Abstract

Government policy in dealing with agrarian conflicts in Indonesia is very important to achieve social justice. Agrarian conflicts often arise due to injustice in the control and use of natural resources, which has an impact on society, especially vulnerable groups. Based on the principles of Pancasila and the 1945 Constitution, the government has the responsibility to create prosperity for all people, including in terms of distribution of land and other resources. The government has implemented various strategies to overcome agrarian conflicts, including formulating inclusive and fair policies. In the context of public policy, social justice is the main basis. This includes protecting the rights of communities marginalized due to unfair development policies. An approach based on community participation in decision making is expected to reduce the negative impacts of these policies. In this way, the government not only functions as a regulator but also as a facilitator who creates an environment that supports social justice for all Indonesian people. This research uses normative legal research methods, using a case approach, a statutory approach and a conceptual approach. Overall, the success of government policies in dealing with agrarian conflicts and realizing social justice is highly dependent on a commitment to protecting people's rights and creating a just and transparent system. Implementation of the principles of social justice in every aspect of community life will be the key to achieving this goal. The aim of this research is to analyze the formulation of inclusive and socially just government policies regarding agrarian conflicts that occur in Indonesia.

Abstract

Sejalan dengan pemindahan ibu kota baru di wilayah Kalimantan Timur, dalam ketentuan pasal 4 Ayat (1) Huruf b UU IKN menyebutkan bahwa Otorita Ibu Kota Nusantara sebagai lembaga setingkat kementerian yang menyelenggarakan Pemerintahan Daerah Khusus Ibu Kota Nusantara, dan Pasal 5 Ayat (4) UU IKN yang menyebutkan bahwa Kepala Otorita Ibu Kota Nusantara merupakan kepala Pemerintah Daerah Khusus Ibu Kota Nusantara yang berkedudukan setingkat menteri, ditunjuk, diangkat, dan diberhentikan oleh Presiden setelah berkonsultasi dengan DPR.Tujuan penelitian ini untuk menganalisis dampak jangka panjang yang timbul dari model pemerintahan terpusat terhadap pelaksanaan sistem pemerintahan baru di Wilayah Ibu Kota Nusantara. Penelitian ini menggunakan jenis penelitian hukum normatif dengan menggunakan Pendekatan Perundang-undangan dan Pendekatan Konseptual. Adapun hasil penelitian ini, dampak yang timbul akan berpengaruh pada politik lokal, demokrasi serta representasi masyarakat atas perwakilannya, dan yang paling mendasar adalah hak konstitusionalnya sebagai warga negara. Sudah dipastikan tidak ada representasi lokal pada sistem politik perwakilan seperti saat ini.Kata Kunci: Ibu Kota Nusantara, Desentralisasi, dan Sentralisasi. In line with the relocation of the new capital city in the East Kalimantan region, in the provisions of Article 4 Paragraph (1) Letter b of the IKN Law, it is stated that the Nusantara Capital City Authority as a ministerial-level institution that organizes the Special Regional Government of the Nusantara Capital City, and Article 5 Paragraph (4) of the IKN Law which states that the Head of the Nusantara Capital Authority is the head of the Nusantara Capital Special Regional Government with a ministerial position, appointed and dismissed by the President after consulting with the House of Representatives. The purpose of this study is to analyze the long-term impact of the centralized governance model on the implementation of the new governance system in the Nusantara Capital city region. This study uses a type of normative legal research using a Legislative Approach and a Conceptual Approach. As for the results of this study, the implications will affect local politics, democracy, community representation of their representatives, and the most basic is their constitutional rights as citizens. It is certain that there is no local representation in the representative political system like today.Key Words: Nusantara Capital City, Decentralization, and Centralization.

Abstract

This study is motivated by the lack of adherence among local government officials in executing decisions issued by the Administrative Court (PTUN). Furthermore, there is a legal inconsistency between Law Number 51 of 2009, which amends Law Number 5 of 1986 on Administrative Courts, and Law Number 30 of 2014 on Government Administration. This discrepancy concerns the sanction mechanisms for government officials who disregard PTUN rulings, potentially leading to ineffective enforcement. The research aims to examine the existing administrative sanction regulations and develop an optimal sanction framework for local government officials who fail to comply with PTUN decisions. Utilizing a normative approach, the findings reveal two distinct methods for enforcing administrative sanctions. Consequently, the author advocates for regulatory reform by redefining Administrative Court authority, enabling it to impose administrative sanctions on non-compliant officials. This adjustment is intended to reinforce the principle of separation of powers and ensure legal certainty.

Abstract

This research focuses on an ideal model of mediation implementation that may be applicable as a strategy to increase the success of litigation on the License to Open State Land (LOSL). The research method is normative juridical research with a statutory and conceptual approach, using futuristic interpretation. As a regional government administrator, the Balikpapan Municipality Government has the authority to manage its own land sector. One of these authorities is realized through the implementation of the LOSL, which is organized through the Land and Spatial Planning Agency and the sub-district of Balikpapan Municipality. The implementation of the LOSL program within Balikpapan Municipality is inevitable due to the probability of disputes or disagreements. In accordance with this, the Balikpapan Municipality Regulation of LOSL and the Regulation of LOSL Implementation allow for the possibility of resolving LOSL disputes through mediation and/or litigation. Furthermore, although the settlement of LOSL disputes is expected to be resolved through mediation, its success rate has decreased since 2021. One constraining factor is the parties' low level of trust in the government. As a result, based on the above research, three ideal mediation models can be implemented to improve LOSL dispute resolution. These models are assumed to be a solution to the decreasing success rate of LOSL dispute resolution in Balikpapan Municipality. They are considered to increase society's trust in mediation as an inexpensive, fast, and simple alternative dispute resolution.

Abstract

This research aims to analyze the implications of supervision that is not based on synergy and accountability and how the regulatory criteria are in accordance with the legislation. This research uses normative juridical research method with statutory approach and conceptual approach. The implications of supervision that is not synergistic and accountable can have conssequences in the form of the risk of corruption and budget abuse, inefficiency in managing state finances, and lack of transparency to the public. 2. The implications of non-synergistic and accountability-based oversight suggest that inefficient oversight increases the risk of corruption, budgetary misappropriation, and inefficiency in the management of the state budget. Furthermore, distorted transparency in the presentation of audit results reduces public confidence in the government's financial oversight system. Follow-up on irregularities is also slow due to differences in audit results and the absence of synergy between oversight institutions.

Abstract

Penelitian ini mengkaji perbedaan pengaturan jangka waktu pemberian Hak Guna Usaha (HGU) antara Undang-Undang Pokok Agraria (UUPA) dan peraturan turunan dari UU Cipta Kerja, yaitu Peraturan Pemerintah Nomor 18 Tahun 2021. Dalam UUPA, tidak terdapat ketentuan mengenai jangka waktu pembaruan HGU, hanya mengatur perpanjangan hak tanpa klausula pembaruan setelah masa berlaku berakhir. Sebaliknya, UU Cipta Kerja dan PP 18 Tahun 2021 memberikan pengaturan jangka waktu yang berbeda, tanpa merujuk pada UUPA dan tanpa kejelasan pelaksanaan aturan tersebut, sehingga menimbulkan ketidakpastian hukum. Tujuan penelitian adalah menganalisis kebijakan penggunaan jangka waktu pembaruan HGU yang diberikan pemerintah. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa kebijakan baru memberikan jangka waktu perpanjangan dan pembaruan HGU hingga 95 tahun. Kebijakan ini berpotensi mengabaikan prinsip fungsi sosial tanah dan lebih mengutamakan investasi jangka panjang dibandingkan redistribusi tanah untuk keadilan agraria. Kata Kunci: Hak Guna Usaha, Jangka Waktu, Kebijakan, Agraria, Investasi Abstract This study examines the differences in the regulation of land use rights (Hak Guna Usaha, HGU) renewal periods between the Basic Agrarian Law (UUPA) and the derivative regulation from the Job Creation Law, namely Government Regulation No. 18 of 2021. The UUPA does not regulate the renewal period for HGU, only the extension of rights without clauses on renewal after the expiration period. Conversely, the Job Creation Law and PP 18 of 2021 regulate the renewal period differently, without referencing UUPA and lacking clarity on implementation, thus creating legal uncertainty. The study aims to analyze government policy regarding the renewal period of HGU rights. The method used is normative legal research with statutory and conceptual approaches. The results reveal that the new policy grants renewal and extension of HGU rights for up to 95 years. This policy potentially neglects the social function of land and tends to prioritize long-term investment interests over land redistribution for agrarian justice. Abstract

This article explores the interpretation and application of the concept of dominus litis—the active role of judges—in the context of the Indonesian State Administrative Court. Unlike the passive adjudicatory model commonly found in civil law systems, the principle of dominus litis in administrative adjudication positions the judge not merely as an arbiter but as a central figure in uncovering the material truth and guiding the resolution of state administrative disputes. Through normative approaches, this study analyzes the legal foundations, limitations, and judicial practices that shape the active role of judges in administrative proceedings. The research further examines how this role aligns with the principles of procedural fairness, legal certainty, and the protection of citizens’ rights against unlawful government actions. Ultimately, the article argues that the appropriate implementation of dominus litis is essential for achieving substantive justice in state administrative adjudication while ensuring that judicial activism remains within constitutional and statutory boundaries.

Abstract

This study aims to examine the reformulation of administrative sanctions imposed on the Land Deed Official (PPAT) who neglects to request proof of payment for the Land and Building Acquisition Duty (BPHTB) before signing the deed of land transfer. As a public official authorized to create authentic deeds, PPAT is responsible for ensuring the completeness of administrative requirements related to BPHTB. However, the administrative fine of IDR 10,000,000 for a PPAT’s negligence is deemed disproportionate, considering the amount of honorarium received by the PPAT based on the applicable regulations. Based on a literature review and interviews with PPAT in Malang Regency, this study highlights the injustice of imposing sanctions on PPAT, which essentially only fulfills administrative obligations in the preparation of the deed of land transfer. Meanwhile, the obligation to pay BPHTB lies with the taxpayer. This study offers a reformulation of administrative sanctions that is fairer by considering the PPAT’s authority, in line with the principles of legal justice. It is hoped that the findings of this study will contribute to the improvement of regulations related to taxation and land registration in Indonesia. Abstract

The principle of decentralization is a constitutional mandate that grants authority to regional governments to administer governance and manage natural resources within their respective jurisdictions. This principle emerged as a corrective measure to the centralized governance model of the New Order regime, which had resulted in significant disparities in welfare between the central government and the regions. Law Number 4 of 2009 on Mineral and Coal Mining initially reinforced this decentralization by delegating the authority to issue Mining Business Permits (IUP) to local governments, thereby contributing to the enhancement of local community welfare in resource-rich regions. However, the enactment of Law Number 3 of 2020, which amended Law Number 4 of 2009, reversed this decentralization by reassigning such authority to the central government. This legislative shift represents a constitutional anomaly, contradicting the decentralization spirit embedded within the 1945 Constitution of the Republic of Indonesia. This study employs normative legal research methods using statutory and conceptual approaches to examine the division of authority between the central and regional governments in managing the mineral and coal mining sector. The findings reveal that the recentralization of IUP authority not only undermines regional autonomy but also adversely affects the development of resource-producing regions and hampers the realization of social justice as envisioned in the framework of a welfare state.
