Abstract

Kurangnya tenaga pendidik di wilayah perbatasan menjadi salah satu perhatian pemerintah di masa pemerintahan Presiden Joko Widodo yang tertuang dalam Nawa Cita. Salah satu program dalam Nawa Cita adalah membangun Indonesia dari pinggiran dengan memperkuat daerah-daerah dan desa dalam kerangka negara kesatuan dan meningkatkan kualitas hidup manusia Indonesia melalui peningkatan kualitas pendidikan dan pelatihan dengan program "Indonesia Pintar". Manifestasi dari program Nawa Cita tersebut untuk meningkatkan pendidikan di wilayah perbatasan negara salah satunya diwujudkan melalui program Guru Garis Depan (GGD). Program GGD merupakan program khusus dalam sistem rekrutmen Calon Pegawai Negeri Sipil melalui Formasi Khusus Sarjana Mendidik di Daerah Terdepan, Terluar dan Tertinggal (SM-3T). Program ini merupakan Kementerian Pendidikan dan Kebudayaan (Kemendikbud) dan Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokarasi (KemenPAN-RB).

Abstract

The purpose of education is to enable every human being to develop his dignity and personality freely so that he can actively participate in a free society and seek a life that is tolerant and respectful of human rights. The Universal Declaration of Human Rights (Duham) also recognizes that the goals and objectives of education have to do with human rights. In Article 26 paragraph (2) Duham stipulates that: Education should be directed at developing personalities in full and to strengthen respect for human rights and basic freedoms. Such education must advance understanding, tolerance and friendship among all nations, religious groups and races, and should continue the activities of the United Nations to maintain peace.Keywords: education, human rights, borders

Abstract

Dalam konteks legal, pemenuhan hak atas pendidikan merupakan sesuatu yang justisiabel bagi setiap orang untuk menerima, memperoleh dan menikmati pendidikan. Di lain pihak, negara berkewajiban untuk memenuhinya.  Kualitas dan kuantitas pendidikan wajib dipenuhi oleh pemerintah sebagai penyelenggara negara. Kewajiban tersebut berdasarkan pada aplikasi prinsip-prinsip dasar pemajuan dan perlindungan terhadap pilar-pilar dasar hak asasi manusia, yaitu kebebasan, kesamaan dan integritas. Ketiga dasar tersebut melahirkan semangat untuk menghormati dan memenuhi terhadap pemenuhan hak ekonomi, sosial dan budaya berdasarkan tiga kewajiban utama yaitu kewajiban pencapaian hasil, kewajiban melaksanakan kemauan dalam Konvensi dan kewajiban pelaksanaan kewajiban-kewajiban tersebut secara transparan di dalam pengambilan keputusan terhadap indikator pemanfaatan dan pengunaan sumber daya maksimal yang tersedia.  Secara khusus, Indonesia terikat untuk melaksanakan kewajiban dalam pemenuhan hak atas pendidikan berdasarkan kewajiban untuk “undertakes to take steps, to the maximum of its available resources, with a view to achieving progressively the full realization of the rights recognized in the present Covenant”. Terbukanya akses pendidikan bagi semua warga negara merupakan conditio sine qua non dihargainya nilai kebebasan dan keadilan. Karena itu, akses pendidikan bagi semua warga merupakan prioritas dasar sebab dengannya dijamin persamaan. Persamaan dalam mengenyam pendidikan memungkinkan tiap warga menghayati kebebasannya sehingga mereka mampu aktif berperan serta dalam kehidupan demokratif yang kian mengukuhkan martabat mereka sebagai manusia.

Abstract

Pelaksanaan hak atas pendidikan yang berasal dari Undang-UndangDasar Negara Republik Indonesia Tahun 1945 dan ketentuan-ketentuanpokok hukum hak asasi manusia internasional seperti dalam TheUniversal Declaration on Human Rights (UDHR)1949, The InternationalCovenant on Economic, Social and Cultural Rights (ICESCR)1966 dandalam The Convention on The Rights of The Child 1989. Hakekat hak ataspendidikan pada tingkat pendidikan dasar, sebagaimana ditegaskandalam ICESCR, merupakan suatu kondisi tertentu harus diciptakan olehnegara peratifikasi. Aspek substansi pendidikan dan manajerialpenyelenggaraan pendidikan merupakan elemen dasar dalam Pasal 13ICESCR bagi negara untuk menyediakan pendidikan dasar bagi setiaporang. Aspek ketersediaan dan kemudahan sarana dan prasaranapendidikan, dan aspek penerimaan dan daya penyesuaian merupakansegmen-segmen hukum (indikator) yang harus dikondisikanpemenuhannya secara bertahap oleh negara untuk setiap saat dicapaidan ditingkatkan pemenuhannya dalam bidang pendidikan, khususnyapendidikan dasar dan menengah.

Abstract

Penelitian ini bertujuan untuk mengetahui substansi hukum menganai hak atas pendidikan sebagai bagian dari hak asasi manusia, khususnya hak ekosob seperti yang diatur dalam the International Covenant on Economic, Social and Cultural Rights (ICESCR). Di samping itu juga, membahas relasi antara ketentuan hukum nasional dan internasional (das sollen) yang dapat meminimalisir atau mengatasi permasalahan (das sein) pemenuhan hak anak atas pendidikan di Indonesia. Secara lebih khusus, fokus atau relevansinya adalah kontekstualitas hukum bahwa Indonesia telah meratifikasi ICESCR dengan Undang-undang Nomor 11 tahun 2005 pada tanggal 30 September 2005. Ratifikasi ini memperkuat struktur hukum pemajuan, perlindungan dan pemenuhan hak anak atas pendidikan di Indonesia yang terdapat dalam the Convention on the Rights of the Child (CRC), yang telah diratifikasi pula oleh Indonesia. Dari kedua ratifikasi instrumen hukum hak asasi manusia tersebut diatas, kewajiban-kewajiban internasional yang ditentukan dalam kedua aturan tersebut berlaku mengikat bagi Indonesia.

Abstract

Pelaksanaan pendidikan dasar dan menengah di Provinsi Kalimantan Barat secara umum dan kondisi faktual di kelima kabupaten di kawasan perbatasan. Pola, kecenderungan dan dinamisasi faktual di lapangan merupakan dasar penalaran atau konstruksi hukum untuk menginterprestasikan tingkat kesesuaian pemenuhan kewajiban normatif di tingkat internasional di level nasional. Pola dan kecenderungan adalah rasio pendekatan ilmu sosial dan kesesuiaan adalah justifikasi yuridis dalam kerangka penalaran hukum. Relasi dalam penalaran hukum ini terletak pada analisis munculnya gap atau ketimpangan antara apa yang terjadi di lapangan dengan ketentuan normatif sehingga dinamisasi hukum merupakan cerminan konsistensi dan afirmasi terhadap pengimbangan antara yang terjadi dengan yang seharusnya terjadi. Konteks dan perspektif Provinsi Kalimantan Barat dan di kawasan perbatasan negara merupakan ciri atau pendekatan partikularisme dalam analisis pemenuhan dan perlindungan HAM yang berbasis pada nilai-nilai universal berbasis pada kesamaan, kemerdekaan dan kebebasan. Dengan demikian, eksistensi tersebut membuktikan komitmen dan kepatuhan negara pada standar internasional utamanya pada pemenuhan hak atas pendidikan dasar dan menengah.

Abstract

The purpose of this research is to respect the legal protection of ethnic Uighur women in Xinjiang, China from the perspective of International Human Rights and to find out and study the resolution of cases of serious international human rights violations against ethnic Uighur women in Xinjiang, China. Legal protection for women of Uighur ethnicity is based on articles 3,4,5,9,10,11, the Universal Declaration of Human Rights, namely by providing protection in the form of protection of the right to life, the rights to freedom, and the right to personal security, and others that are regulated in international legal instruments. 2) Serious human rights violations committed by the government of Xinjiang, China are not justified by international law because they violate the provisions stipulated in the subsequent Universal Declaration of Human Rights for the incidents of human rights violations, so the settlement of disputes between the two parties is carried out by negotiation or mediation. first. If this method is not effective, the UN Security Council can submit the case to an international court such as the International Criminal Court as regulated in article 1 of the 1998 Rome Statute.

Abstract

With regard to primary and secondary education policies in the border area of ​​West Kalimantan and Sarawak, it cannot be separated from the policies of primary and secondary education nationally and in West Kalimantan Province. Within the scope of West Kalimantan Province, the policy of the Education and Culture Office (Dinas Dikbud) is compiled in a Strategic Plan (Renstra) which is the guideline and implementation of education and cultural programs in West Kalimantan Province. The current strategic plan is the 2013-2018 Strategic Plan. This strategic plan is then elaborated in a work plan (Renja) which is compiled annually. With the existence of the Renstra and Renja from the West Kalimantan Provincial Education and Culture Office, all educational and cultural development plans that have been prepared are expected to be implemented efficiently, on time, on target, synergistically. and accountable so that it can meet the expectations of the government and all levels of society, especially in realizing and implementing educational and cultural development planning.

Abstract

This doctoral reseach on “The Implementation of the fulfilment of Elementary School According to the International Covenant on Economic, Social and Cultural Rights (ICESCR) in the State Border Areas Between Indonesia and Malaysia in West Kalimantan Province” aims to find out relevance of state compliance toward international obligations contained therein in terms of law, policy, program, action and funds to overcome or to minimize emergence of “areas of unwilling to school” since Indonesia ratified the ICESCR in 2005. Furthermore, it also aims to reveal determinant factors for its effective fulfilment carried out by central as well as local governments. This research is a empirical normative legal research conducted through an extensive and in-depth analysis of relevance legal data, i.e. primary and secondary data. Primary data were obtained through interviews and delivering in-depth list of questions directed to those who have authority in terms of planning, making and executing law, policy, programs, actions and funds for fulfilment of elementary school in the area. Secondary data were obtained through literature reviews on education as fundamental rights, state obligations under international human rights laws and other relevant international law. Analysis was conducted by identification and systematization of the data justifying their relevance roles, functions and contribution. While at the end, they were completed through in depth analysis of legal logic to sustain their correlation and attribution to the said indicators of availibility, accessibility, adaptability and acceptability enshrined in the ICESCR based on localities’ contexts and perspectives. This research reveals two conclusions. First, since 2005, the fulfilment of the primary education has been progressively fulfilled by introducing new laws, approaches and new concepts of increasing accessibility to basic or primary education’s infrastructures and incentives. However, these initiatives is still far more to go in accordance to the ICESCR objectively verified indicators of availibility, accessibility, adaptability and acceptability. Second, technical and geographical factors has played as determinant roles of reducing fulfilment of right to primary education on border areas of Sambas, Sintang, Sanggau, Kapuas Hulu, and Bengkayang. They formed areas of unwillingness to go to school even though government has introduced new legislations, policies, programs, actions and appropriate funds vertically and horizontally as realization of sovereignty as responsibility taken by central and local governments.

Abstract

This dissertation research concludes two (2) conclusions. First, implementation fulfillment of the right to primary and secondary education in border areas in the province West Kalimantan from 2005 to 2017 has been gradually fulfilled by the government center and area. The conformity factor has been endeavored to be carried out according to the provisions or international standards as in the Covenant on Economic, Social and Cultural Rights. However, regulations, policies and programs that have been made are not yet harmonious at the vertical level and horizontally thereby slowing down the process. Second, technical factors and geographical factors become the main determining factor in the low fulfillment of the right to primary and secondary education. These factors gave rise to the status quo "areas that do not want schools" in the border area in five districts, especially in the Kapuas Hulu district. The two determining factors has systematically reduced the implementation of laws, policies, programs and funding primary and secondary education both at the vertical and horizontal levels.
