Abstract

The purpose of the survey on student satisfaction with the educational process (lectures) in general is to maintain the continuity of the quality system implementation at the Faculty of Law, University of Tanjungpura. Specifically, measurements are taken to determine the level of student satisfaction with the educational process (lectures), to obtain feedback related to continuous improvement efforts in providing educational services to students as one of the stakeholders and to determine components or aspects of institutional performance that need to be followed up immediately. based on priority scale. This study applies quantitative research, while this type of research uses a survey method. The results of this study show that in terms of reliability aspects related to the ability of lecturers and institutions in the educational process (lectures), responsiveness (responsiveness) in the process of implementing education (lectures), assurance (treating students) in the educational process (lectures), empathy (understanding of student interests) in the educational process (lecturing), the information system (student information system) in the educational process (lecturing) is classified as satisfying.

Abstract

The Conversion Supplement Instrument (ISK) has been stipulated based on Higher Education National Accreditation Agency Regulation (PERBAN-PT) Number 2 of 2020. The Conversion Supplement Instrument (ISK) is used to convert A, B, and C accreditation ratings, for Accreditation carried out using Accreditation Instrument 7 Standards to become Superior, Excellent, and Good accreditation ratings. Regulation of the Higher Education National Accreditation Agency (PERBAN-PT) Number 27 of 2022, determines 3 (three) categories of conversion arrangements, namely: general arrangements and transition to Independent Accreditation Institutions (LAM), conversion and its consequences and enforcement of Higher Education Accreditation conversions (APT) and Study Program Accreditation (APS) which has received an extension.

Abstract

Bank secrecy regarding customer data in Indonesia is regulated in Law no. 7 of 1992 concerning Banking as amended by Law no. 10 of 1998. Then Perppu No. 1 of 2017 and PMK No. 73/PMK/03/2017 which makes bank customer data accessible for their financial information for tax purposes. Problems: First, what is the urgency for legal protection of bank customer data confidentiality? Second, what banking customer data can be provided for tax information purposes? Third, what are the legal consequences related to violations of banking customer data confidentiality? The method used in this paper is normative legal research method. The results of the study: First, the urgency of protecting the confidentiality of banking customer data is to provide trust and assurance that customer data is not misused and for the banking industry in providing services based on the principle of trust regarding the security of customer data as a very important element of the financial system and economy of a country. country. Protection of bank confidential security related to customer data is one of the principles of protecting Human Rights (HAM); Second, access to financial information for taxation purposes including banking customer data is regulated covering access to receive and obtain financial information in the framework of implementing provisions of laws and regulations in the field of taxation and implementation of international agreements in the field of taxation; Third, if there is a violation of the confidentiality of bank customer data, it will result in legal consequences for the party who commits the violation, threatened with imprisonment as well as fines or administrative sanctions as stipulated in the Banking Law.

Abstract

The purpose of this study is to provide legal protection to the ethnic Rohingya, with the ASEAN Charter and the establishment of the ASEAN Intergovernmental Commission of Human Rights will strengthen the instruments in protecting human rights in ASEAN. Philosophically with the establishment of the ASEAN Intergovernmental Commission of Human Rights, member countries would prefer a regional settlement to an international one. Regional settlements were chosen because the rules are adapted to regional conditions. This ASEAN Intergovernmental Commission of Human Rights needs a strong foundation and position to be able to give a reprimand. Rohingya is one example of ASEAN’s failure to guarantee human rights in the region. If this conflict cannot be resolved, of course, it is possible that future human rights violations will occur again. This research is a normative juridical study, the ASEAN Intergovernmental Commission of Human Rights is obliged to provide protection to ethnic Rohingya because the violation occurred in the Southeast Asia region and it is time for ASEAN member countries to give strict sanctions to Myamar due to the behavior given to the Rohingya ethnicity. The principle of non-intervention contained in the ASEAN Way will always be a barrier for ASEAN member countries in providing protection to ethnic Rohingya in Myanmar, but ASEAN member countries must continue to persuade Myanmar to respect every human right without exception. and ask for help from the international community to pressure Myanmar to stop persecuting the Rohingya.

Abstract

Sebagai warga negara Indonesia, penyandang disabilitas juga memiliki hak, kewajiban dan peran serta yang sama dengan warga negara Indonesia lainnya. Dalam Pembukaan Undang-Undang Dasar 1945 alinea keempat dan aturan beberapa batang tubuh secara tegas telah menjamin pemenuhan hak-hak warga negara tidak terkecuali para penyandang disabilitas dalam kehidupan sehari-harinya. Pemerintan Kalimantan Barat telah memiliki Peraturan Daerah Provinsi Kalimantan Barat Nomor 1 Tahun 2014 Tentang Perlindungan Dan Pemenuhan Hak Penyandang Disabilitas, hal ini sinyal positif dimana pemerintah daerah khususnya Kalimantan Barat memiliki niat baik untuk memberikan pelayanan kepada masyarakatnya khususnya para penyandang disabilitas dan menjamin hak-haknya sama dengan masyarakat yang lainnya. Abstract

China telah menyebabkan konflik dengan negara-negara di ASEAN. Secara sepihak berdasarkan bukti sejarah, pada tahun 2009 Cina telah mengeluarkan peta resmi yang dikenal sebagai Peta Sembilan Garis Putus-putus untuk mengklaim Laut Cina Selatan. Secara sepihak berdasarkan bukti sejarah, pada tahun 2009 Tiongkok telah mengeluarkan peta resmi yang dikenal sebagai Peta Nine Dash Line untuk mengklaim Laut Cina Selatan. Konflik yang melibatkan banyak negara di Laut Cina Selatan belum berakhir atau surut. Klaim China tumpang tindih dengan pihak lain seperti Vietnam, Filipina, Malaysia, dan Brunei. Dalam membela klaimnya, China berusaha untuk mendominasi baik di wilayah sengketa dan dalam negosiasi multilateral. Tiongkok juga terus meningkatkan kekuatan militernya untuk menekan negara-negara lain. Penelitian ini bertujuan untuk menganalisis strategi masing-masing negara anggota ASEAN terhadap China terkait dengan sengketa di Laut Cina Selatan (SCS) seperti apa akar dari konflik dan urgensi bahkan konsekuensi dalam merumuskan strategi solusinya. Metode penelitian yang digunakan dalam peneitian ini dilakukan dengan menggunakan metode penelitian normatif dengan mengumpulkan data sekunder studi perpustakaan yang studi ini berasal dari data sekunder.

Abstract

Hak Asasi Manusia (HAM) merupakan deklarasi hukum yang mencakup segala kebutuhan manusia untuk hidup secara utuh. Deklarasi Universal Hak Asasi Manusia (DUHAM) tetap menjadi dasar bagi banyak instrumen hak asasi manusia internasional. Upaya untuk memperluas pemahaman tentang hak asasi manusia perlu dilakukan secara terus-menerus di setiap wilayah geografis dan pada berbagai tingkatan masyarakat. Secara khusus, hak-hak ekonomi, sosial, dan budaya harus diperhatikan sebagai bagian dari hak asasi manusia termasuk di Desa Mekar Sari Kabupaten Kubu Raya. Hasil diseminasi dapat disimpulkan bahwa secara keseluruhan, hak asasi manusia (HAM) adalah pernyataan hukum yang komprehensif dan menyeluruh. Semua hak asasi, baik sipil, budaya, ekonomi, sosial, maupun politik, diakui sebagai hak universal. Pandangan hidup dan kepribadian bangsa Indonesia, yang merupakan kristalisasi nilai-nilai luhur bangsa, menempatkan manusia pada kedudukan tinggi sebagai makhluk Tuhan Yang Maha Esa, dengan kesadaran akan kodratnya sebagai individu dan makhluk sosial, sebagaimana tercantum dalam Pembukaan dan Batang Tubuh Undang-Undang Dasar 1945. Upaya memperluas pemahaman tentang hak asasi manusia harus terus dilakukan di setiap wilayah geografis dan pada berbagai tingkatan masyarakat, khususnya mengenai hak-hak ekonomi, sosial, dan budaya sebagai bagian dari hak asasi manusia.

Abstract

This study analyzed the urgency and construction of penal mediation in the criminal justice system. The method used in this study was the normative juridical method with a doctrinal legal approach. The urgency of penal mediation in the criminal justice system was caused by the paradigm of retributive law enforcement, the limitations of criminal law, and the shift in the purpose of punishment. The construction of penal mediation in the criminal justice system was divided into two: penal mediation inside and outside the court. The settlement mechanism for penal mediation in court was carried out by giving authority to law enforcement officials to carry out the mediation process. The settlement mechanism for penal mediation outside the court could be left to the choice agreed upon by all parties involved in the settlement of criminal cases.This study analyzed the urgency and construction of penal mediation in the criminal justice system. Abstract

This study aimed to determine the extent of the implementation of the ASEAN Agreement on Transboundary Haze Pollution in the Southeast Asia Region. This study was normative empirical legal research (applied law research). Empirical normative legal research began with written positive legal provisions that were applied to in-concreto legal events in society. The principle of the working mechanism of the ASEAN Agreement on Transboundary Haze Pollution was the right to exploit one’s own resources with environmental and development policies, but this cannot be separated from the responsibility to ensure that exploitative activities did not cause environmental damage and threaten human health from other countries or an area outside the jurisdiction of a country but seeing the incidence every year there were still forest fires that cause a large haze and cause inconvenience to other ASEAN member countries and this must be immediately sought out so that an agreement that had been mutually agreed upon the same can be a parameter to reduce the occurrence of haze in the Southeast Asia region.

Abstract

The purpose of this study was to study and know the provisions of the Police Code of Ethical Principles that are the basis for the performance of duty, to study and know the responsibility of the police for violating the Code of Ethical Principles, and to know the responsibility for the violation of the Code of Ethical Principles. According to the provisions of the Regulation of the Chief of the National Police of Indonesia No. 14 of 2011 on the Code of Ethical Principles of the National Police of Indonesia, Article 1 regarding the definition of KEPP, viz. "The Code of Ethical Principles of the POLRI, hereinafter abbreviated as KEPP, is the norms or rules that constitute the unity of ethical or philosophical foundations regarding behavior and speech in relation to things that are required, prohibited, appropriate or inappropriate to be done by members of the POLRI in the performance of the duties, powers and responsibilities of the position.
