Abstract

Penulisan ini bertujuan membahas kedudukan Badan Permusyawaratan Desadalam penyelenggaraan pemerintahan desa ditinjau dari Undang-undang Nomor 6Tahun 2014 tentang Desa. Metode yang digunakan dalam penulisan ini adalah metodepenelitian hukum normatif dengan menggunakan pendekatan perundang-undangan danpendekatan fakta. Hasil penelitian menunjukkan bahwa kedudukan BadanPermusyawaratan Desa dalam penyelenggaraan pemerintahan desa adalah sejajardengan kedudukan Kepala Desa selaku pemerintah desa. Undang-undang tidakmemisahkan kedudukan Badan Permusyawaratan Desa dan Kepala Desa dalamkedudukan yang hirarkis, melainkan menempatkan posisi kedua lembaga pemerintahandesa tersebut sesuai fungsinya masing-masing.

Abstract

Penulisan ini berjudul “Kewenangan Baperjakat (Badan Pertimbangan Jabatan dan Kepangkatan) Dalam Memberikan Pertimbangan Kepada Pejabat Pembina Kepegawaian Pasca Dilaksanakannya Kebijakan Lelang Jabatan” yang memiliki tujuan yaitu tidak lain untuk memahami kedudukan Baperjakat. Metode penelitian yang digunakan dalam penulisan ini adalah penelitian hukum normatif. Kesimpulan dari permasalahan tersebut adalah berlakunya Undang-Undang Nomor 5 Tahun 2014 Tentang Aparatur Sipil Negara kewenangan dari Baperjakat tidak ada lagi karena pengisian jabatan dilakukan melalui mekanisme promosi terbuka atau lelang jabatan yang dilaksanakan oleh Pejabat Pembina Kepegawaian dengan pembentukan panitia seleksi,Instansi Pemerintah memilih 3 (tiga) nama calon untuk setiap 1 (satu) lowongan jabatan disampaikan kepada Pejabat Pembina Kepegawaian untuk jabatan sruktural Eselon II ke bawah Jabatan Pimpinan Tinggi di Instansi Pusat dan Daerah. Terkait dengan hal tersebut perlu ada pembaharuan terhadap ketentuan peraturan pemerintah agar sesuai dengan Undang-Undang Aparatur Sipil Negara.

Abstract

Tulisan ini berjudul Tanggung Jawab dan Kewajiban British Petroleum (BP) Terhadap Dampak dari Kasus Gulf of Mexico, terkait dengan kejadian tumpahan minyak dan dampak terhadap lingkungan. Tulisan ini menggunakan penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan historis. Tulisan ini menggambarkan tanggung jawab perusahaan, kewajiban, kronologis dalam kasus Gulf of Mexico. Kesimpulan yang dapat ditarik melalui tulisan ini adalah bahwa tanggung jawab perusahaan memiliki kewajiban untuk memperbaiki yang salah menempatkan korban dalam situasi aslinya sesegara mungkin dengan melakukan kompensasi.

Abstract

The problems that caused by migrant have been felt nowadays disturbing thecomfort of Balinese community. Because that, many step have been taken, by bothof government and Balinese traditional organization of desa pakraman. Incommon, desa pakraman has been regulated this migrant matter on an adatregulation of awig awig. Even if the models and substances of the migrantregulation are varying, one common principle on awig awig desa pakraman is theprinciple of balance between the rights and obligations of the migrants that liveon domain of desa pakraman.

Abstract

Gender inequity and inequality in the community would restrict developmentprocess. Therefore, struggle toward gender equity and equality is become interestingglobal issue for the world and also Indonesia and Bali.The aims of this study is 1) to analyze knowledge, perception, and attitude ofBalinese community toward gender concept and gender equity and equality, and 2) toknow implementation of gender role in the family and community. This study is carriedout in the three regencies/city in Bali, i.e. Buleleng, Tabanan and Denpasar. In eachregency/city, two types of village is determined that are urban and rural. Data arecollected by implementing structured interview based on questionnaire which is asked to120 respondents and completed with in-depth interview based on interview guidance tosome key respondents.The finding shows that most of respondent (68.30 %) have not known genderconcept, means that only 21.70 percent stated that they already known it, and they havedifferent understanding both about gender term and gender equity and equality. Withregard to gender equity and equality, only 24.20 percent of respondent report that theyhave read and heard about this term. However, when it is related to gender equity andequality program, most of them (91.60 %) of respondent stated that they agree with sucha program. In addition, it is also found that in the reality, almost all respondent actuallyhave implemented job sharing between man and women flexibly, means that they swapthe role of each other depend on situation and condition. This reality reflects that there isa shifting of thinking pattern of the community from rigid toward flexible division of job.Based on the findings, it can be concluded that although only small number ofcommunity member have known and understand gender concept and gender equity andequality, actually they have implemented it in their daily life. In general, communitymember also agree for changing their attitude toward gender role, so the condition ofgender equity and equality can be achieved.

Abstract

This study aims to determine the regulation on customary justice in the traditionalrules of awig-awig of  pakraman village, the rules made by the customarycommunity unit of Pakraman village in Bali. This study focused on structure,competency, mechanism, and principle of customary justice. The result shows thatstructure and competency of customary justice have been regulated clearly onawig-awig of pakraman village, but the mechanism of customary justice doesn’tregulated clearly. Awig-awig of desa pakraman only regulates initial mechanism,namely the process of filing a case, but does not regulate mechanisms after thecase was subsequently processed by the customary justice. It can be identifiedsome principles in awig awig of pakraman village to be a guidance for thecustomary courts in resolving cases that occur on it’s jurisdiction

Abstract

Tulisan ini bertujuan untuk mengkaji perubahan ideologi gender yang terjadi dalam masyarakat dan pengaruhnya terhadap perkembangan hukum adat Bali, terutama yang menyangkut hak waris perempuan. Kajian didasarkan pada hasil penelitan kepustakaan (doktriner) dengan pendekatan konseptual, historis dan futuristik hukum. Hasil kajian menyimpulkan bahwa telah terjadi perubahan ideologi gender dalam masyarakat. Perubahan ideologi gender dalam masyarakat adat Bali, terutama yang terjadi dikalangan intelektual dan tokoh-tokoh adat, menyebabkan lahirnya Keputusan Pasamuan Agung III Majelis Utama Desa Pakraman (MUDP) Bali Tahun 2010 yang mengangkat derajat dan harkat perempuan Bali di bidang pewarisan, di mana diputuskan bahwa perempuan dalam batas-batas tertentu berhak atas harta peninggalan orang tuanya This article aiming to review the change of gender ideology that happened on the society and its influence on development of Balinese customary law, especially that concerning women’s inheritance. The review based on result of literary research with conceptual, historical, and futuristic legal approach. The review result concluded that there is already a change on gender ideology of society. The change of gender ideology on Balinese customary society, especially that happened on intellectuals and custom’s important figures, had causing the birth of Majelis Utama Desa Pakraman (MUDP) Third Pasamuan Agung of 2010 Decree that lifted Balinese women’s dignity on inheritance, which decreed that women in certain limit have right on their parent’s inheritance.

Abstract

This research objective is to study about autonomy concept in cutomary law society of desa pakraman in Bali. There are two main problems that will studied in this research, which are: (1) which powers are in scope of desa pakraman’s autonomy?; (2) what are the boundaries of desa pakraman’s autonomy in its relation with the sovereignty of  Republic of Indonesia? Based on the research’s result, can concluded that: First, it is concluded that the scope of desa pakraman’s autonomy including: (1) sovereignty to make its own law; (2) sovereignty to govern itself; (3) sovereignty to make its own self-defense force; and (4) sovereignty to perform its own court. Secondly, it is concluded that, desa pakraman’s autonomy isn’t a autonomy without boundary, it is bound by conditions set by state’s constitution, which is must on date and principles of Republic of Indonesia.

Abstract

On 2017, Minister of Agrarian Affair and Spatial/Head of National Land Agency of Indonesia enacted a decision that point desa pakraman on Bali Province as communal owner right subject of the land. That decision was causing a certain implication that important to study. This research was aimed to discuss implication of those decisions on the position of land owned by desa pakraman in Bali. This research was carried out through a normative legal study method with using statute approach, conceptual approach, and historical approach. On behalfs of discussion of a problem, this research use source on a form of legal material (primary and secondary) and non-legal material. After going through discussion and analysis, finally, it can be concluded that the Minister’s Decision above can have both positive and negative implication on the position of desa pakraman’s land in Bali. The positive implication has happened because that decision can give legal certainty and certainty of right on a position of desa pakraman’s land (tanah druwe desa). On the flipside, the application of that Minister’s Decision can have negative implication if desa pakraman’s lands that were been given to a member of desa pakraman (krama desa), which were tanah pekarangan desa and tanah ayahan desa, were registered as owned individually by the member of desa pakraman. Tahun 2017 Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Republik Indonesia mengeluarkan keputusan yang menunjuk desa pakraman di Provinsi Bali sebagai subyek hak pemilikan bersama (komunal) atas tanah. Keputusan Menteri itu menimbulkan implikasi tertentu yang penting diteliti. Penelitian ini bertujuan untuk membahas implikasi Keputusan Menteri di atas terhadap kedudukan tanah milik desa pakraman di Bali. Penelitian dilakukan melalui metode penelitian hukum normatif dengan menggunakan pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan historis (historical approach). Untuk kepentingan pembahasan masalah, dalam penelitian ini digunakan sumber-sumber penelitian berupa bahan hukum (primer dan sekunder) dan bahan-bahan non-hukum. Setelah melalui pembahasan dan analisis, akhirnya dapat disimpulkan bahwa Keputusan Menteri di atas dapat berimplikasi positif dan negatif terhadap kedudukan tanah milik desa pakraman di Bali. Implikasi positif terjadi karena Keputusan Menteri tersebut dapat memberikan kepastian hukum dan kepastian hak terhadap kedudukan tanah milik desa pakraman (tanah druwe desa). Di sisi lain, pelaksanaan Keputusan Menteri tersebut dapat berimplikasi negatif apabila tanah-tanah milik desa pakraman yang telah diserahkan pengelolaannya kepada perseorangan anggota desa pakraman (krama desa), yaitu tanah pekarangan desa dan tanah ayahan desa, didaftarkan atas nama perseorangan anggota desa pakraman.

Abstract

This study aimed to determine the knowledge of indigenous people of Bali against theConstitutional Court No.46 / PUU-VII / 2010, meaning the Constitutional Court rulingrelated to the child outside the mating position, to identify and analyze the attitudes ofindigenous communities Bali on the discharge of the Constitutional Court. This study is anempirical law with non-doctrinal approach (socio legal research).The results showed that indigenous people in general do not yet know Bali Court DecisionNo.46 / PUU-VII / 2010 was. Meaning beyond mating gives children the same rights aschildren born within marriage. Balinese people’s attitudes related to this decision, can beclassified into two: 1. Most accept the decision of the reason; children outside the matingstatus to clear, the mother can claim responsibility for the biological father of the child,the child is no longer despised in the family and society. 2. small Sebagain reject reason;children outside mating can cause problems in inheritance in biological father, contraryto the customary law of Bali, girls may prefer not to marry. The attitude of the indigenouspeoples of Bali pros and cons of the legal culture of society.Conclusion: Its meaning is to give children the right to marry outside the same as childrenborn within marriage. Balinese customary law community in general have not been awareof the Constitutional Court. Balinese people’s attitudes towards the Constitutional Courtruling pro and cons.
