Abstract

Cryptocurrency has set intriguing and innovative trends in investment amidst the fluctuating global economy following government policies. This research aims to investigate the trends of policies of cryptocurrency in Indonesia, seen from the perspective of taxation and investment laws. Low tax charged in Indonesia is seen as relaxation by investors and cryptocurrency users, while the trends in legal policies concerning investment are experiencing hyper regulations in legislative products set to assure investors, in comparison to those of other countries. These trends attract some attention from investors and cryptocurrency users from abroad. This research is a unique offering that will illustrate which countries are suitable and friendly for businesspeople to carry out crypto business activities. The methodology used in this study is normative research with a conceptual approach and comparative law. The research results are expected to shed light on foreign investors wishing to invest their money in cryptocurrency businesses by considering the low tax from the perspective of current taxation law in Indonesia compared to those in Canada, the United States, and Singapore. According to the details of taxation in Canada, the United States, and Singapore, it is obvious that Indonesia gives ease to foreign cryptocurrency investors in Indonesia from the aspect of taxation law. The countries compared seem to charge very high taxes for cryptocurrency users and businesses in investment cryptocurrency. This comparison gives easier access to foreign investors to invest their assets for the development of cryptocurrency businesses and companies in Indonesia by considering the amounts of taxes imposed on cryptocurrency businesses and users. Indonesia makes it easier for foreign cryptocurrency investors in Indonesia compared to Canada, the United States, and Singapore from a tax law perspective. In terms of investment regulations, Indonesia has broader laws and regulations compared to other countries, where the investment process involving cryptocurrency businesses in Indonesia receives sufficient attention from these laws and regulations.KEYWORDS: Cryptocurrency, Investment Law, Taxation Law.

Abstract

This study aimed to analyze changes in the provisions for registering limited partnership after enacting the Minister of Law and Human Rights Regulation Number 17 of 2018 and the position of Minister of Law and Human Rights Regulation Number 17 of 2018 on the hierarchy of laws and regulations in Indonesia. The type of research used was normative juridical law with a conceptual, historical, and statutory approach. After the enactment of Minister of Law and Human Rights Number 17 of 2018, the authority to register limited partnerships, which was previously the authority of the Minister of Trade, was transferred to the Minister of Law and Human Rights. The position of Minister of Law and Human Rights Regulation Number 17 of 2018 is seen from the procedure for forming ministerial regulations that do not meet the requirements as implementing regulations and are contrary to the principle of business certainty.

Abstract

The research analyses whether the regulations concerning the mechanisms of control and evaluation of regional regulations on taxes and levies, as outlined in Law No.1 of 2022, comply with the concept of regional autonomy in Indonesia. With normative juridical approach, this research found that the mechanisms of control and evaluation of regional regulations on taxes and levies do not comply with the concept of regional autonomy. However, such mechanisms are required in Indonesia as a unitary state that is based on autonomy, since no system of autonomy works in the absence of control. Nonetheless, in this case, the supervisory authority given to the central government, in the form of preventive and repressive supervision, tends to cause too much interference in the process of shaping policies regarding regional taxes and levies, which should be within the authority of regional governments. Therefore, assertive and specific provisions should be made to prevent intervention by the central government that goes beyond what is required

Abstract

Indonesia sebagai negara yang menganut sistem negara kesatuan dengan prinsip dasar pemerintahan yang berdaulat. Namun, konsep negara kesatuan yang dianut Indonesia tetap menerapkan desentralisasi. Pemberian kewenangan terhadap daerah dimaksudkan agar mampu mengendalikan dan mengelola rumah tangganya. Sebagai cara untuk memperkuat semua peluang ekonomi yang dapat dijadikan sebagai Pendapatan Asli Daerah (PAD). Sumber Pendapatan PAD terdiri dari pendapatan pajak daerah, pendapatan retribusi daerah, pendapatan dari badan usaha milik daerah, dan pendapatan dari pengelolaan kekayaan daerah lainnya, serta pendapatan lain yang sah. Pengaturan terkait dengan pajak dan retribusi daerah telah mengalami beberapa kali perubahan hingga pada tahun 2022, disahkanlah Undang-Undang Nomor 1 Tahun 2022 tentang Hubungan Keuangan Antara Pemerintah Pusat dan Pemerintahan Daerah, sebagai peraturan yang dimaksudkan untuk merevitalisasi regulasi pajak dan retribusi daerah. Dengan adanya pembaruan terhadap regulasi pajak daerah dan retribusi daerah memiliki tujuan yang hendak di capai dengan adanya penyesuaian rezim UU HKPD, sebagai salah satu upaya untuk menciptakan hubungan keuangan yang efektif, efisien, transparan, akuntabel, dan adil antara pemerintah pusat dan pemerintah daerah.

Abstract

Trial mechanism as the only procedure in resolving election administrative violations is a mechanism that is not in accordance with the concept of law enforcement in administrative law that uses not only the trial mechanism but also direct sanctions. Therefore, the concept of law enforcement in these violations needs to be redesigned, to be in line with the administrative law and be more effective and easier to implement. This study examined the concept of law enforcement in administrative law as a conceptual and theoretical basis in redesigning the concept of law enforcement in election administrative violations. It used legal research methods with statutory, conceptual, and comparative approaches. The results of this study recommend a new concept in resolving election administrative violations by looking at the legal subjects who commit violations and the characteristics of the violations. For the violations committed by non-officials, the law enforcement is sufficient to use direct sanctions. Meanwhile,  for the violations committed by officials, if they cause direct losses, it must use a trial mechanism. But, if the violation is only limited to non-compliance with the legislation and does not cause harm to anyone, direct sanctions can be executed. Hence, it is necessary to change the mechanism for resolving election administrative violations as stipulated in the Election Law.

Abstract

The Act of Higher Education stated that Higher Education Management Autonomy is carried out by the basis and objectives and abilities of tertiary institutions. This causes not all State Universities to have the same status, one of which is Legal Entity State University. Legal Entity State University is a state university established by the government which is an autonomous public legal entity. Implementing regulations related to Legal Entity State University is Government Regulation Number 26 in 2015 on the Form and Mechanism of Legal Entity State University Funding. The Government Regulation indicates that Legal Entity State University can have a business entity. The problem is, if the Legal Entity State University carries out a business activity, there will be a possibility that the business will suffer losses. If there is a loss, how is the liability for the loss of the Legal Entity State University?Based on the business judgment rule doctrine, not every business loss is classified as a state loss. If the financial loss is not caused by intentional acts against the law or abuse of authority, then that matter is not classified as a state loss. If the losses included state losses, then the liability losses caused by the activities of those business entities owned by state universities are carried out in three ways, there are criminal liability, civil liability, and accountability in the state administrative law.

Abstract

This study aims to analyze the legal implications of disharmony of authority between the Corruption Eradication Commission (KPK) and the Indonesian National Army Military Police Center (Puspom TNI) in investigating corruption perpetrators from military personnel as well as the ideal formulation in the investigation of corruption cases from the perspective of the principle of equality before the law in the future. This research is normative juridical research that uses both the statutory and conceptual approaches. This study concludes two things. First, the resolution of the disharmony of authority between the KPK and Puspom TNI in the 2002 KPK Law, the Military Justice Law, and the TNI Law is that the legislators harmonize the regulatory material, submit a request for judicial review of the law in the Mahkamah Konstitusi, and apply the principle of lex specialis derogat legi generalis. Second, the ideal formulation for the future is to revise the Military Justice Law and the TNI Law, which specifically regulates TNI soldiers who commit military crimes only. If a soldier commits a corruption crime, the Corruption Court will resolve the case without distinguishing the perpetrator's military or civilian status.

Abstract

The International Labor Organization has clearly regulated that human rights such as the right to work must be upheld and guaranteed. Therefore, no one should be prevented from working to meet their needs, whether domestically or abroad. The most crucial factor is the state's ability to safeguard its inhabitants, particularly those who work overseas, so that they can be treated with the respect and dignity befitting human beings. The private sector, represented by PTKIS, is given broad responsibilities by Law Number 18 of 2017 concerning the placement and protection of Indonesian workers abroad. However, Chapter VI of the law provides protection only during placement and does not include a comprehensive protection system. This study employs normative legal research using both a concept and statutory approaches. The study concludes that significant changes are required, including giving the government more authority to place and protect migrant workers. Up to now, there has been no clear definition of the extent or boundaries of this authority. It remains challenging to apply the development of legal frameworks and protections for migrant workers in line with the labour rights principles outlined in the ILO convention on the protection of all migratory workers to the issues encountered by workers overseas. The protection of migrant workers is frequently implemented in a fragmented and unsustainable way.

Abstract

Upon his appointment as president, Joko Widodo prioritized agrarian justice through agrarian reform. Many individuals examine it through the lens of doctrinal studies, yet their focus remains on its execution. On the other hand, this study will look at the background and motives for the formation of Jokowi's agrarian reform, because in the history of the practice of agrarian reform from time to time, it has always been influenced by existing political-economic conditions. This study will ask key questions about the influence of the doctrine of neoliberalism on the encouragement of capitalist states and international institutions that have developed rapidly since the 1970s. The study method involves conducting socio-legal studies using a conceptual and historical approach, primarily obtaining data through literature reviews and government and non-government documents. This study shows that Jokowi's pattern of agrarian reform has not changed much in principle from previous eras, which were based on the workings of the land mechanism for the market system. Since the second period, this has been strengthened through job creation products that regulate norms regarding land banks and land tenure rights (HPL), thereby benefiting investors. Instead of promoting significant redistribution, this approach reinforces the privatization and deregulation of land, which aligns with the principles of neoliberalism. This condition has implications for the tendency to use repressive methods, as it prioritizes the legality of the land market over resolving the problem of land tenure inequality.   Salah satu agenda prioritas Joko Widodo (Jokowi) ketika dilantik menjadi Presiden adalah keadilan agraria melalui reforma agraria. Cukup banyak yang mengkajinya melalui studi doctrinal, namun terbatas sekedar pada pelaksanaan. Sebaliknya, studi ini akan melihat latar belakang dan motif terbentuknya reforma agraria Jokowi, karena dalam sejarah praktik reforma agraria dari masa ke masa, selalu terpengaruh dengan kondisi ekonomi-politik yang ada. Studi ini akan mengajukan pertanyaan kunci tentang pengaruh doktrin neoliberalisme dorongan negara kapitalis dan lembaga internasional yang berkembang pesat sejak 1970-an. Metode studi melalui kajian socio-legal dengan pendekatan konseptual dan sejarah, data diperoleh sekunder melalui kajian literatur, dokumen pemerintah maupun non-pemerintah. Studi ini menunjukkan pola reforma agraria ala Jokowi tidak banyak berubah secara prinsip dengan era-era sebelumnya, dimana berpijak pada cara kerja mekanisme tanah untuk sistem pasar. Hal ini menguat sejak periode keduanya melalui produk Cipta Kerja yang mengatur norma tentang Bank Tanah dan Hak Penguasaan Lahan (HPL) yang menguntungkan investor. Alih-alih redistribusi yang signifikan, cara kerja itu memperkuat privatisasi dan deregulasi atas tanah seperti prinsip dalam neoliberal. Kondisi itu berimplikasi pada kecenderungan cara-cara represif dengan memprioritaskan legalitas pasar tanah dibandingkan menyelesaikan masalah ketimpangan penguasaan tanah.

Abstract

Health services have become more accessible than ever due to the rise of telemedicine. Among the most popular are application-based telemedicine services, especially those offered by tech companies specialising in teleconsultation. In Indonesia, users are particularly drawn to e-services that partner with healthcare providers, pharmaceutical services or maternity care providers. However, unlike Malaysia and Singapore, which have made significant strides in telemedicine for their communities, Indonesia still faces a legal gap in regulating, implementing, guiding and overseeing telemedicine services—especially those that are application-based and developed by tech companies. This study adopts a juridical-normative approach, analysing Indonesian laws and regulations and comparing them with those in Malaysia and Singapore. Using statutory, conceptual and comparative methods, the study aims to generate specific ideas for implementing regulations to govern the licensing of application-based telemedicine in Indonesia. The findings indicate that Indonesia lacks specific licensing regulations for telemedicine services developed by tech companies. More detailed regulations could be introduced through government regulations that align with the legal framework and ‘beleidsregel’ (policy rules), utilising the discretionary authority of administrative officials to address this regulatory gap. This approach aligns with the legal principle lex semper dabit remedium, meaning ‘the law always provides a remedy’, resonating with the spirit of progressive law in society.
