Abstract

Anak sebagai pelaku tindak pidana, akan dilakukan tindakan hukum atau proses hukum. Dalam tindakan hukum tersebut, yang masih anak-anak lebih didepankan pada aspek perlindungan hak-hak anak tersebut dalam tiap tingkat pemeriksaannya.Anak sebagai salah satu sumber daya manusia merupakan generasi penerus bangsa, sudah selayaknya mendapatkan perhatian khusus terutama anak yang berperkara dengan hukum, untuk itu hak-haknya harus dilindungi. Menurut Maidin Gultom bahwa anak tidak dapat melindungi sendiri hak-haknya, banyak pihak yang mempengaruhi kehidupannya.Negara dan masyarakat berkepentingan untuk mengusahakan perlindungan hak-hak anak. Penelitian ini membahas mengenai Politik Kriminal Terhadap Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Hasil penelitian ini menunjukan berdasarkan hasil penelitian Kasus Pidana anak Dalam praktek satu satunya solusi adalah menitipkan ke dinas sosial di bawah kemensos, namun ada kesulitan pertama, tidak semua wilayah juga ada lembaga sosialnya. Kedua, jika terkait keamanan (misalnya potensi anak lari dari tempat penitipan) Polisi setempat tidak bisa melakukan penjagaan setiap hari di dinas sosial, dan ada pula soal birokrasi pengamanan di Polri yang harus dilakukan, intinya untuk penempatan di dinas sosial belum ada peraturan yang mewadahinya. Akibatnya anak-anak juga berpotensi dititipkan ke Rumah Tahanan, yang justru ditolak oleh UU SPPA.

Abstract

Corruption is an extraordinary crime that causes significant losses to the state, both materially and immaterially, which has a broad impact on the economic, social and political stability of a country. As the main victim in corruption crimes, the state bears the burden of recovering the losses incurred. The concept of bargaining for punishment offers an alternative approach in corruption law enforcement by allowing the perpetrator to reduce the sentence through the return of state losses. This research aims to analyze the application of the concept of bargaining for punishment in the context of Indonesian criminal law, especially in realizing justice and benefits for the state as a victim. The method used is Normative Juridical legal research, this research discusses the relevance of bargaining for punishment in bridging the interests of the state for the recovery of losses with the principles of criminal justice. The results show that the application of this concept can accelerate the case settlement process, reduce the burden on the justice system, and maximize the return of lost state assets. However, the application of bargaining for punishment must be closely monitored so as not to harm the principle of justice, especially in dealing with perpetrators with a significant level of guilt. Bargaining for punishment has the potential to become a strategic mechanism in eradicating corruption in Indonesia, provided that it is applied proportionally by considering aspects of justice, expediency, and legal certainty. This research recommends strengthening regulations and guidelines for the implementation of bargaining for punishment to ensure optimal recovery for the state as victims of corruption crimes

Abstract

The development of information technology has provided new challenges in the fight against corruption, especially in terms of technology-based crimes that are difficult to detect. This research aims to analyze the application of the concept of bargaining for punishment in handling digital corruption cases and evaluate the challenges and benefits arising from its application. The method used in this research is a literature study and analysis of applicable legal concepts in the context of technology-based crimes. The results show that the application of this mechanism can accelerate the process of disclosing corruption cases involving technology, by offering incentives to reduce sentences to defendants who are willing to cooperate. However, the application of this concept also faces a number of challenges, such as the potential for abuse of the justice system, the complexity of obtaining valid evidence, and the need for regulatory updates and capacity building of law enforcement agencies. Overall, while bargaining for punishment offers great potential to accelerate the disclosure and recovery of state losses, its success relies heavily on the integrity of the legal system and strict oversight.

Abstract

This article discusses the enforcement of criminal law against children as perpetrators of street violence (gangsters) in the Jambi Police area. This research method is empirical juridical, this study dissects the field reality and the implementation of applicable regulations. The results of the study indicate that the enforcement of criminal law against children as perpetrators of street violence has not been running optimally because the application of diversion and restorative justice has not been implemented optimally. This is caused by the less than optimal implementation of the principles of diversion and restorative justice in the investigation process. This is caused by 4 factors, namely: (1) There are significant obstacles in reaching an agreement or consent between the parties involved; (2) The characteristics of street violence crimes which are often classified as serious crimes, making it difficult to meet the qualifications for diversion; (3) lack of support from victims and the community for the implementation of diversion; and (4) weak coordination between related institutions. The main obstacle in the enforcement of criminal law against children as perpetrators of street violence lies in the less than optimal application of the principles of diversion and restorative justice in the investigation process. ABSTRAK Artikel ini membahas penegakan hukum pidana terhadap anak sebagai pelaku dalam kekerasan jalanan (gangster) di wilayah Polresta Jambi metode penelitian ini bersifat yuridis empiris, studi ini membedah realitas lapangan serta implementasi regulasi yang berlaku. Hasil penelitian menunjukkan bahwa penegakan hukum pidana terhadap anak sebagai pelaku dalam kekerasan jalanan belum berjalan secara optimal karena penerapan diversi dan keadilan restoratif belum dilaksanakan secara maksimal. hal tersebut disebabkan oleh belum maksimalnya implementasi prinsip diversi dan keadilan restoratif dalam proses penyidikan. Hal tersebut disebabkan oleh 4 faktor, yaitu: (1) Adanya hambatan signifikan dalam mencapai kesepakatan atau persetujuan antara pihak-pihak yang terlibat; (2) Karakteristik tindak pidana kekerasan jalanan yang sering kali tergolong kejahatan serius, sehingga sulit memenuhi kualifikasi diversi; (3)kurangnya dukungan dari korban dan masyarakat terhadap pelaksanaan diversi; serta (4)lemahnya koordinasi antar lembaga terkait. Kendala utama dalam penegakan hukum pidana terhadap anak sebagai pelaku kekerasan jalanan terletak pada belum optimalnya penerapan prinsip diversi dan keadilan restoratif dalam proses penyidikan.
