed in an organization, this is because leaders who will determine the direction of the organization will be brought to where. Leadership itself is a person's activity in influencing and moving all its members to be able to achieve the stated goals. leadership is understood as the power to move and influence people. The leader in the educational institution is the principal. the principal must be able to mobilize all citizens of the school to achieve educational goals. Educational leadership is carried out at educational institutions, with the aim of influencing all school citizens to carry out their duties and work properly and correctly in accordance with their respective responsibilities which ultimately aims to develop all the potential possessed by students.

Abstract

Penelitian ini bertujuan untuk mengetahui seberapa besar hubungan antara kompetensi manajerial kepala sekolah dan kemampuannya dalam aplikasi teknologi informasi dan komunikasi dengan mutu pengelolaan pada SMA Negeri 21 Makassar. Penelitian ini merupakan penelitian kuantitatif dengan populasi pada penelitian ini adalah guru, staf, tenaga pustakawan dan siswa SMA Negeri 21 Makassar. Sampel pada penelitian ini adalah guru yang berjumlah 40 orang, staf sebanyak 5 orang dan siswa sebanyak 40 orang. Data penelitian dianalisis secara teknik deskriptif dan teknik inferensial. Hasil analisis deskriptif kompetensi manajerial kepala sekolah menunjukkan bahwa skor rata-rata adalah 30,63 dari tabel analisis statistik deskriptif, skor rata-rata kemampuan dalam aplikasi teknologi informasi dan komunikasi adalah 6 dari hasil uji statistik dan skor rata-rata variabel mutu pengelolaan adalah 14,30 dari hasil statistik deskriptif. Hasil analisis inferensial diperoleh bahwa skor kompetensi manajerial kepala sekolah memperoleh nilai sig. (p-value) sebesar 0,648 > 0.05, Artinya sampel variable Kemampuan Manajerial Kepala Sekolah berasal dari populasi yang berdistribusi normal. Hasil skor variabel kemampuan dalam aplikasi teknologi informasi dan komunikasi, diperoleh nilai sig. (p-value) sebesar 0,082 > 0.05, maka H0 diterima. Artinya sampel variable Kemampuan Aplikasi TIK berasal dari populasi berdistribusi normal. Dan variabel mutu pengelolaan diperoleh hasil nilai sig. (p-value) sebesar 0,685 > 0.05, maka H0 diterima. Artinya sampel variable Mutu Pengelolaan Sekolah berasal dari populasi berdistribusi normal. Hasil analisis korelasi pearson diperoleh bahwa bahwa korelasi antara kompetensi manajerial kepala sekolah dengan mutu pengelolaan didapat nilai koefisien sebesar 0,187 dengan arah positif. Karena koefisien mendekati angka 0, maka dapat disimpulkan bahwa antara kompetensi manajerial kepala sekolah dengan mutu pengelolaan memiliki hubungan yang rendah. koefisien sebesar 0,187 dengan arah positif. Korelasi antara aplikasi TIK dengan mutu pengelolaan didapat nilai sebesar 0,627. Karena koefisien mendekati angka 1, maka dapat disimpulkan bahwa hubungan antara kemampuannya dalam aplikasi TIK dengan mutu pengelolaan memiliki hubungan yang tinggi. Jadi dapat disimpulkan bahwa terdapat hubungan yang signifikan antara kompetensi manajerial kepala sekolah dan kemampuannya dalam aplikasi teknologi informasi dan komunikasi dengan mutu pengelolaan SMA Negeri 21 Makassar.

Abstract

Administration and supervision are supporting tools for achieving educational goal. Likewise also the purpose of school education can also be achieved if there is a systimatic and continous administration and super vision activities. Super vision theory from perspective of the approachused begins with directive supervision. But after seeing the axxistence of supervision ineffctiveness, the directive then emerged the teory of non directive supervision.   But, after seeing the existence of supervision ineffectiveness, the directive then emerged the theory of non directive supervision. The ineffectiveness of directive supervision because directive supervision does not give teachers the opportunity to develop their abilities aand creativity, full responsibility is on the supervisor, so the supervisor is dominnt. This is one of the factors behind the birth of the ssupervisor directive.

Abstract

The implementation of the pilgrimage in the mid-19th century experienced a significant increase. Various purposes and activities they do while in the holy land. Hajj is a means of communication between a servant and his Creator. This worship was first prescribed in the sixth year of the Hijrah. The word al-Hajj according to language means intentional. Therefore, according to the term Islamic shari'a, it means deliberately visiting the Ka'bah in Mecca to perform several series of acts of worship according to the pillars and conditions that have been determined by syara'. Hajj is the fifth pillar of Islam and the fourth point of worship, which is ordered after the three previous points of worship are prescribed, namely: prayer, fasting in Ramadan, and zakat. Hajj has many roles and many benefits. This study is examined by looking at the contribution of the Hajj in various social fields that occur after performing the worship for the people in Indonesia.

Abstract

Every child certainly has the same rights in terms of inheritance and others, mistakes made by both parents should not have an impact on children who are victims of immoral acts or adultery of both parents. Every human being has the same rights in the eyes of the law, whether Islamic law or positive law and it is regulated in the law so that in determining the inheritance status of a child born as a result of adultery, if born at the age of marriage of at least 6 (six) months, the child can follow the lineage of the father and the rights to inherit the property. It is also explained in articles 100 and 186 of the Compilation of Islamic Law which means that children from the consequences of adultery have the rights to inherit if they are born in a marital relationship

Abstract

This article explains how the Existence of the Marriage Agreement in the Sambas Community of the Indonesia-Malaysia Border. Based on the pros and cons of the Sambas Malay Society, especially about the marriage agreement regarding taklik talak as a marriage agreement in Islam. With qualitative research methods that are phenomenological observations in the field, the author wants to describe how the existence of divorce taklik talak as a marriage agreement in Islam itself and its practice in the Sambas Malay Community and the reasons for the pros and cons of religious leaders. Almost every prospective husband and wife in marriage to the Sambas Malay Community does not say sighat taklik talak by the husband to his wife after the ijab qobul consent. Sighat taklik talak only knowing that it has been written or listed in a marriage book without being notified to the husband and wife. Although divorce taklik talak has written in the marriage certificate is not an obligation to say. Still, once taklik talak has said, the taklik talak cannot be revoked again. If an agreement with a husband and wife did not fulfil by one of the parties, then the other party has the right to submit the matter to the Religious Court to resolve it. The study concludes that the pros and cons of divorce taklik talak as a marriage agreement in Islam cause a lack of knowledge about Marriage Law Number 1 of 1974 article 29 regarding marriage agreements and the Compilation of Islamic Law (KHI) Article 46 concerning taklik talak. And the lack of socialization of related parties from KUA through religious counsellors and BP4 in Sambas.

Abstract

AbstrakPotensi zakat pertanian di Desa Bissoloro sangat besar, terkhusus dalam pertanian padi dan jagung. Setiap panen rata-rata masyarakat paling di bawah 30 karung atau 1.500 kg dan paling banyak 80 karung gabah (padi). Sedangkan jagung berkisar antara 3 ton sampai 8 ton dalam satu kali panen. Pengelolaan zakat di Desa Bissoloro Kecamatan Bungaya Kabupaten Gowa, belum berjalan dengan baik. Masih ada masyarakat yang belum mengeluarkan zakat, sebab kurangnya pemahaman tentang hukum zakat. Dalam hal pengeluaran zakat di Desa Bissoloro, ada yang sudah sesuai syariat Islam dan ada yang belum sesuai serta takaran zakat pertanian yang dikeluarkan, sesuai dengan yang mereka inginkan atau dirasa cukup tanpa memikirkan bahwa ini sudah sesuai dengan yang ditentukan dalam Islam. Berdasarkan Undang-undang tentang pengelolaan zakat pada pasal 38, dijelaskan bahwa zakat harus dikelola oleh lembaga yang resmi agar tidak terjadi kesinambungan sosial. Walaupun pihak Kecamatan mengatakan akan membentuk kembali amil zakat yang lebh baik, akan tetapi itu hanya di kecamatan bukan di Desa Bissoloro.Kata Kunci: Hasil Pertanian, Potensi Zakat,  Zakat pertanian.AbstractThe potential for agricultural zakat in Bissoloro Village is very large, especially in rice and corn farming. Every harvest the community averages at least 30 sacks or 1,500 kg and a maximum of 80 sacks of grain (paddy). While corn ranges from 3 tons to 8 tons in one harvest. The management of zakat in Bissoloro Village, Bungaya District, Gowa Regency, has not been going well. There are still people who have not issued zakat, due to a lack of understanding of the law of zakat. In terms of spending zakat in Bissoloro Village, there are those that are in accordance with Islamic law and some are not appropriate and the amount of agricultural zakat issued is according to what they want or is deemed sufficient without thinking that this is in accordance with what is specified in Islam. Based on the Law on the management of zakat in article 38, it is explained that zakat must be managed by an official institution so that social sustainability does not occur. Although the sub-district said it would re-establish a better amil zakat, but that was only in the sub-district, not in Bissoloro Village.Keywords: Agricultural Products, Agricultural Zakat, Potential Zakat.

Abstract

The purpose of this study was to examine the orientalist N.J. Coulson's point of view on the discrepancy between the doctrine of Sharia and reality in the case of adultery in the evidence of a witness. This research was qualitative in nature and employed a descriptive normative juridical technique to answer the research questions. Documenting data, conducting data analysis through reduction, presenting data and drawing conclusions were all examples of data collection techniques. With regard to the testimony of adultery, the researcher aimed to uncover and then offer evidence regarding the disagreement between Sharia doctrine and reality in order to better understand the phenomenon. Based on the findings of the study, it could be stated that Islamic Sharia is a Sharia that places a great value on human honor, and that hifz al-irdh was one of the maqashid sharia, or honor code. With the introduction of hifz al-'irdh, the Islamic Criminal Law had strengthened the requirement for four witnesses to testify in an adultery case. This was also consistent with the punishment for adultery, which might range from stoning to death. However, the criticism levelled against N.J. Coulson regarding the seeming conflict between Sharia doctrine and reality in terms of the strictness of testimony was essentially incorrect, as Islamic law granted the privilege of maintaining human honor (hifz al-'irdh) rather than a conflict.

Abstract

Muhammad Hasybi adalah seorang otodidak, ia menempu pendidikan hanya birkisar satu tahun lebih di bangku sekolah Al-Irsyad (1926). Namu, melalui pendidikan formal yang singkat tersebut ia mampu menojolkan dirinya menjadi seorang pemikir. Keahlian Hasybi dalam ijtihad ia mampu memperkenalkan diri sebagai intelektul yang tekenal di dunia internasional. Terkait dengan hasil ijtihad Hasybi mennggambarkan keadaan fiqh ke-Indonesiaan dapat dilihat pada ijtihad Hasbi tentang zakat dengan mengacu pada pandangan Abu Hanifah yang berbeda dengan pendapat jumhur ulama – Hasybi bependapat bahwa mesin-mesin produksi di pabrik besar wajib di zakati. Pandangan ini cukup relevan dengan konteks pembangun negara yang membutuhkan banyak modal. Pendapat Hasybi mengenai zakat diserahkan kepada pemerintah untuk mengelolanya. Sebab, bagi Hasybi zakat tersebut sepaket dengan pengebangan untuk kemakmuran masyarakat, baik non muslim maupun muslim. Oleh karena itu, pungutan zakat seharusnya juga tidak hanya ditujukan kepada kaum muslimin, akan tetapi juga kepada kaum nonmuslim. Kemudian, prinsip zakat, yaitu diambil pada jenis harta yang berkembang, harta yang sudah cukup nishabnya, dan zakat harta.
