Abstract

Border governance is a necessity for Indonesia as an archipelagic country bordering maritime and / or land with other countries. Indonesia is located geographically between two continents and two oceans and no less than 17,504 islands. the border region has a very strategic multifunctionality. Politically, border areas provide legal certainty for internal and external sovereignty, both in the context of managing government administration and applying national law and in engaging with other countries. The existence of clarity of this border region will also provide legal certainty for a country for the utilization and management of natural resources contained in its territory for the benefit of the prosperity of the whole community. Border management must also be aimed at the prosperity of the people, especially those living on the border. The development of socio- economic activities to improve the socio-economic well-being of people at the border is very important because it will directly and indirectly strengthen the security aspects at the border. Abstract

With the increasingly escalating discrimination against groups of people with disabilities, humanity will then be made aware of the importance of recognizing that they are the same human beings as others, equal in rights and free in making choices. Therefore there are special rights for groups of people with disabilities. Special rights are not privileges, but they are granted so that persons with disabilities are able to maintain their unique identity, characteristics and traditions. Special rights such as non-discriminatory treatment are equally important to achieve the same treatment. Therefore the principle of equality, and non-discrimination (non-discrimination) becomes very important in human rights.

Abstract

As an ICESCR participating country, Indonesia is bound to implement the provisions of the covenant, especially the use of the institutions in it because Indonesia does not declare a reservation and / or a declaration of the provisions of the Covenant. Five years after Indonesia ratified the covenant, namely in 2010, Indonesia was obliged to send a country report containing the progress of the implementation of the covenant to the Committee on Economic, Social and Cultural Rights. This mechanism is established by the agency / committee concerned to monitor the progress of the implementation of state obligations as stated in the agreement. This is done through various reports that the state must submit within a certain period to the committee concerned. The Committee meets periodically among itself and meetings of delegates of the state parties. During these meetings the committee assessed the report prepared by the state and asked a number of clarifying questions. After that the committee made conclusions and recommendations. Usually the committee identifies positive things that have been achieved, issues that are still crucial and certain recommendations.

Abstract

Kebebasan dalam hidup merupakan suatu hak mutlak yang harus dimiliki oleh setiap manusia tanpa terkecuali. Karena dengan adanya kebebasan bagi seseorang akan meningkatkan kualitas hidup yang lebih baik lagi. Jika melihat banyak kasus mengenai kekerasaan dan penganiayaan yang terjadi seringkali membuat banyak orang bertanya mengenai arti kebebasan dan hak hidup yang menjadi milik diri sendiri. Seperti salah satu kasus terjadi kepada Tenaga Kerja Indonesia (TKI) yang bekerja diluar negeri. Kita sering mengetahui banyak warga negara Indonesia yang memilih bekerja di luar negeri karena beberapa faktor, meskipun begitu warga negara yang menjadi TKI tetap mendapat perlindungan hukum dan juga tetap memiliki hak sebagai warga negara Indonesia. Media pemberitaan memberitakan mengenai penganiayaan yang terjadi terhadap TKI membuat banyak pihak turun tangan untuk mengatasi permasalahan tersebut seperti diplomat Indonesia yang ada pada negara tempat terjadinya kasus tersebut. Contoh kasus nya adalah kekerasan yang didapat seorang TKI oleh duta besar dari Arab Saudi. Adapun beberapa hukum yang mengatur mengenai beberapa kasus penganiayaan TKI diluar negeri yakni hukum diplomatik dan konsuler. Pada penilitian ini mengangkat tema yang berjudul “Perlindungan Hukum Terhadap Tenaga Kerja Indonesia Yang Mengalami Kekerasan : Hukum Diplomatik Dan Konsuler”, dalam pembahasan kali ini melakukan analisis mengenai bantuan hukum yang dapat diterima oleh warga negara yang memiliki pekerjaan di luar negeri.

Abstract

Increasing access to education cannot be separated from the spatial use and utilization plan of the border area itself. Oftentimes, the Regional Spatial Planning (RTRW) which is intended for the opening and construction of schools at the village and sub-district levels becomes an obstacle to the program because it must be reviewed and changed, or simply violated. In fact, almost all of the licensing processes for the establishment of primary and secondary schools for private primary and secondary schools established by non-state entities are very difficult to obtain due to the unclear use and utilization of regional space. The number of permits issued has begun to be targeted by the DPRD for the fulfillment of PAD, so that issues that do not match the existing spatial plan are not taken seriously. In the end, sustainability as a principle and good governance as a practice which are two twin aspects of good spatial planning only exist in the concept because they only serve as tools to legitimize public sector malpractice in the use of space and exploitation of resources, especially in border areas. Permits to use space for the establishment of primary and secondary schools by the private sector should be adjusted to the state's alignment with increasing access to education.

Abstract

The factual conditions and determining factors for the fulfillment of the right to primary and secondary education are a re-actualization of state sovereignty. State sovereignty is the result of a reflection, abstraction and contemplation of a country's ability to maintain and maintain its existence in international law and relations. State sovereignty builds arguments about the laws and legal systems that apply in a country, including the fulfillment of the right to education in Indonesia. State sovereignty is a legal prescription to make, implement and enforce the law on people, objects and legal actions in the field of education in accordance with applicable standards and laws. Legal rights and obligations are formed and interact with each other in the legal system of a country so that the factual conditions and determining factors for the right to primary and secondary education in border areas are the sovereignty of the Indonesian state itself in accordance with the international agenda accepted by Indonesia in the field of education. The concept of state sovereignty is one of the most important elements in determining rights and obligations in international law. State sovereignty in international law establishes a standard identity of subjects of international law. State sovereignty is a legal prescription to make, implement and enforce the law on people, objects and legal actions. The prescription creates an agreement between the right holder and the right holder. The truth and fulfillment of the law becomes the standardization of state behavior towards its citizens or individual groups within the country within the framework of the protection, fulfillment and promotion of human rights in its territory or jurisdiction, including the right to basic and secondary education in the border areas of the Indonesian state.

Abstract

This study explores the fulfillment of the right to basic education in Temajuk Subdistrict, a border area in West Kalimantan, Indonesia. Despite strong legal frameworks such as the 1945 Constitution, Law No. 20 of 2003, and international commitments under the ICESCR, the actual implementation faces significant challenges. Using a combined normative and empirical juridical approach, the research analyzes regulations and incorporates interviews with local stakeholders. Findings show limited educational facilities serving approximately 2,687 residents, poor infrastructure, inadequate supporting resources, and difficult access due to challenging geography and transportation. High teacher turnover and a curriculum misaligned with local needs further hinder education quality. Additionally, the lack of specific regional regulations and weak coordination among agencies obstruct effective policy execution. The study highlights the urgent need for targeted government intervention, improved infrastructure, better teacher support, localized curricula, and strengthened inter-agency collaboration. Enhancing government responsiveness and involving local communities are essential to achieving equitable, quality education in Temajuk and fulfilling Indonesia’s constitutional and international educational obligations in border areas.

Abstract

Kewajiban negara berkaitan dengan HAM adalah untuk melindungi, memajukan, memenuhi dan menghormati. Berkaitan dengan hak atas pendidikan kewajiban negara tersebut berkaitan dengan segala upaya agar hak tersebut dapat dinikmati oleh semua orang tanpa diskriminasi atau memerangi semua ketidakadilan yang ada dalam mengakses dan menikmati pendidikan. Kewajiban negara ini dapat diwujudkan melalui pembuatan peraturan-peraturan ataupun cara-cara lain untuk memajukan persamaan kesempatan dan perlakuan dalam pendidikan sebagaimana ditetapkan dalam Konvensi Melawan Diskriminasi dalam Pendidikan yang disepakati oleh Konferensi Umum UNESCO pada tanggal 14 Desember 1960. Dengan kebijakan pemerintahan saat ini yang ingin memulai pembangunan dari wilayah perbatasan dan wilayah terluar semestinya kondisi pemenuhan hak atas pendidikan bagi masyarakat di wilayah perbatasan menjadi salah satu prioritas. Dengan demikian diperlukan sebuah kajian untuk mendapatkan gambaran mengenai politik hukum dan kebijakan negara dalam memenuhi hak atas pendidikan dasar dan menengah bagi masyarakat di perbatasan Kalimantan Barat dengan Sarawak.Analisis situasi dan kebutuhan terhadap pemenuhan hak atas pendidikan dasar dan menengah di wilayah perbatasan negara di ProvinsiKalbar perlu dilakukan secara menyeluruh terhadap kebijakan, program, kegiatan dan pendanaan dalam pemenuhan hak atas pendidikan.

Abstract

This doctoral reseach on “The Implementation of the fulfilment of Elementary School According to the International Covenant on Economic, Social and Cultural Rights (ICESCR) in the State Border Areas Between Indonesia and Malaysia in West Kalimantan Province” aims to find out relevance of state compliance toward international obligations contained therein in terms of law, policy, program, action and funds to overcome or to minimize emergence of “areas of unwilling to school” since Indonesia ratified the ICESCR in 2005. Furthermore, it also aims to reveal determinant factors for its effective fulfilment carried out by central as well as local governments. This research is a empirical normative legal research conducted through an extensive and in-depth analysis of relevance legal data, i.e. primary and secondary data. Primary data were obtained through interviews and delivering in-depth list of questions directed to those who have authority in terms of planning, making and executing law, policy, programs, actions and funds for fulfilment of elementary school in the area. Secondary data were obtained through literature reviews on education as fundamental rights, state obligations under international human rights laws and other relevant international law. Analysis was conducted by identification and systematization of the data justifying their relevance roles, functions and contribution. While at the end, they were completed through in depth analysis of legal logic to sustain their correlation and attribution to the said indicators of availibility, accessibility, adaptability and acceptability enshrined in the ICESCR based on localities’ contexts and perspectives. This research reveals two conclusions. First, since 2005, the fulfilment of the primary education has been progressively fulfilled by introducing new laws, approaches and new concepts of increasing accessibility to basic or primary education’s infrastructures and incentives. However, these initiatives is still far more to go in accordance to the ICESCR objectively verified indicators of availibility, accessibility, adaptability and acceptability. Second, technical and geographical factors has played as determinant roles of reducing fulfilment of right to primary education on border areas of Sambas, Sintang, Sanggau, Kapuas Hulu, and Bengkayang. They formed areas of unwillingness to go to school even though government has introduced new legislations, policies, programs, actions and appropriate funds vertically and horizontally as realization of sovereignty as responsibility taken by central and local governments.

Abstract

Reformasi hukum menjadi isu penting dalam upaya mewujudkan keadilan sosial di Indonesia. Artikel ini membahas tantangan dan prospek pengembangan sistem peradilan di Indonesia dalam konteks reformasi hukum. Metode kualitatif digunakan untuk menganalisis studi literatur dan melakukan library research guna mendapatkan pemahaman yang mendalam tentang reformasi hukum dan peradilan di Indonesia. Berdasarkan studi literatur yang dilakukan, terdapat sejumlah tantangan yang dihadapi dalam reformasi hukum untuk mewujudkan keadilan sosial. Salah satunya adalah masalah birokrasi dan korupsi yang menghambat efektivitas sistem peradilan. Selain itu, rendahnya tingkat kesadaran hukum di masyarakat juga menjadi faktor penghambat dalam mewujudkan keadilan sosial. Meskipun demikian, terdapat pula prospek pengembangan sistem peradilan di Indonesia. Perkembangan teknologi informasi memberikan peluang untuk meningkatkan aksesibilitas terhadap sistem peradilan. Selain itu, reformasi hukum yang berkelanjutan dan peningkatan kapasitas aparat hukum menjadi kunci dalam meningkatkan efektivitas sistem peradilan. Pengembangan kerja sama antarlembaga hukum dan penguatan independensi peradilan juga menjadi langkah penting dalam memperbaiki sistem peradilan yang ada. Kesimpulannya, reformasi hukum menjadi hal yang penting dalam mewujudkan keadilan sosial di Indonesia. Meskipun menghadapi sejumlah tantangan, terdapat pula prospek pengembangan sistem peradilan yang memberikan harapan bagi peningkatan aksesibilitas dan efektivitas peradilan. Diperlukan komitmen yang kuat dari berbagai pihak, termasuk pemerintah, lembaga hukum, dan masyarakat secara keseluruhan untuk melanjutkan dan memperkuat upaya reformasi hukum guna mewujudkan keadilan sosial yang lebih baik di Indonesia.
